ANTHONY VILLAGE STATE OF MINNESOTA RESOLUTION 20-017 A RESOLUTION VACA TING CERTAIN DRAINAGE AND UTILITY EASEMENTS WITHIN LOT 2, BLOCK 1 OF THE SILVER LAKE VILLAGE PLAT WHEREAS, the city of St. Anthony Village (the "City") is a municipal corporation, organized and existing under the laws of Minnesota; and WHEREAS, Doran SLY, LLC (the "Developer") is the fee owner of Lot 2, Block 1 of the Silver Lake Village plat (the "Property"); and WHEREAS, the Developer has requested that the City vacate the drainage and utility easements currently existing on the Property which will interfere with Planned Unit Development (the "PUD"); and WHEREAS, the Developer proposes new drainage and utility easements with the PUD; and WHEREAS, pursuant to Minn. Stat. § 412.851, the City scheduled a public hearing for February 11, 2020 to consider vacation of the drainage and utility easements described on Exhibit A and depicted on Exhibit B attached hereto; and WHEREAS, notice of the public hearing was posted, published in the official newspaper, all in accordance with law; and WHEREAS, the City held the public hearing on the proposed vacation on February 11, 2020, at which hearing all interested parties were heard; and WHEREAS, following the public hearing, the City determined that vacation of the drainage and utility easements as requested is in the public interest. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of St. Anthony Village that: I)The City hereby declares that the easements legally described on Exhibit A and depicted on Exhibit B attached hereto are hereby vacated. 2)The City Manager or his designee is authorized and directed to prepare and present to the RamseyCounty auditor a notice that the City has completed these vacation proceedings and record with Ramsey County the described vacation following the final approval of the PUD plat of the Property and assurance that said plat will be duly recorded and the drainage and utility easements depicted thereon conveyed to the City.
