ANTHONY 2 CITY COUNCIL REGULAR MEETING MINUTES 3 November 26, 2019 4 5 CALL TO ORDER. 6 7 Mayor Faust called the meeting to order at 7:00 p.m. 8 9 PLEDGE OF ALLEGIANCE. 10 11 Mayor Faust invited the Council and audience to join him in the Pledge of Allegiance. 12 13 ROLL CALL. 14 15 Present: Mayor Faust, Councilmembers Gray, Jenson, Randle and Stille. 16 Absent: None 17 Also Present: City Manager Mark Casey and Public Works Director Jay Hartman. 18 19 20 CONSIDERATION, DISCUSSION, AND POSSIBLE ACTION ON ALL OF THE FOLLOWING 21 ITEMS. 22 23 I. APPROVAL OF NOVEMBER 26, 2019 CITY COUNCIL MEETING AGENDA. 24 25 Motion by Councilmember Gray, seconded by Councilmember Randle, to approve the City 26 Council Meeting Agenda of November 26, 2019. 27 28 Motion carried 5-0. 29 30 II. PROCLAMATIONS AND RECOGNITIONS. 31 32 A. Students in Government Presentation 33 34 City Manager Casey explained on November 20, 2019 approximately sixty students joined the 35 City for its annual Students in Government program. He reviewed the event and showed 36 pictures. He thanked Bonnie Brevor for all the help on this project. 37 38 Mr. Vincent Favorite, Delegate from St. Anthony Area High School stated he went on the public 39 works trip along with seeing the Fire Department and was very interesting. He reviewed his 40 experience of the event with the City Council. 41 42 Mayor Faust asked Mr. Vincent Favorite why he chose Public Works. Mr. Favorite stated he 43 jumped in the program at the last second and that was what was left. He explained he did enjoy 44 it and was glad he went and very interesting and he did not have any regrets. Mayor Faust 45 thanked Mr. Favorite for coming to the meeting. 46 47 B. Presentation of 2019 Water Conservation Poster Winners 48 City Council Regular Meeting Minutes November 26, 2019 Page 2 1 Public Works Director Jay Hartman made a presentation and presented the 2019 Water 2 Conservation Poster winners to the City Council. He noted this is the third consecutive year that 3 the Parks Commission sponsored the contest and two schools participated. St. Charles Third 4 Grade and Wilshire Park Fourth Grade classes participated. 5 6 Hartman announced the 4th place winner was Addie J. He announced the 3rd place winners were 7 Neva F and Lucy J. and the 2" place winners were Sasha W. and Elise O. Mayor Faust 8 presented the winners with water bottles and certificates. 9 10 Hartman announced the 1st place winner of the contest was Sena A. Mayor Faust presented her 11 with a water bottle and certificate. He also took photos with the winners. 12 13 Mayor Faust congratulated all the participants of the contest. 14 15 III. CONSENT AGENDA. 16 17 A. Approve November 12, 2019, Council meeting minutes. 18 B. Licenses and permits. 19 C. Claims. 20 21 Motion by Councilmember Randle, seconded by Councilmember Gray, to approve the Consent 22 Agenda items. 23 24 Motion carried 5-0. 25 26 IV. PUBLIC HEARING — NONE. 27 28 V. REPORTS FROM COMMISSION AND STAFF — NONE. 29 30 VI. GENERAL BUSINESS OF COUNCIL. 31 32 A. Resolution 19-084; a Resolution of the Canvass of the 2019 Municipal Election Recount. 33 34 City Manager Casey reviewed the resolution with the Council and indicated that the results of 35 the recount showed votes case for Bernard Walker to be 1,298 and votes for Hal Gray to be 36 1,294. 37 38 Motion by Councilmember Jenson, seconded by Councilmember Randle, to approve Resolution 39 19-084; a Resolution of the Canvass of the 2019 Municipal Election Recount. 40 41 Motion carried 5-0. 42 43 B. Ordinance 2019-10; an Ordinance Amending Multiple Sections Relating to Sewer, 44 Water, and Stormwater Fees and Other Fees. 45 City Council Regular Meeting Minutes November 26, 2019 Page 3 1 City Manager Casey reviewed the resolution with the Council and indicated that this is the third 2 and final reading and builds on the multi -year approach towards rate adjustments that began in 3 2012. He noted since the two -reading staff has not received any calls or letters regarding this 4 item and staff recommends adoption to take effect on January 1, 2020. 5 6 Motion by Councilmember Stille, seconded by Councilmember Gray, to approve the Final 7 Reading and Adoption of Ordinance 2019-10; an Ordinance Amending Municipal Sections 8 Related to Sewer, Water, and Stormwater Fees and Other Fees. 9 10 Motion carried 5-0. 11 12 C. Resolution 19-085; a Resolution Approving the Summary Publication of Ordinance 13 2019-10. 14 15 City Manager Casey reviewed the resolution with the Council and indicated that State Statute 16 permits the ability to do a summary publication. He asked the Council to approve Summary 17 Publication of Ordinance 2019-10. 18 19 Motion by Councilmember Randle, seconded by Councilmember Gray, to approve Resolution 20 19-085; a Resolution Approving the Summary Publication of Ordinance 2019-10. 21 22 Motion carried 5-0. 23 24 D. Resolution 19-086; a Resolution Adopting the 2020 Fee Schedule 25 26 City Manager Casey reviewed the resolution with the Council and indicated that staff is asking 27 approval of the proposed 2020 fee schedule. 28 29 Motion by Councilmember Jenson, seconded by Councilmember Gray, to approve Resolution 30 19-086; a Resolution Adopting the 2020 Fee Schedule. 31 32 Motion carried 5-0. 33 34 E. Resolution 19-087; a Resolution Approving the Agreement Extension of our Residential 35 Solid Waste and Recycling Collection Services for One Year until April 1, 2021. 36 37 City Manager Casey reviewed the resolution with the Council and indicated that this is an 38 amendment to the agreement for residential solid waste and recycling collection services. Staff 39 is recommending renewing the agreement for one year until April 1, 2021 with the same terms 40 and conditions. 41 42 Motion by Councilmember Stille, seconded by Councilmember Jenson, to approve Resolution 43 19-087; a Resolution Approving the Agreement Extension of our Residential Solid Waste and 44 Recycling Collection Services for One Year until April 1, 2021. 45 46 Motion carried 5-0. City Council Regular Meeting Minutes November 26, 2019 Page 4 1 2 F. Process for Filling City Council Vacancy 3 4 City Manager Casey reviewed the item with the Council and indicated that Once Councilmember 5 Stille takes office of Mayor on January 6, 2020 this will leave an open City Council seat. 6 Councilmember Stille's remaining term will be less than two years and therefore the City can 7 appoint an individual to finish out his term which ends January 3, 2022. Staff recommends 8 posting on the city's website applications to fill the vacancy until 12:00 p.m. Friday, December 9 13, 2019 with interview conducted on Wednesday, January 8, 2020 and appointment at January 10 14, 2020 at the City Council meeting. 11 12 Councilmember Stille indicated the other option would be a special election. Mr. Casey 13 indicated that was correct. He noted recently that was changes to be quarterly so the next 14 available special election would be April 1, 2020. 15 16 Mayor Faust recognized public input. 17 18 Mr. David Johnson, 2916 Silver Lake Court, explained from his perspective the most democratic 19 and transparent thing to do would be to fill this vacancy through special election. He understood 20 this would incur significant costs which he did not believe were budgeted by the city to open 21 precincts and hold a special vote and would take more time to seat someone. He believed if done 22 the right way and appoint can be a good solution if there are a few stipulations. 23 24 Mr. Johnson thought the process needed to be totally transparent to the citizens and that meant 25 any interested Villager should be able to gain information about the candidates and provide input 26 into the process before Council before the Council would decide on who that individual would 27 be. He believed that a more peer process would dictate that the entire decision, including the 28 decision on the process, whether done through a special election or appointment, would be made 29 by the incoming Council. The intent maybe the same and the outcome may be the same, but he 30 thought a decision by the incoming Council would be more transparent and in keeping with the 31 will of the citizens that was made clear through the election on November 5th. He realized that 32 this takes more time and the incoming appointee may miss some training opportunities and there 33 may be other considerations as well that he is not aware of, but he thought that the upside and 34 transparency does deserve the Council's consideration. He would encourage the Council to 35 consider a motion and a second to have that discussion. 36 37 Mr. Johnson stated if the Council does decide on an appointment process that the Council 38 consider two things, first during interviews and questioning of applicants that the Council would 39 ask candidates whether they planned to run for the seat they would be appointed to in 2021. He 40 thought that the Council should consider only candidates who state they would not run as it 41 would remove the advantage of incumbency that would be gifted to an applicant through this 42 process. Secondly, he would like the Council to consider the lack of gender diversity on the 43 current and incoming Council as a significant gap in City leadership and that an appointment 44 presents an opportunity to address this fact. 45 City Council Regular Meeting Minutes November 26, 2019 Page 5 1 Mayor Faust stated a special election is not budgeted for, it would take some time, and would be 2 cumbersome in that respect. He explained the information has always been made public. 3 Anyone can apply for this and as far as deciding by the incoming Council is moot point because 4 there is not a vacancy until two of the current Councilmembers are gone. He indicated the new 5 Councilmember will be on the decision -making process. He indicated they had thought about 6 over the years asking people not to run for the seat. He thought about that several years ago and 7 every time after, and felt this is not a good question to ask because who knows what the person is 8 going to do two years down the road. He also explained it is not enforceable and not a legal 9 question to ask someone. As far as the incumbency aspect of it, nothing on any ballot says the 10 person is an incumbent. Only judges in the State of Minnesota get to state that. He stated 11 everybody is open to gender diversity and he thought it speaks for itself. 12 13 Councilmember Stille stated if this discussion is delayed until January 14th and then the process 14 is started, it would be well into February before an appointment would be made. During that 15 time, the Council has its goal setting discussion and it is critical that a new Councilmember 16 would be part of that process. Furthermore, every year there is a newly elected leaders 17 conference held in January with a lot of input so to appoint someone in February and have them 18 miss those to critical events would be a disservice to any new Councilmember coming in and 19 also a disservice to the community. From a timing perspective, he would not support that. 20 21 Mr. Bernard Walker, Councilmember Elect, stated a lot of what was already said are some of the 22 things he was going to bring up. He stated his remaining concern would be that he would not be 23 a part of the interview process. He explained it would be important to him to be a part of that 24 process because he represents St. Anthony residents and if he is going to be on the Council, he 25 would like to have a say in who he is working with. 26 27 Mayor Faust reviewed the timeline with the audience. He indicated Mr. Walker will be involved 28 in the interview and selection process in January. He noted he will remain in the discussion but 29 will abstain during the motion because he will not be a part of the interview process on January 30 8th 31 32 City Manager Casey stated on January 6th Councilmember Elect Walker will take the Oath of 33 Office that will be done in the City Clerk office to make sure he is sworn in and then on January 34 14th there will be a public Oath of Office during the Council meeting and is ceremonial. 35 36 Mayor Faust indicated he agreed with Councilmember Stille's comments regarding the training 37 at the beginning of the year and Council goal setting discussion. 38 39 Councilmember Jenson thought the Council goal setting meeting is very important and includes 40 many staff members and contractors that support the city. 41 42 Motion by Councilmember Stille, seconded by Councilmember Jenson, to accept the procedure 43 for filling the City Council position as outlined in City Manager Casey's memo dated November 44 26, 2019. 45 46 Ayes -3, Nays — 0, Abstain — 2 (Faust, Grav). REPORTS FROM CITY MANAGER AND COUNCIL MEMBERS. 3 4 Councilmember Randle stated on Wednesday, November 13th he attended a Worksession, 5 Thursday, November 14th he attended the League of Minnesota's Metro Cities Regional meeting, 6 Wednesday, November 21 St he attended a Students in Government meeting and Thursday, 7 November 22nd he attended the Annual Meeting of Ramsey County League of Local 8 Governments. 9 10 Councilmember Jenson stated he also attended a Worksession on November 13th, regarding 11 Trident Development for the Bremer bank site. On November 14th, he attended the Metro Cities 12 Annual meeting and there were three concepts in that meeting. On November 17th he attended 13 the St. Anthony Village Historical Society Annual meeting and their primary discussion was 14 developing a picture booklet for St. Anthony's 75th Anniversary. On November 21' he attended 15 the Ramsey County League of Local Governments Board of Directors Annual meeting and the 16 2020 Strategic Plan was reviewed. Jim Hall made a presentation on How to Attract the Next 17 Generation of Government Leaderships and at that meeting he was elected President of the 18 Organization for 2020. On November 25th he attended the city Worksession and nine Planning 19 Commission candidates were interviewed. 20 21 Mayor Faust congratulated Councilmember Jenson on his election. 22 23 Councilmember Stille stated he attended the November 13th Worksession. Regarding Trident 24 Development, the project is the Bremer bank site and is looking at putting a free-standing 25 building on this site along with 75 units of residential housing where twenty would be affordable 26 housing to fifty or sixty percent area median income. Any decisions made regarding that would 27 be before the City Council. 28 29 Councilmember Gray stated he attended the November 13th Worksession. He also attended 30 Coffee with the Council on November 16th at Cub Foods with Mayor Elect Stille and 31 Councilmember Jenson and he also participated in the Planning Commission candidate 32 interviews. 33 34 Mayor Faust stated on November 18th he was part of a ribbon cutting ceremony for Carbone's 35 new pizza place. He noted he also attended the November 13th, 14th events as well. November 36 20th' he met with Students in Government and he also attended the November 25th Worksession. 37 38 VIII. COMMUNITY FORUM. 39 40 Mayor Faust invited residents to come forward at this time and address the Council on items that 41 are not on the regular agenda. 42 43 Hearing none, Mayor Faust moved forward with the agenda. 44 45 IX.
