The hours of use for the Islamic center: • Prayer hour each day from 1:00 PM to 2: PM • Ramadan is the ninth month of the Islamic calendar, when Muslims fast (Sawm) during daylight hours. In the evening worshippers will come to pray and share food and eat after sunset. These prayers also give Muslims a chance to meet at the Mosque every day during this period, and so they help to improve relationships in the Muslim community. • Food is limited to a pot luck meal everyone brings something to share food items and will not include a commercial kitchen. The traditional meal would be eating a few Dates • Since this activity occurs after working hours there would be no conflict with the office and other tenant business use. The Conditional use permit would be a requirement for the Mosque (prayer area) which is an assembly use. This will also cover other activities such as the waiting and lounge area which are large group social areas. The location is ideal and convenient to the Muslim community it servers. They are interested in using a portion of this complex for their use. The St. Anthony Business Center is located in a Light industrial Building Zone. Abu - Huraira Islamic Center is seeking a Permitted conditional use as per section 152.142 — (G) Assembly. There would be no addition or expansion to existing Structure. They will occupy the lower level of south building. One of the requirements of an assembly Occupancy is that the area be sprinkled. The lower south structure has a sprinkler system and will be retrofitted to any new remodeling to meet code requirements for the Abu - Huraira Islamic Center. There is a firewall separation between the north 3 story office tower and the one story south structure with fire door and self closing rated doors connecting the two occupancies. A new Handicapped entrance will be added at the lower level with direct access to grade. Three new handicapped parking spaces will be added to and close to this entry. The business center will not change its character or Occupancy use and would continue to run as Office tenant space. The site is bounded by New Brighton Boulevard highway 8 and old highway 8 to the east and west. A condo sits to the north side of the site. To the west across old Highway 8 is bounded by single residential unit. Their back door and back yard faces the St. Anthony business Center. Staff met with representatives from the Abu - Huraira Islamic Center, who are proposing to purchase the Light Industrial property, St. Anthony Business Center at 3055 Old Hwy. 8, also known as the Medtronic building. They are planning to submit a request for a Conditional Use Permit for assembly and for a school. The property currently has a CUP for a daycare center. Some considerations that Staff has responded to in response to this request: • In speaking with the City Attorney, he indicated that a CUP will have to be requested for each additional permitted conditional use as listed in the Zoning Code for the Light Industrial zoning district. • Additionally, since schools are not a permitted conditional use for the LI zoning district, the applicants will have to petition an amendment to the zoning code, subdivision §152.142 PERMITTED CONDITIONAL USES, to include schools. A suggestion was made that the property could be re -zoned to an R -4 designation to accommodate having a school on this site. The City Attorney reported that re- zoning would create several legal non - conforming uses because of the businesses that are currently housed in the St. Anthony Business Center. The realtor for the applicant had reported that there are currently several businesses currently operating in the building, some with leases going out to 2015. The attorney advised that re- zoning should not be an option at this time. This property was also split into two (2) lots in 2009 to encourage redevelopment of the site. Lot A, which is the north half of the property , which serves as the parking lot for the building. Abu - Huraira Islamic Center plans to purchase both lots, which will then provide sufficient parking for their cultural, educational, and religious activities. When asked, the City Attorney indicated that there is no requirement for the proposed buyers to combine the lots; they may do so whenever they feel it is appropriate. • An important consideration for the City to weigh is if this property is granted a CUP for assembly, their religious activities may have them petitioning Hennepin County for property tax exclusion once their tenants have fulfilled the terms of their lease and have moved out. This would be a consideration with any religious group that proposes to buy any non- tax - exempt property in the City. Staff is proposing text amendments to §152.039, DIMENSIONAL REGULATIONS. Last summer, we had several requests for garage setback permits. Staff, in explaining that a garage being sited in a front yard, back yard and /or side yard setback required a setback permit, would get questions about what constituted a yard and a setback. Despite receiving several explanations, the applicant often remained very confused. In reviewing the ordinance language, Staff did find that the ordinance describing the front, rear and side yards was confusing and assumed that the difference between the yards and respective setbacks was understood. The attached proposed text amendment is an attempt to more clearly define each of the yards and the corresponding setbacks. Staff met with Tom LaSalle, LaSalle Group, who is representing a bio -tech research incubator company. The company is small but growing and as such is interested in purchasing the property at 2845 Anthony Lane S. They are looking for a larger property, which can be renovated into a plant research laboratory. As a part of the building, they also want to build greenhouses to supply the plants that are needed for ongoing research projects. §152.141 PERMITTED USES, (E) allows laboratories for research and testing. Mr. LaSalle reported that the plan for the greenhouses puts them on the south side of the property but because that side is adjacent to the street, the required side yard setback is 40 feet. Staff advised that a variance to the 40 -foot setback would be needed before the construction of the greenhouses could begin. Attachments. More information will be communicated when available. 18 19 Commissioner Heinis and Assistant City Manager Moore -Sykes attended the strategic planning 20 session. 21 22 Chair Jensen asked about the Autumn Woods development and Assistant City Manager Moore - 23 Sykes stated it will come before the Council at their next meeting. 24 25 XIV. Mr. Moffat stated he is not 2 certain but believes it to be 8 -10 feet wide. Mr. Moffat stated the bridge is approximately 160 3 feet long. 4 rvices to the shed. Mr. Moffat stated it would be similar to 8 Chair Jensen asked about the color palette 9 that palette of the building. 10 11 Commissioner Heinis asked if all equipment would be put away at the end of the day. on 12 Moffat stated it would since it would be a daytime operation from approximately Memorial Day 13 to Labor Day. 14 15 Mr. Moffat stated he did a quick survey on the existing parks as to the setback from the 16 lakeshore and indicated this project is well within the plan. 17 18 Motion by Commissioner Niccum, second by Commissioner Chaput, to recommend approval 19 that the City council approve the application for lakeshore setback variance based on the 20 following findings of fact: 21 to a reasonable use without the variance due to the 22 a. That the property cannot be put 23 architecture in the planned development; 24 b. That the circumstances causing the practical difficulty were not created by the owner; 25 C. That the variance, if granted, will not alter the essential characteristics of the locality; 26 d. That economic considerations alone are not the basis for the practical difficulty; 27 e. That the circumstances causing the practical difficulty are unique to the individual lot; 28 and, 29 f. The granting of the variance is in keeping with the spirit and intent of the Zoning Code 30 and Comprehensive Land Use Plan. 31 32 Commissioner Chaput requested an amendment to the conditions for approval to indicate that no 33 hazardous materials be stored in the shed with the exception of 5 gallons of fuel at the time. 34 35 Commissioner Niccum suggested the carpenter be contacted regarding the peak height. OTHER BUSINESS. Planning Commission Regular Meeting Minutes January 17, 2012 Page 3 1 Mr. Dan Bartel, 4021 Silver Lane Terrace NE, stated his concern is the storage of fuel and 2 hazardous materials. He is also concerned what this shed would do to the beauty of the lake, 3 fears residents may wish to construct a boat house, and questioned where the "line" would be 4 drawn. Mr. Moffat stated the shed would be part of the park plan. 5 6 Chair Jensen closed the public hearing at 7:21 p.m. 8 Commissioner Crone asked where exactly 200 feet is. Mr. Moffat indicated 200 feet on the site 9 plan, noting it brings the location up the hill close to the parking lot. The attendant would be 10 required to carry heavy equipment up and down the hill on a daily basis. Commissioner Crone 11 asked about the peak height being 14 feet. Mr. Moffat stated that could be revised if the City 12 requires it to be lower. 13 14 Commissioner Crone asked if the shed would be used as a concession stand in the future. Mr. 15 Moffat stated that would not happen. 16 17 Commissioner Crone asked if there would be one or two attendants. Mr. Moffat stated most 18 often there would be one attendant and they would have a cell phone in case of a safety concern. 19 20 Commissioner Crone stated the ramp that was nicely constructed and asked if the ramp is wheel 21 chair accessible. Mr. Moffat stated the ramp was built meeting ADA standards. Mr. Moffat 22 stated a goal of the District is to make as much of the park handicap accessible. He stated the 23 slope is ADA accessible. 24 25 Commissioner Crone asked if there would be a porta -potty along the trail. Mr. Moffat stated they 26 do not foresee having one. Commissioner Crone asked why the area was cleared. Mr. Moffat 27 stated there was quite a bit of invasive species that needed to be removed. 28 29 Commissioner Niccum stated this variance, if approved, is based on the fact there is a danger 30 element of renting canoes without this a structure close to the lake. A similar request from a 31 resident would not be allowed because these criteria would not be met. 32 33 Chair Jensen summarized the shed would provide storage and an area from which to rent 34 equipment. He asked if someone on staff is trained in safety. Mr. Moffat stated he and all staff 35 are trained and there is a standard emergency response plan. 36 37 Chair Jensen noted at the last meeting a question was raised about amending the existing ROS 38 that would allow such a structure instead of considering this as a variance. She stated this is a variance application for the construction of a 12' x 18' canoe 23 rental /storage shed approximately 80 feet from Silver Lake, immediately adjacent to existing 24 fishing piers and trails. Mr. Tom Moffat, Three Rivers Park District is the petitioner. The 25 Commission is requested to establish Findings of Fact for this request, based on information and 26 testimony presented by the applicants, the public, and Staff and pass a recommendation to 27 Council regarding the variance request to the Lakeshore Setback requirement in the City's 28 Zoning Code. 29 30 Assistant City Manager Moore -Sykes stated Staff has not received any resident's comments. 31 32 Mr. Tom Moffat, Three Rivers Park District appeared before the Commission. He stated he 33 agrees with the details Staff provided. Mr. Moffat stated the setback would actually be 83 feet 34 from Silver Lake. A concept drawing was shown indicating the peak height being 14 feet. This 35 height could be lowered if requested. The question was raised whether there would be any 36 landscaping. Mr. Moffat stated shrubs would be planted between the shed and the lakeshore. 37 The Horticulture Department has a landscaping plan for that entire area. The landscaping would 38 occur after the construction is completed in the spring. 39 40 Commissioner Chaput asked if the use for the shed was solely storage. Mr. Moffat stated it 41 would be used for storage and boat rental. Commissioner Chaput asked if there would be fuel 42 storage. Mr. Moffat stated there may be a gas can for an outboard motor that would be used in 43 an emergency but they are researching electric motors charged by solar. 44 I CITY OF ST.
