ANTHONY 1 CITY COUNCIL REGULAR MEETING MINUTES 2 APRIL 24, 2018 3 4 CALL TO ORDER. 5 6 Mayor Faust called the meeting to order at 7:00 p.m. 7 8 PLEDGE OF ALLEGIANCE. 9 10 Mayor Faust invited the Council and audience to join him in the Pledge of Allegiance. 11 12 ROLL CALL. 13 14 Present: Mayor Faust, Councilmembers Gray, Jenson, Randle and Stille. 15 Absent: 16 Also Present: City Manager Mark Casey, Parks Commission Chair Scott Bentz, Planning 17 Commission Chair Domonic Papatola, and James Lehnhoff, Ehlers & Associates 18 19 CONSIDERATION, DISCUSSION, AND POSSIBLE ACTION ON ALL OF THE FOLLOWING 20 ITEMS. 21 22 I. PROCLAMATIONS AND RECOGNITIONS. 30 31 A. Students in Government Presentation. 32 33 The students were not present at the meeting. 34 35 B. Arbor Day Proclamation. 36 37 Parks Commission Chair Scott Bentz provided the Arbor Day Proclamation for Council 38 consideration. Mr. Bentz noted two years ago St. Anthony became a Tree City USA. The Parks 39 Commission acts as the Tree Board for the City and May 5, 2018 is Spring Clean-Up Day when 40 seedlings will be given away. 41 42 Councilmember Randle read the Proclamation in full. 43 44 Mayor Faust stated when road construction is done 20% more trees are planted than the number 45 of trees that need to be removed. 46 47 III. Claims. 3 4 Motion by Councilmember Stille, seconded by Councilmember Jenson, to approve the Consent 5 Agenda items. 6 7 Motion carried 5-0. 8 9 IV. PUBLIC HEARINGS – NONE. 10 11 V. REPORTS FROM COMMISSION AND STAFF. 12 13 A. 2018 Planning Commission Work Plan. 14 15 Planning Commission Chair Dominic Papatola reviewed the St. Anthony Village Planning 16 Commission 2018 Work Plan and some of the 2017 accomplishments of the Planning 17 Commission. 18 19 Motion by Councilmember Stille, seconded by Councilmember Gray, to approve the St. Anthony 20 Village Planning Commission 2018 Work Plan. 21 22 Motion Carried 5-0. 23 24 Mayor Faust encouraged the new Park Commissioners to attend the GTS Training that is offered. 25 26 VI. GENERAL BUSINESS OF COUNCIL. 27 28 A. Resolution 18-036; a Resolution Authorizing Issuance, Awarding Sale, Prescribing The 29 Form and Details and Providing for the Payment of $2,610,000 General Obligation 30 Bonds, Series 2018A. 31 32 Mr. James Lehnhoff, Ehlers & Associates, reviewed the process for the issuance of the General 33 Obligation Bonds to fund the street improvements. It was noted the amount of the bonds is 34 reduced to $2,610,000. 35 36 Councilmember Stille asked what the rate was last year and Mr. Lehnhoff stated the rate in 2017 37 was at 2.58%. Councilmember Stille mentioned this is a tax exempt rate. 38 39 Motion by Councilmember Stille, seconded by Councilmember Jenson, to approve Resolution 40 18-036; a Resolution Authorizing Issuance, Awarding Sale, Prescribing the Form and Details 41 and Providing for the Payment of $2,610,000 General Obligation Bonds, Series 2018A. The sale 42 goes to FTN Financial Capital Markets. 43 44 Motion Carried 5-0. 45 46 4 City Council Regular Meeting Minutes April 24, 2018 Page 3 B. Authorization for WSB & Associates, Inc. to conduct a traffic study on 27th Avenue NE 1 and Pahl Avenue. 2 3 City Manager Casey reviewed the proposal from WSB & Associates to provide professional 4 engineering services relating to the 27th Avenue NE/Pahl Avenue NE Traffic Study. The Scope 5 of work includes the project tasks as data collection, analysis of existing conditions, traffic 6 forecasting, identification of traffic calming alternatives and evaluation, recommendations report 7 and meetings. The proposed scope of services presented in this proposal is based on feedback 8 from residents and discussions with City Staff. The total base cost is $12,416 for the study. 9 10 Mayor Faust noted this would provide a baseline before construction begins. 11 12 Councilmember Stille asked about the timing and a concern that the data collection will be done 13 while school is in session. 14 15 Councilmember Jenson requested that after the development is completed, a similar study be 16 done. 17 18 Ms. Susan Guthrie, 2616 Pahl Avenue, stated she lives on the corner of Pahl and Wilson. She 19 wants to see the traffic study done and noted Hennepin County has portable cameras on a trailer 20 that are controlled by Mpls. Police. They just need to be requested to be used and this may 21 reduce the cost of the study. She asked that a 4-way stop be considered. 22 23 Motion by Councilmember Stille, seconded by Councilmember Gray, to authorize WSB & 24 Associates, Inc. to conduct a traffic study on 27th Avenue NE and Pahl Avenue at a cost not to 25 exceed $12,416. 26 27 Motion carried 5-0. 28 29 C. Request to City Council to Implement an Organics Recycling Pilot in St. Anthony. 30 31 City Manager Casey presented a letter dated February 28, 2018 from Mr. Ben Knudson, 32 Hennepin County regarding an organics recycling program. Staff recommends Council refer this 33 to the Parks Commission for recommendations on possible sites, costs, grant opportunities, and 34 research other cities that have implemented this program for issues, etc. 35 36 Ms. Lona Doolan, 3511 Harding Street NE and Mr. Michael Guest, 3626 Belden Drive NE, 37 representing Citizens for Sustainability, requested the City of St. Anthony direct staff to identify 38 potential collection site(s) within City limits, engage Ramsey and Hennepin County resources to 39 provide an Organics Recycling Pilot Program in St. Anthony, and establish common space for 40 residents to pick up buckets and bags. They provided a PowerPoint presentation reviewing 41 MPCA Objective for Managing Municipal Solid Waste, Why Now, Background, Opportunity, 42 Example of Residential Collection Site, and Best Practices to Address Top 3 Concerns. Ms. 43 Doolan explained the difference between the Hennepin and Ramsey County opportunities. 44 45 5 City Council Regular Meeting Minutes April 24, 2018 Page 4 Councilmember Jenson asked Mr. Casey if his suggestion was to have the Parks Commission 1 look at both County opportunities. Councilmember Jenson also asked how long the pilot would 2 last. Mr. Casey stated the pilot would be the implementation of the program and negotiations 3 with the hauler for 2020 would begin in 2019. Ms. Doolan stated Minneapolis chose to keep 4 their drop off sites up and running for residents that do not have curbside pickup available. 5 6 Councilmember Stille asked how many sites are needed for the programs. He would like the 7 Parks Commission to research the number of sites needed. Mr. Guest recommended two 8 collection sites in St. Anthony. 9 10 Mayor Faust noted recycling is in the chart for 45-48% but he believes St. Anthony has a higher 11 percentage. He is a bit concerned about the sanitation of a program and is in favor of having the 12 Parks Commission research the programs further. 13 14 The consensus of the Council was to have the Parks Commission research and make 15 recommendations to the City Council. 16 17 Mr. Casey stated this could be put on the agenda for the Parks Commission June Meeting. 18 19 Ms. Erin Jordahl-Redlin, Vice Chair of Parks Commission, and Mr. Scott Bentz, Chair of the 20 Parks Commission, appeared before the Council. They noted the Parks Commission would like 21 to work on this with the CFS and residents but due to timing, may only be able to make 22 recommendations on the Ramsey County program. 23 24 Motion by Councilmember Stille, seconded by Councilmember Jenson, to have the City 25 Manager refer this item to the Parks Commission for research and to provide a recommendation 26 to City Council on implementation of an organics recycling pilot in St. Anthony. 27 28 Motion carried 5-0. 29 30 D. Resolution 18-037; a Resolution to Approve a Request to Temporarily Graze goats for 4-31 14 Days in an R-1 Zoning District at 3312 Silver Lake Road. 32 33 City Manager Casey stated the applicants have requested to temporarily graze goats on their 34 property to help with weed control. They have provided a written request and presentation 35 describing the specifics of grazing the goats. The goats will be fenced in on the property in order 36 to keep them in and predators out. They will graze for 4-14 days, at an undetermined date. The 37 grazing program will be managed by the company Goat Dispatch, which has a Certificate of 38 Insurance. Goat Dispatch is a company run out of Faribault, MN that specializes in land 39 management/brush removal with the use of goals. 40 41 Ms. Lona Doolan, representing Nativity Lutheran Church, 3312 Silver Lake Road, provided a 42 PowerPoint presentation including Landscaping Challenge, Innovative Solution, Responsible 43 Stewardship, and a Learning Experience. They are requesting approval of a temporary variance 44 to City Ordinance Chapter 91.56, the keeping of certain animals, which would allow the 45 6 City Council Regular Meeting Minutes April 24, 2018 Page 5 temporary keeping of goats on Nativity Lutheran Church’s property at 3312 Silver Lake Road 1 NE. The plan is to hire Goat Dispatch. 2 3 Councilmember Randle commented he is concerned about opening up this door and not being 4 able to bring it back in as there will always be someone that will challenge it. He is concerned 5 about setting a precedent. 6 7 Councilmember Stille stated he agrees but thinks this is worth a try, noting this approval is only 8 good for 2018. He asked how many goats would be present. Ms. Doolan stated she needs to send 9 photos of the space to determine the degree of the problem. Tree areas that will be enclosed, the 10 pens have electric fencing, and the Certificate of Insurance should be reviewed by the church’s 11 insurance company. 12 13 Mayor Faust noted Ms. Doolan is not an officer or business manager of the church. Mayor Faust 14 asked if Pastor Seefeldt is in agreement as well as the church’s Business Manager. Ms. Doolan 15 stated they are aware and in agreement. 16 17 Mayor Faust suggested the information on the Goat Rental be put on the church’s website as 18 information for the members because there needs to be a point of contact at the church rather 19 than the Police Department. Mayor Faust stated he understands the need and would consider this 20 a pilot program. 21 22 Councilmember Stille stated this would also get rid of noxious weeds, which is included in the 23 Code. 24 25 It was noted staff has reviewed the request and recommends approval. 26 27 Motion by Councilmember Gray, seconded by Councilmember Jenson, to approve Resolution 28 18-037; a Resolution to Approve a Request to Temporarily Graze Goats for 4-14 Days in an R-1 29 Zoning District at 3312 Silver Lake Road NE to be completed by December 31, 2018. 30 31 Motion carried 4-1 (Randle). 32 33 E. 1st Quarter Goals Update. 34 35 City Manager Casey presented the 1st Quarter Goals Update. Mr. Casey provided comments to 36 the Action Steps. The next update will be at the end of 2nd Quarter. 37 38 Mayor Faust commended the Public Works Department on their last two weeks of work. 39 40 VII. REPORTS FROM CITY MANAGER AND COUNCIL MEMBERS. 41 42 City Manager Casey had no report. 43 44 Councilmember Stille stated on April 11, he attended the Comp Plan Input Session as a member 45 of the Steering Committee. On April 12, he attended the Chamber Dinner. On April 18, he 46 7 City Council Regular Meeting Minutes April 24, 2018 Page 6 attended the Students in Government and he hopes the students will attend an upcoming Council 1 Meeting and give a presentation. On April 19, he attended Metro Cities Annual Meeting. 2 3 Councilmember Gray noted on April 18, he also attended the Students in Government Program 4 and last Saturday was the first Coffee with the Council hosted by Mayor Faust and himself. 5 6 Councilmember Randle stated on April 12, he attended the Chamber Annual Meeting. On 7 Wednesday April 18, he was the guest speaker at the Kiwannis Monthly Meeting. He also 8 attended the Students in Government Program. On April 20, he attended Culture Night at the 9 High School. 10 11 Councilmember Jensen stated on April 11, he also attended the Comp Plan Input Session. He 12 attended the Chamber Annual Meeting and the Students in Government Program. On April 23, 13 he attended the Metro Cities Annual Meeting. 14 15 Mayor Faust stated he looks forward to the Students in Government presentation. On April 18, 16 he attended the LMC Loss Control Workshop. He attended Coffee with the Council which will 17 be continued as it is a good informal environment. 18 19 VIII. COMMUNITY FORUM. 20 21 Ms. Pam Kaplan, 31st Avenue NE, asked where she can find the Commission Work Plan. Mr. 22 Casey stated it can be found on the City’s website. Councilmember Stille gave Ms. Kaplan his 23 copy of the Work Plan. Ms. Kaplan noted she cannot hear Council about half the time other than 24 Mayor Faust and Councilmember Stille. She asked where the speakers are in the Council 25 Chambers. Mayor Faust stated the audio/video system is being upgraded. 26 27 IX. INFORMATION AND ANNOUNCEMENTS. 28 29 Mayor Faust reminded residents to sign up for the Water Pledge online. Water usage can be 30 monitored on the website. 31 32 X. Revisions were necessary as Ramsey County’s GIS mapping did not fully encompass all the assessable parcels associated with one property (Parcel 8 of the assessment roll). Assessments to all other properties remain the same as previously approved. Included in the Council packet are the assessments that have been calculated in accordance with the City’s street assessment policy for the 2018 Street and Utility Improvement Project. ANTHONY VILLAGE HENNEPIN COUNTY, MINNESOTA RESOLUTION 18-040 RESOLUTION TO APPROVE A REQUEST TO KEEP TEN (10) FEMALE CHICKENS IN AN R-1 ZONING DISTRICT AT 2616 27TH AVE NE WHEREAS, staff received a request from Susan Cox and Jesse Pikturna for permission to keep chickens on their property located at 2616 27th Ave NE; and WHEREAS, the City of St. Anthony Code of Ordinances, Section 91.56, Keeping of Certain Animals, specifies that livestock, including fowl, require approval from the City Council; and WHEREAS, Susan Cox and Jesse Pikturna have submitted a written request for approval from the City Council, as outlined in Subsection 91.56, to approve their request to keep chickens; and WHEREAS, Susan Cox and Jesse Pikturna have submitted a diagram showing the dimensions and placement of the enclosure that will house the chickens in relation to their property; and WHEREAS, Hennepin County Environmental Health Division has stated that this matter is within the City’s jurisdiction and authority; and NOW THEREFORE BE IT RESOLVED that the City Council of the City of St. Anthony Village approves the request to keep ten (10) female chickens in an R-1 Zoning District at 2616 27th Ave NE.
