Mayor Faust called the meeting to order at 7:00 p.m. PLEDGE OF ALLEGIANCE. Mayor Faust invited the Council and audience to join him in the Pledge of Allegiance. ROLL CALL. Present: Absent: Also Present: Mayor Faust, Councilmembers Gray, Jenson, and Stille. Councilmember Randle City Manager Mark Casey, City Planner Stephen Grittman, and City Engineer Justin Messner. CONSIDERATION, DISCUSSION, AND POSSIBLE ACTION ON ALL OF THE FOLLOWING ITEMS. I. II. APPROVAL OF OCTOBER 8, 2019 CITY COUNCIL MEETING AGENDA. Motion by Councilmember Gray, seconded by Councilmember Jenson, to approve the City Council Meeting Agenda of October 8, 2019. PROCLAMATIONS AND RECOGNITIONS — NONE. CONSENT AGENDA. A. B. C. D. Motion carried 4-0. Approve September 24, 2019, Council meeting minutes. Licenses and permits. Claims. Resolution 19-069: a Resolution Accepting Grants and Donations in the 31-d quarter of 2019. Motion by Councilmember Gray, seconded by Councilmember Stille, to approve the Consent Agenda items. Motion carried 4-0. IV. PUBLIC HEARING — NONE. V. REPORTS FROM COMMISSION AND STAFF. City Council Regular Meeting Minutes October 8, 2019 Page 2 1 A. Resolution 19-070; a Resolution Denying a request for a Subdivision, Variances from 2 Required Lot Area, and Variance for Setback from the Public Right of Way for property 3 at 3645 Chelmsford Road. 4 5 City Planner Grittman reviewed the resolution with the Council and indicated that staff and 6 Planning Commission recommend denial of the proposed subdivision and lot area variances 7 along with denial of the proposed setback variance for proposed Parcel A based on the findings 8 shown in the staff report. 9 10 Mayor Faust offered an opportunity for the public or applicant to speak with no one coming 11 forward. 12 13 Motion by Councilmember Stille, seconded by Councilmember Jenson, to approve Resolution 14 19-070; a Resolution denying a request for a Subdivision, Variances from Required Lot Area, 15 and Variance for Setback from the Public Right of Way for property at 3645 Chelmsford Road. 16 17 Councilmember Stille explained staff presented this item well, noting this request exceeds the 18 City Zoning Code by a lot. He noted a short while ago the City denied a request similar to this 19 one as well. He thought variances were not to be taken lightly. 20 21 Motion carried 4-0. 22 23 VI. GENERAL BUSINESS OF COUNCIL. 24 25 A. Resolution 19-071; a Resolution Accepting and Approving the grant agreement between 26 the City of St. Anthony Village and the Metropolitan Council of Environmental Services 27 for the Improvement of Publicly owned infrastructure. 28 29 City Engineer Messner reviewed the resolution with the Council and indicated that staff 30 recommended approval of the Resolution. 31 32 Councilmember Stille asked what this money is being used for and what the purpose of the grant 33 is. City Engineer Messner explained what the grant is and how the money will be used in 34 improving the wastewater treatment plant. He noted the grant funds are only for infrastructure 35 improvements within the road right-of-way and does not include the private sewer services to the 36 homes. He stated as part of the street reconstruction project, the City is also analyzing the 37 private sewer services to the homes and trying to find deficiencies within those pipes. 38 39 Councilmember Stille indicated in terms of the environmental sustainability component of this 40 exercise, this is not just doing a favor for the homeowner it really makes an impact. 41 42 Councilmember Jenson asked for clarity if the sanitary sewer system water going into the storm 43 water sewer system and going into the Mississippi River. City Engineer Messner indicated the 44 storm water is getting into the sanitary sewer system. He explained when it rains heavily the 45 rainwater infiltrates into the ground where a lot of the old system has cracks in the pipes and 46 water seeps into the cracks and the pipe. City Council Regular Meeting Minutes October 8, 2019 Page 3 1 2 Mayor Faust stated when the residents started seeing the rates go up because of the inflow that is 3 what caused the City to become a little more proactive because the Metropolitan Council is 4 charging the residents more money then what the City knew was actually being discharged. 5 Through the City's efforts, mainly WSB, testified through the Metropolitan Agencies of Metro 6 Cities to get funding. He indicated this adds to the environmental issue as well as the economic 7 issue of it as well. He noted this rewards cities that are proactive, such as St. Anthony, on what 8 the City is doing in its street reconstruction project. 9 10 Councilmember Stille asked City Manager Casey where the $150,000 will go. City Manager 11 Casey explained the money will be a source used when the City does its peak to plateau and are 12 able to reinvest that in order to bring the costs down as the City works through its multi -year 13 street improvement program. 14 15 Councilmember Stille noted this money will be used for future street improvement projects and 16 the City will not have to levy as much or borrow as much. 17 18 Motion by Councilmember Gray, seconded by Councilmember Jenson, to approve Resolution 19 19-071; a Resolution Accepting and Approving the grant agreement between the City of St. 20 Anthony Village and the Metropolitan Council of Environmental Services for the Improvement 21 of Publicly owned infrastructure. 22 23 Motion carried 4-0. 24 25 B. Resolution 19-072; a Resolution Authorizing Mayor and City Manager to Approve 26 Agreement with Ramsey County for the Silver Lake Road Flooding Project. 27 28 City Engineer Messner reviewed the resolution with the Council and indicated that staff 29 recommends the City Council approve the agreement with Ramsey County for the Silver Lake 30 Road Flooding project. 31 32 Councilmember Stille asked when the final mill and overlay will be completed. City Engineer 33 Messner explained this was put off due to the weather and the City has received notice that it will 34 start next week. 35 36 Mayor Faust indicated this is a very quick process so should not take long to get it done. 37 38 Motion by Councilmember Gray, seconded by Councilmember Stille, to approve Resolution 19- 39 072; a Resolution Authorizing Mayor and City Manager to Approve Agreement with Ramsey 40 County for the Silver Lake Road Flooding Project. 41 42 Motion carried 4-0. 43 44 C. Resolution 19-073; a Resolution Approving Participation in the Voluntary Statewide 45 Lump -Sum Volunteer Firefighter Retirement Plan. 46 City Council Regular Meeting Minutes October 8, 2019 Page 4 1 City Manager Casey reviewed the resolution with the Council and indicated that staff 2 recommends approval of the Resolution based on the benefits gained with joining the PERA 3 plan, and that the PERA and SAFRA modeling both project a $3,800 benefit level will maintain 4 the plan at more than 100% funded. 5 6 Councilmember Stille asked for elaboration on the benefits of the vesting. City Manager Casey 7 explained the vesting benefits with the Council and indicated by moving the period from ten 8 years to five years it will encourage the firefighter to stay on rather than leave. 9 10 Councilmember Jenson stated he attended the meeting at the Fire Department that discussed this 11 plan in detail, and it was quite lengthy but at the end of the meeting it was unanimous that the 12 rank and file approved this plan to go forward with it. 13 14 Mayor Faust noted this is only for the paid on -call volunteer Fire Department, not for the full- 15 time employees. 16 17 Motion by Councilmember Jenson, seconded by Councilmember Gray, to approve Resolution 18 19-073; a Resolution Approving Participation in the Voluntary Statewide Lump -Sum Volunteer 19 Firefighter Retirement Plan. 20 21 Motion carried 4-0. 22 23 D. Resolution 19-074; a Resolution Certifying Special Assessments for Delinquent Public 24 Utility Service Accounts to the 2020 Hennepin County Tax Rolls. 25 26 City Manager Casey reviewed the resolution with the Council and request the City Council 27 approve the Resolution Certifying Special Assessment for Delinquent Public Utility Service 28 Accounts. 29 30 Motion by Councilmember Stille, seconded by Councilmember Gray, to approve Resolution 19- 31 074; a Resolution Certifying Special Assessment for Delinquent Public Utility Service Accounts 32 to the 2020 Hennepin County Tax Rolls. 33 34 Motion carried 4-0. 35 36 E. Resolution 19-075; a Resolution Certifying Special Assessments for Delinquent Public 37 Utility Service Accounts to the 2020 Ramsey County Tax Rolls. 38 39 City Manager Casey reviewed the resolution with the Council and request the approval of the 40 Resolution Certifying Special Assessments for Delinquent Public Utility Service Accounts for 41 Ramsey County. 42 43 Motion by Councilmember Gray, seconded by Councilmember Jenson, to approve Resolution 44 19-075; a Resolution Certifying Special Assessments for Delinquent Public Utility Service 45 Accounts to the 2020 Ramsey County Tax Rolls. 46 City Council Regular Meeting Minutes October 8, 2019 Page 5 1 Motion carried 4-0. 2 3 F. Resolution 19-076; a Resolution Certifying Special Assessments for Delinquent Waste 4 Hauler Accounts to the 2020 Hennepin County Tax Rolls. 5 6 City Manager Casey reviewed the resolution with the Council and request the City Council 7 approve the Resolution Certifying Assessment for Delinquent Waste Hauler Accounts for 8 Hennepin County. 9 10 Motion by Councilmember Jenson, seconded by Councilmember Stille, to approve Resolution 11 19-076; a Resolution Certifying Special Assessments for Delinquent Waste Hauler Accounts to 12 the 2020 Hennepin County Tax Rolls. 13 14 Motion carried 4-0. 15 16 G. Resolution 19-077; a Resolution Certifying Special Assessments for Delinquent Waste 17 Hauler Accounts to the 2020 Ramsey County Tax Rolls. 18 19 City Manager Casey reviewed the resolution with the Council and request approval of the 20 Resolution Certifying Special Assessments for Delinquent Waste Hauler Accounts for Ramsey 21 County. 22 23 Motion by Councilmember Gray, seconded by Councilmember Stille, to approve Resolution 19- 24 077; a Resolution Certifying Special Assessments for Delinquent Waste Hauler Accounts to the 25 2020 Ramsey County Tax Rolls. 26 27 Motion carried 4-0. 28 29 H. Resolution 19-09; an Ordinance Amending Multiple Sections of Chapter 111 of the 30 Tobacco Ordinance to Raise the Minimum Age to Purchase to 21. 31 32 City Manager Casey reviewed the resolution with the Council and indicated that staff is 33 requesting approval of this Ordinance. 34 35 Motion by Councilmember Stille, seconded by Councilmember Jenson, to approve third reading 36 and adopt Ordinance 2019-09; an Ordinance Amending Multiple Sections of Chapter 111 of the 37 Tobacco Ordinance to Raise the Minimum Age to Purchase to 21. 38 39 Motion carried 4-0. 40 41 Ms. Ann Trench stated she appreciated that the Council took this issue up and has raised the age 42 to 21. She thought it was very important and will help keep a lot of the vaping out of the high 43 schools. She also thought it was a puzzle here. The tobacco sales age deals with access but the 44 flavors also make it very appealing. She thought it would encourage high school students to still 45 go around the age law because it is something that they want. She thought appeal and access are 46 both important to prevent use and addiction and an epidemic. States have made drastic moves City Council Regular Meeting Minutes October 8, 2019 Page 6 1 recently pulling all flavored products off the shelf and she would suggest that there be an 2 amendment to restrict all flavored to adult only stores. Minneapolis and St. Paul have this, 3 Lauderdale, Falcon Heights also have this. This would pull all flavored products out of stores 4 that high school students frequent. She noted she brought this up at the very first reading, 5 September 24th, and did not know that she should have taken more of an active role in between 6 the readings. She was glad the City Council did this but was not sure why this did not include 7 flavored products as well. 8 9 Mayor Faust explained the City was trying to get the vaping and cigarette smoking to age 21. 10 Once it gets to 21, if someone wants to damage themselves that is their prerogative. He thought 11 this should be a State issue and not dealt with at the city level. He thought the City exercised its 12 power effectively and thoughtfully and the goal is to keep it out of the high school kids' hands. 13 14 I. Resolution 19-078; a Resolution Approving Summary Publication for Ordinance 2019- 15 09. 16 17 City Manager Casey reviewed the resolution with the Council. 18 19 Motion by Councilmember Gray, seconded by Councilmember Jenson, to approve Resolution 20 19-078; a Resolution Approving Summary Publication for Ordinance 2019-09. 21 22 Motion carried 4-0. 23 24 J. Resolution 19-079; a Resolution Designating the Star Tribune the Legal Newspaper for 25 the City of St. Anthony Village for the Calendar Year 2019. 26 27 City Manager Casey reviewed the resolution with the Council and indicated that staff is 28 recommending designating the Star Tribune for the remainder of 2019 and reevaluate options for 29 2020. 30 31 Councilmember Stille asked if the publication Finance and Commerce would be a publication 32 the City could use. City Manager Casey explained the State Statute regarding this item. He 33 indicated this will give the Council time to evaluate the possibilities before the beginning of next 34 year for the official newspaper. 35 36 Mayor Faust thought it is the only way the City can continue to be transparent with the public 37 even thought the Star Tribune will be more expensive. There are issues the City wants people to 38 know about and to be able to respond to. 39 40 Motion by Councilmember Stille, seconded by Councilmember Gray, to approve Resolution 19- 41 079; a Resolution Designating the Star Tribune the Legal Newspaper for the City of St. Anthony 42 Village for the Calendar Year 2019. 43 44 Motion carried 4-0. 45 46 K. Quarterly Goals Update. City Council Regular Meeting Minutes October 8, 2019 Page 7 1 2 City Manager Casey reviewed the quarterly goals and accomplishments with the Council. 3 4 Councilmember Stille asked if City Manager Casey mentioned the potential for working with the 5 School District on the football field. City Manager Casey indicated that is one of the areas where 6 City Staff is helping to submit a grant to Hennepin County in regard to looking at artificial turf at 7 the athletic facilities that the City co -works with along side the School District. He noted this is 8 in the preliminary stages and getting information put together on what the request would be and 9 what is needed for the project. 10 11 Mayor Faust thought it was important to realize that when the Council comes up with the seventy 12 items in January and that was one of the items that the Council knew was going to be a multi- 13 year function to get to and to find the right partners and collaboratives and to get it. The City 14 Council also realizes that if they are not partnering with the School District, the City only have 15 1,506 acres and the City cannot build up on ballfields, so the City has to make them useable 16 more of the time. The City will probably be working some different groups and the Council will 17 be supportive of them and he thought it was a way to get things done. He commended City Staff 18 for the hard work on all of the projects and it allows them to get the community behind some of 19 these supports and pay for those functions as they come about. 20 21 VII. REPORTS FROM CITY MANAGER AND COUNCIL MEMBERS. 22 23 City Manager Casey reported that there was a Fire Department open house on Saturday and 24 attendance was good despite the weather. He noted the newsletter has been sent out. October 25 19th there will be the next Coffee with the Council at 9:00 a.m. at Autumn Woods. 26 27 Councilmember Jenson stated he attended the Candidate Forum on October 3`d and the Fire 28 Department open house. He noted the weather was somewhat difficult but there was a steady 29 flow of people. He could tell the staff put a lot of time and effort into that event. 30 31 Councilmember Stille stated on October 3rd he met with Representative Omar's Chief of Staff 32 and also other representatives. He thought it was important to recognize that office and St. 33 Anthony has always had good relationships with the representatives. 34 35 Councilmember Gray stated he attended the Fire Department open house on October 5th and was 36 amazed at how many people were there. He thought the kids really enjoyed the different things 37 that were available, and he thought it was a successful event. He thanked City staff for the hard 38 work. 39 40 Mayor Faust stated he attended all of the events mentioned. He also acknowledged the Public 41 Works for keeping the streets clean in all types of weather. 42 43 VIII. COMMUNITY FORUM. 44 45 Mayor Faust invited residents to come forward at this time and address the Council on items that 46 are not on the regular agenda.
