Motion carried unanirnoyeo Mayor Faust noted that Cor:incilmember'I'hueseri is unable to fulfill the duties of being a Participant in Northwest. Youth & Family Services, and an amendment must be made to Resolution 05-006. Motion'by Councilmember Thuesen, seconded by Councilmember Stille, to amend Resolution 05-006 removing Brian Thuesen as a participant in an outside organization of Northwest Youth & Family Services. Motion carried unanimously Mayor Faust explained Resolution 05-007 must be amended to add Association of Metropolitan Municipalities Alternate, and add ICiwards to the list of outside organizations Councilmember Stille will be a participant in. Motion by Councilmember Stille, seconded by Councilmenmber'I'huesen, to amend Resolution 05-007 adding Association of Metropolitan Municipalities Alternate, and Kiwanis to the list of outside organizations for Councilmember Stille. Motion carried unanimously Mayor Faust requested an amendment be made to Resolution 05-009 designating Councilmember Gray as a participant in an outside organization, and add to the list of organizations, Northwest Youth & Family Services, as well as strike the Association of Metropolitan Municipalities. PUBLIC HEARINGS, None. V. REPORTS FROM COMMISSION AND STAFF. A. Resolution 05-011 • Greater Men %olitan tlousin Commission City Manager Mornson welcomed Jennifer Bergman, Greater Metropolitan Idousing Commission, to the meeting. Ms. Bergman is the Director of Housing Resource Center, and gave an overview of what the organization does. She said the Housing Resource Center provides three services. The first service is housing information, which is provided to any resident in. St. Anthony free of charge. She stated they also provide information on home financing, home maintenance, home buying, and home improvement. She stated they have provided services to 352 St. Anthony residents. She explained the second service provided is construction management service. She further explained ibis service allows consultants to meet with homeowners and make recommendations to improve their houses. They can help review bids, and provide some mediation if tbore arc problems. She said they can monitor construction throughout the process. She stated her agency has provided 388 housing consultations to residents. Ms. Bergman stated the third service they provide is financing. She said they can help to fund home improvements. She explained they are a lender for the Minnesota Ifousing FinanceAgency. They have granted 49 loans to residents in the City. Councilmember Stille questioned how St. Anthony compares with the other cities serviced by Greater Metropolitan Housing Commission in terms of use. He also inquired whether St. Anthony helps to provide sufficient advertising. Ms. Bergman said. advertising is very ,important, and they would appreciate being mentioned in the City Newsletter. She added that St. Anthony does get the word out very well. Councilmember Stille asked for clarification regarding the Senior Housing Regeneration Program. Ms. Bergman explained this program was created two years ago. It was created in order to purchase homes from senior citizens who are moving into senior rental or nursing homes. The GMHC rehabs the home and sells it to fust time homebuyers. She said it has been an extremely popular program. She explained the organization continues to apply for money through agencies such as the Minnesota Housing Finance Agency in order to acquire sufficient funds to continue with the program. She explained that senior citizens enjoy the program because they do not have to hire a realtor or handle any of the moving out issues. Mayor Faust commented that helping people to rehabilitate their homes in a fearless environment is important. He asked if there was a resource limit. Ms. Bergman answered there is an income limit of $88,320 for this program. Councilmember Stille questioned how the funds are regenerated. Ms. Bergman replied the organization applies for loans and grants on the City's behalf. Lane South, Subdivision ofProRert. 8 Mayor Faust welcomed Planning Commissioner Joel Stronngren to the meeting. 10 Planning Cory) In Stromgren addressed Council and provided an overview of the request I 1 by John Dennison to subdivide property at 2812 Silver Lane South. He said they are satisfied 12 with recommendation from staff. 13 14 Craig Kepler, law firm of Macicall, Crounse & Moore, representing the applicant, stated he was 15 available to respond to any questions. 16 17 Motion by Councilmember Stille, seconded by Councilmember Horst, to adopt Resolution 05- 18 012, for Approval of a Subdivision of Lot 2 Block 1, Birkeland 2°1 Addition; Plus 20 -.feet of Lot 1.9 1, Block 1, Birkeland 2`1 Addition, as an Addition to the Property at 2821 Silver Lane. 20 21 Aves — 4, Abstaining—1FCray . Resolution 05-0I3� 2504_ -39°i Avcnue Subdivision oCl'rroinertv- 24 Planning Connnissioner Stromgren. addressed Council and provided an overview of the request 25 by Hunt Associates to subdivide property at 2504 — 39°i Avenue. This will include a portion of 26 Apache Lane. He said it is a routine request and is consistent with the development agreement. 27 28 Motion by COLmCihnennbel- Thuesen, seconded by Councilmember Stille, to adopt Resolution 05- 29 013, 2504- - 39`t' Avenue, Subdivision of Property. 30 31 Ayes -- 4, AbstaininP —I GiLlyl• Motion carried. 32 33 3, Resolution 05-014; 4001 Stinson Boulevard, Planned Unit DeveloppimaR DA 34 Rezonina Retq test. 35 Planning Commissioner Stromgren addressed Council and provided an overview of the request 36 by Quest Development, Inc. to rezone 4001 Stinson Boulevard as a Planned Unit ,Development 37 (PUD). Their proposal is to convert the medical complex as well as build two buildings on site. 38 He noted their intent was to construct new buildings in 2005/06. He explained they have 39 requested to be attached to the existing PUD for the Apache Plaza redevelopment as a way to 40 handle the issue of their property being unsuitable for a PUD. 41 42 City Manager Morrison noted that Quest Development has requested a 30 -day extension and 43 questioned whether Chair Stromgren should return with an update on February 8, 2005. He 44 explained the Council has the option to grant the 30 -day extension as requested, or refuse the 45 request and act on the item as it appears on the agenda. 46 19 City Council Regular Meeting Minutes C January '11, 2005 Page 5 Mayor Faust pointed out that Quest Development may resubmit a different plan. He asked if the Council had questions. 4 Councilmember Horst asked if Mr. Gilligan had reviewed this request. Mr. Gilligan responded 5 he did, and stated that since it does not appear that Quest has sufficient ownership interest in the 6 - -other PUD, they cannot amend that PUD. Ile advised they should return and request a variance from the requirements, or an amendment from the code. 9 Councilmember' Horst asked whether Quest would rather have aPUD than be rezoned. Chair 10 Stromgren answered they want to have mixed use, and therefore need a PUD. He added that the 11 City would need to grant a variance for the land area. 1.2 13 Councilmember Stille inquired what the consensus was of the Planning Commission. Chair 14. Stroingren responded that the concerns of the Staff and City Consultants included whether the 15 utilities would be sufficient to handle the requirements. He noted that one neighbor spoke to the 16 issue of density and traffic. Tae said he understood a fiull blown traffic study was not completed. 17 18 Councilmember Stille clarified whether the City could grant Less than a 60 -day extension when 19 that request is made. Mr, Gilligan explained less than 60 days can be granted, with one 20 extension. In this case, if another extension is requested before February 8, 2005, it could be 21. granted. 2'2 23 Motion by Councilmember Stille, seconded by Coumcilrnember Gray, to grant a 30 day extension 24 on Resolution 05-014, and require the presence of Quest Development Inc. at the City Council 25 February 8, 2005 meeting to present their plan for action and to get a legal opinion from counsel. 26 27 City Manager Mornson asked if a Planning Commissioner could return to give a full staff report 28 on February 8, 2005. 29 30 Motion carried nnanimonsiy. 31 32 VI. GENERAL POLICY BUSINESS OF THE COUNCIL. 33 A. 2005 Street hnprovement Assessments. 34 1. Resolution 05-015; Calling a Hearing on 2005 Street and Utilitylinprovements. 35 Mayor Faust welcomed Todd Ilubmer, WSB & Associates, to the meeting. 36 37 Mr. Hubmer noted that 11 bids were received for the 2005 Street Reconstruction project. He 38 said the low bid was for $1,311,115.722, and that it is anticipated the Council will consider this 39 contract award at the February 22, 2005 meeting. 40 41 Mr. Hubmer reviewed Resolution 05-015, and noted that the estimated cost of improvements is 42 $1,800,000. He noted the public hearing for proposed improvements will be held on February 8, 43 2005 at 7:00 p.m. 44 45 Motion by Councilmember Thuesen, seconded by Councilmember Horst, to adopt Resolution 46 05-015, Calling a ;Hearing on 2005 Street and Utility Improvements. 47 City Council Regular Meeting Minutes January 11, 2005 Page 6 Motion carried unarthnously. 2. Mr. Hubmer reviewed the resolution with the Council and indicated that the 2005 project costs 6 —have -been -determined. Resolution QS -U1 / Callin) a II_earirlg_o-_ --osed Assessment for 2005 Street 14 and Utility Im rovements. 15 Mr. IIubmcr reviewed the resolution with the Council and indicated that the City will hold a 16 hearing on February 8, 2005 at 7:00 p.m. or as soon thereafter as possible. He also indicated an 17 additional public hearing will be held on February 2, 2005 at 7:0 p.m. to give updated 18 information on street reconstruction. 19 20 Councilmember Horst asked 'if cach homeowner would be given an idea of what they will be 21 assessed. Mr. 1lubrncr answered they would. 22 23 Motion by Councilmember Gray, seconded by Councilmernber Gorst, to adopt Resolution 05- 24 017; Calling a Hearing on Proposed. REPO WrS FROM CITY MANAGER AND COUNCiLMEMBERS. 29 City Manager Mornson reported the following: 30 0 Recognition for activities in St. Anthony has been greater this past year. A feature on our 31 municipal liquor stores was done in a magazine; the League of Minnesota Cities featured 32 St. Anthony; many interviews regarding the City were conducted. 33 ® Chandler Place donated money to the local fire dept to purchase a new delibrillator for 34 the new truck the Fire Department wishes to purchase. 35 ® We are being nominated for award by the 'Real Estate Journal for best mixed use 36 development; and also being nominated for best in landscaping. 37 ® The insurance office will audit the fire and water department next month in order to give 38 a new rating. The rating is 5 now, and according to the insurance adjustor, that is a good 39 rating. This is a three-day audit that happens every 15 years. 40 41 Councilmember Stille asked if the National Association of Homebuilders has been to the City. 42 Mr. Mornson said he wasn't sure and offered to find out. 43 Mayor Faust indicated that the team effort has been played by 3 integral parts: Council, Staff and 44 advisors, and the community. He said we have a fine community and now we are getting the 45 recognition for it. 46 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 46 47 City Council Regular Meeting Minutes January 11, 2005 Page 7 Councilmember Stifle said the Parks and Recreation Department is in a transition phase and with central park completed, there is no specific report to the council yet. He commented he attended. the open house at Si:mset Cemetery earlier and said it was a good tour. He noted. January 17 will be the final meeting on the Blue Ribbon Task Force, and the School Board, and a report will come shortly after. Councilmember Thuescn stated it has been an honor to work on some of the projects in the City, specifically the Harding Holding Pond. He noted that there was a lot of citizen input and involvement, and encouraged all citizens to provide input to the City. Councilmember Gray said he appreciated the opportunity to serve the citizens of St. Anthony in this capacity. Mayor Faust said he attended a Blue Ribbon on December 21, and many state representatives were in attendance. He noted the representatives and senators encouraged citizens to give input to the legislature regarding funding He said he attended the.Mississippi watershed meeting earlier and was re-elected to be the representative. VIII. CCMMUN11'Y FORUM. Mayor Faust invited residents to come forward at this time and address the Council on items that are not on the regular agenda. Dennis Cavanaugh, 2909 St. Anthony Blvd., suggested ideas to consider at the Council Retreat of 2005. He noted 8 items. 1) Complete Silver Lake Village. He said this should be a top priority and added that it is a nice piece of work. 2) Complete the Market Place redevelopment. He commented he did not like the commercial enterprise crowding the development and would like to see some green space. 3) Redevelopment of Silver Lake Road :from St. Anthony Boulevard to 37°i Avenue. 4) The landscaping of the Village should be maintained. He said a plan needs to be developed. He said landscaping is a big part of the Village. 5) Work to eliminate noise, especially vehicles with illegal rnuftlers. He said this is an epidemic, and this is a statewide problem. 6) Work to enlarge the Hennepin County Library, stating that usage increased 10% last year. 7) Assure the community that any building done at Sunset Memorial Park maintains the historical character of the property. 8) Find ways to involve the community. Hearing no further items, Mayor Faust moved forward with the agenda. IX. INFORMATION AND ANNOUNCFMENTS. Mayor Faust announced the legislative policies are now in-house and available. Mayor Faust stated Comcast announced they will show the international channel 73 to all subscribers due to the coverage on the tsunami disaster, rather than just for digital customers. Mr. Mornson said there is public hearing at the next Council meeting for the liquor license for Applebees. The Planning Commission recommended the City proceed with the study, and will cost about $2,500 for that assessment. The SAPID conducted their investigation and no concerning items were discovered. The intent and purpose of this AGREEMENT is to: 1. Establish certain hours, wages and conditions of employment; 2. Establish procedures forthe resolution of disputes concerning this AGREEMENT'S interpretation and/or application; 3. Specify the full and complete understanding of the parties; and 4. Place in written form the parties' AGREEMENT upon terms and conditions of employment for the duration of the AGREEMENT. The EMPLOYE=R and the UNION, through this AGREEMEN r, continue their dedication to the highest quality of public, service. ARTICLE 1: RECOGNITION The EMPLOYER recognizes the UNION as the exclusive representative in matters involving conditions of employment of all essential employees of the City of St. Anthony, Minnesota, who are public employees within the meaning of Minn. Stat. 179A.03, subd. 14, excluding supervisory and confidential employees. ARTICLE 2 UNION SECURITY In recognition of the UNION as the exclusive representative, the EMPLOYER shall Deduct the first pay day of each month an amount sufficient to provide the payment of such dues or fair share established by the UNION to be due and payable, and 2. Remit such deduction to the UNION at the earliest practicable date after collection. 3. The UNION may designate certain employees from the bargaining unit to act as Stewards and shall inform the EMPLOYER in writing of such choice. 4. The UNION agrees to indemnify and hold the EMPLOYER harmless against any and all claims, suits, orders orjudgments brought or issued against the EMPLOYER as a result of any action taken or not taken under the provisions of this Article. 1 M r y. New employees shall be on a one (1) year probationary period. Annually, the EMPLOYER shall furnish to the UNION a seniority list of the employees showing their respective dates of hire. There shall be one (1) master seniority list per classification established based on the employees original date of hire. Senior qualified Employees shall be given preference in bidding for shifts, within job classifications. All Employees covered by this AGREEMENT are eligible to bid for shifts by seniority, except those Employees with less than one (1) year continuous service in the Saint Anthony Police Department at the time of such bidding, orwhich are herein expressly exempted. Except as otherwise provided in the Contract, the EMPLOYER will not assign an Employee to work a shift other than the one assigned through the bid process, for the duration of the bid process, unless the EMPLOYER gives the Employee 24 hours notice. If a 24 hour notice is not provided, the EMPLOYER shall pay overtime. Bidding shall commence not less than thirty (30) days prior to the commencement of the work schedule being bid, and bidding shall be open until twenty (20) days prior to the commencement of the work schedule being bid. ARTICLE 4. LAYOFF / RECALL In the event it becomes necessary to lay off employees for any reason, employees within one classification shall be laid off in the inverse order of their seniority. Employees shall be recalled from layoff according to their seniority in their classification. No new employees shall be hired until all employees on layoff status desiring to return to work have been recalled. The employee's option to return to work shall be limited to three (3) years after first notice of recall, subject to EMPLOYER'S determination of competence. ARTICLE 5: DISCIPLINE AND DISCHARGE Discipline shall be forjust cause and in one or more of the following forms: oral reprimand, written reprimand, suspension, demotion, and termination. Grievances relating to this Article shall be initiated by the Union at Step 3 of the grievance procedure under Article 20. ARTICLE 6: PROMOTIONS Promotions are solely at the discretion of the EMPLOYER, subject to the following: 1. There shall be a posting of a job vacancy in the unit for at least ten (10) days before the official closing of applications. The City shall require such written, oral, performance, psychological and other examinations or evaluations as deemed necessary to fill the position. The date(s) of W110 such examination and their respective weight in determining selection shall be communicated to all candidates before the first examination. 3. A written notification of promotion and salary shall be given to the person selected. Amount allowed. Full time employees shall earn personal leave according to the following schedule: Years of Service Hours Accrued Per Year 0 - 5 years 176 hours 5 - 14 years 216 hours 15+ years 256 hours Employees using earned personal leave shall be considered to be working for the purpose of accumulating additional personal leave. 2. Usage, Personal leave may be used as earned, subject to approval by the Department Head and City Manager of the time at which it may be taken. In order to allow coordination of personal leave with family and medical leave, employees seeking to take personal leave may be required to provide enough information about the purpose of the time off to allow a determination of whether the time will also qualify for family and medical leave. If the personal leave also qualifies for family and medical leave, the employee must take both leaves simultaneously. 3. Terminal Leave. Any employee leaving the municipal service in good standing after giving proper notice of such termination of employment, will be compensated for personal leave accrued and unused to the date of separation according to the schedule set forth in Section #7. 4. Waiver of Personal Leave Prohibited. No employee is permitted to waive personal leave for the purpose of receiving double compensation. 5. Procedure. To be eligible for personal leave with pay, an employee shall report as soon as possible to his or her Department Head the need to take personal leave and its estimated duration. 6. Workers Compensation. Employees are covered by the workers compensation laws of the State. In the event an employee is disabled and is entitled to workers compensation, the employee will keep any workers compensation payments received and be eligible to receive a bi-weekly pay check equal to 1/3 pay through the use of personal leave benefits. In addition, the employee will be entitled to earn 1/3 of the amount of the personal leave pay they would otherwise be entitled to during an absence from their employment. Employees receiving such workers compensation will be considered working for the purpose of accumulating additional personal leave benefits. W 7. Unused Personal Leave Pay. An unused personal leave pay policy is established subject to the following rules and regulations: (a) The employee must be in good standing and give proper notice of termination in the case of resignation. (b) Qualifying employees shall receive their accumulated personal leave up to a maximum as listed in the following schedule: Years of Service Maximum Pam 0 - 3 years of service 1/2 of personal leave accrued 3+ years 480.0 hours 4 + years 528.0 hours 5 + years 600.0 hours 8. Donation of Personal Leave to Employees with Serious Medical Problems.. Employees may voluntarily donate personal leave time in hour increments which can be converted to use by employees facing serious medical problems or extended time off due to serious medical problems and who have no accumulated personal leave time or compensatory time available. The use of this donated personal leave must be approved by the Department Head and the City Manager and will be converted to the receiving employee=s paid hourly rate. This does not include temporary or seasonal positions or unionized employees who have a sick pool that is already established. Maximum personal leave is 1,200 hours for all employees hired after January 1, 2004. In the event of the death of any employee's spouse, children, or parents or spouse's parents, the employee will be granted three (3) days of funeral leave with pay. In the event of the death of an employee's or his spouse's grandparents, brothers and sisters, an employee will be granted one (1) day's funeral leave with pay. Employees subpoenaed as witnesses, or called and selected for jury duty shall receive their regular compensation less jury pay. Mileage allowance will not be considered as jury pay. Whenever any employee is delegated to attend conventions of labor which require his absence from work, the EMPLOYER agrees that such absence shall be allowed, provided there is not substantial work interference, and the EMPLOYER is able to make satisfactory arrangements. M All Employees shall observe the following twelve (12) paid holidays each year, plus an additional twelve (12) hours of holiday pay. The normal work week for full time Employees shall be an averaged forty (40) hours. EMPLOYEES, when ordered to work overtime, shall work no longer than a 16 hour shift. The Chief of Police has authority to establish shifts. The average work month for Employees for the purpose of computing personal leave and fractions of a month's work shall be one hundred seventy-three (173) hours. All Employees will be allowed two work relief periods a shift not to exceed fifteen (15) minutes each. ARTICLE 12: OVERTIME Overtime is defined as all hours worked in excess of the scheduled shift. Overtime for all Employees shall be paid as it is earned at the rate of time and one-half (1 /2). Officers called in for SWAT shall receive a minimum of 2 hours of pay at time and one- half (1 YZ). With the mutual agreement of the EMPLOYER and the Employee, overtime shall be compensated at the rate of time and one-half (1 1/2) compensatory time off. Overtime shall be divided on a seniority basis, as equally as possible among all Employees on the seniority list. Officers called in for court appearance while off duty will receive a minimum of three (3) hours pay at time and one-half (1 1/2). Officers required to be "on call" for a court appearance during time off will receive a maximum of two (2) hours pay at time and one half (1 1/2). A duly authorized representative of the UNION will be permitted to visit the premises of the EMPLOYER at reasonable times for the purpose of transacting legitimate business of the UNION, provided there will be no undue and unreasonable interference with the operation of the department. The UNION shall be allowed to post reasonable and appropriate UNION notices for employees at a convenient place designated by the EMPLOYER. One (1) Employee at a time shall be granted leave without pay to attend to UNION business not to exceed a total often workdays per calendar year. The EMPLOYER shall attempt, if possible, to arrange the employee's work schedule so that the employee will not lose pay. ARTICLE 15. HEALTH AND LIFE INSURANCE The EMPLOYER will contribute six hundred twenty dollars ($620.00) per month for 2005 towards the total cost of the Employee's health and life insurance and any dependent's health insurance costs. By mutual agreement employees may use up to Fifteen Dollars ($15.00) of health insurance for dental insurance. If the total cost of the insurance is less than the City contribution, then the City will refund the difference in a one-time, taxable payment on January 30th for the previous year. All additional longevity pay in lieu of insurance benefit is hereby terminated. Employees separating during the year will receive paid refund on a pro -rata basis. (The provisions of this paragraph will not apply to any employee hired after December 31, 1988. When two-day holidays fall on the Friday pay day and the Thursday preceding the Friday pay day, employees will receive their pay checks on the preceding Wednesday. E. Shift Differential. Sergeant. Employees classified or assigned as Sergeant shall receive $300.00 per month in addition to regular Patrol wages in 2004. Investigator. Employees classified or assigned as Investigator shall ive $1 rece50.00 per month in addition to regular Patrol wages in 2004. ARTICLE 17. LONGEVITY Employees with the required service credit shall receive longevity pay according to the following: Five (5) years but less than ten (10) $100/month Ten (10) years but less than fifteen (15) $150/month Fifteen (15) years or more $200/month ARTICLE 18: SCHOOLS AND TRAINING SESSIONS All employees shall be required to attend such schools or training sessions as may be required by EMPLOYER. Compensation for such attendance is considered included in the approved salary schedule unless EMPLOYER is reimbursed from an outside source. The EMPLOYER will contribute 100% of the cost of any necessary license fee and application for such license under the Peace Officer Standards and Training Act (P.O.S.T.). The EMPLOYER is to make every effort possible to provide the necessary P.O.S.T. certified training required under the current law during the course of duty time. In the event that it is not possible to provide necessary P.O.S.T. certified training during duty time, the employees will be reimbursed in the form of compensatory time off for off duty training hours at the rate of time and one-half, effective from the date the agreement is signed. The EMPLOYER will recognize Stewards selected by the UNION as the grievance representatives of the bargaining unit. The UNION shall notifythe EMPLOYER in writing of the Stewards and of their successors when so named. 3. A grievance is defined as a dispute over the interpretation or application of this AGREEMENT. 4. Grievances shall be resolved in the following manner: STEP 1. An employee claiming a violation concerning the interpretation or application of this AGREEMENT shall within twenty-one (21) calendar days after such alleged violation present such grievance to the employee's immediate supervisor designated by the EMPLOYER. The EMPLOYER - designated representative will give a final answer to Step 1 grievance within ten (10) calendar days. If a grievance is not resolved in Step 1, such grievance shall be placed in writing and referred to Step 2 within ten (10) calendar days after the EMPLOYER'S final answer in Step 1. Anygrievance not referred in writing by the employee within ten (10) calendar days shall be considered waived. STEP 2. The written grievance shall be presented personally to the employee's department head or other EMPLOYER -designated representative. A copy will be sent by registered mail, return requested to the City Manager. The EMPLOYER -designated representative shall give the employee the EMPLOYER'S Step 2 answer within ten (10) calendar days after receipt of such Step 2 grievance. If a grievance is not resolved in Step 2, such grievance shall be referred to Step 3 within ten (10) calendar days following the EMPLOYER -designated representative's final Step 2 answer. Any grievance not referred in writing by the employee within ten (10) calendar days shall be considered waived. STEP 3. The written grievance shall be presented personally to the EMPLOYER -designated representative (City Manager). The EMPLOYER - designated representative shall give the EMPLOYER'S answer within ten (10) calendar days after receipt of such Step 3 grievance. If a grievance is not resolved in Step 3, such grievance shall be referred to Step 4 within ten (10) calendar days following the EMPLOYER -designated representative's final Step 3 answer. Any grievance not referred in writing by the employee within ten (10) days shall be considered waived. M STEP 3A. If the grievance is not resolved at Step 3 of the grievance procedure, the parties, by mutual agreement, may submit the matter to mediation with the Bureau of Mediation Services. Submitting the grievance to mediation preserves timelines for Step 4 of the grievance procedure. STEP 4. Unresolved grievances are subject to the arbitration provisions of Minnesota Statutes, Section 179A.21. The arbitrator shall not have the right to amend, modify, nullify, ignore, add to, or subtract from the provisions of this AGREEMENT. The arbitrator shall consider and decide only the specific issue submitted in writing by the EMPLOYER and the UNION and shall have no authority to make a decision on any other issue not so submitted. The arbitrator shall be without power to make decisions contrary to or inconsistent with or modifying or varying in any way the application for laws, rules or regulations having the force and effect of the law. The arbitrator shall submit his decision in writing within thirty (30) days following the close of the hearing or the submission of briefs by the parties, whichever is later unless the parties agree to an extension. The decision shall be based solely upon the arbitrator's interpretation or application of the express terms of this AGREEMF_N r on the facts of the grievance presented. All documents, communications and records dealing with a grievance shall be filed separately from the personnel files of the involved employee(s). The time limits established in this Article may be extended or modified by mutual consent of the EMPLOYER and the UNION and shall be in writing. Employees shall be allowed reasonable time to process grievances during working hours without loss of pay. Uniform allowance shall be $500.00 in 2005 for each officer to be paid to the officer as a reimbursement for uniform expenses. Protective clothing, i.e., bulletproof vests, etc. will be provided by the EMPLOYER, per Federal and State regulations. The EMPLOYER will supply at no cost to the Employees all required uniform items and reasonable replacements upon initial hire. New hire's will not qualify for uniform allowance until they complete one year of service. ARTICLE 22: EMPLOYER AUTHORITY The UNION recognizes the prerogative of the EMPLOYER to operate and manage its affairs in all respects in accordance with existing and future laws and regulations of appropriate authorities including municipalities personnel policies and work rules. Rules and regulations shall be reasonable and consistent with this AGREEMENT and applied uniformly and without discrimination. The prerogatives and authority which the EMPLOYER has not officially abridged, delegated or modified by this AGREEMENT are retained by the EMPLOYER. Nothing in this AGREEMENT shall prohibitor restrictthe right of the EMPLOYERfrom sub- contracting work performed by employees covered by this AGREEMENT. In the event any provision of this AGREEMENT shall be held to be contrary to law by a court of competent jurisdiction from whose final judgment or decree no appeal has been taken within the time provided, such provision shall be voided. All other provisions shall continue in full force and effect. The voided provision shall be renegotiated at the request of either party. ARTICLE 24 DURATION This AGREEMENT shall be effective as of the first day of January 2005 and shall rernain in full force and effect until the thirty-first day of December 2005.
