THIS PAGE LEFT INTENTIONALLY BLANK PR O C L A M A T I O N WHEREAS,the Minnesota Crime Prevention Association, AAA of Minnesota and the St. Anthony Village Police Department are sponsoring a statewide crime and drug prevention program on August 2, 2022, called "Night to Unite"; and WHEREAS,this is the 14th Annual Night to Unite” in Minnesota and it provides a unique opportunity for St. Anthony Village to join forces with hundreds of other communities across Minnesota in promoting cooperative, police-community crime and drug prevention efforts; and WHEREAS,City of St. Anthony Village plays a vital role in assisting the St. Anthony Village Police Department through joint crime and drug prevention efforts in St. Anthony Village and is supporting "Night to Unite 2022" locally; and WHEREAS,it is essential that all citizens of St. Anthony Village be aware of the importance of crime prevention programs and the impact of their participation can have on reducing crime and drug abuse in the City of St. Anthony Village; and WHEREAS,police and community together promote neighborhood safety, awareness and cooperation, are important themes of the "Night to Unite" program. B.34 Licenses and Permits. C.35 Claims. D.36 Resolution 22-057 – Accepting 2022 2nd Quarter Donations and Grants. 37 38 Motion by Councilmember Jenson, seconded by Councilmember Walker, to approve the Consent 39 Agenda items. 40 41 Motion carried 4-0. 42 43 IV.PUBLIC HEARING. 44 A.45 Resolution 22-058 – Approving the Proposed 2023 Debt Levy and the Phase II Debt 46 Levy Program for the City of St. Anthony Village. 47 48 Mayor Stille opened the public hearing at 7:08 p.m. 49 City Council Regular Meeting Minutes July 12, 2022 Page 2 1 Finance Director Shelly Rueckert reviewed it’s common practice for local governments use tax 2 exempt bond financing to provide funds for major project such as Street and Utility 3 Reconstruction (annually), Park Improvements, Trails and Sidewalks (as needed), Building 4 Improvements or Replacement (as needed), and Major Equipment Purchases Fire Trucks (once a 5 decade). Annual street improvements are the main driver of the debt levy. Engineering and 6 Financial planning begins approximately one year in advance of the construction Start Date. The 7 sources and uses for street improvement and debt service funds were reviewed. A future Street 8 Improvements Map was provided for Council review. Ms. Rueckert reviewed the Debt Levy 9 Planning Program. Ms. Rueckert stated there will be no street improvements in 2023. 10 11 The City Council is requested to approve the proposed 2023 Debt Levy of $2,487,181. This is 12 the fourth year in a row at that amount. 13 14 Councilmember Randle stated debt levy that is flat for four years in a row says a lot. 15 16 Mayor Stille stated the City has had their foot on the gas for reconstructing streets for the past 20 17 years. Over 80% of our roads have been reconstructed. The City has been fortunate. 18 19 Mayor Stille closed the public hearing at 7:16 p.m. 20 21 Motion by Councilmember Randle, seconded by Councilmember Walker, to Approve Resolution 22 22-058 Approving the Proposed 2023 Debt Levy and the Phase II Debt Levy Program for the 23 City of St. Anthony Village. 24 25 Motion carried 4-0. 26 27 V.REPORTS FROM COMMISSION AND STAFF – NONE. 28 29 VI.GENERAL BUSINESS OF COUNCIL. 30 A.31 Resolution 22-059 – Approving the Gambling License for the Northeast Minneapolis 32 Lions Community Foundation Located at 2720 Highway 88. 33 34 City Manager Yunker reviewed the Northeast Minneapolis Lions Community Foundation has 35 secured a lease with the Village Pub for gambling that will begin on or before September 1, 36 2022. The organization is applying for a Premise Permit for gambling with the State of 37 Minnesota. A requirement of the State permit application is acknowledgement by the local unit 38 of government and allowance of the gambling to take place within City limits. Two 39 representatives from the Northeast Minneapolis Lions Community Foundation were present. Mr. 40 Tom Hagen and Ms. Heidi Zaworski were present. Ms. Heidi Zaworski stated they have been in 41 the Village Pub since it opened. She reviewed some of the items they have donated within the 42 City and have been a long-time supporter of St. Anthony. Mr. Hagen thanked the Council for 43 allowing them to attend and request the license. 44 45 City Council Regular Meeting Minutes July 12, 2022 Page 3 1 Motion by Councilmember Jenson, seconded by Councilmember Randle, to Approve Resolution 2 22-059 – Approving the Gambling License for the Northeast Minneapolis Lions Community 3 Foundation Located at 2720 Highway 88. 4 5 Motion carried 4-0. 6 B.7 Resolution 22-060 Approving the Off-Site Gambling License for the Minneapolis NE 8 Lions Club at 3503 Silver Lake Rd NE. 9 10 City Manager Yunker reviewed the Minneapolis NE Lions Club is applying for an off-site 11 gambling license with the State of Minnesota. A requirement of the State permit application is 12 acknowledge by the local unit of government and allowance of the gambling to take place within 13 City limits. They are requesting the off-site gambling license for VillageFest located at 3503 14 Silver Lake Rd NE. 15 16 Motion by Councilmember Walker, seconded by Councilmember Randle, to Approve Resolution 17 22-060 – Approving the Off-Site Gambling License for the Minneapolis NE Lions Club at 3503 18 Silver Lake Rd NE. 19 20 Motion carried 4-0. 21 C.22 Goals Update. 23 24 City Manager Yunker provided an update on the 2022 Annual Goals for the last quarter. 25 26 Councilmember Walker asked when the water tower project will be completed, and Mr. Yunker 27 stated by the first week of August. 28 29 Councilmember Jenson stated he appreciates the way the goals report has been reformatted. 30 There were 56 goals and of those 40 have had some action. 31 32 VII.REPORTS FROM CITY MANAGER AND COUNCIL MEMBERS. 33 34 Councilmember Jenson had no report. 35 36 Councilmember Walker stated he attended the Interstate Development 28-unit apartment project 37 for a tour. Mayor Stille noted he and Councilmember Jenson also attended. This is a new concept 38 for construction in the area. 39 40 Mayor Stille stated on June 29 he attended the Mississippi Watershed Management Organization 41 Executive Committee Meeting. On July 11, he attended the Regional Council of Mayors 42 Meeting. The topic of that meeting was Education. Today he attended the Mississippi Watershed 43 Management Organization Board Meeting. 44 45 City Manager Yunker reminded about the cardboard recycling event on Saturday, July 16 9am – 46 1 p.m. at Public Works. The new law was passed by the Legislature as part of Chapter 98. Article 13 makes several changes to Minnesota Statutes, section 151.72 regarding the sale of certain cannabinoid (CBD) products. The City’s Code regulates the sale of medical cannabis and dispensaries, however, it does not regulate the sale of edible cannabinoid products. And, the new law does not require edible cannabinoid products to be sold from a dispensary. The City has the authority to be more restrictive than state law, but not less restrictive. The City Council discussed the new law at its Work Session on July 12, 2022, and the consensus was to adopt an interim ordinance that would place a moratorium for up to one year on the sale of those products specified in Minnesota Statutes, section 151.72. This will allow time for the City to research and determine how to proceed in appropriately regulating the products. City Staff is in the process of researching the issue to provide guidance on the new law, and will bring recommendations to the Council based on guidance from the League of Minnesota Cities and the City Attorney. Should the Council choose to implement the interim ordinance; staff will directly contact retailers in the City that would be impacted so they are aware of the interim ordinance being in affect. ANTHONY VILLAGE STATE OF MINNESOTA RESOLUTION 22-061 RESOLUTION TO APPROVE THE USE OF CENTRAL PARK FOR A SPECIAL EVENT ON AUGUST 5 & 6, 2022 WHEREAS, Julianne Hunter has submitted a special event permit to use city property to host VillageFest on August 5 & 6, 2022; and WHEREAS, the applicant has requested access for event set up on August 5, 2022 as well as clean up on August 7, 2022; and WHEREAS, the event will include live bands with amplified sound, alcohol, food trucks, bouncies, a petting zoo, bingo, silent auction and fireworks. THEREFORE, BE IT RESOLVED, the City Council of the City of St. Anthony Village approves the request from Julianne Hunter to host VillageFest on August 5- August 6, 2022 at Central Park.
