ANTHONY CITY COUNCIL REGULAR MEETING MINUTES MAY 14, 2024 CALL TO ORDER. Mayor Webster called the meeting to order at 7:00 p.m. PLEDGE OF ALLEGIANCE. Mayor Webster invited the Council and audience to join him in the Pledge of Allegiance. ROLL CALL. Present: Mayor Webster, Doolan, Jenson, Randle and Stephens. Absent: None. Also Present: City Manager Charlie Yunker and City Planner Steve Grittman. CONSIDERATION, DISCUSSION, AND POSSIBLE ACTION ON ALL OF THE FOLLOWING ITEMS. I. APPROVAL OF MAY 14, 2024 CITY COUNCIL MEETING AGENDA. Motion by Councilmember Randle, seconded by Councilmember Jenson, to approve the City Council Meeting Agenda of May 14, 2024. Motion carried 5-0. II. PROCLAMATIONS AND RECOGNITIONS — NONE. III. CONSENT AGENDA. A. Approve April 18, 2024, Town Hall meeting minutes. B. Approve April 23, 2024, Council meeting minutes. C. Licenses and permits. C. Claims. D. Resolution 24-034 — Resolution Approving the Off Site Gamblin¢ License for the Minneapolis NE Lions Club located at 3503 Silver Lake Road NE. Motion by Councilmember Jenson, seconded by Councilmember Stephens, to approve the Consent Agenda items. IV. PUBLIC HEARING — NONE. V. REPORTS FROM COMMISSION AND STAFF. Motion carried 5-0. City Council Regular Meeting Minutes May 14, 2024 Page 2 A. Resolution 24-035 — Resolution Approving a Request for a Conditional Use Permit for Modifications to a Restaurant Drive -Through in a "C", Commercial District City Planner Grittman reviewed the resolution with the Council and indicated that the applicants are seeking a Conditional Use Permit to modify an existing drive -through facility on the Culvers Restaurant property to add a formal second order/stack lane, and make some modifications to parking and traffic flow resulting from the change. Restaurants with drive -through facilities are allowed in the C-Commercial District by Conditional Use Permit provided they comply with the requirements of the terms of the Conditional Use reviews and code requirements. T 11 City Planner Grittman explained that for this project, the applicant will make only a few 12 construction changes to the site, with the primary access points remaining untouched (an internal 13 private street on the south and a right -in, right -out driveway from Silver Lake Road on the west). 14 Internal circulation will be modified, however, resulting from two new medians installed to 15 separate drive- through ordering and pick-up traffic, and a change to the circulation flow — 16 creating a one-way counter -clockwise circulation on the north and east sides of the property from 17 what is currently a two-way pattern. The one-way circulation change reconfigures 90 degree 18 parking on the north and west boundaries to a combination of 11 angled spaces and 5 parallel 19 waiting spaces for pre -order customers — reducing overall parking on the site by approximately 20 16 spaces. A small change to an existing curb island is also included to manage waiting spaces at 21 the exit portion of the site. 22 23 City Planner Grittman stated the Council is asked to consider Resolution 24-035 approving a 24 Conditional Use Permit for modifications to a drive -through facility for Culver's at 4004 Silver 25 Lake Road based on a finding that the proposed use is consistent with the requirements of the 26 Zoning Ordinance, incorporating the conditions of approval therein. 27 28 City Planner Grittman noted the Planning Commission reviewed the proposed Conditional Use 29 Permit request at a public hearing held on April 16, 2024. There was no one in attendance at the 30 hearing, and no written submissions were received from members of the public. The 31 Commission queried staff on details of the plan, including options for future changes if needed. 32 The recommended terms suggest that ongoing review of parking demand and supply are subject 33 to review if needed. 34 35 Representatives of the applicant were present, and spoke to the changes to the site and to the 36 facility overall. They noted an increase in drive -through use, and the sufficiency of parking for 37 staff and dine -in customers. After consideration, the Planning Commission voted unanimously to 38 recommend approval of the Conditional Use Permit, with the conditions listed in the Staff report. 39 40 City Planner Grittman stated staff has reviewed the project for land use compliance with the 41 intent and policies of the City's Comprehensive Plan, and for zoning consistency with the 42 Commercial District as a baseline. In summary, the Comprehensive Plan supports commercial 43 uses in this area. The proposed application would, with appropriate conditions, facilitate that 44 purpose for the subject property. However, there are conditions that staff has recommended to City Council Regular Meeting Minutes May 14, 2024 Page 3 1 mitigate or clarify potential impacts from the revised plan. With those conditions, staff 2 recommends approval of the proposed CUP. 4 Councilmember Doolan expressed concern with the safety of the food runners. City Planner 5 Grittman reported the food runners currently cross traffic routinely and noted the change would 6 formalize the white spaces more effectively on this site of the facility. He commented further on 7 how traffic would flow through the site noting there was still egress from the south parking lot. 9 Councilmember Doolan inquired if there would be additional wait space for the drive-thru. City 10 Planner Grittman explained there would be additional wait space. 11 12 Councilmember Jenson requested further information on how the traffic lanes would flow 13 through the site. Rachel Bulbo, representative for the applicant, reviewed the location of the 14 drive through menu and bypass lanes. She noted there would be eight designated wait spaces for 15 the double menu board, which was more than Culver's has now. 16 17 Councilmember Doolan indicated there would be an increase in the number of waiting cars 18 between the restaurant and the Equinox apartments. She questioned if there were any efforts to 19 reduce the amount of exhaust that goes up to the apartment complex. Ms. Bulbo reported a 20 retaining wall would be installed on this side of the property leading up to the apartment complex 21 garage. 22 23 Councilmember Stephens questioned if the two drive thru lanes would go down into one lane. 24 Ms. Bulbo stated this would be the case. 25 26 Jenny Hedmeyer, Culvers ownership representative, explained her staff was very excited about 27 having a double menu drive thru configuration noting this would be more effective for her team 28 members. 29 30 Motion by Councilmember Stephens, seconded by Councilmember Jenson, to approve 31 Resolution 24-035, a Resolution Approving a Request for a Conditional Use Permit for 32 Modifications to a Restaurant Drive -Through in a "C", Commercial District. 33 34 Motion carried 5-0. 35 36 VI. GENERAL BUSINESS OF COUNCIL. 37 38 A. Resolution 22-036 — Resolution Approving a Special Event Permit at 3701 Stinson 39 Boulevard NE. 40 41 City Manager Yunker presented the draft resolution to approve a special event permit request 42 from The Dive Sports Bar and Grill at 3701 Stinson Boulevard NE on May 18 and 19, 2024. The 43 special event permit application was included in tonight's meeting packet. 44 City Council Regular Meeting Minutes May 14, 2024 Page 4 City Manager Yunker stated staff has created a special event permit to facilitate gathering event information, department head reviews of event, and staff recommendations to the City Council. The special event permit is used if the event fits one or more of the following criteria: 4 • Expected attendance of more than 100 people and open to the general public 5 • Event is requesting the use of city property and/or street closures 6 • There will be amplified live or pre-recorded music 7 • There will be the sale of alcoholic beverages 8 City Manager Yunker explained that Mr. Bauman is seeking permission in their parking lot to: 9 Utilize spaces in their parking lot for games, temporary bar, and beer truck. 10 Amplified broadcasting of music and announcements 11 12 City Manager Yunker stated staff has reviewed the special event and finds it to be reasonable and 13 consistent with previous special events held in their parking lot in past years. Staff recommends 14 the amplified broadcast ends by 8 p.m. to comply with our noise ordinance and that Mr. Bauman 15 notifies the adjacent homeowners of the event due to the amplified broadcasting of music. Staff 16 has reviewed the special event and recommends approval. 17 18 Councilmember Doolan asked if the street would be closed for this event. City Manager Yunger 19 reported the street would not be closed as the event would be held in the parking lot. 20 21 Mayor Webster thanked staff for the detailed staff report. She indicated she supported this event 22 moving forward. 23 24 Motion by Councilmember Doolan, seconded by Councilmember Randle, to approve Resolution 25 22-036, a Resolution Approving a Special Event Permit at 3701 Stinson Boulevard NE. 26 27 Motion carried 5-0. 28 29 VII. REPORTS FROM CITY MANAGER AND COUNCIL MEMBERS. 30 31 Councilmember Doolan stated she attended the Minnesota Cities Climate Caucus on April 25 32 where CEE discussed electrifying everything. She noted she participated in clean up events at 33 Trillium and Silver Point Parks on Earth Day. On April 28 she assisted with the Kiwanis 34 Pancake Breakfast. She explained she attended the joint school board meeting on April 30 and 35 last week she spoke with fifth graders about gardening. 36 37 Councilmember Jenson stated he attended the joint school board meeting on April 30. He 38 reported on May 8 he attended the NYFS annual luncheon. He explained on May 9 he attended 39 the Ramsey County League of Local Governments climate action working group and on May 10 40 he attended Ramsey County's monthly program meeting. 41 42 Councilmember Stephens reported she attended some of the other events in the City and attended 43 the DEI and cyber security training through the LMC. 44 City Council Regular Meeting Minutes May 14, 2024 Page 5 2 Mayor Webster stated she attended a meeting with Sola Finland and Ruth Ann Marx on April 25. 3 She reported exchanges and the 40`s Anniversary sister city partnership were discussed. She 4 indicated she attended a Nine North cable commission meeting on April 25 and on April 30 she 5 met with Hennepin County Sheriff Witt. She explained she attended the joint school board 6 meeting and on May 3 she met with City Manager Yunker to discuss potential grant funding. She 7 commented on the concert and middle school play she attended this past weekend. 9 VIII. COMMUNITY FORUM. 10 I 1 Mayor Webster invited residents to come forward at this time and address the Council on items 12 that are not on the regular agenda. 13 14 Hearing none, Mayor Webster moved forward with the agenda. 15 16 IX. INFORMATION AND ANNOUNCEMENTS. 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 Councilmember Doolan reported the band booster garage sale would be held this weekend and donations could be made at the high school gym on Wednesday of this week. Mayor Webster congratulated former Fire Chief Mark Sitarz for receiving the 2024 distinguished alumni award from Totino Grace High School. Mayor Webster wished city employees Ed Markels, Mark Mosby and Dan Johnson a long and health retirement. X. ADJOURNMENT.
