Resolution 21-049; a Resolution Ordering Preparation of Feasibility Report for 2022 3 Street and Utility Improvements. 4 5 Mayor Stille disclosed he lives on one of the streets in the project. The City Attorney advised 6 Mayor Stille that he is fine with voting on this, because it does not only include his street. None 7 of the Councilmembers had any issue with this. 8 9 City Engineer Justin Messner reviewed Council is requested to approve the resolution ordering 10 preparation of a Feasibility Report for 2022 Street and Utility Improvements. The method for 11 selection of projects was reviewed. 12 13 This project proposes the following locations for street and utility reconstruction: 14 • Rankin Road from 33rd Avenue NE to 31st Avenue NE 15 16 This project also proposes the following locations for bituminous mill and overlay: 17 • Crestview Drive from 29th Avenue NE to 31st Avenue NE 18 • Armour Terrace from Silver Lake Road to Crestview Drive 19 • Bell Lane from Armour Terrace to Crestview Drive 20 • East Gate Road from Crestview Drive to Rankin Road 21 • Coolidge Street Alley from Murray Avenue to 29th Avenue NE 22 • Murray Avenue/St. Anthony Boulevard Alley from Wilson Street to Coolidge Street 23 • 29th Avenue NE/St. Anthony Boulevard Alley bounded by 29th Avenue NE, Roosevelt 24 Street, St. Anthony Boulevard and Stinson Boulevard. 25 26 Mr. Messner reviewed each project in detail and indicated the location on a map. The project 27 schedule continues with Council Accepting Feasibility (August 24, 2021); 1st Public 28 Informational Meeting (September 2021); 2nd Public Informational Meeting (November 2021); 29 Council approving plans (December 2021); Open Bids/Compute Assessments (February 2022); 30 3rd Public Informational Meeting (March 2022); Public Hearing/Award Contract (April 2022); 31 Begin Construction (June 2022); Substantial Completion (September 2022); and Final Paving 32 (June 2023). 33 34 Additional information regarding street reconstruction projects for the City of St. Anthony, can 35 be found by visiting the “St. Anthony Village Reconstruction Process” webpage located under 36 the “Projects” tab on the City’s website at http://www.savmn.com. 37 38 Councilmember Webster thanked Mr. Messner for his overview. Councilmember Webster stated 39 a resident reached out to her asking if the alley between St. Anthony Boulevard and Murray was 40 scheduled to be fixed and she thanked Mr. Messner for providing that information. When the 41 project schedule is laid out, is this a WSB project schedule or is it a requirement since an 42 assessment is involved. Mr. Messner stated the Minnesota Statute Chapter 429 dictates 43 assessment policies which lays out the meetings required. 44 45 2 City Council Regular Meeting Minutes May 11, 2021 Page 3 Mayor Stille encouraged the residents to sign up for the push notifications. Mill and overlay is 1 generally done after a road is reconstructed for 20 years. This would give the road 40 years at 2 which time another mill and overlay can be done to extend the road life to 60 years before a 3 reconstruction is needed. 4 5 Motion by Councilmember Webster, seconded by Councilmember Jenson, to adopt Resolution 6 21-049; a Resolution Ordering Preparation of Feasibility Report for 2022 Street and Utility 7 Improvements. 8 9 Motion carried 5-0. 10 11 Mayor Stille asked for a 2021 Project Update from City Engineer Messner. Meetings are being 12 held with the contractor for a pre-construction meeting later this week. The construction should 13 begin in early June, based on previous discussions with the contractor. This project will progress 14 fairly quickly and should be completed by the end of July 2021. 15 16 Mayor Stille asked when the final lift would be put on the segment of road for the 2020 Project. 17 Mr. Messner stated the contractor was there last week and replaced any of the curb and gutter 18 and any new concrete that cracked over the winter. Looking at milling Silver Lane next week. 19 Within the next week or two the entire project should be completed. Mayor Stille noted grass in 20 many places looked really good. Mr. Messner stated if there are any bare spots the contractor 21 will reseed. The turf will be continually monitored and repaired as necessary. There is a two-22 year warranty on these projects. 23 24 VII. REPORTS FROM CITY MANAGER AND COUNCIL MEMBERS. 25 26 City Manager Yunker announced Jeremy Gumke will be the City’s new Public Works Director. 27 28 Councilmember Walker had nothing to report. 29 30 Councilmember Randle had nothing to report. 31 32 Councilmember Webster stated she participated in City Clean-Up along with the Mayor and 33 other Councilmembers. VillageFest is currently considering some options for the 2021 34 celebration. Chad Gillard is the Villager of the Year for 2021. Saturday, May 15 at 9am she 35 invited residents to join Councilmember Jenson and herself for Coffee with the Council. 36 37 Councilmember Jenson stated he attended the City Clean-Up Day. He also participated in the 38 Community Center COVID Vaccine Clinic last week as a greeter. 39 40 Mayor Stille stated on May 10, he attended the Regional Council of Mayor with 17 Mayors 41 attending. The speaker was from Alliance on Alliances. Earlier today, he attended the MWMO 42 Board Meeting. 43 44 VIII. The property is zoned R-1, Single Family Residential, and is surrounded by single family homes in all directions. The Applicants have provided a site plan of the property showing the location and dimensions of the chicken coop in relation to their property. The proposed location is along the side side wall of the detached shed in the rear yard. The applicants have indicated proposed materials as wood, painted to coordinate with the existing shed and adjoining garden wall. The coop is proposed to be just under 7 feet long by 3 feet wide, and approximately 4 feet in height. A hardware cloth enclosure would provide run area surrounding the coop. The shed, along with existing vegetation and topography on this and adjoining properties, would appear to obscure view of the structure from neighbors. It would appear that the proposed location is reasonably well situated, and should meet all setbacks, given the location of the existing home and other structures on the site plan. As noted, the applicants are requesting approval for three female chickens (hens). The City’s requirements specify that the chickens must all be hens, no male roosters permitted on the property to avoid noise concerns. The application indicates compliance with this condition. 11 Page 2 CITY CODE RELATED TO REQUEST Title IX General Regulations, Chapter 91 Animals, Section § 91.56 KEEPING OF CERTAIN ANIMALS states that “No person may keep swine, cattle, horses, goats, or more than 2 dogs or 3 dogs allowed under § 91.01 through 91.05 or fowl, within the city nearer than 500 feet to any human habitation or platted land, without approval of the City Council. The City Council may, before approving or denying any request for approval, request a report from the Health Officer concerning the effect on public health.” REQUESTED ACTION Staff has reviewed the request, and recommends approval of the request. 1. Motion to adopt a resolution approving the request to keep three female chickens on the property located at 3631 Belden Drive. A resolution reflecting approval is attached to this staff report. Alternate Motion 2. Motion to deny the request for chickens at 3631 Belden Drive, and direct staff to prepare a resolution declaring terms of the same. In the event the City Council chooses denial of the request, it should clearly state its reasons for the denial and direct staff to prepare a resolution based on said findings. The current use is a single family home. The property formerly contained a detached garage in the rear yard that was destroyed by fire. In reviewing the proposed rebuild, it was discovered that the property consists of two separate parcels of record, with the boundary line running through the original (and proposed rebuilt) garage location. Due to building code issues, the garage would not be able to meet building code requirements (or zoning setbacks) due to the lot line. To remedy the property condition, and accommodate a rebuild of the garage, the lots must be combined into a single parcel. Under the current certificate of title, the applicant has indicated that Hennepin County treats the property as a single parcel; however, the parcels are shown separately on the County’s website. This combination process is necessary to correct the problem and qualify the lot for building permit. As discussed in the Analysis below, planning staff believes that the tests for “reasonable use” and the exceptions to the full platting requirement are present to qualify the request for a minor subdivision. Staff recommends approval of the combination as proposed. Minor subdivisions may proceed directly to the City Council for consideration, without a requirement for Planning Commission review or public hearing. Background The applicant is proposing to combine two parcels that have worked as a single building site into one lot of record. The property is occupied by a single family home, and a concrete driveway and slab that formerly contained a two-car garage with upper floor space. That garage was destroyed by fire earlier this year. As noted above, the property consists of two separately described and platted parcels, which raises code issues for allowing the rebuild of the garage. As such, the applicant must formally combine the two parcels to eliminate the lot line, thereby accommodating the proposed garage location. 18 November 24, 2020 Page 3 A. Subdivision The Subdivision Ordinance provides for the following process: § 151.08 SUBDIVISION WITHOUT PLATTING. The City Council may waive compliance with the platting requirements of this subchapter and approve subdivision by conveyance of land by adoption of a resolution to that effect based upon findings by the City Council that: compliance with the platting requirements would create an unnecessary hardship or expense because of the nature of the subdivision, and failure to require the filing of a plat does not interfere with the purposes of this subchapter. The City Council may consider the number of parcels resulting from the subdivision, the complexity of the legal descriptions, the necessity for dedication of streets or drainage and utility casements, and the probability of future subdivision of the parcels. The proposed lot combination creates a single residential parcel, as noted previously. The survey identifies the location of the previous garage and concrete slab, which will serve as the location of the rebuilt structure. An aspect of the rebuild is that the garage appears to have been legally non-conforming due to inadequate setbacks from the side (just over 3 feet) and rear (less than 2 feet). The code requires 5 feet of setback. However, such nonconformities, if destroyed, may be reconstructed in their prior location provided the structure is not expanded, and the permitting is completed within a specific time period. The applicant has indicated that they will reconstruct the garage on the same location, but the structure will no longer be two stories in height. This is consistent with the requirements of the non-conformity regulations, and the survey provides evidence of that former location. 2. Representative Codes Referenced.
