RESOLUTION 25-066
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAINT ANTHONY
VILLAGE APPROVING A CONDITIONAL USE PERMIT FOR COFFEE CART MPLS
FOR A COFFEE CATERING BUSINESS AT 3901 FOSS ROAD
WHEREAS, the applicant has proposed to occupy a portion of any existing building at 3901
Foss Road; and
WHEREAS, the subject property is zoned L-I, Light Industrial; and
WHEREAS, catering businesses are allowed in the L-I district by Conditional Use Permit; and
WHEREAS, the proposed catering business is consistent with the existing conditions on and
around the proposed site; and
WHEREAS, the proposed catering business is not expected to create inordinate conflicts with
traffic or other public roadway congestion in or around the site; and
WHEREAS, the proposed business will be reviewed and monitored by City Public Works
officials to ensure no negative impacts with city utility services; and
WHEREAS, the Planning Commission held a public hearing on September 16, 2025 on the
application and the applicant and members of the public were provided the
opportunity to present information to the Planning Commission; and
WHEREAS, the Planning Commission recommended approval of the Conditional Use
Permit with the conditions discussed in the Staff report and as listed below;
and
WHEREAS, the City Council makes the following findings of fact in support of the resolution
for approval:
1. The property is located in an area of industrial land uses on a minor collector roadway.
2. The proposed use is consistent with the existing and future land uses in the area.
3. The proposed application demonstrates consistency with the requirements for Conditional
Use Permit consideration as listing in the zoning ordinance.
4. The proposed use is expected to be compatible with existing utility services available to
the site in question.
NOW THEREFORE BE IT RESOLVED that the City Council of City of Saint Anthony
Village, Minnesota approves the Conditional Use Permit for Coffee Cart MPLS at 3901 Foss
Road, subject to the following conditions:
1. The applicant continues to comply with any requirements of the City's Public Works
department related to sanitary sewer or water services and/or the applicant shall provide
ongoing verification of compliance as may be requested by public works officials.
