7 Mayor Faust called the meeting to order at 7:00 p.m.

9 PLEDGE OF ALLEGIANCE.

11 Mayor Faust invited the Council and audience to join him in the Pledge of Allegiance.

26 Motion by Councilmember Gray, seconded by Councilmember Jenson, to approve the City
27 Council Meeting Agenda of September 24, 2019.

1 A. Resolution 19-067; a Resolution Approving Wine/Beer License for Hickory Hog Grill &
2 Smokehouse located at 3900 Silver Lake Road.

4 City Manager Casey stated the Council is asked to consider approval of a combination
5 Wine/Strong Beer License for Hickory Hog located at 3900 Silver Lake Road. This is a new
6 business opening where Smashburger use to be located. He stated staff has completed
7 background checks and recommends approval.

9 Mr. Lars Karlson, owner of Hickory Hog, explained in 2015 he started a food truck in the area
10 with great success and has recently had the opportunity to open a restaurant.
11
12 Motion by Councilmember Jenson, seconded by Councilmember Gray, to approve Resolution
13 19-067; a Resolution Approving Wine/Beer License for Hickory Hog Grill & Smokehouse
14 located at 3900 Silver Lake Road.

16 Motion carried 5-0.

18 B. Fire Prevention Presentation.

20 Fire Chief Sitarz introduced Lieutenant Mattie Jaros to the Council who used a PowerPoint to
21 provide a presentation related to fire prevention.
22
23 Mayor Faust indicated he was glad the Fire Department was concerned about children's anxiety
24 when doing fire drills. He noted apartments are required by code to have fire alarms, so the Fire
25 Department is putting efforts into homes without fire alarms.

27 Councilmember Jenson asked regarding the file for life, what has the response been in the past
28 because this has been provided for several years, or at least something similar. Lieutenant Jaros
29 explained the residents love it.

31 Councilmember Stille put a plug in for the open house and Village big rigs. This is a community
32 event he wanted to promote for new families in the community. He thanked the Fire Department
33 for doing that.

35 Mayor Faust thanked the Fire Department and their involvement in the community.

39 C. Resolution 19-068; a Resolution Authorizing Mayor and City Manager to Approve
40 Toward Zero Deaths Grant.

42 City Manager Casey stated this is a request to authorize the approval of the Toward Zero Deaths
43 Grant. He noted this grant was originally administered by Ramsey County but is now being
44 administered by the City of St. Paul. He introduced Police Lieutenant Diegnau.

46 Police Lieutenant Diegnau explained the Towards Zero Deaths Grant program.

2 Councilmember Randle asked how long St. Anthony has been involved in this program. Police
3 Lieutenant Diegnau indicated it has been close to eleven years and before that, St. Anthony
4 Police was involved in the Safe and Sober Campaign.

6 Councilmember Stille stated the entire cost of the program is $688,000 and wondered what
7 reimbursement St. Anthony will receive. Police Lieutenant Diegnau explained St. Anthony's
8 share will be $37,400 and is distributed among the eleven agencies due to size. He noted the
9 $688,000 is not St. Anthony's cost, that is the overall grant amount.

11 Councilmember Stille thought this was really focused on safety, education, enforcement and
12 training. Police Lieutenant Diegnau indicated that was correct.

14 Mayor Faust indicated the $37,400 is not coming out of the City's budget. He saw this as much
15 more than an enforcement program.

17 Motion by Councilmember Stille, seconded by Councilmember Gray, to approve Resolution 19-
18 068; a Resolution Authorizing Mayor and City Manager to Approve Toward Zero Deaths Grant.

20 Motion carried 5-0.

22 Mayor Faust asked Police Lieutenant Diegnau for information on the law regarding school buses.
23 Police Lieutenant Diegnau reviewed the law with the Council.

25 D. Ordinance 2019-09; an Ordinance Amending Multiple Sections of Chapter 111 of the
26 Tobacco Ordinance to Raise the Minimum Age to Purchase to 21 (2nd of 3 readings).
27
28 City Manager Casey reviewed the ordinance with the Council and indicated it would raise the
29 age from 18 to 21 to purchase tobacco products within the City of St. Anthony. This is the
30 second of three readings required, the final reading is scheduled for October 8, 2019 and if
31 approved, the amended ordinance would subsequently be published and take effect immediately.

33 City Manager Casey indicated the City has received letters of support from the American Heart
34 Association, Hennepin County Public Health, The Association of Non -Smokers Minnesota and
35 the Minnesota Public Health Association.

37 Julie Philbrook explained she is a St. Anthony resident, nurse, and mother to an eleventh grader
38 at the high school. She was at the meeting to ask the City Council to support the ordinance that
39 would prohibit the sales of any nicotine tobacco containing product to anyone under 21. She
40 stated according to the 2015 Institute of Medicine report, ninety percent of people who use
41 tobacco start before the age of 18. She noted she lost two family members to smoking related
42 lung cancer, both her father and sister-in-law started smoking at the age of fifteen. With the
43 addition of vaping, now people can inhale the chemicals with little detection by teachers and
44 parents. Young people in St. Anthony are vaping and with alarming news with over 530 cases of
45 severe lung damage and nine deaths. She stated the City needs to act now to minimize the
46 chances that these kids still developing brains and lungs are not permanently damaged. The

1 deadly effect of cigarette smoking can take decades to show up, with vaping it can take just days
2 to change their life. She urged St. Anthony to take a proactive step to help limit the access of
3 these harmful products to people under the age of 21 by passing this ordinance.

5 Jaime Martinez explained he is wearing two hats; one is he has lived in the City of St. Anthony
6 Village for nineteen years and has also participated as an election judge for the City. He is also
7 representing the Minnesota Public Health Association. He indicated he has worked in public
8 health for almost thirty years and part of that time was spent at the Hennepin County Community
9 Health Department. He has also been at Clearway Minnesota, the foundation created from the
10 tobacco settlement. He noted he has been involved in tobacco and alcohol policy for many years
11 and is also co-chair of the Health Equity Committee with the organization. The association is
12 very committed to creating a healthier Minnesota through effective public health and practice of
13 engaged citizens. Their vision is to be an active, independent voice for public health in
14 Minnesota. The organization is made up of 400 members Statewide and has been around since
15 1907. He thought raising the age to 21 is a preventative effort to reduce the use of commercial
16 tobacco products by young people and prevent young people from either becoming addicted to
17 the product or incurring the resulting diseases that can come from smoking and premature death
18 as well.

20 Motion by Councilmember Randle, seconded by Councilmember Gray, to approve second
21 reading of Ordinance 2019-09; an Ordinance Amending Multiple Sections of Chapter 111 of the
22 Tobacco Ordinance to Raise the Minimum Age to Purchase to 21.

24 Councilmember Jenson thanked Staff for providing all of the different ways tobacco can be
25 consumed and the forms it can take.

27 Councilmember Stille mentioned this is the second reading and the Council could have waived
28 the second and third readings and got this through sooner. However, the Council talked about it
29 and determined it was an educational piece and the most democratic way to do this.

33 VII. REPORTS FROM CITY MANAGER AND COUNCIL MEMBERS.

35 City Manager Casey reported that Thursday, September 26th there will be a Smart Salting
36 Training for property managers from 9:00am-1:00pm. They are working in partnership with the
37 Rice Creek Watershed District. He also showed a video that was produced from the Ecofest.

39 Mayor Faust noted the City of St. Anthony Village was one of twelve cities invited by the
40 Commerce Department to have a presentation or day at the State Fair. This was a great honor for
41 the elected officials and is all Staff initiated.

43 Councilmember Gray stated he attended the Coffee with the Council last Saturday at City Hall.
44 There were some good discussions. He indicated the City continues to have these on the third
45 Saturday of every month and encouraged residents to attend. He noted he also attended the
46 Worksession last night which was a combination with the Planning Commission.

2 Councilmember Randle stated he attended a function on September 13d' with St. Anthony
3 Village for Equity and Community (SAVEC), and Racial Equity Minnesota was a part of it.
4 This was a community -wide event to get the community together for conversations with each
5 other. The speaker that night, Jodi Farr, was very good and brought a lot to the table. He
6 indicated he came out of the meeting a little bit wiser with a different perception. He also
7 attended the Worksession and Joint meeting with the Planning Commission.

9 Councilmember Jenson stated he attended the Coffee with the Council last Saturday as well. He
10 noted there are different topics each time and a good way to communicate and learn about what
11 people are looking for. He also attended the Worksession as well.

13 Councilmember Stille stated he attended the two Worksessions last night as well and reviewed
14 the topics discussed at the meetings.

16 Mayor Faust stated he attended the Worksessions as well.

18 VIII. COMMUNITY FORUM.

20 Mayor Faust invited residents to come forward at this time and address the Council on items that
21 are not on the regular agenda.

23 Hearing none, Mayor Faust moved forward with the agenda.

25 IX. INFORMATION AND ANNOUNCEMENTS.

27 Mayor Faust stated the Chamber of Commerce is hosting a candidate meeting on October 3rd in
28 the Council Chambers.
