7 Mayor Faust called the meeting to order at 7:00 p.m.

34 Ms. Marilyn Jenson announced the 2017 Salo Park Performance Schedule (Thursday nights 7 -8

B. Dare 2 Be Real Students Presentation
Councilmember Brever introduced students from the Dare 2 Be Real program at the high school.
She provided a brief summary of what the students did. Mr. Estrada, the adviser was present and
introduced the students (captains and future captains). The students described the program and
noted three community meetings have been held.
9 Councilmember Brever thanked the group for attending, wished the seniors the best of luck, and
10 thanked them for leading the three community meetings.

12 Councilmember Stille suggested the Kiwanis organization may be a group they should meet with
13 and give a presentation. One of the students mentioned the Key Club at the high school, which is
14 affiliated with the Kiwanis.

16 Mayor Faust stated the title of Captain will show leadership for future endeavors. Mayor Faust
17 stated he started out as a Student Council member in High School, noting the students are
18 showing a great attitude. He stated the community meetings were very good and thanked Mr.
19 Estrada and the students for their involvement.

21 C. Summer Survival Camp Presentation
22
23 Police Chief Jon Mangseth thanked the Dare 2 Be Real students and for their organization of the
24 community meetings and stated the Police Department wants to be part of the process going
25 forward. Police Chief Mangseth introduced Officer Jim South and Firefighter Joe Basara. He
26 announced the dates for the Summer Survival Camp are June 14 -15, 2017. This is a camp for 41
27 graders and is the 7°i annual camp. Officer South and Firefighter Basara provided a summary of
28 the camp, reviewed the daily activities, and indicated the camp is full this year with a waiting
29 list.

31 Councilmember Gray asked how many kids are in the program. Officer South stated there are 55
32 kids. The number of kids are limited due to staff time and there are currently 2 on the waiting
33 list.

35 Mayor Faust stated he was amazed eight years have gone by with this program, noting it is a
36 positive impact with the children and the parents. He thanked them for their time and effort. A
37 photograph was taken of the group present.

16 A. Resolution 17 -45• a Resolution to Approve a Request to Keep Chickens in an R -1 Zoning
17 District at 3626 Belden Drive NE

19 City Manager Casey reviewed a request letter and stated a coop site plan diagram was received
20 from applicants Michael Guest, Kim Borton and Connor. The site plan shows the planned
21 location of the coop is in the southwest comer of the rear yard and according to the applicant,
22 that corner of the yard is relatively isolated with an 8 -foot fence separating their yard from the
23 neighbor to the west and a shed partially blocks the view from the neighbors to the south. Staff
24 has reviewed the area and confirmed that these structures exist and will likely obstruct the view
25 of the coop from the surrounding neighbors' yards. There does not appear to be a fence
26 separating the applicant's property from the property to the south, although there is existing
27 vegetation on both properties that will provide some visual screening. Mr. Casey reviewed the
28 specifications of the proposed coop and noted the four chickens will be females. Staff has
29 reviewed the applicant's materials and based on the reasonable location, dimensions, and details
30 provided, do recommend approval of this request to keep four female chickens on the property.
31 Staff recommends that the coop location be set back at least 5 feet from any property line as is
32 the standard for an accessory structure. Currently setback dimensions are not indicated on the
33 site plan.

1 City Manager Casey reviewed a request letter and stated a coop site plan diagram was received
2 from the applicants, the Wesches. The site plan shows that the planned location of the coop is
3 adjacent to an existing garden and 18 feet set back from the south property line with the garden
4 separating the coop from the neighboring property to the south. The site plan also shows existing
5 vegetation acting as a partial screening buffer along the eastern property line and a tall wooden
6 fence along the northern property boundary that would screen the view from the property to the
7 north. The applicants' property is bounded by a chain link fence on the east and south sides,
8 which does not completely screen the view of the coop from neighboring properties. The
9 applicants have indicated that they have communicated with and received verbal consent from
10 their neighbors to the east and south regarding their plans to keep a chicken coop in the back
1 I yard. Mr. Casey reviewed the specifications of the coop. The applicant has indicated that they are
12 only planning to keep six chickens on their property. Staff has reviewed the applicant's materials
13 and based on the reasonable location shown on the site plan and the statement of neighbor
14 consent, do recommend approval of this request to keep six chickens on the property.

16 Councilmember Stille asked if this was the first request for six chickens. City Manager Casey
17 stated he does not recall.

20 046; a Resolution Approving a Request to Keep Chickens in an R -1 Zoning District at 3631
21 Harding Street NE.

25 C. Resolution 17 -047; a Resolution to Approve Special Event at The Unofficial on July 29
26 2017.

28 City Manager Casey reviewed Chris Christopherson has submitted a request to hold a special
29 customer appreciation event at The Unofficial Dive Bar & Grill on Saturday July 29, 2017.

31 Mr. Christopherson reviewed the event, noting it was approved and held last year. A diagram of
32 the event submitted was provided for Council review. They are requesting approval to have
33 outdoor food, liquor, and music.

35 Mayor Faust stated the application stated 4 -10 p.m. Mr. Christopherson stated the live music will
36 run from 4 -10 p.m. Food, beverages and the craft vendors will begin at 10 a.m. and end by 10
37 p.m.

39 Councilmember Stille asked about the live music. Mr. Christopherson stated there will be
40 amplified instruments (PA and speakers). The music will face away from the apartment
41 buildings. He did not believe there were any issues last year.

43 Councilmember Gray stated he lives in Silver Lake Condominiums and he enjoyed the music but
44 a number of people in the area did not approve. He noted the music is difficult with senior
45 housing being even closer than he is and some found it annoying after 6 or 7 p.m.

I Mayor Faust stated there were some complaints and questioned the naming of the event. Mr.
2 Christopherson stated he would like this to be an annual event where the community can come
3 together. He explained this is the first he's heard about any complaints and they want to work
4 with the community to make this work.

6 Councilmember Gray asked the City Manager about what complaints were received. Mr. Casey
7 noted according to the police records there were three calls complaining about loud music.
8 Councilmember Gray noted the people who were there loved it. He suggested the timing of the
9 music be changed.

11 Mayor Faust stated the Council can change the hours of the music as they need to be sensitive to
12 the neighbors not attending the event. He suggested 9 p.m. be the end of the music. Mayor Faust
13 stated it is also an issue of the noise after the music stops.

15 Mr. Christopherson said 9 p.m. would be fine.

17 Councilmember Stille stated it can be reviewed again before next year's event. City Manager
18 Casey stated he will give Mr. Christopherson a run -down after the event of any complaints
19 received.

21 Motion by Councilmember Jenson, seconded by Councilmember Brever, to adopt Resolution 17-
22 047; a Resolution Approving a Special Event at The Unofficial on July 29, 2017 revising the
23 time for the music from 4 to 9 p.m.

27 D. Resolution 17 -048; a Resolution to Approve Special Event at The Unofficial on August
28 6.2017

30 City Manager Casey stated Chris Christopherson has submitted a request to hold a special classic
31 car show event at The Unofficial Dive Bar & Grill on Saturday, August 6, 2017.

33 Mr. Chris Christopherson reviewed the event, stating they would host the Spartans Classic Car
34 Club in their parking lot and have between 80 -100 beautifully restored 1964 and older classic
35 cars parked around the perimeter of their parking lot. The event will run from 9 a.m. to 3 p.m.
36 During the event, they would like to sell cans of beer and soda and sandwiches outside. They are
37 also requesting a DJ playing music at a reasonable volume. The DJ will play from 10 a.m. to 2
38 p.m.

40 Councilmember Brever noted this is Village Fest weekend and asked if there was another car
41 show on Sunday. Mayor Faust stated the only thing on Sunday is the pancake breakfast.

43 Mayor Faust stated the timing for the music needs to be added to the resolution being 10 a.m. to
44 2 p.m.

7 E. Resolution 17 -049; a Resolution to Appoint Plannine Commissioner to Fill Vacancy

9 City Manager Casey reviewed this resolution is to appoint Jedd Larson to the Planning
10 Commission. On May 8, 2017, the City received a resignation from Marshall Lichty whose term
11 ends on December 31, 2018. Mr. Jedd Larson applied and was interviewed last December for the
12 Planning Commission and would fill out Mr. Lichty's term through December 31, 2018.

14 Commissioner Stille thanked Marshall Lichty for his service to the Planning Commission. Mayor
15 Faust agreed.

17 Motion by Councilmember Brever, seconded by Councilmember Jenson, to adopt Resolution 17-
18 049; a Resolution Appointing Jedd Larson to the Planning Commission through December 31,
19 2018.

23 VII. REPORTS FROM CITY MANAGER AND COUNCIL MEMBERS.

25 City Manager Casey had no report.

27 Councilmember Jenson stated on May 16, he attended the tour of the City and the work session
28 that followed. On May 18, he attended Ramsey County Local League of Governments/Met
29 Council Joint Meeting. On May 22, he attended the Fire Department Relief Association Meeting.

31 Councilmember Stille attended the May 16 City Tour. On May 17, he spoke at the Kiwanis
32 Meeting.

34 Councilmember Gray attended the May 16 City Tour and work session.

38 Mayor Faust attended the May 16 City Tour and work session. On May 19, he and City Manager
39 Casey attended a meeting with another City and talk about organized collection.

41 VIII. COMMUNITY FORUM.

43 Mr. Ira Marts, 3220 Edgemere Avenue, stated he has lived there for thirty years and on his street,
44 people are driving way too fast. He explained there are a number of preschool aged children on
45 the street and he is trying to avoid a tragedy. He does not know what needs to happen to get
46 people to slow down. Chris Farhead, a neighbor, stated vehicles are not slowing for the

crosswalk. Another neighbor stated he was in his front yard and tried to get someone to slow
down and the car drove around him.
Mayor Faust stated the City Manager will speak with the Police tomorrow and get back to Mr.
Matts.
Mr. Matts stated he thought about writing a letter and passing it around the neighborhood
outlining what is happening. He explained they know at least one neighbor who has been
speeding down the street. Mayor Faust suggested Mr. Matts wait until Mr. Casey gets back to
him.
IX. INFORMATION AND ANNOUNCEMENTS.
Mayor Faust stated the City has not received anything regarding Lowry Grove for any action and
the Council cannot comment on anything until they see items for approval. He explained when
items are received, notification will be given to residents for public input.
X. ADJOURNMENT.
Mayor Faust adjourned the meeting at 8:10 p.m.

Request: Request to keep three (3) hens in an R -1 Zoning District at 3313 Wendhurst
Ave
BACKGROUND /ANALYSIS
Staff received a request letter and a coop site plan diagram from the Applicants on May 17`x'. The coop
site plan diagram shows the approximate location the proposed chicken coop in the northwest corner of
the rear yard of the Applicant's property.
The Applicants' letter describes that the coop will be located in the backyard directly behind the garage,
and provides an image showing the proposed location in relation to the Applicant's house. The site plan
indicates a setback of 35 feet from the rear property line and 22 feet from the side property line. The
Applicant states that the coop will not be visible from the vantage of her neighbor's property to the
east, and that "a large bush will block the view of the coop for the neighbors on the west side of us." The
Applicant further explains that her neighbors to the north will have a "very limited view" of the coop
due to the visual obstruction of trees.
The Applicant indicates she has spoken to her east and west neighbors about her intent to have chickens
on her property and that both neighbors are "supportive of her interest."
In her letter, the Applicant describes the coop's dimension as "roughly 4ft by 6ft by 4ft", with the latter
dimension being the coop height. She provides an image of the coop she intends to purchase from Fleet
Farm, which shows an elevated nesting box and a run fully enclosed with chicken wire. The Applicant
has stated that she plans to keep three hens in the coop, and no roosters.
CITY CODE RELATED TO REQUEST
Title IX General Regulations, Chapter 91 Animals, Section § 91.56 KEEPING OF CERTAIN ANIMALS states
that "No person may keep swine, cattle, horses, goats, or more than 2 dogs or 3 dogs allowed under §
91.01 through 91.05 or fowl, within the city nearer than 500 feet to any human habitation or platted
land, without approval of the City Council. The City Council may, before approving or denying any
request for approval, request a report from the Health Officer concerning the effect on public health."
The City Council may elect to include reasonable conditions or specifications with a resolution approval,
should they deem such conditions appropriate to the intent of the ordinance.

ACTION
Staff has reviewed the Applicant's materials and, based on the reasonable nature of the proposed coop
location and design as well as the statement of neighbor support, do recommend approval of this
request to keep three (3) hens on the property in question.
2. Motion to adopt resolution approving the request. The City Council may refer to the resolution
for approval to include any conditions that it deems necessary.
2. Motion to deny the request. In the event the City Council chooses denial of the request, it
should clearly state its reasons for the denial and direct staff to prepare a resolution.

I am writing to request approval to have 3 hens at our home in St. Anthony (3313 Wendhurst Ave.). I am
so excited to raise them from chicks, and have fresh eggs for our family and neighbors. It will also be a
great learning opportunity for my three "city" kids. ❑
Attached is our lot with a drawing of where we plan to locate the coop (in our back yard behind our
garage). It will be located 35 ft from the north lot line and 22 ft from the west lot line. The coop is
roughly Oft by Eft by Oft.

I have spoken with our neighbors on the east and west sides of our property on Wendhurst Ave, and
both are supportive of our interest in raising chickens. The coop will not be visible to our neighbors on
the east side of us, and a large bush will block the view of the coop for the neighbors on the west side of
us. The neighbor we share a backyard property line with will have very limited site of the coop as there
are large trees along the fence line.
We also do not plan on having a rooster as we don't want to have the eggs fertilized (or the annoying
wake up callsl!).

WHEREAS, staff received a request from Adrienne Olson for permission to keep chickens on her
property located at 3313 Wendhurst Avenue; and
WHEREAS, the City of St. Anthony Code of Ordinances, Section 91.56, Keeping of Certain
Animals, specifies that livestock, including fowl, require approval from the City
Council; and
WHEREAS, Adrienne Olson has submitted a written request for approval from the City Council,
as outlined in Subsection 91.56, to approve their request to keep chickens; and
WHEREAS, Adrienne Olson has submitted a diagram showing the dimensions and placement of
the enclosure that will house the chickens in relation to their property; and
WHEREAS, the submitted materials show a reasonable plan for the chicken coop location and
design and indicate support from surrounding neighbors; and
WHEREAS, Hennepin County Environmental Health Division has stated that this matter is within
the City's jurisdiction and authority; and
BE IT RESOLVED, that the City Council of the City of St. Anthony Village approves the request
to keep three (3) chickens in an R -1 Zoning District at 3313 Wendhurst Avenue.

Dear Honorable Mayor, City Council, and Staff;
Attached are the existing and the proposed schedules for the Street and Utility Reconstruction Program
for the City of St. Anthony Village. The Street Reconstruction Program is reviewed annually to ensure the
City is addressing the most critical components of the City's infrastructure.
When developing the recommended schedule, several criteria are taken into consideration
1. Flood relief effort
2. Condition of the existing utilities beneath the street
3. Conditions of the streets and anticipated maintenance needs
4. Adjacent infrastructure replacement (construction phasing)
5. Funding and requests from project partners
In recent years the City has revised the schedule to address utility issues on Chandler Drive, pedestrian
and project partner availability on Stinson Boulevard, and pedestrian and partner concerns on Silver Lake
Road.
I will be available at your June 13, 2017 City Council meeting to present the proposed schedule and
discuss the recommendations with you.

Attached for your consideration is a resolution ordering the preparation of a feasibility report
for the 2018 Street and Utility Improvement Project.
This project proposes the following locations for street and utility reconstruction:
• MacAlaster Drive from 37th Avenue NE to railroad tracks
• Foss Road from 37th Avenue NE to Chandler Drive
• Highcrest Road from 37th Avenue NE to cul -de -sac
Please note the location of the proposed project for 2018 has been changed from the Street
and Utility CIP presented last year. During our annual spring road tour with the Public Works
Department it was noted the utility and pavement condition of the location being proposed
was very poor and required more immediate attention. In addition to the proposed 2018
project location, an adjustment to the timing of other future project locations is being
recommend. Attached is a revised Street and Utility CIP for your consideration.
In addition to the locations described above, the feasibility report will also include the review
and cost analysis of the following improvements:
• Asphalt mill and overlay of Anthony Lane from County Road C to cul -de -sac
• Central Park splash pad water reuse /irrigation retrofit
We are recommending that the mill and overlay of Antony Lane be considered with the 2018
improvement project due to the time and resources that Public Works Staff has been spending

on repairing deteriorating pavement on Anthony Lane. Furthermore, to continue the City's
water conservation initiative we also recommend the addition of the Central Park water reuse
improvements to the 2018 improvement project.
