ANTHONY 1 CITY COUNCIL REGULAR MEETING MINUTES 2 SEPTEMBER 25, 2018 3 4 CALL TO ORDER. 5 6 Mayor Faust called the meeting to order at 7:00 p.m. 7 8 PLEDGE OF ALLEGIANCE. 9 10 Mayor Faust invited the Council and audience to join him in the Pledge of Allegiance. 11 12 ROLL CALL. 13 14 Present: Mayor Faust, Councilmembers Gray, Jenson, Randle and Stille. 15 Absent: None 16 Also Present: Assistant to the City Manager Charlie Yunker, Ramsey County Commissioner Mary 17 Jo McGuire, Assistant Fire Chief/Fire Marshal Chris Fuller, and Fire Chief Mark 18 Sitarz 19 20 21 CONSIDERATION, DISCUSSION, AND POSSIBLE ACTION ON ALL OF THE FOLLOWING 22 ITEMS. 23 24 I. APPROVAL OF SEPTEMBER 25, 2018 CITY COUNCIL MEETING AGENDA. 25 26 Motion by Councilmember Gray, seconded by Councilmember Jenson, to approve the City 27 Council Meeting Agenda of September 25, 2018 as presented. 28 29 Motion carried 5-0. 30 31 II. PROCLAMATIONS AND RECOGNITIONS. 32 33 A.Presentation from Ramsey County Commissioner.34 35 Ramsey County Commissioner Mary Jo McGuire provided an update on what is going on with 36 the County. Commissioner McGuire stated she will also provide an update on issues obtained 37 from City Manager Casey. The Vision, Mission and Goals of Ramsey County were presented 38 along with the restructuring into four service areas. The Community Indicators were presented. 39 There will be a public hearing on the final proposed budget on Monday, November 26 at 6:30 40 p.m. in the Red Cap Room at Union Depot with final budget approval on December 11, 2018. A41 graph indicating the 2019 Supplemental Budget was provided with detailed summary.42 Information and public records can be obtained on the Open Data Portal –43 https://openperformance.ramseycounty.us. Commissioner McGuire described the Pritzker44 Children’s Impact Network and community health assessment and community engagement and45 projects relating to community engagement input received.46 47 Commissioner McGuire reviewed the St. Anthony specific updates including Silver Lake Road 48 Flood Issues in 2019, Traffic Studies: 4-lane to 3-lane analysis for 37th Avenue and signal timing 49 1 City Council Regular Meeting Minutes September 25, 2018 Page 2 on Silver Lake Road, MnPass lane construction and impacts on Silver Lake Road and County 1 Road C improvements. Ramsey County will be awaiting completion of MnPass before making 2 any improvements to county or city roads in St. Anthony. District 2 Contact 4 Information was provided 651-266-8359 district2@co.ramsey.mn.us. 5 6 Councilmember Stille thanked Commissioner McGuire for her update. He referred to the 7 Community Engagement information and encouraged the students to contact her office. 8 Councilmember Stille suggested Commissioner McGuire contact Wendy Webster regarding the 9 Pritzker Children’s Impact Network. Councilmember Stille thanked her for the work on County 10 Road C. 11 12 Councilmember Jenson referred to the contact information and asked if residents were wanting 13 volunteer opportunities would that be how residents should contact Ramsey County. 14 15 Mayor Faust suggested the work on County Road C be consolidated with Hennepin County and 16 Commissioner Higgins. A two-year plan was done last week by Council and staff on road 17 construction. Mayor Faust thanked Commissioner McGuire for her comments. 18 19 III. CONSENT AGENDA. 20 21 A. REPORTS FROM COMMISSION AND STAFF – NONE. 33 34 VI. GENERAL BUSINESS OF COUNCIL. 35 36 A. Fire Prevention Presentation. 37 38 Assistant Fire Chief/Fire Marshal Chris Fuller provided a power point presentation on St. 39 Anthony Fire Department Fire Prevention. He provided Updates, Fire Fatalities in Minnesota, 40 Alarming Statistics 2017 Fatal Fires, Smoke Alarms Save Lives, Carbon Monoxide Alarms – 41 “CO”, and provided contact information for those interested in either a Home Safety Survey, File 42 of Life, Fire Safety Presentation or any Questions. The St. Anthony Fire Station can be 43 contacted at 612-782-3400 or email firemarshal@savmn.com. Useful Information and Fact 44 Sheets are available from the MN State Fire Marshal https://dps.mn.gov/divisions/sfm. 45 46 2 City Council Regular Meeting Minutes September 25, 2018 Page 3 There will be an Open House held Saturday, October 6, 2018 from 1-4pm. This is a free event. 1 2 Councilmember Randle asked about sending out push out notifications as a reminder for 3 residents to check their smoke detectors and co detectors. Assistant Fire Chief Fuller thanked 4 Councilmember Randle for the suggestion and mentioned it is included in the City Newsletter. 5 6 A question from the audience was asked about the date on smoke detectors. (Unidentified). The 7 date is when the unit was manufactured. 8 9 B. Resolution 18-063; a Resolution Adoption of the Hennepin County All Hazard 10 Mitigation Plan. 11 12 Fire Chief Mark Sitarz reviewed in 2010, the incorporated cities and Hennepin County formed 13 an agreement which established the unification in the development of writing the plan. The 14 Hennepin County Board of Commissioners and City Councils from each participating 15 municipality were required to adopt the plan prior to its submittal to HSEM and FEMA for final 16 approval. Fire Chief Sitarz explained the Plan in detail. 17 18 The Plan is intended to serve many purposes including: Enhance Public Awareness and 19 Understanding, Create a Decision Tool for Management, Promote compliance with State and 20 Federal Program Requirements, Enhance Local Policies for Hazard Mitigation Capability, 21 Provide Inter-Jurisdictional Coordination of Mitigation-Related Programming and Achieve 22 Regulatory Compliance. 23 24 A copy of the Plan is available by contacting Fire Chief Sitarz. Council is requested to vote in 25 favor of adoption of the plan. 26 27 Motion by Councilmember Gray, seconded by Councilmember Jenson, to approve Resolution 28 18-063; a Resolution Adopting the Hennepin County All-Hazard Mitigation Plan. 29 30 Motion carried 5-0. 31 32 C. Resolution 18-064; a Resolution Supporting St. Anthony Village High School’s Voter 33 Registration Day, September 25, 2018. 34 35 Councilmember Stille read the resolution in full. 36 37 Motion by Councilmember Stille, seconded by Councilmember Jenson, to approve Resolution 38 18-064; a Resolution Supporting St. Anthony Village High School’s Voter Registration Day 39 September 25, 2018. 40 Motion carried 5-0. 41 42 Mayor Faust noted this came before Council two weeks ago and Council was able to respond. 43 This is a good example of cooperation. Mayor Faust thanked City Clerk Nicole Miller, School 44 Community Engagement Coordinator Bonnie Brever and School Communications Director 45 3 City Council Regular Meeting Minutes September 25, 2018 Page 4 Wendy Webster getting the information and coordinating the event. Mayor Faust congratulated 1 the CHANGE students who were at the high school encouraging students to vote. 2 3 Councilmember Stille thanked the students that came up with the ideas. 4 5 VII. REPORTS FROM CITY MANAGER AND COUNCIL MEMBERS. 6 7 Councilmember Jenson stated he attended the Fire Relief Association Meeting last evening. 8 9 Councilmember Stille stated today he attended a NAOIP Meeting and the topic was Pace Funds. 10 11 Councilmember Gray reported he received an email from Dana Healey, Director of CTV. The 12 FCC has a meeting tomorrow and one of the subjects is to promote faster development of 5G 13 Wireless. 14 15 VIII. COMMUNITY FORUM. 16 17 A former resident of Lowry Grove stated she is looking for justice because Council knew Lowry 18 Grove was going to be sold and the Council lied to them. She felt they were discriminated 19 against because they were poor and she wants justice for their community. She thinks the 20 Council does not care about the lives of seniors and children because they were ‘thrown to the 21 curb’ by Council. 22 23 A former resident of 2501 Lowry Grove, stated she is here fighting for justice for the residents of 24 Lowry Grove. She has to get up early so her son can catch the bus at 5:30 a.m. because Council 25 closed Lowry Grove. They are fearful in their new neighborhood and they felt safe in Lowry 26 Grove. She believed it was not right what Council did to them because they are Latinos. Her son 27 still attends school in St. Anthony. She asks for justice for everyone. 28 29 Ms. Antonia Alvarez, lived at 2501 Lowry Grove, stated she brought her own interpreter because 30 they have never been offered an interpreter from the City. From the very beginning, they have 31 faced discrimination from the Council. She said it is the Mayor’s fault that some of the students 32 attending St. Anthony schools do not live in St. Anthony because the Council threw them out. 33 She demanded the check of justice that the community of low-income people were denied. The 34 resident association demands affordable housing for their low-income community. They would 35 like to receive damages for the residents of Lowry Grove because many are still paying the price 36 for the injustice Council has done to them. Every day she receives calls from people who are still 37 living in the streets. They want the right to return to the City with dignity as a community of 38 color and low-income. She stated the longer the residents of Lowry Grove need to wait for 39 justice the longer the Council’s cross to bear will become. There was a man that killed himself in 40 Lowry Grove (Frank Delmar). She demands justice on behalf of him and the whole community 41 in Lowry Grove. She hopes Council has seen the newspapers because others are demanding with 42 them. She stated they want justice, affordable housing, and damages to be paid to the resident 43 association. She wants Council not to just listen to her but to act. 44 45 IX. Attached are resolutions, county specific, with the outstanding water/sewer and waste hauler accounts for 2018 certification. With City Council approval, they will be certified to the appropriate county’s tax rolls for the year payable of 2019. For Public Utility services, an account is delinquent upon amounts over $50 and at least two quarters past due. For Waste Hauler services, an account is delinquent upon amounts over $50 and at least 90 days past due. A letter was mailed to delinquent account holders and the property owners if different. Attached is a sample letter for both utilities and waste hauling. If the entire delinquent balance is not paid by November 28, 2018, the delinquent amount would be certified the property owner’s property taxes plus eight (8) percent annum. ANTHONY VILLAGE STATE OF MINNESOTA RESOLUTION 18-069 A RESOLUTION CERTIFYING SPECIAL ASSESSMENTS FOR DELINQUENT WASTE HAULER ACCOUNTS TO THE 2019 RAMSEY COUNTY TAX ROLLS WHEREAS, waste hauler records for the City of St. Anthony identify certain delinquent charges and waste hauler accounts as of October 04, 2018; and WHEREAS, the owners of record of the properties served by each delinquent account have been notified of the delinquency according to the legal requirements of the ordinance 33.107; and WHEREAS, the delinquent charges may be assessed under Minnesota Statutes §429.101 and 444.075 that authorize certification of such delinquent charges to the County tax rolls for collection; and WHEREAS, pursuant to proper notice duly given to the owners of record as required by law, the City has met the requirements for the assessment of these delinquent waste hauler charges. NOW, THEREFORE, BE IT RESOLVED that: 1) The special assessment of delinquent waste hauler accounts is hereby adopted and certified as Levy No: 81201802 for the attached properties and amounts: 2) The special assessments as adopted shall be payable with collectible ad valorem taxes in 2019, with interest thereon at eight (8) percent per annum, and shall bear interest from the entire period of November 30, 2018 through December 31, 2019. 3) The City Clerk shall transmit a certified copy of this assessment to the County Auditor to be extended to the proper tax lists to the county, and such assessments shall be collected and paid over the same manner as other municipal taxes.
