ANTHONY CITY COUNCIL REGULAR MEETING MINUTES OCTOBER 24, 2023 CALL TO ORDER. Mayor Stille called the meeting to order at 7:00 p.m. PLEDGE OF ALLEGIANCE. Mayor Stille invited the Council and audience to join in the Pledge of Allegiance. ROLL CALL. Present: Mayor Stille, Councilmembers Jenson, Randle, Walker, and Webster. Absent: None Also Present: City Manager Charlie Yunker, City Planner Steve Grittman and Fire Chief Mark Sitarz. CONSIDERATION, DISCUSSION, AND POSSIBLE ACTION ON ALL OF THE FOLLOWING ITEMS. I. APPROVAL OF OCTOBER 24, 2023 CITY COUNCIL MEETING AGENDA. Motion by Councilmember Randle, seconded by Councilmember Jenson, to approve the City Council Meeting Agenda of October 24, 2023 as presented. Motion carried 5-0. II. PROCLAMATIONS AND RECOGNITION - NONE. III. CONSENT AGENDA. A. Approval of October 10, 2023 City Council Meeting Minutes. B. Licenses and Permits. C. Claims. D. Resolution 23-059 — Authorizing Mayor and City Manager to Approve Toward Zero Deaths Grant. Motion by Councilmember Jenson, seconded by Councilmember Webster, to approve the Consent Agenda items. IV. PUBLIC HEARING - NONE. REPORTS FROM COMMISSION AND STAFF - NONE. A. Rental Housing City Planner Grittman reviewed the Planning Commission considered three separate ordinance proposals related generally to rental housing as a follow-up to the Council's discussion at a recent Work Session. The ordinances addressed (1) Short-term Rental housing; (2) General single family home rental limitations; and (3) "Sacred Settlements", a new topic raised by the 2023 State Legislature. The Commission opened a public hearing on draft ordinances that addresses each of the three topics, copies of which are included for Council review. The Commission became concerned that few members of the public who may otherwise have an interest in some of these issues were participating in the review. One member of the public had contacted staff by email, encouraging the City to adopt both the short-term limitations and restrictions on rental housing generally. The Commission's views were varied on these two topics, with support expressed for the ordinances as presented (in general), concerns over limitations on individual owner's rights by restricting either short-term rentals or limiting rental overall, concerns that the proposed limitations may be subject to work-arounds by creative landlord/applicants, and support for considering alternatives to code -based limitations (such as more aggressive code enforcement and/or penalties for violations). For the "Sacred Settlement" ordinance, the Commission expressed only minor changes or concerns to a few aspects of the amendment as presented (primarily parking and fencing). The Commission expressed a desire to pursue a stronger public engagement program in this regard, prior to making a formal recommendation. The public hearing was continued to a future agenda date, and staff indicated they would follow-up with the City Manager and Council as to further direction. Because some of the comments from the Planning Commission implicate other policy topics or financial investments, staff is seeking direction from the City Council as to next steps. Follow-up from the Council may include consideration of the following questions, or others: 1. Should staff develop a plan for community outreach on these topics? 2. Would Council prefer to see a more interactive engagement, or more communication from City to the public as to rental housing regulations, whether short-term or long-term? 3. Would the Council prefer that the Planning Commission facilitates community outreach on these topics? 4. Would the Council prefer to schedule a Work Session to discuss community outreach — or these topics more broadly — with the Planning Commission? 5. Does the Council have further direction for the Planning Commission and/or Staff as to scope or context as a part of returning these topics to the Commission for review and recommendation? Is there other direction from the Council for either staff or Commission? 3 As the Planning Commission continued the public hearing, staff is expecting that the ordinances 4 could be returned to the Commission at its November 21 meeting — however, more extensive 5 public engagement would likely delay consideration until a later date. 10 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 46 Mr. Grittman noted no formal action is required at this time. Staff is seeking direction on next steps, including possible scheduling of a joint work session with Council and Planning Commission on rental housing topics. Maps showing a sampling of property values in areas of rental housing were provided. This analysis samples an area in each of the four "quadrants" used in the draft ordinance — additional data could be developed if the Council is interested. The primary caution with this data relates to the wide variety of inputs that affect property values. The draft ordinances were also provided for Council review along with the complete staff report provided to the Planning Commission at their meeting. Councilmember Webster stated she appreciates the thoughtfulness the Planning Commission had during their discussion and the multiple perspectives that were shared. Councilmember Jenson stated he watched the Planning Commission meeting and agree with Councilmember Webster's comments. He stated single family homes are a way to build generational wealth. With St. Anthony being built out and no longer being able to add to the single family home inventory, we don't want to reduce the number of owned homes by converting them to rentals. There will be at least 60% rental and we need to preserve the potential for people to purchase homes. This needs further discussion. Mayor Stille noted the Planning Commission continued the public hearing after a 2 hour discussion and that item is still on the table at the Planning Commission level. This concept was part of their discussion. Councilmember Jenson stated he does not mean to argue but that did not come up unless his video stopped short. Mayor Stille stated it did because the push back was how can property rights be taken away. The question in front of the Council is how to proceed. He would be fine to have another work session with the Planning Commission to discuss. Councilmember Jenson agreed. We can also talk about public input and whether or not to use a survey. Need to determine what the goal is. At the goal setting session he would like to discuss code enforcement enhancements. This would be the right way to do it. The consensus of the Council was to meet with the Planning Commission to have further discussion on this matter. Councilmember Walker stated there was no mention of sacred settlement which he would like to discuss further. City Planner Grittman stated Staff decided to add that to the discussion at the Planning Commission level since some ordinances were being considered. Councilmember Randle noted this seems to have become more complicated since the last discussion. There are some things that popped up that he did not realize. Further discussion with the Planning Commission is warranted for a number of reasons. City Council Regular Meeting Minutes October 24, 2023 Page 4 Councilmember Webster referred to number 4 in the staff report and she feels a discussion with the Planning Commission is in order. There was a strong desire to gain more community input on this. 5 Mayor Stille stated the predominant theme is going to be the real estate aspect. Council will 6 make the decision on whether to move forward with a survey or not but Planning Commission 7 input will be heard. The Planning Commission meeting was very interesting and they did their 8 job and they did it well. 10 City Planner Grittman stated he will ask the Planning Commission to close the public hearing at 11 their next meeting and look for a date for a Council — Planning Work Session. 12 13 VI. GENERAL BUSINESS OF COUNCIL. 14 15 A. Resolution 23-060 — Accepting Donations to the Fire Department. 16 17 Fire Chief Sitarz introduced Mr. Roy Quady. This will be his third time before the Council. He 18 absolutely loves St. Anthony. In 2014 he made a donation to the Police Department and in 2015 19 to make a donation to the Fire Department. In 2014 he made a donation to the Police Department 20 and in 2015 to make a donation to the Fire Department. Mr. Quady reviewed a Power Point 21 describing the Mlinar Sisters (his mother and two aunts). He provided detailed background 22 information on his family. Mr. Roy Quady on behalf of the Mlinar Sisters donated $10,000 to the 23 Fire Department to be used for station equipment and EMS training props. 24 25 Mayor Stille thanked Mr. Quady for his third donation and his unwavering support for the City. 26 Mr. Bob Manske of the historical society is present this evening to document this event. 27 Photographs were taken. 28 29 Councilmember Randle read the resolution in full. 30 31 Motion by Councilmember Randle, seconded by Councilmember Walker, for approval of 32 Resolution 23-060 — Accepting Donations to the Fire Department. 33 34 Motion carried 5-0. 35 36 B. Goals Update 37 38 City Manager Yunker reviewed the 2023 Goals Chart and provided updates to each of the Action 39 Steps. 40 41 Mayor Stille commented the three half days spent in goal setting are a systematic way to keep us 42 on track. 43 44 VIL REPORTS FROM CITY MANAGER AND COUNCIL MEMBERS. 45 City Council Regular Meeting Minutes October 24, 2023 Page 5 1 Councilmember Walker reported on October 18, he attended the Parks and Environmental 2 Commission Work Session Meeting with the City Council. 4 Councilmember Jenson stated on October 13, he attended the monthly Ramsey County Local 5 League of Governments Meeting. He also attended the Climate Action Plan Joint Meeting last 6 week. Councilmember Randle had no report. 10 Councilmember Webster stated she also attended the Joint Meeting with the Parks and 1 I Environmental Commission where the survey results were reviewed. 12 13 Mayor Stille stated on October 12, he attended the Regional Council of Mayors social lunch 14 meeting. He attended the October 16 Joint Meeting with the Parks and Environmental 15 Commission. 16 17 Vill. COMMUNITY FORUM - NONE. 18 19 IX. INFORMATION AND ANNOUNCEMENTS. 20 21 City Manager Yunker stated he received the notice from Police Chief Jon Mangseth that he plans 22 to retire on January 31, 2024 after 29 years with the City. The recruitment plan is ready and will 23 begin tomorrow. 24 25 X.
