A.14 Fire Department Annual Report
15
16 Fire Chief Mark Sitarz presented the St. Anthony Fire Department 2022 Annual Report. There
17 are 29 total Staff including 7 full-time Career and 22 Paid On-Call 5 of the paid on-call are
18 current rookies. Nine of the fire fighters are women. There are two part-time employees that
19 handle Housing and Rental Compliance. In 2022 there were 1668 calls for service which is an
20 85.12% increase over 2001 calls (901). The call breakdown for 2022 were 29 Fires, 38
21 Hazardous Conditions, 261 Service Calls, 109 Good Intent, 81 False Alarms, 1 Weather Related
22 and 1,149 Medical Calls. The dollar loss from fire was $11,928.
23
24 Chief Sitarz reviewed the Hazmat Team. There were 4 calls in 2022 including: Mercury Spill,
25 Chemical Suicide: 1 DOA, 1 Rescue, 2 Treated, Chemical Reaction at a Business and Water
26 Treatment Plant Chlorine Release.

28 St. Anthony Fire Department had 1,805 hours of training documented which averages 62.24
29 hours per firefighter. Training consisted of: EMT, Live Fire, Hose line advancement, Vehicle
30 Extrication, and Strategies and Tactics.

32 Fire crews’ community outreach was continued at: Local Schools, High School, Local
33 Organizations, Senior Living Community, Aquatennial EMS Standby, Night to Unite and
34 Summer Survival School. The Open House is the largest event of the year. Captain Maddie Jaros
35 leads the planning of this event.

37 Chief Sitarz reviewed the Housing and Rental Code and stated there were 862 contacts with
38 residents and businesses and 195 total rental inspections.

40 The department is looking for more on-call fire fighters.

42 Councilmember Randle stated he appreciates the Fire Department and the work they do. He
43 asked what chemical suicide is. Chief Sitarz stated it is a decision to end life by mixing
44 chemicals together. The Hazmat team needs to deal with it.

1 Councilmember Webster thanked Chief Sitarz for the overview. She is grateful for the 2 minute
2 response time. Chief Sitarz stated they are at 2 minutes 54 seconds for Code 3 calls.

4 Councilmember Jenson asked Chief Sitarz to pass onto the staff how privileged St. Anthony is to
5 have such a great department. The level of training that is provided is outstanding. On the
6 number of calls, is there ever more than one call at the same time and Chief Sitarz stated just
7 today there were two calls at the same time. At this point the same high level of service can be
8 provided.

10 Councilmember Walker stated he appreciates the hands-on experience the City Council obtained
11 to see what fire fighters need to do. It was a once in a lifetime experience. He asked about the
12 file of life which is a program. If a person has advanced directives they have the availability to
13 make those wishes known to the fire department. This also includes medical history, medications
14 used. The file of life form is available at the fire department. He asked about the dollar loss
15 increase in 2019 and why it was so high. Chief Sitarz stated it was an arson fire in an apartment
16 building.

18 Mayor Stille stated the training event held in Maplewood proved to him he could not be a fire
19 fighter. The dedication of the department is admired.

B.23 2023 Quarterly Goals Update.

25 City Manager Charlie Yunker reviewed the 2023 Goals Chart. The Mission is to “Promote a
26 high quality of life to those we serve through outstanding city services”. The Vision is “Saint
27 Anthony is a small and inclusive Village where all people can live, work, learn, play and thrive”.

29 The Core Values S.E.R.V.I.C.E. – The St. Anthony Way. Mr. Yunker reviewed the Core Values:

1 Mr. Yunker reviewed the Action Steps for the Strategic Initiatives for the 1st quarter of 2023.

3 Mayor Stille thanked Mr. Yunker for the update and noted there are challenges that need to be
4 addressed.

6 VII.REPORTS FROM CITY MANAGER AND COUNCIL MEMBERS.

8 City Manager Yunker stated the Steering Wheel Lock Event will be held April 15 for 2021
9 Hyundai or Kia owners. Register at City Hall. On April 19 the Code Officials are presenting a
10 City Code Forum at 6-8pm in Council Chambers.
11
12 Councilmember Walker had no report.

14 Councilmember Jenson reminded the Metro Cities Annual Meeting is April 19 at 5pm at the
15 Roseville Skating Center. Councilmembers are invited.

17 Councilmember Randle had no report.

19 Councilmember Webster reported the Waste Hauler Transition has gone very well. She
20 appreciated the creativity the residents reached out to one another. It is all working out. She
21 stated the next two Thursdays a Youth Mental Health First Aid Training to be held in St.
22 Anthony.

24 Mayor Stille stated a joint meeting was held with the Parks and Environmental Commission to
25 discuss the Climate Action Plan. All Council attended. On April 10 he attended the Regional
26 Council of Mayors Meeting and the topic was Public Safety.

28 VIII.COMMUNITY FORUM.

30 Ms. Mary Lynn Waterhouse stated she lives on Mirror Lake on Foss Road and they have been
31 noticing semitrucks parked on Foss Road. The signs do not deter them being parked there for
32 several days. The traffic has become more difficult going around the semis. Her neighbor has
33 been calling the police and tickets have been issued but thrown on the ground. The trucks are not
34 from around St. Anthony. She noted Foss and Chandler were not designed to be parking areas for
35 semitrucks and it is dangerous for people trying to walk across the street. This all started about a
36 year ago and is now very prevalent. She asked if slow signs could be put up since a school bus
37 stops twice a day.

39 Mayor Stille stated Mr. Yunker will investigate and report back to Council.

43 Councilmember Walker announced April 22 from 10am – 12noon the St. Anthony Village
44 Historical Society will be holding their Annual Meeting at City Hall.

A RESOLUTION REGARDING RENEWAL OF MUNICIPAL INSURANCE COVERAGE
AND THE NON WAIVER OF TORT LIABILITY LIMITS FOR THE LEAGUE OF
MINNESOTA CITIES INSURANCE PROGRAM.
WHEREAS, the City Council of the City of St. Anthony hereby approves participation in the
League of Minnesota Cities Insurance Trust (LMCIT) insurance program for the
year 2023 through 2024; and
WHEREAS, the City has elected to purchase excess coverage in the amount of $1,000,000.00.
WHEREAS, the City DOES NOT WAIVE the monetary limits on municipal tort liability
established by Minnesota Statutes, Section 466.04.
BE IT RESOLVED, that the City Council of the City of St. Anthony hereby approves the renewal
of insurance coverage through the League of Minnesota Cities for the policy period of June 1, 2023
to May 31, 2024.
THEREFORE, BE IT FURTHER RESOLVED, that the City Council of the City of St. Anthony
hereby does not waive the monetary limits on tort liability established by MN statute 466.04, Subd.
7, to the extent of the limits of the liability coverage obtained from the LMCIT for the policy period
of June 1, 2023 to May 31, 2024.

PROJECT DESCRIPTION
The Applicants are seeking vacation of an Easement Agreement originally held by the HRA, but
since assigned to the City of St. Anthony Village. The easement encumbers the northwest area
of the Hannay’s commercial property at the above address. Easement vacations are considered
as a part of a public hearing held by the City Council.
Per the applicant’s materials, the easement was granted in 1999, with the purpose of
facilitating the creation of an open space and other public improvements as a part of a larger
redevelopment plan. Those plans have not resulted in a project to date. The applicants are
hoping to have that easement released, with the intention that they enclose the space with
screening fence and utilize it for temporary boat storage and staging for vessels they have in for
service.
There are, as a result, a number of issues raised by the request. First is the entitlement issue
related to the easement itself; second is the existence of other utilities and utility easements
overlapping a portion of the same area; and third, a land use issue related to the use of the
property once and if the easement is removed.
STAFF RECOMMENDATION
Staff has reviewed the project for land use compliance with the intent and policies of the City’s
Comprehensive Plan, and for zoning consistency with the “C”, Commercial District as a baseline.
For public easement vacations, no Planning Commission hearing is required. In summary, the
Comprehensive Plan promotes use of the subject properties that reflect the proposed
commercial uses in the area. The proposed easement vacation would facilitate that purpose
for the subject property. However, there are conditions that complicate the question, including
long-term public use of the area, reservation of drainage and utility easements, and further
land use processing depending on the applicant’s proposed use of the area in question.

COUNCIL ACTION: For the purposes of the easement vacation, if the Council believes that
the vacation is appropriate, with the staff conditions and/or other requirements, staff is asking
the Council to table final action and direct staff to prepare a resolution, along with the required
descriptions for the drainage and utility easements as recommended by the City Engineer.
Formal action, along with the descriptions and resolution would come to the Council at an
upcoming meeting.

Background and Analysis
Project Description.
As noted, the applicant seeks to remove an easement that encumbers the property to
accommodate the operations of the Boat sales and service facility. The property is zoned
commercial, and the applicant is using the property for commercial purposes. One of the
issues in the proposed change, however, is the request to extend additional boat storage to this
area, and secure the area with a screening and fence.
With regard to the removal of the easement and its original purpose, the City has held the
easement for many years with the expectation that it would become valuable as a part of a
long-range open space and redevelopment plan.
Vacating the easement would result in the loss of this opportunity. As noted by the applicant,
that purpose has been in place for nearly 25 years without action. The Council would have to
decide whether the expectations for the easement use are still important to retain. This
question is a policy matter rather than a technical one.
Access serving the easement area includes two public ways. Coolidge Street NE extends
northward from the site area, and a “Service Drive” extends to the southeast, past the Hannay’s
building to Highway 88 and the frontage road. The southerly extension of Coolidge Street,
formerly extending through this portion of the Hannay’s property, has been vacated.
The Service Drive is the north half of what was originally named Sunset Avenue, which has been
vacated to the northwest (now a portion of the Autumn Woods housing project. The south half
of Sunset was also vacated previously, now providing access to the Hannay’s building. The
white areas in the zoning map illustration above show the remaining public right of way. The
blackened portion is Hannay’s property, but which is covered by the easement in question.
As shown in the aerial photo clip below (included in the public hearing notice) the adjoining
land uses include Hannay’
retail facility to the
southeast, multi-family
residential to the southwest
and northwest, and retail
shopping center to the
northeast. The new Bremer
Bank facility adjoins the
northernmost corner of the
site.
Finally to be noted, there
are a series of utility
easements that also
encumber the property.
These include public
sanitary sewer and storm
sewer mains through the
entire length of the
Coolidge Street alignment

(including north, through, and south of this parcel); and further include utility easement in both
the existing and vacated portions of Sunset Avenue, in which private utilities (electrical, etc.)
are currently in place.
With regard to the utilities, the City Engineer recommends that any easement vacation takes
care to retain public drainage and utility easements necessary for those purposes. A drawing is
included below that illustrates the retained D/U easements in yellow highlight.
The land use issues are a key aspect of the discussion, as the applicant expects to put the area
subject to the vacation to a use providing outdoor storage for boats served by the principal use.
The issue here is that
outdoor storage is only
allowed as an accessory
aspect of motor vehicle
repair in the C, Commercial
District, with a series of
conditions, including
extent, screening, and
other factors. Boats are
included in the City’s
definition of vehicles. Thus
the use would potentially
be allowed, but a complete
CUP application and
processing would be
necessary to resolve the
land use question.
While the applicants suggest that this would the intended use for the site upon completion of
any vacation, approval of the vacation (if granted) would not imply approval of the land use.
Summary. In summary, staff believes that the easement vacation could be accomplished,
under the following circumstances and conditions:
1.The City retains the drainage and utility easements as noted in the sketch above.
Formal descriptions would be necessary to ensure the proper transfers.
2.The City Council finds that the purpose of the easement – reservation of land for public
use as a component of a future redevelopment - no longer exists.
As a separate matter, the applicant could continue to use the area for parking and could
secure the area with fencing that meets the City’s requirements, but could not utilize the
space for the storage – temporary or otherwise – until separate land use processing was
approved.

Indemnification Agreement and Insurance Information
The applicant hereby agrees to save, defend, hold harmless, and indemnify the City of St. Anthony Village and all of its
officers, departments, agencies, agents, and employees (collectively the “City”) from and against any and all claims, losses,
damages, injuries, fines, penalties, and costs, including attorneys’ fees, charges, liability, or other exposures, however caused,
resulting from, arising out of, or in any way related to the applicant’s event as herein described and applicant’s use of City
property and/or right-of-way. Nothing herein shall have any effect on the City’s right to assert any liability defense in
accordance with Minnesota Statutes, Chapter 466.
The City, in its sole discretion, may require the Applicant to obtain liability insurance coverage(s) for any event. If the City
notifies the Applicant in writing that liability insurance is required, the Applicant must provide proof of the appropriate
liability insurance(s) in the amount(s) provided herein.

The Applicant must provide the City with a Certificate of Insurance showing proof of the required liability insurance(s). The
City must be listed as an additional insured on all liability policies. Applicant’s insurance shall act as the primary insurance
coverage for any claims of loss covered by the insurance policy.
The City requires the Applicant to obtain any or all of the following insurance coverage, in at least the coverage amounts
contained herein:
1. Commercial general liability insurance or equivalent special event coverage protecting Applicant and City from claims for
damages or bodily injury and property damage which may arise out of or in connection with the event’s operation and use of
the City’s property or right-of-way. This general liability insurance policy shall be in an amount not less than $1,000,000.00
per occurrence.
2. If Applicant will be using an automobile for any portion of the Applicant’s event, Applicant must obtain automobile liability
insurance in an amount not less than $1,000,000.00 per occurrence. Such policy must include liability coverage for owned,
nonowned, and hired automobiles.
3. If alcohol will be served or included in Applicant’s event, Applicant must obtain liquor liability (also known as dram shop)
insurance in an amount not less than $1,000,000.00 per occurrence.
The City reserves the right to modify these insurance requirements at its sole discretion based on the nature and scope of
Applicant’s proposed event.

requested, the extent to which the group involves city residents and their use of city park facilities, the anticipated effect upon
other users of the park and adjacent residential properties, the likelihood of damage to park property and any other facts
relevant to the health, safety, and general welfare of the residents of the city. The City Council reserves the right to deny any

WHEREAS, The St. Anthony Girls Golf has submitted a special event permit to use city property
for a car wash on May 6, 2023; and
WHEREAS, City staff has reviewed the request and finds it to be acceptable.
THEREFORE, BE IT RESOLVED, the City Council of the City of St. Anthony Village approves
the request for the St. Anthony Girls Golf to host a car wash in the Community Center parking lot
on May 6, 2023 from 10 AM to 1 PM.

OVERVIEW
In front of you this evening is a resolution to approve a special event permit request from SANBE (St. Anthony New Brighton
Education) Foundation to hold a Party at the Pavilion at the Central Park Pavilion and parking lot on June 3, 2023 from 6:00
p.m. -10:00 p.m.
Staff has created a special event permit to facilitate gathering event information, department head reviews of event, and
staff recommendations to the City Council. The special event permit is used if the event fits one or more of the following
criteria:
Expected attendance of more than 100 people and open to the general public
Event is requesting the use of city property and/or street closures
There will be amplified live or pre-recorded music
There will be the sale of alcoholic beverages
The applicant is seeking permission to host an event at the Central Park pavilion and parking lot which will include alcoholic
beverages, amplified pre-recorded music and will be held on city property.
Staff has reviewed the special event and recommends approval.

multiple locations. Attach a complete map showing assembly and dispersal locations, route plan, and any
streets or parking lots you are requesting be blocked.
☐Temporary Liquor License application is required for the sale of alcoholic beverages. MN State Statute
340A.404 (10) The governing body of a municipality may issue to (1) a club or charitable, religious, or other
nonprofit organization in existence for at least three years, (2) a political committee registered under
section 10A.14, or (3) a state university, a temporary license for the on-sale of intoxicating liquor in
connection with a social event within the municipality sponsored by the licensee.
