CITY COUNCIL REGULAR MEETING MINUTES
NOVEMBER 28, 2023
CALL TO ORDER.
Mayor Stille called the meeting to order at 7:00 p.m.
PLEDGE OF ALLEGIANCE.
Mayor Stille invited the Council and audience to join in the Pledge of Allegiance.
ROLL CALL.
Present: Mayor Stille, Councilmembers Jenson, Walker, and Webster.
Absent: Councilmember Randle
Also Present: City Manager Charlie Yunker, Fire Captain Mattie Jaros, City Engineer Justin
Messner, and City Planner Steve Grittman.
CONSIDERATION, DISCUSSION, AND POSSIBLE ACTION ON ALL OF THE FOLLOWING
ITEMS.
I. APPROVAL OF NOVEMBER 28, 2023 CITY COUNCIL MEETING AGENDA.
Motion by Councilmember Jenson, seconded by Councilmember Walker, to approve the City
Council Meeting Agenda of November 28, 2023 as presented.
Motion carried 4-0.
II. PROCLAMATIONS AND RECOGNITION.
A. 2023 Fire Prevention Poster Winners.
Fire Captain Mattie Jaros reviewed the Fire Prevention training provided to the schools and
presented the 2023 Fire Prevention Poster Winners. The theme this year was Cooking Safety
Starts With You. The 4th Place winner was Isabel Montoya from St. Charles. The 3rd Place
winner was Bernadette Urdahl from St. Charles. The 2"d Place winner was Grace Nelson from
Wilshire. The 1st Place winner was Josie Johnson from St. Charles.
Santa on the Fire Truck will be held December 10,12,13 starting at 5:30 p.m. each evening.
Donations for Toys for Tots will be accepted along with donations for Nourish 282.

City Manager Charlie Yunker provided some background information on lzzy Diaz and Mayor
Stille administered the Oath of Office to Israel Diaz the new St. Anthony Fire Chief.

Consent Agenda items.

GENERAL BUSINESS OF COUNCIL.
A. Resolution 23-062 — Approving a Special Event Permit at 3701 Stinson Blvd NE on
December 11, 2023.
City Manager Charlie Yunker reviewed The Dive Sports Bar and Grill is requesting a special
event permit for December 11, 2023 at 3701 Stinson Blvd NE. This event will be in conjunction
with the Holiday Train. Staff has reviewed the special event request and finds it to be reasonable
and consistent with previous special events held in their parking lot in the past. Staff
recommends the amplified broadcast ends by 8:00 p.m. to comply with the noise ordinance and
that Mr. Bauman notifies the adjacent homeowners of the event due to the amplified
broadcasting of the game.
Motion by Councilmember Walker, seconded by Councilmember Webster, to approve
Resolution 23-062 — Approving a Special Event Permit at 3701 Stinson Blvd NE on December
11, 2023.
Motion carried 4-0.
B. Resolution 23-063 — Accepting Plans and Specifications and Ordering Advertisement for
Bids for the 2024 Street Improvement Project
City Engineer Justin Messner reviewed this resolution approves the plans and specifications and
authorizes the advertisement for bids for the 2024 Street Improvement Project. The resolution
also includes miscellaneous construction consisting of Salo Park concrete replacement and Silver
Point Park improvements.

1 Mr. Messner reviewed the method for selection for Reconstruction Projects includes flood relief
2 effort, existing utility deterioration, pavement condition and adjacent infrastructure replacement
3 (construction phasing). The method for selection of Mill & Overlay Projects is to maintain and
4 extend the life previously reconstructed roadways. The method for selection of Thin
5 Maintenance Overlays is a non-structural asphalt layer applied as a maintenance treatment for
6 short-term corrective action.
8 A list of the locations for the proposed mill and overlay project was provided. The proposed thin
9 maintenance overlay will be on 31 s` Avenue NE (Silver Lake Road to Rankin Road). The
10 concrete work at Salo Park will replace cracked panels. The total cost for the proposed
11 improvements is estimated to be $2,667,600. A map showing the assessed parcels was provided.

For Silver Point Park the parking lot mill and overlay, reclaim and pave the trail, replace
cracked panels in the concrete and remove and replace the basketball court. These improvements
were included with the bid package for cost information and future Council consideration.
Mr. Messner reviewed the project schedule with substantial completion being done in September
2024. Photographs were provided for Council review.

Councilmember Webster asked since Salo Park is not on City property, but there is a
maintenance agreement in place. Mr. Messner stated the agreement includes the City assuming
maintenance of the area. Mr. Yunker stated the funds come from the stormwater fund.
Councilmember Jenson referred to Silver Point Park and asked when that will be completed, and
Mr. Messner stated nothing is planned at this time but was included in the facilities maintenance
study. The playground replacement project is still going forward.
Mayor Stille stated the street maintenance plan makes sense.
Motion by Councilmember Jenson, seconded by Councilmember Walker, for approval of
Resolution 23-063 — Accepting Plans and Specifications and Ordering Advertisement for Bids
for the 2024 Street Improvement Project.
Motion carried 4-0.
C. Resolution 23-064 — Ratifvine the 2024 Agreement Between the International
Association of Fire Fighters, Local 3486 Representing the St. Anthony Fire Department
Employees and the City of St. Anthony Village.

1 City Manager Yunker reviewed this resolution is for approving the Cost of Living Adjustments
2 (COLA) and market adjustment for Police Officers. A three (3) year contract with the St.
3 Anthony Fire Department, Police Department, and Public Works Department's employees was
4 approved in 2021 which included a reopener for wages in the third year. Health insurance
5 premium changes will be split equally between the City and employees.

7 The union agreed to a 3.50% COLA increase, as was anticipated during the budget and levy
8 discussions in preparation for the preliminary levy approval on September 12, 2023. The union
9 also requested a change in methodology to calculate longevity in an effort to be at a comparable
10 level to the department's peers. The existing contract also included a Memorandum of
11 Understanding (MOU) for a wage differential for those members who obtained a paramedic
12 license by the Emergency Medical Services Regulatory Board (EMSRB), which was removed
13 and absorbed into the wage table provided.

15 Staff recommends approval of the 2024 Agreement between the International Association of Fire
16 Fighters, Local 3486 Representing the Saint Anthony Fire Department Employees and the City
17 of St. Anthony Village.

19 Councilmember Webster thanked Mr. Yunker for the outline of each contract.

21 Councilmember Jenson stated he appreciates the way the pay scales were laid out in the
22 presentation. Mr. Yunker noted the relationship with all the unions continues to be very strong
23 and cordial. They appreciate the support from the Council.

45 Sanitary Sewer Costs, Adjustment to Collection Fee, Adjustment in Usage Rate, Adjustment
46 Impacts, Stormwater Rates, Rate Survey, and Impacts by Tier Levels were provided.

G. Ordinance 2023-06 — Amending the St. Anthony City Code, by Amending Title XI.
Section I I I Relating to Regulation of Smoking in Outdoor Public Places.
City Planner Steve Grittman reviewed the ordinance follows the "nuisance" approach to the
smoking issue, prohibiting cannabis use in specific public spaces, and incorporates a companion
prohibition of tobacco smoking in those same spaces. This expands the City's current regulation
of tobacco smoking from indoor spaces to those identified outdoor spaces. The ordinance
refrains from expanding the prohibition to all outdoor public spaces, such as public sidewalks
along roadways, etc. Tobacco and cannabis smoking would be legal in these locations, although
alcohol use in those areas would continue to be prohibited by State law. It further refrains from
extending the prohibition to privately -owned quasi -public spaces (such as restaurant patios) as
some communities have done. The individual property owner has the right to prohibit smoking —
tobacco and/or cannabis — on its own property.
Council is requested to approve the Third and Final Reading of an Ordinance Amendment
prohibiting smoking on certain public property, per Ordinance No. 2023-06.

and Final Reading and Adoption of Ordinance 2023-06 — Amending the St. Anthony City Code,
by Amending Title XI, Section I I 1 Relating to Regulation of Smoking in Outdoor Public Places.
Motion carried 4-0.
H. Resolution 23-067 — Approving Summary Publication of Ordinance 2023-067.
City Manager Yunker reviewed this resolution is for approval of a summary publication of
Ordinance 2023-06.
Motion by Councilmember Webster, seconded by Councilmember Walker, for approval of
Resolution 23-067 — Approving Summary Publication of Ordinance 2023-06.

Councilmember Walker stated on November 16, he attended the Open House for Twin Cities
Therapeutic Massage as the Council representative. On November 25, he attended the Small
Business Saturday at the Community Center.
Councilmember Jenson stated on November 21 he attended the Joint Meeting with the Planning
Commission.
Mayor Stille noted on November 16, he attended the retirement celebration for Sandy Simon.
