ANTHONY RESOLUTION 98-057 A RESOLUTION APPROVING PARKS COMMISSION MEMBERS AND MEMBERS' TERMS WHEREAS, the City Council of the city of St. Anthony has established a Parks Commission, through adoption of Ordinance 1998-009; and WHEREAS, persons interested in being members on the Parks Commission submitted letters of interest and were subsequently interviewed by the City Council. ANTHONY ORDINANCE 1998-009 AN ORDINANCE ESTABLISHING A PARKS COMMISSION BY ADDING SECTION 306 TO THE 1993 CODE OF ST. ANTHONY ORDINANCES The City Council of the City of St. Anthony hereby ordains: Section 1. Section 306 -Parks Commission will read as follows: SECTION 306 - PARKS COMMISSION 306.01 Purpose. The City of St. Anthony does now operate and maintain public parks for the benefit and pleasure of its residents. A City Parks Commission is hereby established to advise the City Council regarding the promotion of the systematic, comprehensive and effective development of park facilities necessary for the overall health, ability and well being of City residents of all ages. 306.02 Membership. The Parks Commission will consist of ten members, seven voting and three non-voting, all of whom will be residents of the City of St. Anthony. Seven of the ten will be appointed by affirmative vote of a majority of the members of the St. Anthony City Council. There will be three non-voting liaison members, each appointed by their respective organizations. The three liaisons will be appointed by the School Board of District #282; St. Anthony Community Services; and, the Sports Boosters of St. Anthony Village. 306.03 Terms of Office. Members appointed by the City Council will serve three year terms. The first Parks Commissioners will be appointed as follows: 2 members ................................ i year terms 3 members................................2 year terms 2 members................................3 year terms Thereafter, members shall be appointed to three year terms when the original term of office expires, except where a vacancy occurs in the middle of a term. In which case, the appointment will be for the duration of the unexpired term. The three liaison members will serve at the pleasure of their respective organizations and can be replaced at any time. Members of the Parks Commission shall be residents of the City of St. Anthony throughout their term of office. 306.04 Vacancies. Any of the following will cause the office of a Parks Commission member to become vacated: (a) Death. (b) Disability or failure to serve. (c) Removal of legal resident from the City. (d) Resignation in writing. (e) Failure to uphold the oath of office. (f) Failure to attend 4 or more scheduled meetings of the Parks Commission in a calendar year, unless waived by the City Council after a written request from the Parks Commission Member. The City will publish an open invitation to all residents interested in serving on the Parks Commission to inform the city Manager in writing of their interest and desire to be interviewed for a seat on the Parks commission. 306.05 Compensation. The Parks Commission members will serve without compensation. 306.06 Powers and Duties. The powers and duties of the Parks Commission shall be as follows: (a) To prepare, revise, and maintain a comprehensive, long-term plan for the redevelopment of parks within the city. This plan shall be viewed as a working document that serves as a framework and reference to future redevelopment. (b) To make recommendations to and advise the City council and Staff regarding park issues and ideas. (c) To establish priorities and recommend a phasing plan and schedule for implementing innovative park improvements, renovations and plans. (d) To work with other Communities to explore cooperative arrangements to develop connecting routes in the form of bikeways, walking paths and corridors of green space wherever possible. (e) To investigate funding sources, including requests for increases in the City budget, designated for parks and green spaces. (f) To seek new areas for additional parks, natural areas, walking paths, bikeways and green space corridors. (g) To generate community involvement in the development of parks and their elements. (h) To review and recommend revisions to the operation and maintenance of City Parks. (i) To periodically review, re-evaluate and update the comprehensive park plan to reflect current and future park needs of the City. 306.07 Council Action without Recommendation of the Parks Commission. If a matter is referred to the Parks Commission and if no recommendation is transmitted by the parks Commission to the council after referral to the Parks Commission, the Council make take action without such recommendation. 306.08 Requests. All requests shall be submitted to the Planning Commission for review before the request is submitted to the City Council. 306.09 Staff Liaison. The Public Works Director or designee will be the Staff Liaison to the Parks Commission. Section 2. This ordinance shall become effective on the date of publication. ANTHONY VILLAGE PARKS COMMISSION BY-LAWS A schedule of meeting dates shall be established and changed or altered at any regularly scheduled meeting. One regular meeting date is scheduled for the second Monday of each month at 7:00 p.m. in the Council Chambers. 2. Additional meetings may be held at any time upon the call of the Chair or by a majority of the voting members of the Parks Commission or upon request of the City Council following at least twenty-four hours notice to each member of the commission and adhering to the requirements of the Open Meeting Law. The Commission at its first regular meeting in January of each year shall elect a Chair and Vice -Chair. 4. The duties and powers of the members of the Parks Commission shall be as follows: Chair: Preside at all meetings of the Parks Commission. ii. Call, amend, or cancel meetings of the Parks Commission in accordance with the by-laws. iii. Review agenda before scheduled meeting with Staff. Vice -Chair: i. During the absence, disability, or disqualification of the Chair, the Vice - Chair shall exercise or perform all the duties and be subject to all the responsibilities of the Chair. Secretary: i. Record the proceedings of all meetings. Matters referred to the Parks Commission by the City Council shall be placed on the calendar for consideration and action at the first meeting of the Parks Commission after such referral. Four members of the Parks Commission shall constitute a quorum for the transaction of business. Reconsideration of any decision of the Parks Commission may be had when the interested party for such reconsideration makes a showing - satisfactory to the Chair and/or Public Works Director - that without fault on the part of such party, essential facts were not brought to the attention of the Parks Commission. 8. Roberts Rules of Order are hereby adopted for the government of the Parks Commission in all cases not otherwise provided for in these in these by-laws. The by- laws can be amended at any meeting by a vote of the majority of the entire membership of the Park Commission, and City Council approval, provided 5 days' notice has been given to each member of the Parks Commission. Deadline for filing for placement on the agenda for any related Parks issue shall be exactly one week prior to the meeting the applicant desires to be heard. 10. Any member of the Parks Commission who shall feel that he/she has a conflict of interest on any matter that is before the Parks Commission shall voluntarily excuse himself/herself, vacate his/her seat, and refrain from discussing and voting on item(s) in question. 11. Any Park Commissioner who has advanced knowledge that she/he will not be able to attend a scheduled meeting of the Parks Commission shall notify the Public Works Director at the earliest possible opportunity and, in any event, prior to 3:30 p.m. on the date of the meeting. The Public Works Director shall notify the Chair of the Parks Commission in the event that the projected absences will produce a lack of quorum. 12. The Vice -Chair shall succeed the Chair if he/she vacates his/her office before his/her term is completed; the Vice -Chair to serve the unexpired term of the vacated office. - A new Vice -Chair shall be elected at the next regular meeting. 13. The by-laws may be amended at any meeting of the Parks Commission by a quorum of the Parks Commission, provided that notice of said proposed amendment be given to each member in writing at least two weeks prior to said meeting.
