The Code Review Committee is working on additional code amendments that will 49 come to the Commission as part of an upcoming hearing date. Planning Commission Regular Meeting Minutes January 17, 2023 Page 2 1 2 Three documents are provided to the Commission with the first being a copy of the 2023 3 Planning Commission Work Plan that was reviewed in draft form last November 2022. The 4 second is a collection of draft materials that will be incorporated into the City’s Goal Setting 5 activities. There are three components to the Goal-Setting materials: (1) a PowerPoint that 6 summarizes the 2022 accomplishments, and ongoing or upcoming activities; (2) an 7 “Emerging Issues” chart that identifies planning-related elements the City is likely to 8 encounter in the next few years; and (3) an Implementation Matrix for tasks that were directed 9 by the adoption of the 2040 Comprehensive Plan along with status updates for the planning- 10 related activities. 11 12 Mr. Grittman welcomed comments and questions relating to these items. The Commission 13 Chair is also invited to participate in the Goal Setting sessions, and we can raise suggestions 14 and questions as appropriate. 15 16 The third set of documents is a collection of Planning Commission training materials, many of 17 which are familiar to the Commissioners. Since the current Commissioners are returning for 18 2023, no particular orientation time has been planned. The documents are provided for 19 review and discussion of any of the parts at an upcoming meeting. A more structured 20 presentation can be prepared if the Commission desires and presented at a future meeting. 21 B.22 Work Plan Discussion. 23 24 Mr. Grittman provided a copy of the St. Anthony Village Planning Commission Proposed 25 2023 Work Plan including General Items and Specific Tasks for 2023; and 2022 Recap. There 26 is one development plan that will be reviewed at the February meeting. Mr. Grittman 27 reviewed the Specific Tasks for 2023. If any Commissioners have any information or articles 28 to share with the Commission it should be sent to Mr. Grittman or Ms. Miller for distribution. 29 Work sessions will be scheduled as necessary. There will be at least one work session with the 30 City Council scheduled. One addition to the list is Residential Parking and Storage regulations 31 and rules. This is a living document and will be used as an outline going forward. 32 33 Commissioner Morita asked how the topics are added to the list and Mr. Grittman stated some 34 of the topics flow from the Comprehensive Plan or from the Code Review Committee, that 35 meets monthly. Occasionally a topic comes from the City Council. 36 37 Commissioner Rude asked when the Comprehensive Plan is next updated. Mr. Grittman 38 reviewed the Met Council’s process. The 2050 plan is to be completed by 2028. The City 39 Council should begin updating in 2026-2027. It is updated every 10 years. 40 41 Chair Socha asked how the changes made are communicated to the public. Ms. Miller stated 42 that communications via the website, newsletter and social media are all used to explain the 43 why’s and what has changed in the code to the community. 44 45 Councilmember Rude stated traffic will be addressed in 2023. He feels use of the road is 46 related to what type of property will be there. When 37th and Silver Lake Road is shut down 47 Planning Commission Regular Meeting Minutes January 17, 2023 Page 3 1 the traffic will use the side streets. Zoning is tied to the traffic corridor. Mr. Grittman stated 2 land use and transportation are connected. Some communities have regular transportation 3 reports to the Planning Commission. Mr. Grittman will review with the City Manager and the 4 City Engineer further. 5 C.6 Goal Setting Report. 7 8 The goal setting session is scheduled for next week for 3 days. Chair Socha has been invited 9 to attend. Every department reports to the group. All issues are pulled through the discussion 10 and decided by the City Council. A series of goals are created into the pyramid that is put 11 together. Mr. Grittman provided the Planning items that will be reviewed at the Goal Setting 12 Session. 13 14 Mr. Grittman presented a PowerPoint - 2022 Planner’s Report including: 15 16 -Year in Review – Private Applications. 17 -Year in Review – City-Initiated Projects. 18 -Looking Forward. 19 -Examples of Upcoming Planning Commission Activity. 20 -Potential Planning Applications and Review. 21 -Emerging Issues. 22 23 A Matrix showing items and time frame for Land Use and Zoning Topics, General, and 24 Transportation Topics, 25 26 Portions of the St. Anthony 2040 Comprehensive Chapter 10: Implementation were also 27 provided. A matrix showing Comprehensive Plan Action or Strategy / Who is responsible and 28 Progress Notes for the Planning Commission items was provided. 29 30 Emerging Issues do not always get resolved within a year and keep reoccurring on the list. 31 32 Commissioner Morita asked in the transportation topics is 2-5 years the right timeframe for 33 autonomous and electric vehicles. Mr. Grittman stated it could be 0-20 years. This item 34 relates to how these vehicles are serviced and maintained and public and private charging 35 stations. The technology is changing every year. 36 37 Commissioner Hendrickson asked where the City is at assessing EV charging stations on 38 public city property and the transition of city-owned vehicles. Mr. Grittman stated he does not 39 have the answer at this time but he will research and report back to the Commission. 40 41 Chair Socha asked what Mr. Grittman meant by “when we encounter this issue”. It seems like 42 people have their own charging stations this seems to be more of an issue we should be 43 proactive. Mr. Grittman stated when he thinks of this issue he thinks about the likely land use 44 issues for the technology. EV charging has been added to the commercial zoning district. 45 Chair Socha stated this is more an issue of funding. Would the Commission like her to bring 46 this up at the goal-setting session. Should EV charging stations be set up within the City. Planning Commission Regular Meeting Minutes January 17, 2023 Page 4 1 2 Commissioner Morita asked if this issue came up in the city-wide survey. 3 4 Commissioner Hendrickson noted some advertising is done on the EV charging stations that 5 would help pay for the stations. This would be an asset to the community and could be fund- 6 generating to the City. There is so much grant funding available and she wouldn’t want to see 7 the City miss out. 8 9 Chair Socha stated her EV is older and she would love it if there were more charging stations 10 available. There is some use for it now. 11 12 Commissioner Morita stated we should start thinking about ways to encourage EV vehicles in 13 the City. The City should be thoughtful and proactive about EV vehicle charging stations. 14 15 Commissioner Rude stated with multi-family housing could the City require them to have EV 16 charging stations. He feels this is not a City issue but up to the developer to see if it is needed. 17 18 Chair Socha will raise it at the Goal-setting session and asked Mr. Grittman to add it to the 19 agenda. 20 21 Commissioner Erickson stated he does not know much about EV charging stations but would 22 this be something a gas station could offer charging stations. Mr. Grittman stated there were 23 changes made to the Code to allow for EV charging stations. That problem is solved from a 24 Code side. There are private issues that need to be dealt with. The time spent at the charging 25 station is longer than a gas station. They tend to be near stores where the owners can do 26 something else while their vehicle is charging. 27 28 Commissioner Hendrickson asked what happens to underutilized office space. As leases 29 expire some owners may want to use the space for other things. She also suggested access 30 parking be discussed. Another emerging trend is roof-top gardens. She does not know where 31 we are with the ULI district. She shared her idea for the city-owned property. She suggested a 32 daycare usage at the gas station site. It would be an additional business and would involve 33 greenspace. 34 35 Chair Socha stated there is a shortage of daycare. This is an interesting thought. 36 Commissioner Kuykendall stated he recalls a proposal did come in for a daycare on that site at 37 one time. 38 39 Commissioner Hendrickson asked Mr. Grittman if he has heard anything about the Gateway 40 South District. Mr. Grittman stated over several months he hears from the leasing agent 41 occasionally. They have had various tenant opportunities but not a lot of re-development 42 opportunities. He would expect to see re-development in the future. 43 44 Commissioner Rude suggested beautification of the City be added to the discussion. Driving 45 on Hwy 88 that is not a good reflection of the community. Some landscaping could be added 46 or incentives for owners to do something with the property. Planning Commission Regular Meeting Minutes January 17, 2023 Page 5 1 2 Commissioner Erickson stated encouraging beautification would be a benefit to the City. 3 4 Chair Socha stated enforcing the Code is important but it makes it difficult to require people 5 to beautify their property monetarily. 6 7 Commissioner Rude suggested a contest to beautify their properties. Just don’t want things to 8 get worse. 9 10 Chair Socha summarized the requests for her to bring up at the goal setting meeting. 11 D.12 Planning Commission Training Documents. 13 14 Mr. Grittman provided training materials on Planning and Zoning Basics. This is information 15 for Planning Commissioners and others interested in the regulation of land use in Minnesota. 16 This information was written by Northwest Associated Consultants, Inc. 17 18 A PowerPoint was provided titled St. Anthony Village Planning Commission Orientation. 19 Included in the PowerPoint was information on Planning and Zoning Introduction, Meeting 20 Conduct – Roberts’ Rules of Order, Comprehensive Plan, Zoning and Zoning Ordinances, 21 Conditional Use Permits, Interim Use Permits, Variances, Decision-Making, Findings, 60- 22 Day Rule, Subdivisions and Plats, Planned Unit Development, and Nonconformities. 23 24 Commissioner Morita thanked Mr. Grittman for the information. He does not necessarily need 25 another training session but perhaps add to a future agenda to bring up questions. 26 27 Chair Socha stated she appreciates the information. 28 29 V.OTHER BUSINESS - NONE 30 31 VI.COMMUNITY FORUM. 32 33 No one appeared to address the Planning Commission. 34 35 VII.INFORMATION AND ANNOUNCEMENTS. 36 37 Mr. Grittman stated the maps on the back wall of the Council Chambers were part of the 38 Students in Government Program. The student liaison Alayna Peterson was part of that 39 program. 40 41 Ms. Peterson stated it is their AP Government Class that students could sign up for the day 42 trip to the City. MEMORANDUM To:St. Anthony Village Planning Commission From:Stephen Grittman, City Planner Date:Planning Commission Meeting – February 21, 2023 NAC Project No.323.01 – 23.01 Request:Request for a Conditional Use Permit for Catering facility in the Light Industrial District Property Address: 3610 29th Avenue NE Property PID:06-029-23-44-0036 PROJECT DESCRIPTION The Applicants are seeking approval of a Conditional Use Permit to remodel and occupy an existing building at the above address. The site is zoned Light Industrial, and is surrounded by other Industrial parcels. The proposed use would be as a commercial catering and food preparation business, listed as a Conditional Use in the L-I District. The applicants note that the business supports its existing restaurant (The Tea House) at 2423 University Avenue SE in Minneapolis. The application notes that the activity at the site may eventually expand to include fresh and frozen food preparation for sale in groceries and restaurants. The building is a 14,447 square foot structure that occupies the extent of the site, with its attendant parking and circulation spaces. The building exterior would be modified only slightly through the refitting of an existing doorway with a frost stoop to meet building code exiting requirements. The applicant further notes that no exterior signage would be provided, with the exception of directional/identification signage over existing entrances. The plans show parking along the east wall of the main building, and along the north wall of the “warehouse” portion of the building. A single at-grade dock door serves the warehouse portion of the building along that north wall as well. No additional docks are proposed. The applicants indicate the potential for 2 semi- or box-trucks serving the site, with no overnight parking, along with 2 vans for deliveries, which would be parked in existing parking spaces. STAFF RECOMMENDATION Staff has reviewed the project for land use compliance with the intent and policies of the City’s Comprehensive Plan, and for zoning consistency with the L-I, Light Industrial District as a baseline. In summary, the Comprehensive Plan promotes use of the subject properties that February 21, 2023 Page 2 reflect the proposed industrial uses in the area. The proposed Conditional Use Permit meets the requirements of the Zoning Ordinance for the baseline district zoning standards. As such, planning staff recommends approval of the Conditional Use Permit to allow the proposed catering facility in the proposed location. The applicants are seeking a Conditional Use Permit to establish an a catering facility as described above in an existing industrial building. The site location is at the northeast corner of 29th Avenue NE (County Road C to the east), and Anthony Lane. The site is just under one acre in area, and is occupied by a 14,447 square foot building. The use is consistent with both the Comprehensive Plan’s land use direction, as well as with the intent of the relevant zoning, which would be “L-I, Light Industrial for the site and the surrounding area. As noted in the Project Description and the applicant’s narrative, only insignificant changes are proposed for the building, which do not alter the existing site conditions. February 21, 2023 Page 3 The zoning ordinance lists the following required findings for consideration of a Conditional Use Permit: (C) City Council action. A conditional use permit may be granted only by a majority vote of all members of the City Council after determining that: (1) The use is one of the conditional uses specifically listed for the district in which the property is located; (2) The City Council has specified all conditions which the City Council deems necessary to make the use compatible with other uses in the area; (3) The use will not be detrimental to the health, safety, or general welfare of persons residing or working in the vicinity or to the values of property in the vicinity; and (4) The use will provide a service or a facility which is in the interest of public convenience and will contribute to the general welfare. The use is specifically listed in the district, and the site has been developed for industrial uses. As noted by the applicants, only limited employee counts are likely, and even with growth, there appears to be ample room for both the trucking and automobile parking on the site. For Conditional Use Permits, the common consideration is whether the use can compatibly coexist with others in the immediate area. As no changes are contemplated for the site, there are no apparent concerns related to safety or negative impacts on the site or neighborhood. The site has access to both 29th Avenue NE and Anthony Lane, and the low levels of traffic generation are unlikely to raise any issues for street use or other factors. Because the site will operate as a food processing/preparation site, staff will be requesting comment from public works and engineering to ensure that there are no anticipated impacts to sanitary sewer capacities or pre-treatment requirements as a function of building permit review. 2.Criteria for and Consistency with Criteria for CUP Approval. Title XV Land Usage, Chapter 152 Zoning Code, Section §152.243. SUMMARY AND STAFF/PLANNING COMMISSION RECOMMENDATIONS Conditional Use Permit for an Amendment to the Silver Lake PUD - Staff recommends approval with the following conditions: 1.Issues related to utilities shall be subject to comment and recommendation by the City Engineer. 2.Consideration of comments of other City Staff. Catering is a permitted conditional use within this zoning district. Asian Mill is proposing to convert the vacant building into a commercial food processing facility. Steve Grittman City Planner CITY OF SAINT ANTHONY VILLAGE HENNEPIN COUNTY, MINNESOTA RESOLUTION A RESOLUTION APPROVING A REQUEST FOR A CONDITIONAL USE PERMIT FOR A CATERING BUSINESS IN THE L-I, LIGHT INDUSTRIAL DISTRICT WHEREAS, the City of St. Anthony Village received a request from Dio Investments and Daniel Want for a catering and food preparation establishment at 3601 29th Avenue NE; and WHEREAS, the property consists of approximately .94 acres and is located in the L-I, Light Industrial district; and WHEREAS, the subject building is currently vacant, with an independent parking lot; and WHEREAS, catering facilities are allowed by Conditional Use Permit in the Industrial areas of the City; and WHEREAS, consideration of a conditional use permit in such areas is required to avoid unreasonable negative impacts on adjoining commercial property; and WHEREAS, the conditions identified as a part of an approval for the proposed Conditional Use Permit are necessary to ensure full compliance with the St. Anthony Village zoning ordinance; and WHEREAS, the Planning Commission has considered all of the comments and the staff report, which are incorporated by reference into the resolution; and WHEREAS, the Planning Commission held a public hearing on February 21, 2023 on the application and the applicant and members of the public were provided the opportunity to present information to the Planning Commission; and WHEREAS, the Planning Commission recommended approval of the Conditional Use Permit PUD Amendment with the conditions noted in the Staff report, and as listed below; and WHEREAS, the City Council makes the following findings of fact in support of the resolution for approval: 1.The property is located in an area of industrial land use on a major collector roadway. 2.The proposed use is identified as an allowed Conditional Use in the Light Industrial zoning district. 3.The additional impacts of the proposed use expected to be minimal due to the minimal changes to the building and site, including compatibility with other uses in the neighborhood. 4.The proposed business uses constitute a reasonable use of the property. 5.The proposed uses, constructed and operated within the requirements of the Code and the conditions of this resolution, will not impact surrounding property or public areas beyond the expected impacts of permitted, compliant uses in the commercial zoning district, nor negatively impact health, safety, or welfare of the community. 6.With the proposed conditions, the City Council finds that there is no evidence to believe that the use will have a detrimental effect on neighboring uses or property values.
