REPORTS FROM COMMISSION AND STAFF. 46 47 48 1 City Council Regular Meeting Minutes February 12, 2019 Page 2 A. Resolution 19-011; a Resolution denying lot split with variance request for lot size on a 1 corner lot by Walter Sentyrz at 3713 33rd Avenue NE. 2 3 Planning Commission Chair Papatola reviewed the applicant proposes a lot split to allow for two 4 lots on a 19,110 square foot lot on 33rd Avenue NE. The lot split would require a variance to lot 5 size. Lot 1 is proposed to have 9,009 sf and no variance would be needed for that lot. Lot 2 is 6 proposed to have 10,101 sf. and a variance would be needed (899 sf.). The location of the lot was 7 indicated on a map. 8 9 Planning Commission Chair Papatola summarized the applicable codes pertaining to this request, 10 noting City Code, Section 152.039 R-1 Single-Family District Dimensional Regulations, requires 11 a minimum lot size of 9,000 sf. for interior lots and 11,000 sf. for corner lots. City Code, Section 12 152.245 Variance, indicates a variance to the dimensional standards may be granted based on a 13 review of the criteria. 14 15 Planning Commission Chair Papatola explained it was determined the criteria was not met in the 16 criteria for variance approval. On December 17, the Planning Commission held a public hearing 17 and voted unanimously to recommend denial of the lot split and variance, based on review of the 18 criteria. Staff has provided a resolution with findings of fact for Council consideration. 19 20 Mr. Walter Sentyrz stated he has lived in St. Anthony since 1985 in one home next to the 21 property. He is asking for a variance to bring two new families to St. Anthony and redevelop a 22 property that has deteriorated over the years. He is asking for only an 899 sf. variance and has a 23 reliable builder for the project. He provided a chart of other lots size compared to his proposal. 24 He does not know when the requirement in the Code came into effect and is hoping Council will 25 approve his request. 26 27 Councilmember Gray asked Mr. Casey if there are any other situations in St. Anthony with 28 similar requests. Mr. Casey stated he is not aware of any other variances that were granted. There 29 are legal non-conforming lots within the City, but he is not aware that any variances were 30 granted for those. 31 32 Councilmember Jenson asked Mr. Casey if any other variances were granted. Mr. Casey stated 33 the Zoning Code was amended in 1990 and those properties not in conformance when Code was 34 adopted would be legal non-conforming uses. 35 36 Mayor Pro-Tem Stille stated he does not recall a variance for a corner lot in his years on the 37 Planning Commission and the City Council. He stated old housing like on this property does not 38 fit in the community and it is an odd-sized lot. He stated it does not meet the criteria for granting 39 a variance and the Council does not want to do this from an economic perspective. In his 40 opinion, this lot is not conducive to have two single-family homes constructed. 41 42 Councilmember Randle asked if one structure is out of the question. Mr. Sentyrz stated he would 43 prefer to build two houses but if the variance is not approved, he will construct a larger home on 44 the property. He would like to have two 2,000 sf. homes with double or triple garages. 45 46 2 City Council Regular Meeting Minutes February 12, 2019 Page 3 Motion by Councilmember Jenson, seconded by Councilmember Gray, to approve Resolution 1 19-011; a Resolution denying a lot split with variance request for lot size on a corner lot by 2 Walter Sentyrz at 3713 33rd Avenue NE. 3 4 Motion carried 4-0. 5 6 VI. GENERAL BUSINESS OF COUNCIL. 7 8 A. Planning Commission’s recommendation regarding proposed deck ordinance. 9 10 City Manager Casey stated based on an administrative appeal to staff’s interpretation of the 11 regulations applicable to decks, the Planning Commission directed staff to prepare an ordinance 12 relating to and regulating the setbacks for decks. The timeline that depicts the consideration of 13 this matter was reviewed by Mr. Casey. Staff recommends the City Council deny the ordinance 14 to make changes to the provisions for decks in the City Code. 15 16 Councilmember Jenson asked if decks are considered against the 30% rule. Councilmember 17 Jenson also asked about item G and if that means if the criteria was met could the deck take up 18 an entire backyard. 19 20 Mayor Pro-Tem Stille stated one applicant was trying to be accommodated and due process was 21 followed. Two planners reviewed this and the recommendation not to move forward was evident. 22 23 Motion by Councilmember Gray, seconded by Councilmember Jenson, to deny Ordinance 2018-24 01; an Ordinance to make changes to the provisions for decks in the City Code. 25 26 Motion carried 4-0. 27 28 B. Silver Lake Management Plan Update. 29 30 Mr. Tony Havranek, WSB Sr. Environmental Scientist, presented a review of the Silver Lake 31 Management Plan covering existing water quality, fisheries, and vegetation data; herbicide 32 applications; TMDL implementation activities; stakeholders’ issues and goals; and, the status of 33 the plan document. It was noted the project partners were: City of St. Anthony Village, City of 34 Columbia Heights, City of New Brighton, Rice Creek Watershed District, Three Rivers Park 35 District, Silver Lake Homeowners Association, Ramsey County Public Works, MN DNR and 36 WSB. 37 38 Councilmember Gray stated it appears that removal of the carp caused the weeds to grow out of 39 control. Mr. Havranek stated that was one component in addition to many improvements made to 40 water quality. The Secchi data was taken over many months and the key is to balance the 41 components. 42 43 Councilmember Jenson referred to the flood mitigation project next year which will divert water 44 from going into Silver Lake. Mayor Pro-Tem 1 Stille thanked Mr. Hayranck for his presentation. 2 3 VII. REPORTS FROM CITY MANAGER AND COUNCIL MEMBERS. 4 5 City Manager Casey reported Mr. Steve Gritman is the new planner and the City has switched 6 from WSB to Northwest Associated Consultants. Mr. Casey commended staff on the outstanding 7 job done to keep things going during the extreme weather. 8 9 Mr. Casey introduced Ms. Minette Saulog, GreenCorp Member, who showed a video she 10 recently completed giving the quarterly update on Sustainability. Ms. Saulog provided the plan 11 for future videos. 12 13 Mayor Pro-Tem Stille stated Council had a work session with the School District followed by a 14 work session at City Hall where the Minneapolis Park Board made a presentation. 15 16 VIII.
