ANTHONY 1 CITY COUNCIL REGULAR MEETING MINUTES 2 SEPTEMBER 22, 2020 3 4 CALL TO ORDER. 5 6 Mayor Stille called the meeting to order at 7:00 p.m. 7 8 PLEDGE OF ALLEGIANCE. 9 10 Mayor Stille invited the Council and audience to join him in the Pledge of Allegiance. 11 12 ROLL CALL. 13 14 Present: Mayor Stille, Councilmembers Jenson, Randle, Walker and Webster. 15 Absent: None 16 Also Present: Interim City Manager Charlie Yunker, City Planner Stephen Grittman, Assistant Fire 17 Chief Chris Fuller and Sergeant Mike Huddle. 18 Guests: Paul Van Dem Boom 19 20 CONSIDERATION, DISCUSSION, AND POSSIBLE ACTION ON ALL OF THE FOLLOWING 21 ITEMS. 22 23 I.APPROVAL OF SEPTEMBER 22, 2020 CITY COUNCIL MEETING AGENDA. 24 25 Motion by Councilmember Randle, seconded by Councilmember Webster, to approve the City 26 Council Meeting Agenda of September 22, 2020. 27 28 Motion carried 5-0. 29 30 II.PROCLAMATIONS AND RECOGNITIONS. 31 32 A.Spirit of St. Anthony Award.33 Paul Van Dem Boom, 2019 Award Recipient presented the Spirit of St. Anthony Award34 to Officer Jonathan Schlingman.35 36 Officer Jonathan Schlingman thanked everyone on the committee for selecting him for37 the award.38 39 Mayor Stille congratulated Officer Schlingman for the award. He noted Officer40 Schlingman is the eighth recipient and thought it helps with cohesiveness and the ability41 to really let people know publicly how they feel about their employees.42 43 B.Presentation of Night to Unite.44 Sergeant Mike Huddle made a Night to Unite presentation. Mayor Stille stated the City45 is looking forward to this event.46 47 C.Proclamation for Night to Unite on October 6, 2020.48 1 City Council Regular Meeting Minutes September 22, 2020 Page 2 The City Council each read a section of the Night to Unite proclamation and Mayor Stille 1 proclaimed October 6, 2020 as Night to Unite. 2 3 D. Fire Prevention Presentation. 4 Assistant Fire Chief Chris Fuller made a Fire Prevention presentation to the City Council. 5 6 Councilmember Randle indicated he was in multi-family housing for thirteen years and 7 whenever an annual inspection came around the one thing noticed when checking out for 8 smoke detectors and CO detectors, he would normally find a third of them in people’s 9 closets. He wondered what could be done about that because they did try to educate the 10 people and also tried to explain the importance of having a smoke detector up and 11 working, would it be feasible to try to educate the property owner a little bit more. 12 Assistant Fire Chief Fuller explained that would be the thing to do and what part of the 13 Emergency Fire Plan is intended to do. It will explain to the resident the function of the 14 smoke detector in the apartment. 15 16 Councilmember Walker indicated there are planned and unplanned evacuation drills and 17 he imagined that the benefit of the unplanned drill will test a person’s automatic pilot 18 reaction to a fire. He wondered what some other differences are between the two drills. 19 Assistant Fire Chief Fuller explained the reason for two evacuation fire drills. 20 21 III. CONSENT AGENDA. 22 23 A. Approve September 8, 2020, Council meeting minutes. 24 B. Licenses and permits. 25 C. Claims. 26 27 Motion by Councilmember Webster, seconded by Councilmember Jenson, to approve the 28 Consent Agenda items. 29 30 Ayes – 4, Nays – 0, Abstain - 1(Walker). Motion carried. 31 32 IV. PUBLIC HEARING – NONE. 33 34 V. REPORTS FROM COMMISSION AND STAFF – NONE. 35 36 VI. GENERAL BUSINESS OF COUNCIL. 37 38 A. Resolution 20-068; a Resolution Approving the Hennepin County Residential Recycling 39 SCORE Grant Agreement Amendment. 40 41 Interim City Manager Yunker reviewed the resolution with the Council. 42 43 Mayor Stille asked what the typical arrangement the City has had in the past regarding this as far 44 as terms. Mr. Yunker explained he looked back, and this is usually a five-year term where things 45 2 City Council Regular Meeting Minutes September 22, 2020 Page 3 do not change. This year Hennepin County asked for a one-year extension and he was sure that 1 next year a more thorough review will be done. 2 3 Motion by Councilmember Jenson, seconded by Councilmember Randle, to approve Resolution 4 20-068; a Resolution Approving the Hennepin County Residential Recycling SCORE Grant 5 Agreement Amendment. 6 7 Motion carried 5-0. 8 9 B. Resolution 20-069; a Resolution Ratifying the 2021 Agreement Between the International 10 Association of Fire Fighters Local 3486 Representing the St. Anthony Fire Department 11 Employees and the City of St. Anthony Village. 12 13 Interim City Manager Yunker reviewed the resolution with the Council. 14 15 Mayor Stille indicated Mr. Yunker mentioned to him earlier that this is the final year of the five-16 year health insurance contract too. Mr. Yunker explained that was correct and the City 17 participates with a number of other cities to go out for bid for health insurance collectively in 18 order to get better rates and 2021 will be the fifth year of a five-year contract for that. 19 20 Motion by Councilmember Webster, seconded by Councilmember Randle, to approve 21 Resolution 20-069; a Resolution Ratifying the 2021 Agreement Between the International 22 Association of Fire Fighters Local 3486 Representing the St. Anthony Fire Department 23 Employees and the City of St. Anthony Village. 24 25 Motion carried 5-0. 26 27 C. Resolution 20-070; a Resolution Ratifying the 2021 Agreement Between the Law 28 Enforcement Labor Services, Inc. #186 Representing the St. Anthony Police Department 29 Licensed Employees, and the City of St. Anthony Village. 30 31 Interim City Manager Yunker reviewed the resolution with the Council. 32 33 Councilmember Randle asked if the two percent cost of living increase is across the board. Mr. 34 Yunker stated that was correct. 35 36 Motion by Councilmember Randle, seconded by Councilmember Walker, to approve Resolution 37 20-070; a Resolution Ratifying the 2021 Agreement Between the Law Enforcement Services, 38 Inc. #186 Representing the St. Anthony Police Department Licensed Employees and the City of 39 St. Anthony Village. 40 41 Motion carried 5-0. 42 43 D. Resolution 20-071; a Resolution Ratifying the 2021 Agreement Between the International 44 Union of Operating Engineers Local No. 49 AFL-CIO Representing the St. Anthony 45 Public Works Department Employees and the City of St. Anthony Village. 46 3 City Council Regular Meeting Minutes September 22, 2020 Page 4 1 Interim City Manager Yunker reviewed the resolution with the Council. 2 3 Motion by Councilmember Walker, seconded by Councilmember Webster, to approve 4 Resolution 20-071; a Resolution Ratifying the 2021 Agreement Between the International Union 5 of Operating Engineers Local 49 AFL-CIO Representing the St. Anthony Public Works 6 Department Employees and the City of St. Anthony Village. 7 8 Motion carried 5-0. 9 10 E. Resolution 20-072; a Resolution Authorizing DDA Human Resources, Inc. to Assist in 11 the City Manager Search. 12 13 Interim City Manager Yunker reviewed the resolution with the Council. 14 15 Mayor Stille indicated it was the consensus of Council to choose DDA Human Resources, Inc. 16 He noted the Council did talk to them and received answers to questions. The thing he was most 17 interested in is how much the firm knew about St. Anthony and Liza, the recruiter knew St. 18 Anthony very well which is very helpful. Another reason he liked the firm is because it is more 19 local and smaller. 20 21 Councilmember Jenson explained one thing that came out very clear to him during the interview 22 is that the firm has a very diverse group of organizations that they will go out and pursue 23 candidates and will give St. Anthony a good, qualified group of candidates to review. 24 25 Motion by Councilmember Jenson, seconded by Councilmember Randle, to approve Resolution 26 20-072; a Resolution Authorizing DDA Human Resources, Inc. to assist in the City Manager 27 Search. 28 29 Motion carried 5-0. 30 31 VII. REPORTS FROM CITY MANAGER AND COUNCIL MEMBERS. 32 33 Councilmember Randle stated Saturday, September 13, 2020 was the City’s annual clean-up day 34 and it was a good turn out but not nearly as many people as the first time he did the event. On 35 Sunday, September 14, 2020 he visited the Sister Cities Retreat and on Monday, September 15, 36 2020 he attended the Council Worksession. 37 38 Councilmember Walker stated he attended the North Suburban Communications Commission 39 meeting on Thursday, September 11, 2020. CTV will soon be changed to Nine North to 40 represent all of the municipalities. CTV and the North Suburban Communications Commission 41 have worked with developers to make improvements in the security and capabilities and the next 42 goal is to bring this product to market to sell to other cities outside of the GTA. He explained 43 along with CTV, in October there will be a paneled discussion entitled “Africans and African 44 Americans-A Family Reunion”. He reviewed what the discussion will entail. 45 46 4 City Council Regular Meeting Minutes September 22, 2020 Page 5 Councilmember Jenson stated on September 11, 2020 he attended the Ramsey County Local 1 League of Governments and Board of Directors meeting. He explained he was also a member of 2 Metro Cities and Governor Walz announced the Blue-Ribbon Committee to study the Met 3 Council structure and operations. He reviewed the ad hock/race equity committee policy 4 statement that Metro Cities prepared. He noted he also attended the City Council Worksession 5 and Coffee with the Council on September 19, 2020. 6 7 Mayor Stille stated he attended clean-up day as well. On September 14, 2020 he attended the 8 Regional Council of Mayors. He reviewed the Qantas meeting he attended and the topic. He 9 noted he also attended Coffee with the Council with Councilmember Jenson. 10 11 VIII. COMMUNITY FORUM. 12 13 Mayor Stille invited residents to come forward at this time and address the Council on items that 14 are not on the regular agenda. 15 16 Hearing none, Mayor Stille moved forward with the agenda. 17 18 IX. INFORMATION AND ANNOUNCEMENTS. 19 20 Mayor Stille thanked CJ for his three years working behind the scenes for the City meetings and 21 wished him well. CJ stated it has been a pleasure serving the City Council and the City. 22 23 Mayor Still stated the Silverwood Visitor Center has reopened and the hours are 9:00am to 24 5:00pm Friday, Saturday, Sunday, and Tuesday’s. 25 26 Councilmember Webster reminded the community to sign up to host a block party for Nite to 27 Unite on October 6, 2020. 28 29 X. The current contract with Hennepin County expires on July 31, 2020. Attached is a new redlined Assessment Agreement from Hennepin County for the years 2021 – 2024 for your review. Changes to the contract were requested by Hennepin County and are being made in all their contracts for assessment services. The changes were reviewed by staff, and consider them reasonable. 13 THIS PAGE LEFT INTENTIONALLY BLANK 14 Contract No. A20XXXX AGREEMENT THIS AGREEMENT, Made and entered into by and between the COUNTY OF HENNEPIN, a political subdivision of the State of Minnesota, hereinafter referred to as the "COUNTY", and the CITY OF “ST ANTHONY”, a political subdivision of the State of Minnesota, hereinafter referred to as "CITY"; WHEREAS, said CITY lies partially within the COUNTY OF HENNEPIN and constitutes a separate assessment district; and WHEREAS, under such circumstances, the provisions of Minnesota Statutes, Section 273.072 and Minnesota Statutes, Section 471.59 permit the County Assessor to provide for the assessment of property; and WHEREAS, said CITY desires the COUNTY to perform certain assessments on behalf of said CITY; and WHEREAS, the COUNTY is willing to cooperate with said CITY by completing the assessment in a proper manner; NOW, THEREFORE, in consideration of the mutual covenants contained herein, it is agreed as follows: 1. The COUNTY shall perform the 2021, 2022, 2023, and 2024 property assessment for the CITY OF ST ANTHONY in accordance with property assessment procedures and practices established and observed by the COUNTY, the validity and reasonableness of which are hereby acknowledged and approved by the CITY. Any such practices and procedures may be changed from time to time, by the COUNTY in its sole judgment, when good and efficient assessment procedures so require. The property assessment by the COUNTY shall be composed of those assessment services 15 (2) which are set forth in Exhibit A, attached hereto and made a part hereof by this reference, provided that the time frames set forth therein shall be considered to be approximate only. 2. All information, records, data, reports, etc. necessary to allow the COUNTY to carry out its herein responsibilities shall be furnished to the COUNTY without charge by the CITY, and the CITY agrees to cooperate in good faith with the COUNTY in carrying out the work under this Agreement. 3. The CITY agrees to furnish, without charge, secured office space needed by the COUNTY at appropriate places in the CITY's offices. The keys thereto shall be provided to the COUNTY. Such office space shall be sufficient in size to accommodate reasonably two (2) appraisers and any furniture placed therein. The office space shall be available for the COUNTY's use at any and all times during typical business hours, and during all such hours the COUNTY shall be provided with levels of heat, air conditioning and ventilation as are appropriate for the seasons. 4. The CITY also agrees to provide appropriate desk and office furniture as necessary, clerical and secretarial support necessary and reasonable for the carrying out of the work herein, necessary office supplies and equipment, copying machines and fax machines and their respective supplies, and telephone and internet service to the COUNTY, all without charge to the COUNTY. 5. It shall be the responsibility of the CITY to have available at the CITY's offices, or via telephone or teleconference, a person who has the knowledge and skill to be able to answer routine questions pertaining to homesteads and property assessment matters. and to receive, evaluate and organize homestead applications. The CITY shall store all homestead applications and homestead data in secure storage meeting the 16 (3) requirements set by the COUNTY. It shall also be the responsibility of the CITY to promptly refer any homestead application which needs investigation to the COUNTY. 6. In accordance with Hennepin County Affirmative Action Policy and the County Commissioners' policies against discrimination, no person shall be excluded from full employment rights or participation in or the benefits of any program, service or activity on the grounds of race, color, creed, religion, age, sex, disability, marital status, sexual orientation, public assistance status, ex-offender status or national origin; and no person who is protected by applicable Federal or State laws, rules and regulations against discrimination shall be otherwise subjected to discrimination. 7. It is agreed that nothing herein contained is intended or should be construed in any manner as creating or establishing the relationship of joint venturers or co-partners between the parties hereto or as constituting the CITY as the agent, representative or employee of the COUNTY for any purpose or in any manner whatsoever. Any and all personnel of CITY or other persons, while engaged in the performance of any activity under this Agreement, shall have no contractual relationship with the COUNTY and shall not be considered employees of the COUNTY and any and all claims that may or might arise under the Workers' Compensation Act of the State of Minnesota on behalf of said personnel or other persons while so engaged, and any and all claims whatsoever on behalf of any such person or personnel arising out of employment or alleged employment including, without limitation, claims of discrimination against the CITY, its officers, agents, CITY or employees shall in no way be the responsibility of the COUNTY, and CITY shall defend, indemnify and hold the COUNTY, its officials, officers, agents, employees and duly authorized volunteers harmless from any and all such claims regardless of any determination of any pertinent tribunal, 17 (4) agency, board, commission or court. Such personnel or other persons shall not require nor be entitled to any compensation, rights or benefits of any kind whatsoever from the COUNTY, including, without limitation, tenure rights, medical and hospital care, sick and vacation leave, Workers' Compensation, Re-employment Compensation, disability, severance pay and retirement benefits. 8. CITY agrees that it will defend, indemnify and hold the COUNTY, its elected officials, officers, agents, employees and duly authorized volunteers harmless from any and all liability (statutory or otherwise) claims, suits, damages, judgments, interest, costs or expenses (including reasonable attorney’s fees, witness fees and disbursements incurred in the defense thereof) resulting from or caused by the negligent or intentional acts or omissions of the CITY, its officers, agents, contractors, employees or duly authorized volunteers in the performance of the responsibilities provided by this Agreement. The CITY’s liability shall be governed by Minn. Stat. Chapter 466 and other applicable law, rule and regulation, including common law. 9. COUNTY agrees that it will defend, indemnify and hold the CITY, its elected officials, officers, agents, employees and duly authorized volunteers harmless from any and all liability (statutory or otherwise) claims, suits, damages, judgments, interest, costs or expenses (including reasonable attorney’s fees, witness fees and disbursements incurred in the defense thereof) resulting from or caused by the negligent or intentional acts or omissions of the COUNTY, its officers, agents, contractors, employees or duly authorized volunteers in the performance of the responsibilities provided by this Agreement. The COUNTY’s liability shall be governed by Minn. Stat. Chapter 466 and other applicable law, rule and regulation, including common law. 18 (5) 10. The COUNTY shall endeavor to perform all services called for herein in an efficient manner. The sole and exclusive remedy for any breach of this Agreement by the COUNTY and for COUNTY's liability of any kind whatsoever, including but not limited to liability arising out of, resulting from or in any manner related to contract, tort, warranty, statute or otherwise, shall be limited to correcting diligently any deficiency in said services as is reasonably possible under the pertinent circumstances. 11. Neither party hereto shall be deemed to be in default of any provision of this Agreement, or for delay or failure in performance, resulting from causes beyond the reasonable control of such party, which causes shall include, but are not limited to, acts of God, labor disputes, acts of civil or military authority, fire, civil disturbance, changes in laws, ordinances or regulations which materially affect the provisions hereof, or any other causes beyond the parties' reasonable control. 12. This Agreement shall commence on August 1, 2020 and shall terminate on July 31, 2024. Either party may initiate an extension of this Agreement for a term of four (4) years by giving the other written notice of its intent to so extend prior to March 1, 2024. If the party who receives said notice of intent to extend gives written notice to the other party of its desire not to extend prior to, April 15, 2024 this Agreement shall terminate on July 31, 2024. Nothing herein shall preclude the parties, prior to the end of this Agreement, from agreeing to extend this contract for a term of four (4) years. Any extended term hereof shall be on the same terms and conditions set forth herein and shall commence on August 1, 2024. Either party may terminate this Agreement for "just cause", as defined herein. determined by the Commissioner of Revenue after hearing for such a determination is held by the Commissioner of Revenue and which has been attended by representatives of COUNTY and 19 (6) CITY or which said representatives had a reasonable opportunity to attend, provided that after such determination, any party desiring to cancel this Agreement may do so by giving the other party no less than 120 days' written notice. If the CITY should cancel this Agreement, as above provided, before the completion of the then current property assessment by the COUNTY, the CITY agrees to defend and hold the COUNTY, its officials, officers, agents, employees and duly authorized volunteers harmless from any liability that might ensue as a result of the non-completion of a property tax assessment. For the purpose of this Agreement, the term "just cause" shall mean the failure of any party hereto reasonably to perform a material responsibility arising hereunder. 13.A. In consideration of said assessment services, the CITY agrees to pay the COUNTY the sum of Seventy One Thousand Dollars ($71,000) for each assessment, provided that any payment for the current year’s assessment may be increased or decreased by that amount which exceeds or is less than the COUNTY's estimated cost of appraising new construction and new parcels for the current year’s assessment. The amount of any increase or decrease shall be specified in the billing for the current year’s assessment. 13.B. Regarding each assessment, in addition to being subject to adjustment in the above manner, said assessment cost of $71,000 may also be increased by the COUNTY if: (1) The COUNTY determines that any cost to the COUNTY in carrying out any aspect of this Agreement has increased, including but not limited to the following types of costs: new construction and new parcel appraisals, mileage, postage, supplies, labor (including fringe benefits) and other types of costs, whether similar or dissimilar; and/or 2) The COUNTY reasonably determines that other costs should be included in the costs of assessment work. 20 (7) If the COUNTY desires to increase the assessment cost pursuant to this paragraph 13(B), it shall give written notice thereof by June 15 of any year and such increase shall apply to the assessment for the calendar year next following the current calendar year. Any such notification shall specifically set forth the amount of any new construction and new parcel appraisal charges. Notwithstanding any provisions herein to the contrary, if any such increase, exclusive of any charge for the estimated costs of new construction and new parcel appraisals, exceeds seven and one half percent (7.5%) of the amount charged for the assessment for the then current calendar year, exclusive of any charge for the estimated costs of new construction and new parcel appraisals, the CITY may cancel this Agreement by giving to the COUNTY written notice thereof, provided that said cancellation notice must be received by the COUNTY not later than July 24 of the then current calendar year and said cancellation shall be effective no earlier than five (5) days after the receipt of said notice by the COUNTY and not later than July 31 of said next calendar year. Supportive records of the cost increase will be open to inspection by the CITY at such times as are mutually agreed upon by the COUNTY and CITY. Failure of the COUNTY to give the CITY a price-change notice by June 15 shall not preclude the COUNTY from giving CITY such notice after said date but prior to August September 1 of any year, provided that if such price increase exceeds said ten (10%) - all as above set forth - the CITY may cancel this Agreement if the COUNTY receives notice thereof not later than thirty-nine (39) days from the date of receipt by the CITY of any said late price-change notice, provided further that any such cancellation shall be effective not earlier than five (5) days after COUNTY's receipt of said cancellation notice and not later than forty-six (46) days after the CITY's receipt of any said price-increase notice. 21 (8) Payment for each assessment shall be made in the following manner: Any bill from the COUNTY for the current year’s assessment which is received by the CITY before August 18 of the current year shall be due on September 7 1 of said year, provided that the CITY may elect to pay said bill before said date. Any bill received by the city after August 18 shall be due no later than twenty-one (21) thirty (30) days after the CITY’s receipt thereof. The COUNTY may bill the CITY after the aforesaid dates and in each such case, the CITY shall pay such bill within thirty (30) days after receipt thereof. 14. Any notice delivered by hand shall be deemed received upon actual delivery. 15. It is expressly understood that the obligations of the CITY under Paragraphs 7, 8, 12, and 13 hereof and the obligations of the CITY which, by their sense and context, are intended to survive the performance thereof by the CITY, shall so survive the completion of performance, termination or cancellation of this Agreement. Adjust estimated market values on those properties not physically inspected as deemed necessary per sales ratio analysis. 4. Prepare the initial assessment roll. 5. Print and mail valuation notices. 6. Respond to taxpayers regarding assessment or appraisal problems or inquiries. 7. Conduct valuation reviews prior to Board of Review or Open Book Meetings, as determined by the City – approximate dates: March through May 15. 8. Attend Board of Review or conduct Open Book Meeting. All permanent freestanding ground signs shall have self- supporting structures erected on and permanently attached to concrete foundations. The base of Dynamic Display signs must maximize the use of natural materials, such as stone, brick, rock or similar decorative material, in construction and should conform to the material design of the principal structure. In addition to these requirements, there are several operational requirements which are designed to prohibit the impression of video, movement, flashing, scrolling, or similar perceptions of motion. The image must be static for the full 5 seconds (or more). The applicants and owner should be sure to familiarize themselves with the operational requirements, as compliance with these requirements will be a component of the Conditional Use Permit. The proposed sign meets the dimensional and locational requirements of the code. While the image presented as a part of the application shows a graphic that the code would not allow, this appears to be for illustrative purposes, and the sign may be allowed under the CUP, with the notations identified in the code and as summarized above. It should be noted that the base of the structure is shown as a metal panel material. The code requires that the base be constructed of natural materials that complement the principal structure. The principal structure exterior consists of grey ribbed concrete tip-up panels. A grey stone or brick on the ground sign base would comply with the requirements of the code. In summary, the proposed sign appears to meet the requirements of the relevant Zoning and Sign Ordinance requirements, with the following conditions: 1. Verification of the setback – at least 15 feet from the curb line of 29th Avenue NE. 2. Exterior base materials changed to add natural materials as required in the code, and as noted in this report. 3. Compliance with the operational standards of the code in Section 155.29, notably the requirements for a static, monochrome message of at least 5 seconds duration, and other related requirements. 2. Applicable Code Sections. Title XV Land Usage, Chapter 152 Zoning Code, Section 152.253 establishes the process and findings required for consideration of Conditional Use Permits. Title XV Land Usage, Chapter 155 Sign Code, Section §152.29 Dynamic Displays regulates the construction and use of electronic dynamic display signs by Conditional Use Permit, and sets the various performance standards applicable to such signs. PLANNING COMMISSION RECOMMENDATION Planning Commission reviewed the request at its September 15, 2020 regular meeting. Following a public hearing (there was no one who spoke at the hearing), the Commission discussed the project and issues. The Commission asked questions related to the location of the sign, noting that it would appear to meet the required setbacks, and that the prior sign (shown in one of the example photos provided by the applicant) was no longer located on the property. That sign was removed during the road and trail construction along the north side of the building. After discussion, the Commission moved to approve the request with the staff conditions, passing the motion unanimously. 45 October 13, 2020 Page 4 CONCLUSION Staff and Planning Commission recommend approval of the requested Conditional Use Permit for an electronic dynamic display sign at 2827 Anthony Lane with the following conditions: 1.
