This item will 41 come before Council on October 13, 2020. She asked for a volunteer from the Commission to 42 present this item to the City Council. Commissioner Neumann stated she would volunteer to 43 present. 44 45 Chairperson Westrick opened the public hearing at 7:17 p.m. 46 Planning Commission Regular Meeting Minutes September 15, 2020 Page 3 1 City Planner Grittman reviewed the request for a Conditional Use Permit to allow for a 2 Dynamic Display Electronic Sign at the property located at 2827 Anthony Lane. 3 4 Mr. O’Brien, CEO B&F Fastener Supply, addressed the Commission. 5 6 No one was present or online to ask the applicant questions. 7 8 Chairperson Westrick closed the public hearing at 7:26 p.m. 9 10 Commissioner Neumann stated with this particular application usually they have a nice 11 PowerPoint up on the screen. She asked if she was missing something with the PowerPoint 12 not being on the screen with the pictures and locations for the people at home in order to see 13 what is being discussed. Mr. Grittman apologized and indicated it was in the Commission 14 packet, but staff was not able to get it on the screen. 15 16 Commissioner Neumann asked what street the sign is supposed to go on. She explained she 17 saw the picture of the sign in the packet. Mr. Grittman explained it was 29th Avenue, aka 18 County Road C where it extends into Ramsey County to the East. Commissioner Neumann 19 asked what is in that area of St. Anthony. Mr. Grittman explained there are industrial 20 buildings to the South and to the North of 29th Avenue. Commissioner Neumann asked what 21 type of businesses. Mr. Grittman explained as the applicant indicated, theirs is an industrial 22 supply company and there are a variety of manufacturers with some small warehouses and 23 different types of businesses like that. 24 25 Commissioner Neumann asked if she was to understand that in one of these pictures here, that 26 no one can reference because there is no PowerPoint up on the main screen, this fastener 27 supply sign is already out there or is this the sign the company currently has that will be 28 replaced. Mr. Grittman explained the sign that was shown in the packet of materials that 29 would have been the PowerPoint, is the proposed sign. 30 31 Commissioner Neumann stated there is a proposed sign and then another one that does not 32 look like the proposed sign with a man, the white sign. Mr. Grittman thought Commissioner 33 Neumann was referencing a photograph that the applicant included in their application, which 34 was a Google Earth photograph showing a street view with the old sign. 35 36 Commissioner Neumann asked if there is a sign at the location right now. Mr. Grittman 37 explained the sign was pulled up as a result of the road and trailway construction along that 38 area, with the expectation that the applicant would eventually come forward with a new sign. 39 40 Commissioner Neumann asked what year the sign was pulled up. Mr. Grittman stated this 41 happened within the last twelve months or less. Commissioner Neumann asked if the 42 applicant was going to replace the old sign with a new sign that was brighter and nicer in the 43 exact same spot. Mr. Grittman stated the new sign would not be in the exact same spot. It 44 would be farther away because along the street, the trailway extends across the front portion 45 Planning Commission Regular Meeting Minutes September 15, 2020 Page 4 of the applicant’s grass area. As a result, the previous sign was removed and the new sign will 1 be moved farther away from the roadway. 2 3 Commissioner Neumann asked if there would be an issue with the lighting. Mr. Grittman 4 explained there are some requirements in the Code which need to meet as with any other 5 signage. Commissioner Neumann stated she was asking if the applicant was meeting the 6 Code. Mr. Grittman stated that was correct. 7 8 Commissioner Rude stated there was talk about some brightness or illumes leaving the 9 property. He asked if the City does not have anything in place that controls the brightness of 10 signs right now. Mr. Grittman stated he would have to look at the specific section of the Code 11 to confirm that. Commissioner Rude explained his concern, especially with signs near the 12 road or near residential areas, has been with illumes leaving the property. He stated he was 13 surprised the City has not adopted anything yet regarding this and wondered if the 14 Commission could put something in place on this sign. Commissioner Rude explained doing 15 that would make this sign compliant with what the City is working to accomplish. 16 17 Commissioner Neumann stated she liked that. Commissioner Rude stated most communities 18 have that regulation and he thought St. Anthony Village should have that too. Mr. Grittman 19 noted he would check into this a little further and bring it back to the Commission as a 20 discussion item at the next meeting. 21 22 Commissioner Rude asked if the motion should be amended to include this as a condition of 23 the recommendation going forward to the City Council. Mr. Grittman stated he did find a 24 reference in City Code regarding this and there is a brightness requirement. He referenced the 25 Code as 155.29, Section O, and read the requirement to the Commission. 26 27 Commissioner Erickson asked Mr. O’Brien for clarification on the setback of the sign. Mr. 28 O’Brien explained he has not met with the contractor but if the City has a requirement for this, 29 he will make sure it is met. He explained the sign is going to be moved closer to the building. 30 31 Mr. Grittman explained he talked to the sign contractor who did not have a specific proposed 32 dimension but the photograph of the area showed it is expected to be approximately twenty-33 five feet, based on his measurements from what was submitted but this needed to be 34 confirmed. 35 36 Planning Commission Regular Meeting Minutes September 15, 2020 Page 5 Commissioner Erickson asked if the applicant would also be able to change the materials to be 1 compliant, such as natural stone or some sort of natural material. Mr. O’Brien explained they 2 will do a landscaping drawing on that. 3 4 Commissioner Neumann asked how long the applicant has been at the property and what type 5 of business is this. She stated she knew it was a manufacturing business but for the public 6 who do not have a dictionary and are not in manufacturing, could Mr. O’Brien say a little bit 7 more on the record about what the company does, what the company offers specifically to the 8 St. Anthony community, or if his company is just one of the City’s business consumers that is 9 here as well. Mr. O’Brien reviewed the history of his company and indicated the business 10 was started in 1988. 11 12 Commissioner Neumann asked what kind of programs the company has in St. Anthony. Mr. 13 O’Brien stated in this particular location they have hosted “Feed My Starving Children” and 14 the employees volunteer for different things and help out the community. 15 16 Motion by Commissioner Neumann, seconded by Commissioner Morita, to recommend that 17 the City Council approve the requested Conditional Use Permit for an electronic dynamic 18 display sign at 2827 Anthony Lane, with the conditions as detailed in the staff report. 19 20 Motion carried 5-0. 21 22 IV. STAFF REPORTS. 23 24 City Planner Grittman updated the Commission on the Interstate Development PUD 25 Development. He indicated prior to the City Council meeting the applicant requested to be 26 removed from the Council agenda based on some issues related to their concerns over being 27 able to affordably construct the project as anticipated. The Company is continuing to work on 28 options, and this may be back in front of the Council before Thanksgiving, if it does come 29 back. 30 31 V. OTHER BUSINESS. 32 33 City Planner Grittman stated there was a question earlier in the meeting about the disposition 34 of the Planning Commission’s consideration of Temporary Sign regulations. He indicated at 35 this time, staff is pursuing a delay in the discussion of temporary signs until the COVID 36 Pandemic has passed, and it can then be brought to the Commission for further discussion 37 after that time. 38 39 VI. BACKGROUND AND STAFF RECOMMENDATION The applicant is proposing to construct a new Based on a review of the proposed, Planning Staff recommends approval of the CUP request, with conditions related to compliance with code requirements applicable to. GENERAL INFORMATION Applicant: Boulevard Autoworks Owner: Boulevard Autoworks Location: 2801 Kenzie Terrace Existing Land Use / Zoning: Vacant / Zoned: C, Commercial Surrounding Land North: Single Family / Zoned: R-1 – Single Family Residential Use / Zoning: East: Commercial / Zoned: C – Commercial South: Commercial / Zoned: C – Commercial West: Multi Family Residential/ Zoned: PUD – Planned Unit Development Deadline for Agency Complete Application Date: 11-17-20 Action: 60 Days: 1-16-20 Letter Sent: No 120 Days: 3-17-20 December 15, 2020 Page 2 ANALYSIS 1. Background The applicant proposes to construct a car wash facility with a series of outdoor vacuum stations on the subject property, a current vacant parcel along Kenzie Terrace, just west of their current automobile service business. The subject property has been used as overflow parking, with limited pavement, but no buildings or other formal principal use. The proposed car wash building would be located toward the north/middle portion of the property, utilizing the middle of three existing curb cuts to Kenzie Terrace. The other two curb cut access points would be closed. Traffic is designed to enter the site and circulate counter-clockwise around the building to the entrance at the west end, exiting the building to the east, with access to a series of one-way driveways that provide access to outdoor vacuum stations on the south side of the building. The site plan also provides 6 additional parking stalls on the site in two separate bays. Automobile Service and Car Washes are both listed as Conditional Uses in the C, Commercial zoning district. (Sections 152.122 D. and F.). The zoning ordinance provides a series of setback requirements as follows: Front Yard (from street right of way): 35 feet Side Yard: 10 feet Rear Yard: 25 feet to an alley The zoning ordinance imposes an additional setback requirement in Commercial zoning districts adjacent to Residential zoning districts, which provides: Setbacks from residential districts. There December 15, 2020 Page 3 must be a setback area of not less than 20 feet from any property in a residential district within which setback area parking, storage, and/or loading facilities are excluded. The proposed site plan appears to meet these minimum standards. In addition to the minimums, however, a Conditional Use Permit is subject to the following requirements to qualify for City approval, a specific in Section 152. : (1) The use is one of the conditional uses specifically listed for the district in which the property is located; (2) The City Council has specified all conditions which the City Council deems necessary to make the use compatible with other uses in the area; (3) The use will not be detrimental to the health, safety, or general welfare of persons residing or working in the vicinity or to the values of property in the vicinity; and (4) The use will provide a service or a facility which is in the interest of public convenience and will contribute to the general welfare. As such, the standard of review is heightened by measuring how a particular use will impact both the public and the neighboring land uses. In addition to these review criteria, it must be noted that in Minnesota, courts have ruled that Conditional Uses are presumed to be allowed in the zoning district in which they are proposed, but that there are special aspects of the use that require attention and perhaps, mitigation, to ensure that they are consistent with the requirements and intent of the City’s zoning regulations and Comprehensive Plan. That is, there is a presumption that the use is allowed on properly zoned land – the question is whether the impacts of the use can or cannot be mitigated to a reasonable level expected of other permitted uses in the district. Therefore, the review of this use must consider how a typically permitted commercial use would impact the area, and if there are special aspects of this use that require alteration or other attention. For the Commercial zoning district, common commercial uses include retail and office facilities, as well as most commercial service businesses, although many services are also required to obtain Conditional Use Permits. Outdoor commercial uses are not listed as permitted uses in the district. For a car wash, there are some extraordinary aspects that require particular attention, over and above the common commercial use impacts. The most notable are headlight glare from vehicles sitting in stacking lanes, and noise from two sources – the exit dryer location, and the proposed exterior vacuum stations shown on the site plan. To mitigate these issues, staff has proposed some specific additions and changes to the site plan designed to moderate these impacts. As noted above, it is not reasonable to require the elimination of all impacts of commercial activity on the property. However, these recommended changes are intended to address those additional impacts of the proposed use. 1. Revise the plan to shift the facility and westerly egress lane at least 5 feet to the east (see next note). 2. In this additional setback space, plant a continuous row of Spruce trees no greater than 15 feet on center, to create and grow a buffer between the access aisle and the adjoining multi-family residential building. Due to the proposed grade and retaining wall, a wider space (and thus, greater shift) may be necessary to accommodate this planting. 3. Add larger evergreen trees to the northwest corner of the site to moderate impacts of headlights in the stacking lane. 4. Reorient the parking/access lanes in the front area to 90 degree parking angles, and eliminate the one-way circulation patterns that add unnecessary pavement. December 15, 2020 Page 4 5. Add a solid fence line along the north boundary/alley to create a buffer between the commercial activity and the single family neighborhood to the north, and add landscaping in that space to enhance the visual aesthetic and reinforce the buffer. 6. Add larger evergreen stock in the northeast portion of the stacking lane area to screen headlights from the single family properties. 7. Add a permanent canopy cover and solid side-walls to the vacuum area to buffer noise from this area and direct any noise to the south towards Kenzie Terrace, to mitigate noise impacts on the adjoining multi-family building. As noted above, there is no provision for outdoor commercial uses in the zoning ordinance, and a permanent canopy would avoid this conflict. 8. Reduce parking lot light pole height to no more than 20 feet, and ensure full cut-off hooded fixtures to reduce light spillage onto adjoining property. 9. Specify hooded, downcast wall lighting on the building to avoid any light-source glare. 10. Compliance with the requirements of the City Engineer with regard to engineering and construction, including utilities, stormwater, and street improvements. These recommendations are illustrated, in part, as follows: Without these additions to the proposal, staff could not recommend approval of the proposed Conditional Use Permit. However, if these changes are made, staff believes that the use would meet the expectations for the impacts of commercial land uses, minimizing those as necessary to be reasonably compatible with the surrounding area. 2. Applicable Code Sections. Title XV Land Usage, Chapter 152 Zoning Code, Section §152.253 establishes the process and findings required for consideration of Conditional Use Permits. December 15, 2020 Page 5 Title XV Land Usage, Chapter 152 Zoning Code, Section §152.122 identifies the allowable Conditional Uses in a C, Commercial zoning district. Title XV Land Usage, Chapter 152 Zoning Code, Section §152.124 and 125 identify the performance standards application to uses in the C, Commercial zoning district. CONCLUSION Staff recommends approval of the requested Conditional Use Permit for a car wash facility at 2701 Kenzie Terrace, only with the following conditions: 1. Revise the plan to shift the facility and westerly egress lane at least 5 feet to the east (see next note). 2. Motion to recommend denial of the CUP. In the event of a recommendation for denial, the Planning Commission must state its findings related for denial on the record. 3. Request Additional Information and Table Action. A motion to table should be accompanied by the specific information requested of staff or the developer necessary to make a recommendation. The property is located in an area of commercial land use on a major collector roadway. 2. The proposed use is identified as an allowed Conditional Use in the Commercial zoning district in which it is located. 3. The additional impacts of the proposed use are in need of mitigation as a requirement to meet the standards of the zoning ordinance, including compatibility with other uses in the neighborhood. 4. With the modification to the site plan, building design, landscaping, and other improvements identified as conditions recommended by the Planning Commission, the proposed improvements constitute a reasonable use of the property. 5. Without those recommended conditions, the use would be incompatible with the area and intent of the zoning ordinance regulating such uses. 6. The proposed ues, constructed and operated within the requirements of the Code and the conditions of this resolution, will not impact surrounding property or public areas beyond the expected impacts of permitted, compliant uses in the commercial zoning district. 7. NOW THEREFORE MAY IT BE RESOVLED, that the City Council of the City of St. Anthony Village accepts the findings and recommendations documented in the staff report and approves Conditional Use Permit for a car wash as shown on the plans submitted on or before November 17, 2020, at 2701 Kenzie Terrace, as revised in accordance with the following conditions: 1. Revise the plan to shift the facility and westerly egress lane at least 5 feet to the east (see next note). 2. In this additional setback space, plant a continuous row of Spruce trees no greater than 15 feet on center, to create and grow a buffer between the access aisle and the adjoining multi-family residential building. Due to the proposed grade and retaining wall, a wider space (and thus, greater shift) may be necessary to accommodate this planting. 3. Add larger evergreen trees to the northwest corner of the site to moderate impacts of headlights in the stacking lane. 4. Reorient the parking/access lanes in the front area to 90 degree parking angles, and eliminate the one-way circulation patterns that add unnecessary pavement. 5. Add a solid fence line along the north boundary/alley to create a buffer between the commercial activity and the single family neighborhood to the north, and add landscaping in that space to enhance the visual aesthetic and reinforce the buffer. 6. Add larger evergreen stock in the northeast portion of the stacking lane area to screen headlights from the single family properties. 7. Add a permanent canopy cover and solid side-walls to the vacuum area to buffer noise from this area and direct any noise to the south towards Kenzie Terrace, to mitigate noise impacts on the adjoining multi-family building. See rationale for request for postponement: • I believe fewer than half of the 25-30 homes at the Kenzington Condominiums most-affected by the subject of the proposed permit use even have the technology or ability to participate in Zoom meetings. Thus, it isn't really good-faith or equitable public access to a meeting to limit participation on this important item to only those who have access to Zoom. • While there is a different and separate hearing coming up - a December 8 public hearing (tomorrow) - I note that meeting is regarding a development that, once it's built, won't have actual and known constant disturbance of the quality of life for the specific owners of the 25-30 units instantly affected here at the Kenzington by the proposed project at 2701 Kenzie Terrace - not asking for postponement of the December 8 Zoom meeting. The specifically affected homeowners at The Kenzington need to be able to have fair and full access to the meeting that is the subject of the current December 15 notification. • This item is presumably an item on a monthly meeting agenda, but it is for a meeting just 10 days before Christmas, during a pandemic, and there is undue stress on all Minnesotans and the populace in general, this seems like a rush job to fluff over the subject matter of this mailed notice - doesn't feel fair. This item could be postponed per above rationale and the rest of the meeting agenda go forward. • The applicant for this item's conditional use permit should understand that postponement of this item would be a sign of good faith dealing with residents in the community, and is not requested with an adversarial intention at all. Hello, my name is Lee John Kurtz, and I reside at 2601 Kenzie Ter apt 109, the Kenzington Condominiums in St Anthony. I was deeply disturbed yesterday by a letter I received about a possible car wash being constructed at 2701 Kenzie Ter sometime in the future. My unit is one of the unlucky 25 that overlooks the property. I have talked to 3-4 of my neighbors and we are vehemently AGAINST this project! I'm sure NO ONE in their right mind would want a noisy car wash operating so close to their home. The fact that I work from 4:15 PM until 2:30 AM makes this even WORSE for me as I generally sleep from 4 AM until 11 or 11:30 AM during the work week. I see there is a ZOOM meeting scheduled about this in a week or so, but my work schedule and my non experience with Zoom ANYTHING, makes it a no go for me. I just want you all to know that, if necessary, I will rally the residents to at LEAST sign a petition against the possible car wash being built AND a boycott of Blvd Auto. A couple of the neighbors that I have talked to are 10 or more years OLDER than me (I am 60) and would enjoy the hell out of re- living their activities of the 1960's and fighting for a cause/protesting for the greater good (greater good being the residents of our building, and the 7 or 8 houses along 27 Ave NE that would also be affected by this project.) I'm sure there are available industrial use type properties somewhere in the area where a car wash can operate WITHOUT disturbing the lives of property tax paying citizens. Also, IF this car wash were to be allowed to operate on this property, I am SURE that our property values ( along with our property tax amounts) would take a tremendous turn downward. In my case, for example, I purchased my unit in 2017 with the full intention of selling it in June of 2025, to help finance my relocation to my native northern MN after my retirement. There as as many financial plans for the people living here as the number of people living here. Originally, I thought about sending an e-mail to Tom (?), the owner of Blvd Auto, to log my complaint, but reconsidered and decided to leave it to the people whose sworn oath is to protect the citizens of this city. I am neither a Democrat, or a Republican. I generally vote for the person who I think will do best at the job. Some of you I voted for, and others I did not. What I HAVE seen during the almost 4 years of living here, is that St Anthony is WAY better ran than Minneapolis, where I lived the majority of the 40 years since I relocated from Duluth in 1980. This is a simple quality of life issue. A car wash will SEVERELY deter the quality of life for quite a few people if built here. I can only speak for myself when I say that the farther along the plans for this proceed, the bigger the effort to stop it will be. I am BEGGING you to nip this in the bud BEFORE we have to spend the time and effort to fight this. I am ALL IN for this cause and consider myself to NOT be a "cause guy" at all normally.
