RESOLUTION 25-053
A RESOLUTION REQUESTING APPROVAL TO WORK OUTSIDE OF CITY
CONSTRUCTION ACTIVITIES HOURS (92.05 PUBLIC NUISANCES AFFECTING
PEACE AND SAFETY)
WHEREAS, the City of Saint Anthony Village currently restricts construction under section
92.05.V.2.c to occur between the hours of 7:00 a.m. and 8:00 p.m. on any
weekday or between the hours of 9:00 a.m. and 8:00 p.m. on any weekend or
holiday; and
WHEREAS, improvements identified with the 2025 Street and Utility Improvement Project
include mill and overlay improvements along 39th Avenue from Stinson
Boulevard to Silver Lake Road; and
WHEREAS, this segment of 39th Avenue is primarily surrounded by commercial and multi-
family properties with heavy utilization of the on -street parking; and
WHEREAS, the City's Contractor for the 2025 Street and Utility Improvement Project, North
Valley, Inc., is requesting an exception to the City's ordinance 92.05.V.2.c and
allow for construction operations outside of the working hours between 7:00 a.m.
and 8:00 p.m. on any weekday to alleviate impacts to adjacent commercial
properties and minimize disruption to on -street parking.
NOW THEREFORE BE IT RESOLVED that the City Council of City of Saint Anthony
Village, Minnesota approves the following:
North Valley, Inc. to perform construction outside of the working hours under section
92.05.V.2.c for work to be completed along 39th Avenue between Stinson Boulevard and
Silver Lake.
2. North Valley, Inc. is to provide a minimum of 72 hours' notice to adjacent properties
prior to the start of construction operations that are intended to be completed outside of
section 92.05.V.2.c
