1.39 CUP – 3901 Foss Road

41 Chair Socha opened the public hearing at 7:02 p.m.

43 City Planner Grittman reviewed that the applicants are a coffee service catering provider
44 seeking approval to relocate to an industrial building at 3901 Foss Road. The applicants would
45 occupy a portion of the existing building, approximately 1400 square feet. The total building
46 square footage is approximately 12,000 square feet.

48 Catering operations are permitted in the L-1 district pursuant to a Conditional Use Permit. The
49 purpose of the Conditional Use Permit requirement for food-service-related businesses is to

1 review sanitary sewer and water needs, for which food operations can be significant users. In
2 this case, the coffee business is less likely to raise these issues, but additional reviews from
3 public works will regulate this aspect of business use. From a land standpoint, there would not
4 appear to be any significant impact on the surrounding area.

6 The CUP Requirements were reviewed:
1.7 The use is one of the conditional uses specifically listed for the district in which the
8 property is located.
2.9 The City Council has specified all conditions that the City Council deems necessary to
10 make the use compatible with other uses in the area.
3.11 The use will not be detrimental to the health, safety, or general welfare of people
12 residing or working in the vicinity or to the values of property in the vicinity; and
4.13 The use will provide a service or a facility that is in the interest of public convenience
14 and will contribute to the general welfare.

16 Also provided for Planning Commission consideration are Application Materials, Draft
17 Resolution 25-XXX, and PH Notice – CUP Foss Road.

19 Mr. Grittman reviewed Staff recommends the Planning Commission recommend to the City
20 Council approval of the Conditional Use Permit for Coffee Cart MPLS, based on a finding
21 that the information supplied with the application supports compliance of the proposed use
22 with the intent of the L-1 District, and that the applicant provides ongoing verification of
23 compliance with any further requirements of the Public Works Department as may be
24 requested.

26 Commissioner Hark asked who the previous tenant of that building was, and Mr. Grittman
27 stated he did not know.

29 Mr. Mark Meisner, Forest Lake, MN, thanked the Commission for considering his request.
30 The previous tenant was Mobile Detailing. He and his wife own the catering company. They
31 primarily do corporate and private events.

33 Chair Socha asked if the brewing of coffee can be smelled outside the facility. Mr. Meisner
34 stated he does not believe so. There have been no complaints received so far. The conditional
35 use permit is for Suite C.

37 Commissioner Erickson asked about the amount of traffic on the site. Mr. Meisner stated that
38 they have a couple of cargo vans that bring the coffee to the event. The employees leave their
39 cars at the site. There would be no vehicles larger than a cargo van.

43 Motion by Commissioner Morita, seconded by Commissioner Erickson, to recommend the

VII.6 GENERAL BUSINESS - NONE.

8 Ms. Morello informed the Commission that the Active Transportation Plan and planning
9 process are underway. Commissioner Anderson is the Planning Commission Member on the
10 Active Transportation Planning Team. There are open houses on September 22, September
11 26, and October 2. The locations and times are posted on the City website. They are currently
12 in the engagement phase.

14 VIII.STAFF REPORTS.

16 Mr. Grittman reported that the City Council passed Third Reading of the Electric Vehicle
17 Charging Ordinance. The next ordinance that the City Council will consider is rental housing.
18 First Reading will return to Council at their September 23, 2025, meeting.

Request: 2026 Planning Commission Work Plan
BACKGROUND
Saint Anthony Village engages in an annual Goal Setting retreat each January. The Goal Setting retreat is
an opportunity for City Council, staff and key representatives to develop the City’s annual Strategic Plan
and update the City’s Goals Pyramid. This effort utilizes the policy direction from the Comprehensive
Plan, prior goals, implementation steps and Commission Work Plans to finalize it’s Strategic Plan and
annual goals. Attached to this memo is a proposed draft of the Planning Commission 2026 Work Plan,
highlighting the expected activities for the Commission in the coming year.
As always, one of the Commission’s primary responsibilities is to review and recommend Council action
on land use applications, and as needed, staff-generated proposals for updates to the City’s Code
(particularly the Zoning chapter). This coming year, the Commission will also participate in preparing the
City for the upcoming 2050 Comprehensive Plan update. That project will get underway in full in 2027;
however in 2026, the City will identify priorities and expectations for the Plan, and for the consulting
assistance to lead the project. The City’s Comprehensive Plan is anticipated for draft completion in mid-
2028.
One item that may become a land use discussion item again in 2026 is the Legislature’s consideration of
mandating certain housing or housing-related zoning issues. These issues were discussed broadly in
2024 and 2025, but little consensus emerged. It is expected that the 2026 Legislative session will
continue its discussions in this regard.
At the upcoming December meeting, we would like to review these topics for thoughts as to what
should be considered as the Commission’s work plan for 2026, which will be summarized as background
material for the Goal Setting Retreat. From that process, we will generate an updated Work Plan for
2026. Your thoughts on these and other possible topics will be welcomed.
It is anticipated that the Commission can conduct this discussion informally, without formal motion.
Staff will summarize the material for the submissions to the City Manager’s office.
CONCLUSION AND STAFF RECOMMENDATION
No specific recommendation is offered – the discussion at the meeting will serve as consensus going
forward.
