ANTHONY 2 CITY COUNCIL REGULAR MEETING MINUTES 3 JULY 11, 2017 4 5 CALL TO ORDER. 6 7 Mayor Faust called the meeting to order at 7:00 p.m. 8 9 PLEDGE OF ALLEGIANCE. 10 11 Mayor Faust invited the Council and audience to join him in the Pledge of Allegiance. 12 13 Mayor Faust stated the meeting needs to be conducted in a respectful manner. If those in attendance do 14 not allow Council to conduct the meeting they will be asked to leave. 15 16 ROLL CALL. 17 18 Present: Mayor Faust; Councilmembers Brever, Jenson, and Stille. 19 Absent: Councilmember Gray. 20 Also Present: City Manager Mark Casey. 21 22 CONSIDERATION, DISCUSSION, AND POSSIBLE ACTION ON ALL OF THE FOLLOWING 23 ITEMS. 24 25 1. APPROVAL OF JULY 11, 2017 CITY COUNCIL MEETING AGENDA. 26 27 Motion by Councilmember Stille, seconded by Councilmember Brever, to approve the City 28 Council Meeting Agenda of July 11, 2017. 29 30 Motion carried 4 -0. 31 32 11. PROCLAMATIONS AND RECOGNITIONS — NONE. 33 34 III. CONSENT AGENDA. 35 36 A. Approval of June 26, 2017, City Council meeting minutes. 37 B. Licenses and Permits. 38 C. Claims. 39 D. Resolution 17 -053; a Resolution Accepting Donations and Grants Received in the 2 °d 40 Quarter of 2017. 41 42 Motion by Councilmember Brever, seconded by Councilmember Jenson, to approve the Consent 43 Agenda items. 44 45 Motion carried 4 -0. 46 47 IV. PUBLIC HEARINGS — NONE. 48 49 V. REPORTS FROM COMMISSION AND STAFF City Council Regular Meeting Minutes July 11, 2017 Page 2 A. Resolution 17 -054; a Resolution approving a request for an eight foot variance to Accommodate a deck in the rear yard at the property located at 3204 Towniew Avenue located in the R -1 district. Mayor Faust announced this request has been withdrawn by the applicant. 8 VI. GENERAL BUSINESS OF COUNCIL. 9 10 A. Resolution 17 -055, a Resolution Relating to Termination of Contract Agreement for 11 Police Services Between the City of St. Anthony and the City of Falcon Heights. 12 13 City Manager reported on the resolution to terminate the police contract with the City of Falcon 14 Heights. Per the existing contract, either party must provide written notice to terminate by July 15 15 of a given year. If approved, police services for the City of Falcon Heights would end on 16 December 31, 2017. 17 18 City Manager Casey stated Councilmember Gray had contacted him and stated he is in favor of 19 approval of this resolution. 20 21 Motion by Councilmember Stille, seconded by Councilmember Jenson, to approve Resolution 22 17 -055; a Resolution Relating to Termination of Contract Agreement for Police Services 23 Between the City of St. Anthony and City of Falcon Heights. 24 25 Motion carried 4 -0. 26 27 B. 2nd Quarter Goals Update 28 29 City Manager Casey reported on the 2nd Quarter Goals, noting they are available for review. 30 Mayor Faust highlighted the City became a Green Step 5 in June 2017. Councilmember Stille 31 stated St. Anthony is one of six Green Step 5 cities out of 853 cities in Minnesota. 32 33 VII. REPORTS FROM CITY MANAGER AND COUNCIL MEMBERS. 34 35 City Manager Casey mentioned the City Newsletter was mailed out. 36 37 Councilmember Brever had no report. 38 39 Councilmember Jenson had no report. 40 41 Councilmember Stille stated he made a commitment to wish Evelyn Kline a Happy Birthday 42 today. She is 110 years old and a St. Anthony resident. 43 44 Mayor Faust stated he attended the Regional Council of Mayors Meeting on July 10, 2017. The 45 entire conversation at the meeting was regarding water and how it can be better used. Mayor 46 Faust attended the Mississippi Water Management Organization Meeting on July 11, 2017. City Council Regular Meeting Minutes July 11, 2017 Page 3 2 VIII. COMMUNITY FORUM 3 4 Mayor Faust asked that those present to come to order and respect everyone that comes to the 5 podium. Being unable to bring the meeting to order after several attempts, Mayor Faust closed 6 the meeting. 7 8 IX. INFORMAMTION AND ANNOUNCEMENTS — NONE. 10 X. ADJOURNMENT. 11 12 Mayor Faust closed the meeting at 7:10 p.m. 13 14 After meeting was closed at 7:10 p.m. audience started Community Forum. 15 16 I. COMMUNITY FORUM. 17 18 A Lowry Grove resident explained the situation ongoing with Lowry Grove, stating his belief that the 19 Dan Wilson office has low- balled all of the people in the park, less than needed to rebuild their lives 20 elsewhere. He stated a lot of the people that moved before the benefits were received from the MN 21 Housing Finance Agency and compensation was to be received for moving. He stated the City 22 Ordinance called for mitigating the circumstances on moving their home or finding homes elsewhere but 23 people are not being paid what their place is worth so they cannot replace their homes. He asked the 24 Council to look into this and maybe the City can put out some money to compensate these Lowry Grove 25 residents. 26 27 Mayor Faust stated the phone number will be displayed for residents to contact. 28 29 Ms. Antonia Alvarez stated she lived in Lowry Grove and at this point she is homeless. She wants a 30 response from Council about the construction and drawings of Lowry Grove. She stated she does not 31 know if there is a plan to have 840 apartments or what is the plan. 32 33 Mayor Faust stated there is no plan submitted and nothing has been received but Council expects 34 affordable housing in all developments within the City. He explained that when the plans are received, 35 people will be aware as there are many interested in what is happening with that project. 36 37 Ms. Alvarez stated there was one suicide before the park was closed and she was affected by his death. 38 She believed it was not fair that the Council is not paying attention to the residents, noting the Council is 39 witness to the efforts she did to try to save Lowry Grove. Ms. Alvarez stated Frank was one of her 40 brothers and family members and she wants justice from Council and affordable housing for the people. 41 She believed it is not fair there are many that are homeless, noting the City proclaims justice but they are 42 killing their brothers. She requested the Council listen and not let the development built without 43 affordable housing. Ms. Alvarez stated again she wants justice. 44 45 Councilmember Stille noted it is in the Comp Plan to have affordable housing in St. Anthony and there 46 will be some affordable housing in the development. City Council Regular Meeting Minutes July 11, 2017 Page 4 2 Mayor Faust stated some people do not want affordable housing but the Council is committed to have 3 affordable housing. He explained the bigger the project, the more affordable housing that can be put in 4 but it also needs to work with the neighborhood. Mayor Faust restated that there has been no plan 5 submitted so there is nothing for Council to review. He stated the Council would like to have it like 6 Silverwood Village. 8 Ms. Eva Gromes, 3312 Croft Drive, stated she has lived in St. Anthony 15 years and been involved in 9 the schools and chaired many events. She is currently serving on the affordable housing initiatives for 10 Lowry Grove residents. Ms. Gromes stated why she believes there is a lack of leadership on the part of 11 the Council and told Council not to dismiss them. She felt the leadership of the community needed to 12 reflect the goals of the community and the Council is to represent the community. Ms. Gromes stated 13 her concerns and presented the Council with a petition signed by 500 people. She reviewed the items 14 listed in the petition and submitted a paper version with names and comments. Ms. Gromes stated a 15 copy will also be emailed to the Council. 16 17 Mayor Faust stated he didn't think there was anything in the petition that Council disagrees with, adding 18 there is no plan from the developer at this time. 19 20 In response to comments from the audience, Mayor Faust clarified that the only meetings held with 21 Continental Property Group (CPG) were during Council meetings. He stated the City Manager will meet 22 with the group any time they request a meeting. 23 24 City Manager Casey stated he has met with Continental regarding some questions they had. 25 26 Ms. Marisol Marino stated she is a resident of Lowry Grove, a single mother of four children, and now 27 she is homeless. She asked the Council to consider having affordable homes for the homeless people 28 such as she. Ms. Marino stated mothers are fighting and working hard to have a place for their children. 29 She asked for justice for the mothers to have a place for her kids. 30 31 Mr. Jim Roth, 3400 Roosevelt, stated he has lived in St. Anthony since 1991 and had served on the City 32 Council. He explained he left the Council for personal reasons that had nothing to do with interactions 33 with the Councilmembers or Mayor. Mr. Roth stated his belief that the Council is doing a great job and 34 he found the audience members to be pitiful. He suggested that in the future, Council meetings be 35 broadcast but Community Forum go offline as it has become a means of showboating. Mr. Roth asked 36 the audience to withhold their comments, noting he did not talk while others were speaking at the 37 podium. Mr. Roth pointed out that the silent majority are not present at the meeting and the noisy 38 minority does not make them the majority. 39 40 Mr. Roth stated the Council tries to be fair and honest and are not prejudice. He noted at the last 41 meeting, a Park Commissioner spoke about participating in a City training session during which all were 42 asked to keep it confidential. But, during the last Council meeting, the Park Commissioner spoke 43 publicly about the training and comments made by other participants, which he found to be disgraceful 44 and thought she should be removed from the Park Commission. Mr. Roth stated he is with the silent 45 majority. 46 City Council Regular Meeting Minutes July 11, 2017 Page 5 Following additional off -mic comments from the audience, Mayor Faust stated it is difficult for him not to be emotional. He reminded all in attendance that the conversation needs to be civil and respectful. 4 Ms. Michelle Gross, President of Communities United Against Police Brutality, stated she spoke at the 5 last Council meeting. She stated she is in favor of all government functions being open meeting and 6 abiding by the open meeting law. Ms. Gross stated her concern about the monies paid to Officer Yanez 7 as `go away money,' noting Officer Yanez will be paid $80,000. She stated Police Chief Mangseth 8 keeps referring to Office Yanez as an exemplary employee but attempts had been made to complain 9 about Officer Yanez. She believed that Officer Yanez had been a problem and asked the Police Chief to 10 resign. Ms. Gross believed the Police Chief created the culture for the department and that he had not 11 been a good leader in this position. 12 13 Mr. Gene Bird stated he is living in Northeast Minneapolis and would be moving to St. Anthony in a 14 few months. He explained that over the past year, he has had some concerns about where they were 15 moving to as the City's leadership has allowed a number of crisis to occur. Mr. Bird stated he has 16 witnessed racism, noting the citizens of St. Anthony care, want to help, and are deeply committed to 17 making St. Anthony a place in which they are proud to live. He encouraged the Council to follow up on 18 the ideas presented, noting this is an opportunity for change. Mr. Bird thanked the attendees who have 19 come before Council who have very little power, stating it is heartbreaking. He stated he hopes Council 20 is listening to their pain, as it is real and valid. 21 22 Mr. Ry Sigleco, Pastor and instructor at St. Thomas and Bethel Colleges, spoke about heaven and stated 23 his opinion that this is the judgement of heaven, the judgement of God. He stated his opinion that the 24 police department is racist and the same powers that killed Frank in Lowry Grove murdered Philando 25 Castille. Mr. Sigleco asked what Council is going to do to address racism and how the Council is going 26 to support Frank's family in Lowry Grove. Mr. Sigleco asked the Mayor and each Councilmember if 27 they were a person of faith. 28 29 Mayor Faust stated he believes Religion and Government should be separate. Councilmember Stille 30 stated he is a person of faith but there needs to be a separation. Councilmember Jenson stated he 31 believes in the Golden Rule. City Manager Casey stated he is a person of faith. 32 33 Mr. Sigleco stated his belief that the Council has a moral obligation to help the people in the community, 34 stating again his belief that this is God's judgement, God is judging the Council, and how the Council 35 responds is a critical. He stated he has relatives in St. Anthony and urged the Council to respond to the 36 community and do justice. 37 38 Mr. Dave Odie, 3313 Croft Drive, stated he has lived at this address since 2000. He thanked Council for 39 their willingness to serve, indicating he has been proud to be a resident of St. Anthony but the last few 40 years, he has had to think about what is happening. Mr. Odie cited examples of the Islamic Center. 41 Philando Castille, police training, costs associated with policing, and Lowry Grove. He stated this 42 appears to be a pattern and asked who is a Villager. Mr. Odie believed the choices made here affect 43 those who live outside the community. He suggested rethinking who is our neighbor and how we 44 interact with those communities. Mr. Odie stated there are two choices — defend ourselves or be less 45 defensive and actively seek solutions. He stated he went to the memorial for Philando Castille and was City Council Regular Meeting Minutes July 11, 2017 Page 6 inspired by what he saw. He stated he was inspired. Mr. Odie invited new voices and to let those voices guide us to a better future in St. Anthony. 4 Ms. Sandy Sherman stated she went to an Open House that CPG had in March. There were about 200 5 people in attendance and they saw drawings of the plan. She stated she spoke with the City Planner and 6 was told the Council is committed to affordable housing. Ms. Sherman noted over $800,000 was given 7 in subsidy for Silver Lake Village and she was told $1,100 was the cost of affordable housing in Silver 8 Lake Village, which is extremely high and not affordable. Ms. Sherman asked the Council to commit to 9 affordable housing and to lead. She stated they want the Lowry Grove residents to live in St. Anthony 10 and they want real low income affordable housing. 11 12 Mr. Bernard Walker stated he is a resident of St. Anthony and wanted to address reform in the Police 13 Department in St. Anthony. He stated his belief that the death of Mr. Castille was preventable and if 14 Officer Yanez is one bad apple, then he believes that St. Anthony has too many bad apples and bad 15 apples should not be protecting the public. Mr. Walker stated he may not be a good fit for the position. 16 He read some comments from his friend who is a cop from Chicago that described how he would have 17 handled the situation. Mr. Walker described his 2' /z hour meeting with Police Chief Mangseth and spoke 18 about cultural competency testing. He suggested the Mayor work with the Police Chief and let him make 19 recommendations for improvements. Mr. Walker asked Council to be open to changes. 20 21 Mayor Faust stated he is open to the reform, noting the Council is aware of the training for the Police 22 Department. 23 24 Police Chief Mangseth addressed the Bullet Proof Warrior Training, stating 4 -5 officers did attend that 25 training but no other officers are attending it. The training is post - certified for officers. Mayor Faust 26 stated 16 hours per year are required for officer training and de- escalation is a relatively new training. 27 Police Chief Mangseth stated he began advancing the training as soon as he was named Interim Police 28 Chief. He explained that this past year, every officer received 2 hours of de- escalation training and the 29 Police Department received some unique training from the DOJ. He stated procedural justice training 30 will be scheduled. Police Chief Mangseth confirmed he will follow - through with the DOJ on training 31 opportunities for the Department. Mayor Faust stated he is committed to fund any training for the Police 32 Department. 33 34 Mr. Walker stated the Salt Lake City Utah department has gone through de- escalation training and the 35 number of incidents, such as the death of Castile, have dropped drastically. Police Chief Mangseth stated 36 he accepts the responsibility to see that the St. Anthony Police Department is trained in de- escalation. 37 38 Mr. Pablo Tapia, Co- founder of Assembly of Civil Rights, spoke about the crisis in Lowry Grove. He 39 asked why it was easy to have money for Officer Yanez but no money for Lowry Grove residents. He 40 stated within three hours he was pulled over three times in St. Anthony, twice by the same officer. Mr. 41 Tapia stated this indicated to him that there were problems with race in St. Anthony. He stated his 42 opinion that Philando was killed as well as the dreams of the residents of Lowry Grove. He stated his 43 belief that the police made the comment it was a good thing Lowry Grove was closing because there 44 were many problems there. Mr. Tapia asked the Council and Mayor for commitment to work with the 45 citizens of St. Anthony Village and the members of Lowry Grove to move forward on affordable 46 housing. He stated they need affordable housing in the range of $450 -$500 a month. City Council Regular Meeting Minutes July 11, 2017 Page 7 Mayor Faust stated he can't commit to $450 per month. 4 Mr. Tapia asked if Council will meet with the residents. Mayor Faust stated everything will be out in the 5 open. Mr. Tapia stated they will not go away. 6 7 Mayor Faust commented on the importance of the negotiation between the Council and Continental, 8 noting the City has the ability to issue the permits and holds the final card in the negotiation. Mayor 9 Faust stated his belief that during negotiations, the first party that names a price loses. 10 11 Mr. Tapia stated his opinion that the community does not trust the Mayor and Council and the Police 12 Department needs to be reformed. Mr. Tapia stated there needs to be a committee to work on reforms 13 but with the new leadership in Washington, DC, he does not trust the DOJ. Mr. Tapia asked for the 14 Council's commitment that the Police Chief will meet with the committee regarding reform. 15 16 Mayor Faust stated the DOJ is currently doing an analysis of the Police Department and will give 17 recommendations that will be followed. He explained this will most likely occur in the Fall, noting there 18 have been three listening sessions and comments can be sent to the email address available. Mayor Faust 19 stated he would not be willing to meet until after the analysis is completed. 20 21 Mr. Bill Wolnow, 3501 Coolidge, stated he has lived there 46 years. He read a draft he prepared for a 22 Letter to the Editor regarding the Lowry Grove closure. Mr. Wolnow questioned why the City did not 23 make Lowry Grove keep up the property, where the inspectors were, and about the storm shelter. He 24 stated he believes Continental paid too much when they purchased the property and he is bothered about 25 profit centers in St. Anthony. Mr. Wolnow stated his belief that the contractors will not lose any money 26 on the deal and the infrastructure is sufficient for the two miles of St. Anthony. He quoted details from 27 the contractors, which he believed were erroneous. Mr. Wolnow discussed the St. Anthony water supply 28 and provided three constraints that he hopes the contractor will follow. 29 30 Ms. Antonia Alvarez appeared again before the Council and stated she has worked on organizing the 31 community for 16 years and is frustrated that the Mayor will not accept a meeting with the Lowry Grove 32 residents. 33 34 Ms. Karin Wyberg stated she is part of the silent majority. She is a long -term resident of St. Anthony 35 and knew Frank from Lowry Grove. She stated her belief that the Lowry Grove residents have sacrificed 36 much. She stated she has never felt threatened in St. Anthony and there are other communities that she 37 has had no interaction with, such as Diamond Eight Terrace Apartments and Lowry Grove. She stated 38 she has reached out, became involved, and organized the conversation at Nativity when the Islamic 39 Center was denied. Ms. Wyberg stated it hurts her to be part of a community where people have become 40 homeless and the City let it happen. She congratulated the Council on their concern for water but noted 41 they do not have concern for the neighbors in Lowry Grove. 42 43 Mr. Brian Buck stated they have been residents for 1 I years. He communicated his support for real 44 affordable housing and the petition that was submitted. Mr. Buck stated he appreciates the fact that this 45 dialog is happening this evening and encouraged everyone to be proactive rather than reactive. He stated 46 he has been struck by the economic disparity with the Lowry Grove residents, noting his children have City Council Regular Meeting Minutes July 11, 2017 Page 8 played with the Lowry Grove children. He stated he does not understand how the City could let this happen and thinks a solution needs to be found to have real affordable housing. Mr. Buck believed the best way to get through this is for shared experiences at a local level. He stated he supports the St. Anthony Villagers group and appreciates the Council for their service. Mr. Buck asked why there aren't common goals, milestones, and respect for each other. He again asked Council to do what they can do to have real affordable housing. 8 Ms. Nona Kennedy Carlson, 2627 Armor Terrace, stated she wasn't going to speak or march tonight 9 because she was tired but her daughter said she needed to march to support the residents of Lowry 10 Grove. Ms. Kennedy Carlson stated she has been coming to these meetings to Open Forum for a year 11 and believed the Council has ignored the comments from the Open Forum. She felt there had not been a 12 dialog — it's been people speaking with no response from the Council. Ms. Kennedy Carlson stated she 13 does not trust the dialog she has heard tonight. She reviewed the duties of the Mayor and Council and 14 stated they have met with other leaders in neighboring cities. She stated she attended the memorial for 15 Philando but none of the Council was there and that was noticed. Ms. Kennedy Carlson stated a blue 16 lives matter flag was hung on the flagpole at Trillium Park on the anniversary of Philando's death. She 17 asked where that came from, thinking the Council sits behind their desk and they pretend to care. She 18 referred to a Roseville City Council meeting during which their Mayor and Council listened and came 19 up with a plan at that meeting. She stated there are two strong candidates coming for Council seats. 20 21 Ms. Mel Chaput stated she wasn't going to speak but wanted to thank the community for their support. 22 She stated her belief that there are financial reparations that can be made. She stated the community has 23 given help to the residents of Lowry Grove and since the Council is not helping those in the community, 24 the community made emotional reparations. 25 26 Ms. Carolyn Johnson, 3317 Edgemere, asked for clarity and asked Mayor Faust that those looking out 27 for Lowry Grove should take in some of the residents. She stated she has taken some people in. She 28 lived in Lowry Grove for many years as a child and it was a wonderful community. Ms. Johnson asked 29 the Police Chief when he became Chief. Police Chief Mangseth answered July 12 of last summer. 30 31 Ms. Johnson stated her opinion that this Police Chief is taking the `hot seat' for John Ohl who was the 32 Police Chief before him and he is trying to step up and protect the residents. Ms. Johnson stated she had 33 some problems with John Ohl and Captain Cotroneo. She asked Police Chief Mangseth about the 34 sidewalk and stated her truck will sit for more than 24 hours at a time. She asked if she will be treated 35 the same way as she was treated by former Police Chief Ohl. Police Chief Mangseth stated Ms. Johnson 36 will be treated no differently than anyone else and he would be willing to speak with Ms. Johnson 37 directly. Chief Mangseth stated he will listen. Ms. Johnson thanked Police Chief Mangseth. 38 39 Police Chief Mangseth thanked those that marched from Lowry Grove for the fact that only one lane of 40 the street was blocked. 41 42 Ms. Luann Zappa stated she lived in Lowry Grove and thanked Council for opening the dialog. She also 43 thanked the residents of St. Anthony who helped Lowry Grove residents. Ms. Zappa stated she does not 44 want St. Anthony to fall into the pits like North Minneapolis. 45 City Council Regular Meeting Minutes July 11, 2017 Page 9 1 Ms. Jan Nye stated she lives in Minneapolis and believes the Council has a great responsibility. She 2 stated she pays attention to the Constitution and the Open Meeting Laws and agrees the fresh water 3 supply is threatened. Ms. Nye stated she sees the government working against us. She stated Lowry 4 Grove is a beautiful place with huge trees. She believed there is a ripple effect in the City from the 5 closing of Lowry Grove. Ms. Nye commented on the homeless problem in Minneapolis and her belief 6 that extreme greed is going on. 7 8 Ms. Eva Gromes, who spoke previously, reiterated some of the questions posed to the Council including 9 why Lowry Grove was able to deteriorate over the years, aren't there building codes, and why are the 10 Lowry Grove roads so bad. 11 12 Mayor Faust explained they were private roads. 13 14 City Manager Casey explained the Minnesota Department of Health licenses mobile home communities, 15 they have been on site, and had some findings that the previous owner was responsible for taking care 16 of He stated the City does not have codes regarding private streets. The structures themselves were 17 inspected by the inspection department but only on the outside. There was no license inspection for 18 Lowry Grove. City Manager Casey stated there have been issues with water and sewer line breaks, 19 which were the responsibility of the owner. 20 21 Ms. Mary Jackson, 37`h Avenue, stated she has lived here 10' /Z years and was shocked the Council would 22 not give support of affordable housing. 23 24 Mayor Faust clarified the Council is committed to affordable housing. 25 26 Ms. Jackson stated she sees the Council as a financial cost to the City because settlements are being 27 paid. She stated her opinion the City does not offer an interpreter and there is a systematic problem here 28 that is costing financially and emotionally. She stated the City Council needs to treat everyone with 29 respect and suggested the DOJ do a Title 6 review of the City. 30 31 Mayor Faust clarified that if the City knows someone is coming to a meeting and needs an interpreter, 32 the City Manager will get a translator. He also noted the website can be changed to different languages. 33 34 City Manager Casey confirmed that a translator has been provided for many years when requested. 35 36 Ms. Jackson asked why there is no ADA transition plan on the website. 37 38 Mr. Dave Becking stated he lives in Minneapolis and did not intend to speak as the residents of St. 39 Anthony are doing well to speak but he believes the problem is the Council and Police Department have 40 a history that can be reviewed. He stated there has been a history of neglect of Lowry Grove and its 41 residents and problems with the Police Department so people do not trust the priorities of the Council 42 for those closed door meetings. Mr. Becking stated his belief that Police Chief Mangseth was not 43 responsible for Officer Yanez's behavior but if Police Chief Mangseth said Officer Yanez was an 44 exemplary employee, he is not fit to be the Police Chief. He acknowledged there is a lot of baggage and emotion 3 but urged everyone to keep talking, be open, and let our guards down. Mr. Botz stated we need to see 4 each other as people and share without fear of being bullied, assaulted, or threatened.
