A RESOLUTION DENYING A PROPOSED AMENDMENT TO THE
2040 COMPREHENSIVE PLAN FOR THE CITY OF ST. ANTHONY VILLAGE

WHEREAS, under Minnesota law, the City of St. Anthony Village is required to prepare
a comprehensive plan every ten years and the Metropolitan Council is enabled to act as
the reviewing authority for the City' s comprehensive plan; and
WHEREAS ,the City' s comprehensive plan guides land use which is the basis for
regulating zoning in the City; and
WHEREAS, the last update to the comprehensive plan was completed and adopted in
2020; and
WHEREAS, in the creation of the St. Anthony 2040 Comprehensive Plan a steering
committee made up of Planning Commission and City Council members met twelve
times and conducted an extensive and broad public engagement process; and
WHEREAS, the plan was designed to address topics of land use, housing, transportation,
sanitary sewer, water supply, sustainability, and plan implementation; and
WHEREAS, each of the plan components are integrated with the population and housing
projections reflected in the Land Use Plan; and
WHEREAS, changes to aspects of the Land Use Plan result in a cascading set of required
changes to other plan policies and chapters, and are likely to have impacts on other land
use designations in the community, setting off their own required changes; and
WHEREAS, at their final meeting on November 14, 2018, the Comprehensive Plan
Steering Committee by consensus directed staff to submit the St. Anthony 2040
Comprehensive Plan to the City Council for approval and submission to the Metropolitan
Council for formal action; and
WHEREAS, the City Council subsequently approval the draft for distribution in its
Resolution 18-078; and
WHEREAS, the draft Plan underwent thorough review and editing, including response to
comments from Metropolitan Council staff and neighboring jurisdictions; and
WHEREAS, the final version of the 2040 Comprehensive Plan was approved by the full
Metropolitan Council on April 22, 2020, in its Resolution 2020-91; and
WHEREAS, the Metropolitan Council found that the City's 2040 Plan meets all
Metropolitan Land Planning Act requirements; conforms to the regional system plans
including transportation, aviation, water resources management, and parks; is consistent
with Thrive MSP 2040; and is compatible with the plans of adjacent jurisdictions; and
WHEREAS, state statute establishes that approval of the City of St. Anthony
comprehensive plan is within the jurisdiction and authority of the City Council; and
WHEREAS, the City Council duly adopted the 2040 Comprehensive Plan, including the
future land use map, on April 28, 2020; and
WHEREAS, the Goals, Policies, and Plans reflected in the adopted Plan continue to
reflect the City's desired land use pattern; and
WHEREAS, substantive changes to said land use pattern would fundamentally disrupt
the overall balance found in the 2040 Plan; and
WHEREAS, the proposed land use map reflects the best long term interests of the City,
and no changes in overall community patterns or circumstances appear to support any
such changes; and
WHEREAS, the Planning Commission held a public hearing on February 15, 2022 for
review of the applicant's proposed amendment to the land use plan, and following said
hearing, unanimously voted to recommend that the City Council deny the amendment
based on findings as summarize herein;
NOW THEREFORE MAY IT BE RESOVLED, that the City Council of the
City of St. Anthony Village accepts the findings and recommendations documented in the staff
report and the recommendations of the Planning Commission, and hereby denies the proposed
amendment to the 2040 Comprehensive Plan for the City of St. Anthony Village as requested in
the accompanying application, based on the findings in this resolution and the following specific
findings of fact:
1. The 2040 Comprehensive Plan as adopted represents the best vision of future land use
for the City of St. Anthony Village.
2. The proposed amendment to the Comprehensive Plan would disrupt the land use
pattern envisioned by the adopted Plan, and create a series of impacts on other
properties and land uses.
3. Those land use impacts would result in a consequent series of impacts on the
community's housing, population, affordable housing, traffic, utility services, and
other impacts, both foreseen and unforeseen.
4. The City's circumstances and vision have not changed measurably in any way to
support the significant impacts to the Comprehensive Plan and its chapters that would
be necessitated by the proposed amendment.
5. The proposed land use of the subject property, as either a legal land use or a legal
non -conformity, is not impacted by either the amendment or the existing land use
designation.
6. Resolution of any conflict between the Comprehensive Plan's land use designation
and the City's Zoning Map should be addressed through amendment to the zoning,
rather than the much more significant and widespread impacts created by an
amendment to the land use plan.
