C.36 Claims. 37 38 Motion by Councilmember Randle, seconded by Councilmember Walker, to approve the 39 Consent Agenda items. 40 41 Motion carried 5-0. 42 43 IV.PUBLIC HEARING – NONE. 44 45 V.REPORTS FROM COMMISSION AND STAFF – NONE. 46 47 VI.GENERAL BUSINESS OF COUNCIL. 48 City Council Regular Meeting Minutes May 24, 2022 Page 2 A.1 Resolution 22-048 – Approving a Special Event Car Wash Hosted by the SAV Girls and 2 Boys Tennis on May 28, 2022 in the Community Center Parking Lot. 3 4 City Manager Yunker reviewed the request is to approve a special event permit from St. Anthony 5 Boys and Girls Tennis in the Community Center parking lot on May 28, 2022 from 10:00 a.m. to 6 3:00 p.m. 7 8 Councilmember Walker noted a typo in the report indicating it was a permit from Golf. 9 10 Motion by Councilmember Randle, seconded by Councilmember Walker, to Approve Resolution 11 22-048 – Approving a Special Event Car Wash Hosted by the SAV Girls and Boys Tennis on 12 May 28, 2022 in the Community Center Parking Lot. 13 14 Motion carried 5-0. 15 B.16 Ordinance 2022-03 – Amending the St. Anthony City Code by Amending Sections 17 Related to Swimming Pools, Refuse Handling, Signs, Natural Landscapes, Parking, 18 Accessory Uses and Administrative Procedures – FINAL READING. 19 20 The Staff Report indicated the Planning Commission and City Staff have been engaged in 21 working through updates to the City Code and portions of the Zoning Ordinance. A new set of 22 proposed amendments for City Council action. These have been reviewed by the Planning 23 Commission at public hearings for each set of amendments and the subject of a recent City 24 Council work session on April 12, 2022. 25 26 The amendments consist of three general sets of code, each of which with a separate ordinance. 27 First is a revision to the “C” Commercial District zoning regulations. The regulations have been 28 reworked to broaden the categories of allowed uses, dealing more directly with the nature of the 29 use, rather than the specific business. 30 31 The second proposed ordinance addresses the L-I Light Industrial District. This district has been 32 updated in a fashion similar to the Commercial District language, categorizing the permitted uses 33 more generally, and addressing the conditional uses more specifically. For the LI District, the 34 primary changes relate to trucking and warehousing (focusing more directly on manufacturing 35 uses). Per the Council’s discussion at the work session, brewery/taproom uses have not been 36 included in the district. 37 38 The third ordinance is a collection of several code updates reflecting staff experiences with 39 public inquiries and code enforcement observations. These include general administration (fees 40 and/or processing requirements), signs (reconciling political campaign sign regulations with state 41 law), and three larger categories of change: swimming pools, rubbish collection/storage, and 42 natural landscapes. 43 44 The regulations are intended to codify current practices, conform regulations internally, create 45 alternatives for common conditions that cannot track with current ordinances, and establish City Council Regular Meeting Minutes May 24, 2022 Page 3 1 baseline rules for otherwise unregulated (or prohibited) activities (especially with regard to the 2 natural landscape section). 3 4 The Planning Commission held its most recent hearing on updated language at its March 15, 5 2022 regular meeting. No resident or public comments were received. 6 7 Motion by Councilmember Webster, seconded by Councilmember Jenson, to Adopt Third and 8 Final Reading of Ordinance 2022-03 – Amending the St. Anthony City Code by Amending 9 Sections Related to Swimming Pools, Refuse Handling, Signs, Natural Landscapes, Parking, 10 Accessory Uses and Administrative Procedures. 11 12 Motion carried 5-0. 13 C.14 Resolution 22-042 Approving Summary Publication for Ordinance 2022-03. 15 16 Mayor Stille reviewed this resolution is for approval of Summary Publication for Ordinance 17 2022 – 03. 18 19 Motion by Councilmember Jenson, seconded by Councilmember Walker, to approve Resolution 20 22-042 Approving Summary Publication for Ordinance 2022-03. 21 22 Motion carried 5-0. 23 D.24 Resolution 22-049 – Approving Stormwater Facilities Maintenance Agreement and 25 Restrictive Covenant Between Lowry Retail LLC, and the City of St. Anthony Village. 26 27 City Manager Yunker reviewed the Stormwater Facilities Maintenance Agreement and 28 Restrictive Covenant related to the Bremer Bank improvement project. Such an agreement is 29 required as the improvement as proposed will consist of constructing an underground stormwater 30 collection and treatment facility on the Property. 31 32 Per the agreement, the applicant shall: 1.33 Agree to construct and maintain an underground stormwater management facility on his/her 34 property as shown on the approved drawing in exhibit B. 2.35 Maintain and preserve the underground stormwater management facility until such time as 36 the City, its successors or assignees, agree that the underground stormwater management 37 facility should be altered in some manner or eliminated. 3.38 Not to dismantle, revise, alter or remove part of the underground stormwater management 39 facility except as necessary for maintenance, repair or replacement. 4.40 Be responsible for inspecting and maintaining the underground stormwater management 41 facility, on an annual basis. The property owner will provide a letter to the City Engineer by 42 September 1st of each year, stating that inspection and maintenance have been completed. 5.43 Assume all responsibility for the cost of any maintenance and for repairs to the drainage 44 underground stormwater management facility. Such responsibility shall include 45 reimbursement to the City within 30 days after the City mails an invoice to the Owner for City Council Regular Meeting Minutes May 24, 2022 Page 4 1 any work performed by the City. Overdue payments will require payment of interest by the 2 Owner at the current legal rate as liquidated damages. 6.3 Obtain written approval from the City Engineer prior to performing any alterations or 4 modifications to the underground stormwater management facility. 5 6 Motion by Councilmember Walker, seconded by Councilmember Webster, to approve 7 Resolution 22-049 Approving Stormwater Facilities Maintenance Agreement and Restrictive 8 Covenant between Lowry Retail LLC, and the City of St. Anthony Village. 9 10 Motion carried 5-0. 11 12 VII.REPORTS FROM CITY MANAGER AND COUNCIL MEMBERS. 13 14 City Manager Yunker welcomed the new Communications Coordinator Kat Watson. He attended 15 Fire Ops 101. 16 17 Councilmember Walker attended the Fire Ops on Saturday. It was very interesting and enriching. 18 This morning, along with the City Manager and Mayor, had a meeting with faith leaders in the 19 community. He also attended the Tour of the City. 20 21 Councilmember Jensen stated on May 19 he attended the Metro Cities Board of Directors 22 Meeting. He attended the second half of the Tour of the City last week. This Thursday morning 23 he will be attending the Board of Directors Meeting for Northeast Youth and Family Services for 24 the first time. 25 26 Councilmember Randle also attended Fire Ops 101. It was enlightening. He attended the Tour of 27 the City. 28 29 Councilmember Webster stated she attended the May 12 Chamber of Commerce Annual 30 Meeting. She attended the May 16 Tour of the City. On May 17 she presented the pyramid to the 31 Planning Commission. On May 19 she attended the North Suburban Cable Commission Meeting. 32 33 Mayor Stille noted he attended the May 12 Chamber Dinner. He attended the Tour of the City of 34 May 16 with Council and Staff. On May 21 he attended Fire Ops 101. He was very impressed 35 with the training and role of the firefighters. OVERVIEW In from of you this evening is a resolution to designate our polling places for 2022 election year. The council previously adopted a resolution re-establishing polling locations after redistricting was completed in February 2022. We were recently informed by the management at The Landings (our Ramsey County precinct) that they would be doing renovations on the room previously used for voting and can’t guarantee the layout will continue to work as a polling location as well as if it will be completed by the August Primary election. We are fortunate that the management of Silverwood Park, located in Ramsey County, had previously contacted us expressing their interest in becoming a polling location. Ramsey County Elections and our City Clerk have toured Silverwood Park and have determined it meets all the requirements to be designated a polling place. Ramsey County Elections will notify the affected voters of the polling location change in July, via mailed post card. The last time the City Council conducted interviews and subsequently filled a vacancy on February 22, 2022, Lona Doolan was identified as an alternate to fill any mid-term vacancies that arose. This resignation triggers appointing Lona Doolan to the Parks & Environmental Commission to fulfill the term vacated by Renee Reed. The City of St. Anthony Village is currently identified by the MCES as a contributor of excess I/I and as such is included in the MCES I/I Surcharge Program. Since being identified as a contributor of excessive I/I, the City has taken an aggressive approach to the mitigate I/I, some of which includes: • Adopted a City Ordinance that prohibits and requires disconnection of foundation (passive) drains, sump pumps, and rain leaders • City-wide passive drain and sump pump inspection completed in 2007 • Implementation of a “point of sale” inspection program of sump pump and passive drainage systems. • Annual street reconstruction programs include the complete replacement of sanitary sewer system located within road right-of-way • Private sanitary sewer service video inspection of all properties within Street & Utility Improvement areas and assistance with coordinating repair and/or replacement • Pre- and post-reconstruction sanitary sewer flow monitoring The City has recently completed the most recent I/I mitigation work plan mandated by the MCES from the surcharge event that occurred in 2014 and continues complete projects annually to reduce and eventually eliminate I/I. As such, City staff has worked closely with the MCES and has requested that MCES consider removing the City from the I/I Surcharge Program. The MCES has agreed to remove the City from the I/I Surcharge Program under the condition the City enter into a Memorandum of Understanding (MOU) with the MCES to undertake a Long-Term I/I Mitigation Program, which includes: • The City will adopt and implement ordinances which will require a “point of sale” I/I inspection of all private sanitary sewer services. As existing homes and commercial properties within the City are sold, the City will administer an ongoing program requiring a video condition inspection of the sanitary sewer service. Properties found out of compliance will be required to be brought into compliance within the timeframe specified in the MOU. An estimated 50-100 properties on average will be inspected for compliance with the ordinance on an annual basis. This estimate is based on the number of homes on annual street reconstruction projects and home sales. • The City will report to the MCES a list of compliant properties including addresses and cost of service lateral repair including, City contribution. The report shall be submitted by March 31 each year. The City will also submit a report documenting expenditures to the City’s wastewater collection system. The MCES will advise the City of wastewater flows including exceedances, but the City will not be subject to an I/I work plan assignment. • The MCES and the City will work jointly to measure wastewater flows and rainfall totals collected by existing MCES meters to assess program effectiveness. • The City will educate residents on I/I and service repair at least twice a year through the City’s quarterly resident newsletter and City webpage. Communities that have excessive I/I in their wastewater collection systems will be required to eliminate the excessive I/I within a reasonable time. 4.The City of St. Anthony Village (“City”) has been identified by the Council as contributing excessive I/I in the wastewater collection system. 5.The City has implemented an aggressive Street and Utility Capital Improvement Program to replace aging infrastructure throughout the entire city. 6.Because of circumstances related to age of infrastructure, age of housing stock, historical building methods used to handle clear water, and capacity in the local wastewater collection systems, the City is undertaking a long-term I/I mitigation program. Now, therefore, the Council and the City hereby agree as follows: 1.Purpose of Memorandum of Understanding (“MOU”): The parties to the MOU recognize the need to outline their joint and separate efforts in I/I mitigation. Metropolitan Council No. 21I072 2.Continuation of private property I/I mitigation: The City will adopt and implement ordinances which require the following: a.Effective January 1, 2022, an I/I compliance inspection shall occur prior to the sale of an owner-occupied single-family property. The City shall encourage private property owners to have non-compliant services replaced or repaired. c.Effective July 1, 2022, rental properties shall be required to become compliant within 24 months of the property’s annual rental license renewal. d.Effective July 1, 2022, commercial properties and homeowner associations shall be required to become compliant within 24 months of the ordinance becoming effective. e.The City will work with Council staff to conduct city-wide flow monitoring in an attempt to isolate areas of high I/I. f.The City will properly enforce the ordinance. ANTHONY VILLAGE STATE OF MINNESOTA RESOLUTION 22-053 A RESOLUTION ORDERING THE PREPARATION OF PLANS AND SPECIFICATIONS AND ORDERING ADVERTISEMENT FOR BIDS FOR THE HARDING POND STORMWATER QUALITY IMPROVEMENTS WHEREAS,WSB & Associates, Inc. has conducted a bathometric survey and analysis of sediment of the existing Harding Pond originally constructed in 2001. WHEREAS,the analysis recommends removal of accumulated sediment within the basin to restore water quality and flood storage capacity to its originally constructed condition. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of St. Anthony Village that: 1)WSB & Associates, Inc. is hereby designated as the Engineer for this improvement, and they shall prepare plans, specifications, and bid documents for the improvement. 2)WSB & Associates, Inc. shall prepare and cause to be inserted in the official paper and in the Finance and Commerce, an advertisement for bids upon the making of such improvements under such approved plans and specifications. The Advertisement shall be published for two times, shall specify the work to be done, shall state a date when bids will be opened, and bids will be considered by the City Council. Any bidder whose responsibility is questioned during consideration of the bid will be given an opportunity to address the Council on the issue of responsibility. No bids will be considered unless sealed and filed with the Clerk and accompanied by a cash deposit, cashier’s check, bid bond, or certified check payable to the City of St. Anthony Village for Five (5%) percent of the amount of such bid.
