ANTHONY 1 CITY COUNCIL REGULAR MEETING MINUTES 2 JULY 24, 2018 3 4 CALL TO ORDER. 5 6 Mayor Faust called the meeting to order at 7:00 p.m. 7 8 PLEDGE OF ALLEGIANCE. 9 10 Mayor Faust invited the Council and audience to join him in the Pledge of Allegiance. 11 12 ROLL CALL. 13 14 Present: Mayor Faust, Councilmembers Gray, Jenson, Randle and Stille. 15 Absent: None 16 Also Present: City Manager Mark Casey, Liquor Operations Manager Mike Larson, Police Chief 17 Jon Mangseth and Sergeant Mike Huddle. 18 19 20 CONSIDERATION, DISCUSSION, AND POSSIBLE ACTION ON ALL OF THE FOLLOWING 21 ITEMS. 22 23 I. APPROVAL OF JULY 24, 2018 CITY COUNCIL MEETING AGENDA. 24 25 Motion by Councilmember Gray, seconded by Councilmember Jenson to approve the City 26 Council Meeting Agenda of July 24, 2018 as presented. 27 28 Motion carried 5-0. 29 30 II. PROCLAMATIONS AND RECOGNITIONS 31 32 A. Presentation of 2018 VillageFest 33 34 VillageFest Chairperson Ms. Julianne Hunter presented the events planned for the 2018 35 VillageFest, noting they are still looking for participants for some of the events. The website is 36 www.stanthonyvillagefest.com. Ms. Hunter thanked all the sponsors and volunteers to make this 37 a wonderful event. She mentioned the members of the committee who can be seen wearing 38 VillageFest shirts throughout the event. They are still looking for volunteers. 39 40 Mayor Faust asked what the colors of the shirts are this year and Ms. Hunter stated they are 41 purple. The parade shirts are neon yellow/green. Mayor Faust thanked the committee for all their 42 efforts. 43 44 B. Presentation of Night to Unite 45 46 Police Chief Mangseth thanked the Council for their support of Night to Unite. He provided a 47 brief update to the Council regarding some of the technology and systems upgrades in the Police 48 Dept. Body-worn cameras were ordered yesterday. A training program will be developed for the 49 7 City Council Regular Meeting Minutes July 24, 2018 Page 2 officers. The Body-worn Policy will be rolled out during the training. Police Chief Mangseth 1 stated the officers are looking forward to wearing the cameras and squad cars will be equipped 2 with tablet style Panasonic laptops that are currently be programmed. Squad car cameras have 3 arrived and one is currently in service. All technology and cameras will be installed when the 4 brackets arrive. Police Chief Mangseth explained that cameras are being purchased for the 5 holding, booking, and processing areas. All new Hennepin County radios were deployed last 6 week. Mayor Faust thanked Chief Mangseth for the update. 7 8 Sergeant Mike Huddle presented the plans for the August 7, 2018 Night to Unite event. Sergeant 9 Huddle stated St. Anthony has participated in Night to Unite for 10 years. Visits to as many 10 block parties as possible are done by Police, Fire, and the City Council. This effort is fully 11 supported by the City. He noted that the Hennepin County Sherriff’s Office has given the City a 12 limited number of Teraz Brand medication deactivation bags for Night to Unite. These bags are 13 used for residents to safely dispose of prescription medications. Sergeant Huddle explained that 14 block parties need to be registered by August 2 to receive a coupon from Cub Foods for a pail of 15 ice cream. As of today, there are 39 block parties registered. He noted that City Clerk Nicole 16 Miller has worked very hard on the events. 17 18 Councilmember Stille asked whether the Police Department gets to every single block party and 19 Sergeant Huddle stated yes, a representative goes to every registered block party. He mentioned 20 Council gets to as many block parties as they possibly can. Also, representatives from Finland 21 will accompany the Councilmembers. 22 23 Mayor Faust mentioned that City Clerk Nicole Miller made the planning very easy. 24 25 C. Proclamation for Night to Unite on August 7, 2018. 26 27 Councilmember Gray read the Proclamation for Night to Unite on August 7, 2018. 28 29 III. CONSENT AGENDA. 30 31 A. Approval of July 10, 2018, City Council Meeting Minutes. 32 B. Licenses and Permits. 33 C. Claims. 34 D. PUBLIC HEARINGS – NONE. 44 45 V. REPORTS FROM COMMISSION AND STAFF – NONE. 46 8 City Council Regular Meeting Minutes July 24, 2018 Page 3 1 2 VI. GENERAL BUSINESS OF COUNCIL. 3 4 A. Liquor Operations Mid-Year Report. 5 6 Mr. Mike Larson, Liquor Operations Manager, provided a PowerPoint presentation of the Liquor 7 Operations Mid-Year Report. He reviewed the locations, Mission Statement, Vision Statement, 8 the Value of Municipal Liquor Operation Revenue, Trends through June 2018, 2018 Sales 9 Projection, 2018 Net Income Projection, 2018 Sales Comparison, Sunday Sales 2018 10 Accomplishments, and Looking Ahead – 2018. Mr. Larson referred to the website where the 11 event calendar, monthly specials, product requests, store hours, contact information, notify me, 12 email, and text alerts can be found. 13 14 Managers Kevin Morelli and Bill Haugen were also present at the meeting. Mr. Larson thanked 15 City Clerk Nicole Miller for her assistance on the website. Mr. Larson explained the upcoming 16 loyalty program and stated the entire report will be available on the City website. 17 18 Mayor Faust thanked Mr. Larson for his report. 19 20 Councilmember Stille stated it has been a rough couple of years with many changes. 21 22 VII. REPORTS FROM CITY MANAGER AND COUNCIL MEMBERS. 23 24 City Manager Casey stated in the past with street projects, there has been street project education 25 events that gives residents the opportunity to learn how projects are done. This year’s event will 26 be held on August 15, 2018 at 5 p.m. on the corner of Foss Road and Chandler. 27 28 An Open House for the 27th Avenue and Pahl Traffic Study was held on Monday, July 16, and 29 the PowerPoint presentation from that Open House is available on the City’s website. As a result, 30 WSB will continue to do the analysis and present their findings at an upcoming information 31 meeting – date TBD. The final report and recommendations will be presented to Council. 32 33 Mr. Casey mentioned two police officers were dispatched to a possible suicide in progress when 34 the caller saw a posting on Facebook and called 911. The officers had to do a forced entry, 35 knocked down the door, removed the hanging victim, and performed the necessary first aid. He 36 noted this is another example of outstanding work by the Police Department. 37 38 Councilmember Randle stated he and Councilmember Stille attending Coffee with the Council 39 on July 14 at Autumn Woods. One item brought forward was the fact the City does not test an 40 individual’s water. The City tests water as a City, but not on an individual level. City Manager 41 Casey stated he will follow-up on that matter. 42 43 Mayor Faust stated every two years, water is checked within selected homes for lead. Concerned 44 residents could contact the Public Works Department. Councilmember Randle stated it was more 45 of a curiosity than a concern. 46 9 City Council Regular Meeting Minutes July 24, 2018 Page 4 1 Councilmember Jenson had no report. 2 3 Councilmember Stille stated on July 11, he attended Coffee with the Chamber event. He also 4 attended Coffee with the Council on July 14 where about a dozen people were in attendance. 5 Water conservation was a concern to some residents who wanted to know what they could do in 6 Autumn Woods. Mr. Casey noted a program was done at Kenzington and the Public Works 7 Department can share some ideas with residents. Councilmember Stille stated a concern about 8 the sidewalk in front of Autumn Woods was expressed as it was too slanted towards the road. 9 10 Councilmember Gray had no report. 11 12 Mayor Faust noted on July 18, he attended a Metro Cities meeting on policy adoption. 13 14 VIII. In addition, listed in the JPA, Ramsey County will construct an organics drop off site located at the City Hall parking lot near the police department for all St. Anthony residents. The City of St. Anthony will continue to forgo our SCORE funding from Ramsey County in exchange for the use of yard waste sites and organics drop off site for all St. Anthony residents. This agreement supports both the City of St. Anthony and Ramsey County’s goal of providing yard waste and organics recycling to all St. Anthony residents. Upon approval from St. Anthony City Council, the JPA will then go to the Ramsey County Board for approval on August 21, 2018. The current JPA expires December 31, 2018 and was for a one year period. The JPA presented tonight is a five year JPA that expires December 31, 2024. 17 THIS PAGE LEFT INTENTIONALLY BLANK 18 JOINT POWERS AGREEMENT BETWEEN  RAMSEY COUNTY AND CITY OF SAINT ANTHONY  FOR USE OF YARD WASTE MANAGEMENT AND ORGANIC WASTE RECYCLING SITES   USING THE CITY’S ALLOCATION OF SCORE FUNDS    This Agreement is entered into pursuant to Minnesota Statutes Section 471.59 between  Ramsey County (the "County”), a political subdivision of the State of Minnesota, and the  City of Saint Anthony (the "City"), a political subdivision of the State of Minnesota.    WHEREAS, Ramsey County operates a yard waste management system, which  includes seven sites for the collection of yard and organic waste from Ramsey County  residents; and    WHEREAS, Organics policy in the Ramsey County Solid Waste Management  Master Plan states that the yard‐waste and organic waste recycling sites are “only for  residents of Ramsey County”; and     WHEREAS, A portion of the City of Saint Anthony is within Hennepin County, and  City residents within that area have been allowed to use the County's yard waste sites  since 2005, pursuant to a joint powers agreement between the City and Ramsey County;  and    WHEREAS, The Solid Waste Management Master Plan establishes a goal of placing  an organics recycling site in each municipality or within a 15‐minute drive from each  household in Ramsey County; and    WHEREAS, The City of Saint Anthony would like to provide additional organic  waste recycling opportunities to all of its residents, in the form of a collection site located  within the city, whether the site users reside in Ramsey County or Hennepin County; and    WHEREAS, The City of Saint Anthony and Ramsey County have determined that  the amount of SCORE funds currently allocated to the City on an annual basis  approximate the cost of Ramsey County providing the City of Saint Anthony residents that  reside in Hennepin County with yard waste and organics recycling services;      WHEREAS, Ramsey County is willing to make yard waste services and organic  waste recycling available to the City of Saint Anthony for a reasonable cost, and provide  an exception to the policy identified above to address the practical difficulties of  providing yard waste services and organic waste recycling for residents of the City  because this City has significant population in the two counties; and      WHEREAS, the City is willing to forego receipt of its allocated SCORE funds for any  purpose other than making the Ramsey County yard waste and organic waste recycling  sites available to all of its residents; Now, therefore, it is agreed:    19 1. COUNTY OBLIGATIONS  a. The County shall allow all residents of the City, regardless of county of residence,  to use County yard waste and organic waste recycling sites at the same level of  service that the sites are available to County residents.  b. The County will provide the City with information about site services, hours and  dates of operation, and site rules, for use by the City in promoting the sites.  c. The County will apply SCORE funds previously available to the City for other  eligible uses directly to the yard waste program for the use of the sites by  residents as described in 1.a.  d. The County will work with the City to cooperatively promote waste management  programs.      2. CITY OBLIGATIONS  a. The City will forgo its annual allocation of Ramsey County SCORE funds in order to  assure yard waste and organic waste recycling services for those City residents  that do not reside in the County.  b. Pursuant to the Ramsey County Solid Waste Management Master Plan, the City  has a number of obligations related to SCORE related activities, that it shall  perform, as outlined below:  i. Collection  1. The Municipality shall ensure residential recycling service is available  weekly or every other week to residents at their place of residence,  including all multi‐unit dwellings and manufactured home parks.  2. The Municipality shall provide recycling for at least the following materials  at curbside and multi‐unit dwelling properties:  a.  Paper;  b.  Cardboard;  c.  Glass bottles;  d.  Metal cans;  e.  Plastic beverages and food containers; and  f.   Organics when present.  3.      The Municipality shall ensure the collection of textiles for recycling is           available to all residents.  4. The Municipality shall add additional recyclable materials as reliable  markets become available.  5. The Municipality shall maintain a long‐term funding mechanism for its  residential recycling programs.     20   ii. Recycling Performance Work Plan  The Municipality shall implement the strategies on the Recycling Performance  Work Plan, specific to the Municipality, attached as Exhibit 1, to measure its  progress towards achieving recycling goals. Work plans may be updated if  agreed to by both parties in writing.    iii.   Program and Performance Reports  1. The Municipality shall submit a report to the County through ReTRAC, the  County’s recycling and solid waste data management tool, by February  15. The report is to include information on recycling at all residential  units, including multi‐unit dwellings and manufactured home parks, even  if the Municipality does not provide collection services to those units. The  Municipality is responsible for providing complete and accurate  information for all applicable screens in the ReTRAC database.  2. The Municipality shall submit a midyear status report through the ReTRAC  database.       iv.   Evaluation  The City will work with the County to evaluate use of the yard waste and  organic waste recycling sites by City residents and determine whether to  renew this agreement and, if to be renewed, the appropriate terms and  conditions for that renewal.               3.  TERM  The term of this agreement shall be from January 1, 2019, through December 31,  2024, the date of signatures notwithstanding.     4.   TERMINATION  a. FOR CAUSE: In the event that the City fails to comply with the terms of this  Agreement, or any statutory requirement, ordinances and/or plans related to this  Agreement, the County may terminate this Agreement. In the event that the  County exercises its right to terminate the Agreement for cause, the County shall  submit a written notice to the City specifying reasons for termination and the date  upon which the termination becomes effective.    b. WITHOUT CAUSE: This Agreement may be terminated by either party without  cause, on one hundred‐eighty (180) days written notice to the other party.    c. OTHER EVENTS:  In the event that the County’s authority to provide services  contemplated in this agreement is affected by amendments to Minnesota Statutes  or by other means, this Agreement shall be immediately terminated.     21   5. GENERAL CONDITIONS    a. Hold Harmless The City and County agree to defend, and hold the other party  harmless from any costs, claims, demands, actions or causes of action, including  reasonable attorney’s fees, arising out of any act or omission on the part of the  party or any of its agents or employees in the performance of or relation to any of  the work or services provided by the party under the terms of this agreement.  Nothing in this agreement shall constitute a waiver by either party of any  limitations or exceptions of liability under Minnesota Statutes Chapter 466.    b. Data Practices All data collected, created, received, maintained, or disseminated  for any purpose in the course of this Agreement is governed by the Minnesota  Government Data Practices Act, Minn. Stat. Ch. 13, or any other applicable State  statute, any State rules adopted to implement the Act and statutes, as well as  federal statutes and regulations on data privacy. The Municipality agrees to abide  by these statutes, rules, and regulations.    c. Access to Documents All books, records, documents, and accounting procedures  and practices of the Municipality and its (sub)contractor(s), if any, relative to this  Agreement are subject to examination by the County and the State Auditor, as  appropriate, in accordance with the provisions of Minnesota Statutes §16C.05,  Subd. 5.     d.
