ANTHONY, CITY OF ROSEVILLE, CITY OF FALCON HEIGHTS, AND JERONIMO YANEZ, INDIVIDUALLY AND AS AGENT AND/OR EMPLOYEE OF CITYCITY OF ST. ANTHONY VILLAGE STATE OF MINNESOTA RESOLUTION 17 -080 APPROVING A MEDIATION AGREEMENT IN DIAMOND REYNOLDS, INDIVIDUALLY AND AS NEXT FRIEND OF DER, A MINOR CHILD V CITY OF SAINT ANTHONY; CITY OF ROSEVILLE, CITY OF FALCON HEIGHTS; AND JERONIMO YANEZ, INDIVIDUALLYAND ASAGENTAND /OR EMPLOYEE OF CITY OFSAINTANTHONYPOLICE DEPARTMENT, STATE OF MINNESOTA, DISTRICT COURT, COUNTY OF RAMSEY, SECOND JUDICIAL DISTRICT. WHEREAS, Diamond Reynolds and her minor child, DER, served a Complaint venued in Ramsey County District Court, State of Minnesota, against the City of St. Anthony, et al., seeking monetary and other relief concerning the stop of a vehicle on July 6, 2016, the subsequent shooting of Philando Castile in the vehicle occupied by Diamond Reynolds and her minor child, DER, any force allegedly used on Diamond Reynolds and DER, the alleged subsequent detention of Diamond Reynolds and DER, claims relating to racial discrimination under the Minnesota Human Rights Act, emotional distress claims and all other claims against the City of St. Anthony Village (hereinafter "claims "); and WHEREAS, on November 13, 2017, the parties engaged in a mediation which resulted in a proposed Settlement Agreement for the claims alleged by Diamond Reynolds and DER; and WHEREAS, the parties agreed to a proposed monetary settlement of $675,000.00 for all claims as against St. Anthony Village, Jeronimo Yanez, et al., subject to approval by the St. Anthony Village City Council; and WHEREAS, upon the advice of counsel, and in order to avoid further burden and expense to the City of St. Anthony Village and to bring to a close all potential litigation relating to the tragic death of Philando Castile, the City of St. Anthony Village City Council has determined that the approval of the Settlement Agreement is in the best interest of the City of St. Anthony Village; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR THE CITY OF ST. ANTHONY VILLAGE, MINNESOTA: Section 1. The settlement is approved on behalf of the City of St. Anthony Village and its current or former employees. The City Manager is authorized to execute any required Settlement Agreement. Section 2. The City Manager and the City's legal counsel are hereby authorized to take all necessary actions to effect the terms of resolution of the settlement made at the mediation on November 13, 2017.
