CONCEPT REVIEWS. None. VIII. OTHER BUSINESS. A. Introduction of Consultant Planner. Mark Casey, City Manager, presenting. Planning Commission Regular Meeting Minutes April 17, 2012 Page 2 City Manager Casey advised that the City has reorganized some staff and as part of that reorganization, the City has retained a consultant planner. City Engineer Hubmer stated that WSB & Associates has been working with the City since 1996 and is pleased the City has chosen to continue its relationship with WSB. He introduced Ms. Jacqueline ( "Jack ") Corkle as the City's consultant planner. 8 Ms. Corkle stated she began working at WSB in February and has a wide variety of experience 9 in local city planning. She indicated she received her Master's degree in planning and has done 10 consulting and accounting work for 15 years. She stated she will keep office hours at City Hall 11 on Tuesday afternoons and will be available on call as needed by phone or email. She stated she 12 is happy to be working with the City. 13 14 City Manager Casey stated that Ms. Corkle will be the staff person at future Planning 15 Commission meetings and will be responsible for putting together the staff reports and agendas. 16 17 Commissioner Jensen requested further information regarding how staff reports will be prepared 18 for the Planning Commission and asked if the consultant planner will make recommendations for 19 approval or denial of items before the Planning Commission. He also asked if the consultant 20 planner's staff reports will include language for Planning Commission consideration related to 21 actions that require conditions to comply with the City Code. 22 23 City Manager Casey indicated the process will be similar to what has been done in the past and 24 staff reports will include recommendations from the consultant planner. He added that Ms. 25 Corkle's training as a licensed planner will assure consistency and professionalism. 26 27 Ms. Corkle stated that she intends to put together the staff reports and agendas consistent with 28 past practice but encouraged the Planning Commission to let her know if there are things they 29 would like to change. 30 31 Commissioner Jensen stated the Planning Commission has debated whether it was the Planning 32 Commission's task to impose conditions of approval if those conditions are absent from the staff 33 report, particularly related to variance requests. He stated he has felt uncomfortable adding 34 conditions and would like to have staff prepare conditions for Planning Commission review and 35 modification. 36 37 Commissioner Crone expressed gratitude to Ms. Moore and wished her the best. ANTHONY VILLAGE MEMORANDUM To: St. Anthony Village Planning Commission From: Jacqueline Corkle, PTP, AICP Interim City Planner 701 Xenia Avenue South Suite 300 Minneapolis, MN 55416 Tel: 763 - 5414800 Fax: 763 - 541 -1700 Date: May 5, 2012 Planning Commission Regular Meeting for May 15, 2012 City Council Regular Meeting for June 12, 2012 WSB Project No. 01626 -630 Request: Request for a Conditional Use Permit (CUP) to allow a religious assembly at 3055 Old Highway 8 RECOMMENDATION As the Planning Commission is aware, the St. Anthony Village City Council has authorized a study regarding the regulation of assemblies, meeting lodges and convention halls as conditional uses in the Light Industrial and Commercial Districts. In addition, the City Council has passed a moratorium on the issuance of Conditional Use Permits for Assemblies, Meeting Lodges or Convention Halls within Commercial and Light Industrial Zoning Districts in order to allow the study to be completed. The study has not been finalized as of the writing of this memorandum and, therefore, has not been reviewed by the Planning Commission. Without the final report it would not be prudent for staff or for the Planning Commission to make a recommendation to the City Council at this time. Therefore, at this time, staff recommends the following: The Planning Commission should hold the Public Hearing and receive the Applicant's information on the CUP and allow the public to comment on the proposed CUP. After the public hearing is closed, the Planning Commission may discuss the proposal before them. However, staff recommends that no decision be made tonight pending receipt of the study. Instead, staff recommends that a Special Session of the Planning Commission be held on June 4, 2012 to make a recommendation once the study is completed. Staff anticipates the final report will be provided to the Planning Commission the week of May 14, 2012. The Planning Commission will then review the study and be asked to make recommendations prior to the June 12, 2012 City Council meeting. Background. Muxamedrashid Ali on behalf of the Abu - Huraira Islamic Center is requesting a conditional use permit to allow an `assembly' at 3055 Old Highway 8. The Applicant's representative (Michael Medina) has stated that the `assembly' would occupy the lower level of the south building. There is also a space on the main floor of the building that will act as the `receiving room' for the center. The Islamic Center would host a daily prayer hour and special prayer and potluck dining events during Ramadan. According to information provided by the Applicant, the lower level of the south building comprises approximately 13,280 square feet, with approximately 1,625 square feet leased to a tenant. This leaves approximately 11,655 square feet for assembly use in the lower level. The space identified for assembly is 12,940 square feet (11,655 in lower level and 1,286 on the main level). The entire building is approximately 103,460 square feet. The rest of the building (the three story office tower and the first level of the south building) less the receiving room would remain as office /tenant space. The underlying zoning district is LI — Light Industrial which does not include assemblies as a permitted use. However, as noted in Title XV, Chapter 152, Section 152.142, (G) Assembly, meeting lodge or convention halls are considered a `permitted conditional use'. The Zoning Code does not define assembly, meeting lodge or convention hall. The study being prepared will address these definitions. 2. Overview. Location The assembly is proposed to be located in the basement of an existing building. No exterior expansions or modifications to the building are proposed with this application. The interior will be modified to meet current building codes. The proposed assembly is located in the basement of the southern building. The main floor of the southern building would remain as office /tenant space. The entire north building would remain as office /tenant space. Hours of Operation The proposed hours of operation for the `assembly' area include the following: • Daily prayer from 1:00 to 2:00 PM • Evening worship and food sharing during Ramadan May 5, 2012 Page 3 Staffine The Abu - Huraira Islamic Center will be staffed by four people. Parking and Traffic Title XV, Chapter 152, Section 152.179 (A) On -Site Parking (5) Minimum number of spaces indicates that churches, clubs and restaurants must have a number of parking spaces which is no less than the total designed seating capacity of the structure divided by 2.5, plus 1 parking space for each employee on the largest shift. Although the definition is not specific to mosques or assemblies, staff believes that "church" in this case can be applied to the proposed use Information provided by the Applicant indicates that the prayer areas (men's and women's) combined can accommodate a total of 261 persons. Taking 261 and dividing it by 2.5 results in a demand of 105 parking spaces. Adding staff (four persons) parking requirements brings the total number of spaces needed for the conditional use to 109 spaces. Title XV, Chapter 152, Section 152.179 (A) On Site Parking (5) Minimum number of spaces indicates that light industrial, manufacturing, testing and research uses must have I space for every 1,000 square feet of building floor area. The building, minus the area proposed for the `assembly' (12,940 square feet) is 90,520 square feet. Thus, at least 91 spaces must be on the site to serve the remainder of the building. In 2009 a Conditional Use Permit (CUP) was issued for a daycare center at this location. Part of the approval of the CUP included providing parking at higher levels than the I space for every 1,000 square feet for light industrial uses. Required parking included one space for each employee on the largest shift and one visitor space for every 10 children. Based on today's staffing and enrollment, 12 spaces are needed. With all of the combined uses in the building, a total of 210 parking spaces (109 for Islamic Center, 89 for the remainder of the building less the daycare space and 12 for the daycare space) will be needed. The site the building is located on has 92 parking stalls. The parking on this site does not have enough parking to serve the entire building. Parking will be needed from the adjacent parcel in order to meet the parking requirements of the City's Zoning Code. The property adjacent to it has a total of 237 parking stalls, for a total of 329 stalls. Signaee The Applicant has not submitted a sign request at this time. The Applicant must obtain a sign permit from the City prior to the installation of any signage. 3. Ordinance Authority. Title XV Land Usage, Chapter 152 Zoning Code, Section 152.142 Permitted Conditional Uses in the Light Industrial District, allows (G) Assembly, meeting lodge or convention halls. As noted previously, the City is completing a study that will address definitions for assembly. 4. Criteria for Conditional Use Approval. Title XV Land Usage, Chapter 152 Zoning Code, Section 152.243, C: City Council Action, lists the criteria the City Council must consider in determining whether to grant or deny a conditional use permit. The applicable criteria include: (1) The use is one of the conditional uses specitically listed for the district in which the property is located; (2) The City Council has specified all conditions which the City Council deems necessary to make the use compatible with other uses in the area; (3) The use will not be detrimental to the health, safety or general welfare ofpersons residing or working in the vicinity or to the values of property in the vicinity, and May 5, 2012 Page 4 (4) The use will provide a service or a facility which is in the interest of public convenience and will contribute to the general welfare. ACTION Hold the Public Hearing, but defer Recommendation to the City Council. The study regarding the regulation of assemblies, meeting lodges and convention halls as conditional uses in the Light Industrial and Commercial Districts authorized by the City Council is not finalized. It is anticipated to be completed the week of May 14, 2012. The Planning Commission should hold the public hearing, but not make a decision on a recommendation to the City Council. Staff proposes a special meeting of the Planning Commission on June 4, 2012, at which time a recommendation to the Council should be made. Staff will prepare a draft resolution with proposed conditions for use at the June 4'h meeting. Staff will incorporate applicable conditions from the May 15'h discussion. They are interested in using a portion of this complex for their use. The St. Anthony Business Center is located in a Light industrial Building Zone. Abu - Huraira Islamic Center is seeking a Permitted conditional use as per section 152.142 — (G) Assembly. There would be no addition or expansion to existing Structure. They will occupy the lower level of south building. One of the requirements of an assembly Occupancy is that the area be sprinkled. The lower south structure has a sprinkler system and will be retrofitted to any new remodeling to meet code requirements for the Abu - Huraira Islamic Center. There is a firewall separation between the north 3 story office tower and the one story south structure with fire door and self closing rated doors connecting the two occupancies. A new Handicapped entrance will be added at the lower level with direct access to grade. Three new handicapped parking spaces will be added to and close to this entry. The hours of use for the Islamic center: • Prayer hour each day from 1:00 PM to 2: PM • Ramadan is the ninth month of the Islamic calendar, when Muslims fast (Sawm) during daylight hours. In the evening worshippers will come to pray and share food and eat after sunset. These prayers also give Muslims a chance to meet at the Mosque every day during this period, and so they help to improve relationships in the Muslim community. • Food is limited to a pot luck meal everyone brings something to share food items and will not include a commercial kitchen. The traditional meal would be eating a few Dates • Since this activity occurs after working hours there would be no conflict with the office and other tenant business use. The Conditional use permit would be a requirement for the Mosque (prayer area) which is an assembly use. This will also cover other activities such as the waiting and lounge area which are large group social areas. The location is ideal and convenient to the Muslim community it servers. The property currently does not have permanent steps to the front door area. The property owner had submitted a building permit for staff approval of the proposed improvement. Staff reviewed the proposed improvement and recognized that the subject property already exceeded the impervious surface limits for the R -1 district and that the proposed improvement would exacerbate the situation. Staff informed the property owners that a variance would be required if they wanted to proceed with the proposed improvement. The property owner has submitted the required paperwork for a variance application. Property and Zoning Code Information: The property is located at 330131 st Avenue NE. According to Hennepin County property records, the lot is 68 x 134.27. The lot is approximately 9,131 square feet. Current impervious surface on the site includes the following: Garage = 437 square feet House = 2,565 square feet Driveway = 2,279 square feet Total impervious surface is 5,281 square feet. Approximately 57.9 percent of the property is covered by impervious surface. The Zoning Ordinance limits impervious surface to 35 percent on properties that are 9,000 square feet or larger. Proposed Change: As indicated above the property owner wishes to construct front stairs, a sidewalk and a small patio area to provide access from the driveway to the front door. The proposed improvement will add 339 square feet of impervious surface to the lot, bringing the total impervious surface to 5,620 square feet. This would result in approximately 61.5 percent of the property being covered by an impervious surface. Since we have a slope down to our driveway to the right of the proposed front steps, we would like to pour a short walkway to the driveway culminating in a smaller concrete step unit that would meet the driveway. The short walkway would allow us to shovel to the front door from the driveway. The small steps at the driveway would eliminate the possibility of slipping and falling in the winter due to an unsafe grade going up from the driveway to the front door. We now have a little over 50% of our property in cement because of an unusually long driveway made in the 1940's to a garage set back at the back end of our property line, also build in the 1940's. The rest of the property is house and garage making up the amount of cement 1 mentioned. Granting our Variance Application would allow us a safe and practical way to get to our front door and enhance the look of our front property and the neighborhood.
