APPROVAL OF APRIL 27, 2021 CITY COUNCIL MEETING AGENDA. 25 26 Motion by Councilmember Webster, seconded by Councilmember Jenson, to approve the City 27 Council Meeting Agenda of April 27, 2021 as presented. 28 Motion carried 5-0. 29 30 II. PROCLAMATIONS AND RECOGNITIONS. 31 32 A. Presentation from NineNorth’s Executive Director. 33 34 Ms. Dana Healy, Executive Director of NineNorth provided a PowerPoint presentation review of 35 the value NineNorth brought to the City. NineNorth produces community focused digital media 36 to educate and engage. They have reduced their overhead expenses by 33%. The core services 37 include web streaming, virtual events, municipal meeting coverage, cable playback, video 38 production and social media. In 2020 services provided to St. Anthony included 3,238 Meeting 39 Views and 2,132 Landing Page Views; 40 City Meetings; 48 Web Stream Events; 728 Cable 40 Play Backs; Quarterly Report – COVID 19; and Social Media. Audience is built in four locations 41 Facebook, Instagram, LinkedIn and E-newsletter. Ms. Healy reviewed Zoom was ready and 42 operational for the City on April 14, 2020 since the first pandemic-related City Meeting 43 cancellation on March 17, 2020. When the pandemic hit, equipment was difficult to obtain. 44 NineNorth was able to outfit the City within the needed timeframe. Closed captioning 45 capabilities are being researched. They currently support nine metro cities. The staff has 136 46 years of expertise. NineNorth provides recommendations to the City to maintain the equipment 47 and replace as necessary. Moving forward the City should continue having a quarterly report and 48 1 neighborhood network events. The City Council is invited to be a guest on Cities Speak and 1 Council is invited to sign up for the Weekly E-Blast. 2 3 Mayor Stille thanked Ms. Healy for her presentation. The use of zoom meetings has become the 4 norm. Mayor Stille asked if other cities are handling meetings in the same hybrid method as St. 5 Anthony. Ms. Healy stated there are some that are completely zoom, hybrid and in-person 6 meetings. 7 8 Councilmember Webster thanked Ms. Healy and her team for their partnership with the City and 9 the creativity the team uses. 10 11 III. CONSENT AGENDA. 12 13 A. Approve April 13, 2021, Council meeting minutes. 14 B. Licenses and permits. 15 C. Claims. 16 17 Motion by Councilmember Webster, seconded by Councilmember Walker, to approve the 18 Consent Agenda items. 19 20 Motion carried 5-0. 21 22 IV. PUBLIC HEARING. 23 24 2021 Street and Utility Improvement Project 25 26 Mayor Stille stated the public hearing will cover all three of the resolutions, however each will 27 have a separate vote. 28 29 Mayor Stille opened the public hearing at 7:35 p.m. 30 31 City Engineer Justin Messner provided a power point presentation. The locations for the 32 Proposed Street & Utility Improvement Project are Skycroft Drive (32nd Avenue to 33rd Avenue) 33 and Croft Drive (32nd Avenue to 33rd Avenue. 34 35 The proposed Mill and Overlay Improvement Project locations are 31st Avenue (Rankin Road to 36 Old Hwy 8), Croft Drive (Rankin Road to 31st Avenue), 29th Avenue (Stinson Boulevard to 37 Silver Lake Road) and St. Anthony Boulevard (Stinson Boulevard to Kenzie Terrace). 38 39 The Proposed Sanitary Sewer Capacity Improvements are located at the Foss Road Lift Station. 40 These costs will not be assessed to the residents. This project is due to the needed capacity for 41 Silver Lake Village for the additional 400 units of residential. 42 43 Mr. Messner reviewed the common construction concerns being Tree Impacts, Turf and 44 Driveway Restoration, Driveway Access Maintained except during utility installation in front of 45 home, wet weather, curb and driveway paving, and parking on roadways not under construction. 46 2 Any residents who have not attended one of the three previous informational meetings can 1 contact Mr. Messner with questions. Some other common construction concerns are electric 2 vehicle needs, special needs/events, sprinkler systems/invisible fencing, mail/garbage service, 3 private utilities, temporary water service, driveway replacement and sump pump connections. 4 Mr. Messner reviewed each of the concerns in detail. 5 6 Additional information regarding street reconstruction projects for the City of St. Anthony, by 7 visiting the St. Anthony Village Reconstruction Process webpage located on the City’s website at 8 http://www.savmn.com. 9 10 Mr. Messner reviewed project funding along with the assessment policy for street reconstruction, 11 and the assessment policy for mill and overlay. Assessment process follows Minnesota Statute 12 Chapter 429 – Public Improvements. Written objection appeal must be presented in writing and 13 signed by the property owner prior to or at the hearing. Notice of appeal must be filed within 30 14 days after adoption of the assessment. The interest rate is set at the time of assessment 15 certification. Street reconstruction assessments can be paid over a 15-year period. Mill and 16 overlay assessments can be paid over a 10-year period. 17 18 Mr. Messner reviewed the Project Schedule in detail. The upcoming schedule dates are May 11, 19 2021 – Award of Bonds; Construction to begin May/June 2021; Substantial Completion 20 September 2021 with final paving in June 2022. 21 22 Councilmember Randle asked if a homeowner were to sell their property that was assessed, 23 would the new homeowner need be responsible to pay for that assessment. Mr. Messner stated 24 the assessment stays with the property and would be paid off by the seller during the property 25 sales process. 26 27 Mayor Stille stated this is a major shift in doing more to protect the assets we have already 28 reconstructed rather than full reconstruction of the infrastructure. It is important to pay off the 29 assessment by November 30. 30 31 Ms. Mary Sledz, 2712 29th Avenue, asked how the overlay was decided on 29th Avenue. Mr. 32 Messner explained the streets are visually inspected annually and the streets needing overlay are 33 determined. He noted that 29th Avenue was reconstructed in 1999 and that pavement is reaching 34 its useful life. Core samples have been taken of the pavement and some stresses have been seen. 35 Ms. Sledz suggested to help with further deterioration 29th Avenue, it should not be a major truck 36 route. Mr. Messner stated that street is a collector road and state aid road and is a suitable truck 37 route. 38 39 Mayor Stille closed the public hearing at 8:10 p.m. 40 41 A. Resolution 21-042; a Resolution Ordering Improvements for the 2021 Street and Utility 42 Improvements. 43 44 Motion by Councilmember Jenson, seconded by Councilmember Walker, to adopt Resolution 45 21-042; a Resolution Ordering Improvements for the 2021 Street and Utility Improvements. 46 3 1 Motion carried 5-0. 2 3 B. Resolution 21-043; a Resolution Adopting and Confirming Assessments for the 2021 4 Street and Utility Improvements. 5 6 Mayor Stille opened and closed the public hearing at 8:11 p.m. 7 8 Motion by Councilmember Webster, seconded by Councilmember Jenson, to adopt Resolution 9 21-043; a Resolution Adopting and Confirming Assessments for the 2021 Street and Utility 10 Improvements. 11 Motion carried 5-0. 12 13 C. Resolution 21-044; a Resolution Awarding a Bid for the 2021 Street and Utility 14 Improvements. 15 16 Mayor Stille opened the public hearing at 8:12 p.m. 17 18 Mr. Messner stated bids were opened for this project in February, 2021. Eleven competitive bids 19 were received which ranged between $1,896,823.85 to $2,443,550.46. All bids were verified and 20 the low bidder is Northwest Asphalt out of Shakopee, MN. 21 22 Mayor Stille closed the public hearing at 8:15 p.m. 23 24 Motion by Councilmember Webster, seconded by Councilmember Jenson, to adopt Resolution 25 21-044; a Resolution Awarding a Bid for the 2021 Street and Utility Improvements. 26 27 Motion carried 5-0. 28 29 Mayor Stille referred to the Star Tribune article of April 19, 2021 featuring WSB and their 30 training program focusing on bring women and people of color to the construction industry. 31 Mayor Stille gave a shout out to Brett. 32 33 D. Resolution 21-045; a Resolution authorizing issuance, awarding sale, prescribing the 34 form and details and providing for the payment of $3,100,000 General Obligation Street 35 Reconstruction Bonds Series 2021A. 36 37 Mayor Stille opened the public hearing at 8:20 p.m. 38 39 Mr. Keith Dahl, Ehlers and Associates, stated overall the sales today were phenomenal for the 40 sale of $2.97 million. This was reduced from $3.1 million due the premium received. These 41 bonds are being sold to fund the 2021 Street and Utility Improvements Projects as well as to 42 refund the 2013 B Series General Obligation Bonds. The refunding will save the City $118,000 43 over the next 8 years. On April 15, the Cities AA Rating with a Stable Outlook was noted. It is 44 recommended to approve the sale of the bond to Northland Securities Inc. since they were the 45 lowest bidder with true interest cost of 1.14% 46 4 1 Mayor Stille stated that is a great interest rate. 2 3 Mayor Stille closed the public hearing at 8:22 p.m. 4 5 Motion by Councilmember Webster, seconded by Councilmember Walker, to adopt Resolution 6 21-045; a Resolution Authorizing Issuance, Awarding Sale, Prescribing the Form and Details 7 and Providing for the Payment of $2,970,000 General Obligation Street Reconstruction Bonds 8 Series 2021A. 9 10 Motion carried 5-0. 11 12 V. REPORTS FROM COMMISSION AND STAFF – NONE. 13 14 VI. GENERAL BUSINESS OF COUNCIL. 15 16 A. Ordinance 2021-02; an Ordinance amending Chapter 152 or the St. Anthony city code, as 17 it relates to accessory buildings requirements, uses and definitions. 18 19 City Planner Grittman reviewed City Staff is proposing an amendment to the City’s Accessory 20 Building regulations that impact a series of current zoning ordinance sections, including changes 21 to the Zoning Ordinance Definitions (Section 152.08), and an overhaul of the Accessory 22 Buildings text (Section 152.176). 23 24 A public hearing was held at the Planning Commission meeting to invite public comment and 25 there was no public comment offered. The Planning Commission passed a recommendation to 26 adopt the amendments, with one change to the staff item receiving the majority of the discussion. 27 That change relates to the allowable size of a detached garage (or “Accessory Building-Major”) 28 on a single-family parcel. The existing ordinance includes conflicting requirements, which the 29 proposed amendment would resolve. As currently written in the Definitions section, a “Garage” 30 is allowed to be up to 1,000 square feet in floor area, while in the Accessory Building section of 31 the code, such garages are limited to 750 square feet or 80% of the floor area of the principal 32 building. Mr. Grittman provided the language changes in a power point presentation. A table 33 containing the setbacks, maximum square feet within different zones, and maximum height. 34 35 Staff recommends Council adopt the proposed zoning ordinance amendment related to 36 Accessory Buildings and Uses. 37 38 Councilmember Jenson asked if chicken coops fall under the smaller buildings. Mr. Grittman 39 stated a clause was included for pet enclosures that are less than 35sf. 40 41 Mayor Stille stated he feels the 1000sf is a little bold but doesn’t know where that would come 42 into play with setbacks and lot coverage. Mr. Grittman stated the Planning Commission made a 43 point that expanding an existing garage size would be better that outside storage of items that 44 should be stored in a garage. 45 46 5 Motion by Councilmember Jenson, seconded by Councilmember Webster, to adopt Ordinance 1 2021-02; an Ordinance Amending Chapter 152 or the St. Anthony City Code as it Relates to 2 Accessory Building Requirements, Uses and Definitions. 3 4 Motion carried 5-0. 5 6 B. Resolution 21-046 a resolution approving a summary publication of Ordinance 2021-02. 7 8 City Manager Yunker stated this is to allow the publication of the ordinance in a summary 9 format. 10 11 Motion by Councilmember Jenson, seconded by Councilmember Walker, to adopt Resolution 12 21-046; a Resolution Approving a Summary Publication of Ordinance 2021-02. 13 14 Motion carried 5-0. 15 16 C. Presentation of Body Worn Camera Audit. 17 18 Police Captain Jeff Spiess provided a report of the audit done by an outside auditor. State Statute 19 requires the findings of the audit be presented to the City Council. This Statute is relatively new. 20 The items audited include data classification as private, retention of data according to the data 21 retention schedule, access by data subjects, inventory of portable recording system technology, 22 use of agency-issued portable recording systems, authorization to access data and sharing among 23 agencies. MN State Statute 626.8473 applies to public comment and portable recording system 24 policy. 25 26 Captain Spiess reviewed the challenges and successes. The challenges have been relatively new 27 technology needed training, internal compliance checks, recordkeeping, funding, dissemination 28 of data, software and hardware and storage. The successes noted were collaboration, high 29 compliance rate, officer buy-in/community buy-in, transparency, SAPD National Model, 30 complaint resolution and case resolution. No discrepancies were noted by the auditor. 31 32 Councilmember Webster thanked Captain Spiess for his presentation and helping her understand 33 the dissemination of data and other points. She thanked the entire Police Department for the high 34 standards set and followed. 35 36 Councilmember Jenson noted St. Anthony was selected as a National Model when the audit was 37 performed. He asked if this is the first year for the audit and Captain Spiess said it was and is 38 required every two years. Councilmember Jenson asked if there are other certified audit firms 39 and Captain Spiess stated there are. 40 41 Councilmember Walker asked for clarification on the two conditions for transferring the data to 42 the public. He also asked if it is an automatic transfer or what is the timeframe. Captain Spiess 43 stated there could be parameters or parts be redacted if the film would be considered graphic or 44 difficult to watch. 45 46 6 Mayor Stille thanked Captain Spiess for his report and noted this has been a journey. He 1 congratulated the Police Department on the audit and how the staff has embraced this. 2 3 D. Resolution 21-047; a Resolution approving the special event permit for Prom hosted by 4 St. Anthony Village High School at the tennis courts May 15, 2021, 12:00 p.m. to 11:00 5 p.m. 6 7 City Manager Yunker reviewed the request for a special event permit for Prom. Mr. Justin 8 Sawyer stated they are excited with the opportunity to do this outdoors. Final details are being 9 planned. 10 11 Councilmember Webster asked if the idea came from a student. Mr. Sawyer stated the tennis 12 court came up based on its close proximity. 13 14 Councilmember Walker asked about the pods of students. His concern is it is a small space 15 outside the tennis courts. Mr. Sawyer stated they are working with Chief Mangseth on that issue. 16 Students will be required to wear masks in the outdoor space. Councilmember Walker stated it 17 is a very creative idea. 18 19 Mayor Stille asked about garbage and Mr. Sawyer stated they would bring out school 20 receptacles. They are meeting the State guidelines as to maximum persons in space created. 21 Food will be off City property if offered. Mayor Stille asked how insurance would be handled 22 and Mr. Yunker stated the school has more than adequate insurance. 23 24 Motion by Councilmember Jenson, seconded by Councilmember Walker, to adopt Resolution 25 21-047; a Resolution Approving the Use of the St. Anthony Tennis Courts for St. Anthony – 26 New Brighton School District 282 to Host Prom on May 15, 2021. 27 28 Motion carried 4-0-1(Webster abstained). 29 30 VII. REPORTS FROM CITY MANAGER AND COUNCIL MEMBERS. 31 32 City Manager Yunker announced Clean Up Day will be held on May 1, 2021. Residents should 33 sign up on the City’s website. 34 35 Councilmember Jenson stated on April 15 he attended Metro Cities Annual Meeting. He was 36 elected to another term on the Board of Directors. 37 38 Councilmember Webster stated in the past two weeks, she was invited to a meeting with a group 39 of residents who have an idea to make their neighborhood more inviting. She is looking forward 40 to Clean-Up Day. 41 42 Councilmember Randle had no report. 43 44 Councilmember Walker had no report. 45 46 7 Mayor Stille stated he attended the LMC Webinar titled Bridging Divides. 1 2 VIII. WHEREAS, the City Council of the City of St. Anthony hereby approves participation in the League of Minnesota Cities Insurance Trust (LMCIT) insurance program for the year 2021 through 2022; and WHEREAS, the City has elected to purchase excess coverage in the amount of $1,000,000.00.
