Dear Mike:
As you know, the Chamber is cooperating with Len Pratt and his developers to host the Pall Grand
Opening Celebration. It is formally to be known as "Silver Lake Village Fall hest" and will be held
October 15ri' from 3 to 9 p.m. (At this time we are even considering starting at 2 p.nn.) Th.e total
program is still being developed but will include events at the new amphitheater from 3-6 p.m. and
a stage to be set up probably on 39"' street for the 6 — 9 segment. We anticipate we will need street
closing around noon to allow for setup ofvendor booths (local merchants and others).
We have begun fund raising from all major players in this huge development and to a lesser extent
from the new merchants. We also have met with Len Pratt and received a commitment lion him to
help provide a "real community celebration."
In this regard we are asking St. Anthony Village to provide "in-kind" donations, specifically
necessary police and fire protection, public works help in closing streets, providing power if
necessary, and load of picnic tables to be set up opposite the main stage. We are also requesting
permission to set up booths on the sidewalk or street meas for vendors.
We are well aware of the City's involvement in the Silver Lake Village development, and we hope
that we can count on the City's participation in this celebration.

CALL TO ORDER.
Mayor Faust called the meeting to order at 7:00 p.m.
PLEDGE OF ALLEGIANCE.
Mayor Faust invited the Council and audience to join him in the Pledge of Allegiance.
ROLL CALL.

1. APPROVAL OF SEPTEMBER 13, 2005 CITY COUNCIL MEETING AGENDA.
Motion by Councilmember Thuesen, seconded by Councilmember Stille, to approve the City
Council Meeting Agenda of September 13, 2005.
Motion carried unanimously
IL PROCLAMATIONS AND RECOGNITIONS.
A. Kiwanis Peanut Da_
Councilmember Stillc read the proclamation declaring Friday, September 23, 2005 as St.
Anthony Kiwams Peanut Day.
Motion by Councilmember Stille, seconded by Councilmember Thuesen, to approve the
Proclamation Declaring Friday, September 23, 2005 as St. Anthony Kiwanis Peanut Day.
Motion carried unanimousiv.
Councilmember Stille is a member of this group and explained the group provides an outlet for
children through a number of programs. The group shows children by example how to be a part
of the community. He said they are always looking for members. He noted there would be a
meeting the following morning at 8:30 a.m. for students at high school.

VI. GENERAL POLICY BUSINESS OF THE COUNCIL.
A. Consider Resolution 05-00,72, rc: Proposed 2005 tax levy and budget in compliance with
the_Truth-in-J'axation Act.
Mr. Morrison reviewed the Resolution with the Council and indicated that Resolutions have been
prepared resolutions to set the 2006 tax levy. He noted Mr. Larson, Finance Director, and he had
prepared a PowerPoint presentation.
Mr. Morrison explained the Council had asked staff to develop a financial plan to review
alternatives to offset the impact of the 2006 tax levy. He said they have proposed a budget of
54,177,500, which is an 'increase over last year's budget. He noted they have proposed changes
in the budget. Some funding his been restructured. At Council's direction, he stated they are
proposing a 0% increase in the General Fund levy, however, there will be an increase to the
Road hnprovement Levy.
Mr. Morrison siatcd it was learned that the City does not have to hold 11Ie Truth m -Taxation
meetings. The meetings can be held, however, if preferred. if the Truih-in-Taxadoil meetings
are not held, the Council still has to adopt a levy at a December meeting. Hs asked the Council
to consider whether these meetings should be held as he reviewed the budget proposal.
Mr. Morrison explained there is a 5208,500 increase in the General Fund Budget over the 2005
budget. Employee pensions are going up due to the PERA law being changed. The levy will be
kept the same. IIe summarized how the levies impact property taxes. He stated the City is in its
eleventh year of road improvement projects. This portion of the budget has increased $124,180.
This increase for road improvement is the primary reason for the levy increasing.
Mr. Morrison pointed out that there have been no new staff positions; however personnel costs
have increased due to health insurance and PERA laws. Motor fuel costs are up which is an
impact to the General Fund.
He explained that the City receives money from the Fiscal Disparities Pool. This gets distributed
to cities in the metro area. St. Anthony will receive $395,820 this year. He also highlighted
changes in Limited Market Value Credit. 'Phis program has been extended two years until 2010.
This limits the amount of taxable value a property can be increased in one year.
Councilmember Thuesen asked in regard to the fuel costs rising whether the City has a contract
with any providers for discounts on gas if a certain amount was purchased. Mr. Morrison
explained the City does have their own pumps, and less is paid for gas than at the gas stations.
Coumcilmember Stille asked when the Fiscal Disparities will be known for 2006. Mr. Larson
answered the end of October.

Mayor Faust noted that one of the things the Association of Minnesota Municipalities and the
Lcague of Minnesota Cities is working on is to bring some truth into the Truth -in -Taxation
paper. fie also pointed out that the only increase is the road reconstruction, and the staff felt it
was important to continue with the road improvements. Ike asked Mr. Mornson if he was
comfortable with the expenses and whether the budget will adequately handle the expenses
without putting the city at risk. Mr. Morrison answered he is comfortable.
Mayor Faust reiterated that there are two options in the Resolutions. One option is to hold the
Truth -in -Taxation meetings; and the other is to have the statement show that there is no
requirement to hold the Truth -in -Taxation meetings. In this case, the normal monthly schedule
for Council meetings would continue.
Councilmembcr Tlurescn stated he is in favor of holding the Truth -in -Taxation meetings even
though it is not arcquircment. Ile said he feels it is the right thing to do and it shows the
community that the City is up front.
Councilmcmber Stillc asked if the notices would go out either way, and whether there would be
an added cost to sending them. Mr. Lawson explained the notices would go out either way.
Councilmcmber Stille said the bottom line is that we need to let the residents have a chance to
talk. That means wo will have the hearings on a night: that is not traditional for Councilrncetings
and could cause confusion. Ile said he would lean toward keeping the current schedule.
Mayor Faust gave a reminder that there have already been three meetings. The Truth -in -
Taxation hearing is for the purpose of giving the public a chance to ask the City to reduce the
budget. We are keeping the budget the same and cannot reduce it. He said we may give false
hopes, l3e said that the fact that we didn't hit the threshold that requires a ":Crush -in -Taxation
meeting is a good message to the community, This is the first time since 1991 that we are not
required to hold one. We arc attempting to be fiscally responsible. He stated he is inclined to
favor Option one, which is to not hold the Truth -in -Taxation hearing. He pointed out that any
resident can appear at any meeting and matte any statements they wain to regarding the budget.
Motion by Councilmcmber Stille, seconded by Councihneinber Thuesen, to adopt Resolution 05-
072, re: A Resolution Setting the City of St. Anthony Prod osed 2006 Tax Levy and Budget in
Compliance with the Truth -in -Taxation Act, referencing Option 1 in the packet as the preferred
Resolution which does not require a Truth -in -Taxation meeting be held.
Mayor Faust noted the December Council meetings will be held at their normally scheduled date
and times.

B. Consider Resolution 05-073, to: Adopt Salo Park Maintenance and Regulations.
Mr. Morrison reviewed the resolution with the Council and indicated that this has been worked
on for the last 12 months. The property is owned by the developer and the City has an casement
to use. This partnership requires some type of agreement to be set up for maintenance purposes.

Mr. Morrison noted the four points in the Agreement for the maintenance of Salo Park: The City
has a right to use the subject property for park purposes; The development team, through
Apache Park, LLC will manage and maintain the improvements. Reservations for use of
facilities will be taken by Apache Park, LLC and City permitting requirements must be met;
Specific rules for Salo Park are established in Bxhibit B to the Agreement; In exchange for
public use of the facilities, the City will, as outlined in the Redevelopment Agreement, pay the
annual maintenance costs of the Ponding Site Improvements. Apache Park must provide by July
I of each year an estimate of the maintenance costs for the following calendar year.
10 Mr. Morrison noted that Exhibit A is the Public Use of Apache Park Property and Facilities.
11 This is set up differently than any other park in the City due to its ownership. 'there will be a
12 committee of two City employees as well as representatives of the housing and commercial
13 entities. The committee will review applications for use. lie explained the rites are triose in the
14 City Ordinance, and will be consistent with other park rules in the city.

16 CoLine lhnelnber Thuesen asked if there was any discussion about a maximum annual increase
17 that could be charged to the City for the maintenance agreement. Mr. iYlornson responded (here
18 was none.

21 explained that Apache Park will have to submit a budget every year. Flo added that there isalso
22 a provision that the City can take over the maintenance of the park if it feels something is not
23 being handled correctly.

25 Councib�nember Stille questioned whether the name of Salo Park has been fully dedicated and
26 whether the naming of the facility should be incorporated as part of this agreement. Mr.
27 Morrison said a resolution has not been passed for the name of the park.

29 Councilmember Stille commented the Resolution states this would finalize the Agreement,
30 though there are details that need to be worked out.

32 Mayor Faust noted that the final Whereas in the Resolution should have the following added to
33 it: "This park shall heretofore be known as Salo Park." The casement gives us those naming
34 rights. It has been suggested by several committees, and the developers, as well as the Council
35 as a whole to name the park Salo Park.

37 Motion by Councilmember Stille, seconded by Councilmember Thuesen, to adopt Resolution 05-
38 073, re: A Resolution Relating to Assignment, Assumption, Basement, Park Management and
39 Maintenance Agreement, including in the last Whereas "This park should heretofore be known
40 as Salo Park."

® The ISO just completed a review of our fire delivery system. St. Anthony decreased
from a 5 to a 4. Very good news. I is the best number; 10 is the worst number.
® Finance will be conducting an RFP for Audit Services for the 2005 audit.
® Emerald Park Public Information Meeting September 28, 2005. A consultant was hired
at the Council's recommendation.
® Minnesota EDAM presentation Thursday, September 7.5 on St. Anthony's redevelopment
efforts.
8 ® Hennepin County Health Department/St. Anthony Police and Fire conducted an
9 emergency plan for class dispensing site at St. Anthony Schools today.
10 ® Some residents that assisted the Historical Intern and asked if the City would consider a

26 Mayor Faust stated the Historical Society would be excellent for the City and suggested a staff
27 person serve as liaison.

29 Councihmenrbcr Stillc reported he had agreed to serve on Kiwanis Board starting in October.

33 Mayor Faust indicated that the Council met with the School Board for their quarterly meeting.
34 They reported that they had a meeting with the New Brighton City Council. He said it is
35 mutually beneficial to give updates to the boards.

37 Mayor Faust said he was invited to Salo Days in Salo for the Sister City Celebration. He said it
38 is an interesting government compared to ons. There are 43 members on their council. They
39 are responsible for most the functions our county does. They have 1700 employees. He, said we
40 will look at inviting them back next May or June.

42 Mayor Faust also reported he attended the Association of Minnesota Municipalities on
43 September 6, and one of the items he talked about was the Truth -in -Taxation and how the state
44 reports the numbers. Those policies will be brought up for our vote in November.

1 He also reported he attended a Mississippi Watershed Management Organization meeting. He
2 said they have prepared for science classrooms earth science that encompasses the Middle
3 Mississippi River Watershed Management.

Restaurant Group
MANAGER'S REVIEW:
In accordance with ordinance 1000.06; Consideration of Application, Public Hearin the
City is required to hold a public hearing on all new on -sale intoxicating liquor license
following an investigation from the St. Anthony Police Department.
The SAPD conducted their investigation and no concerning items were discovered.
After approval, the license will be sent to the State of Minnesota for review and
approval. This process can take up to 30 days. No hearing is required for renewal or
the transfer of a license. The fees for said license are as follows:

Background:
Mr. Leonard appeared before the Planning Commission in a concept review at their August 1611, meeting,
Proposing to move Snyder's Drug Store from its current location in the St. Anthony Shopping Center to the
end cap unit in the St. Anthony Marketplace. He indicated that the lease at their current location is soon up
and since the current site no longer suits their needs they became interested in the end cap when they were
advised that it was available. Mr. Leonard stated that this unit is attractive to Snyder's because it is an end
cap and they could easily install a drive-thru for the convenience of their physically challenged customers
and parents with small children.
The Planning Commissioners discussed the traffic flow of the proposed. drive-thru window and it was
suggested that to alleviate traffic issues that the proposed. drive-thru be a one-way.

activities as a permitted conditional use, it will give the City the ability to place conditions on this use to

Because the City's zoning ordiincunce did not allow this use .in the Industrial Zoning District, the. RJEO 49
requested that the Ordinance at Section 1640.03 be amended to allow catering as a permitted conditional.
use in the Industrial Zoning District. At their August 23rd. meeting, the City Council approved the text
amendment -and after the required reading, the amended ordinance was published in the City's legal
newspaper, :making it effective.
Mr. Refiners is now requesting a public hearing to consider granting IUOE 49 a conditional use permit for
their catering services.
Proposed Conditions:
1.) All parking must be contained to on-site parking hots.
1) .'The Applicant must abide by and comply with all regulations imposed by the Hennepin.
County Public health and the State of Minnesota.

Currently, the property is zoned R-1, with an existing single-family structure on the lot. It is a corner lot

The current owner also went before the City Council at its June 21st meeting with a petition for an R-3
Townhouse Zoning District rezoning request. 'The Council denied the requ.est due to concerns about spot
zoning. Mr. Martenson is now proposing to submit a rezoning request that would change the current
zoning of R-1. to R-2 and presented his concept to the Planning Commission at a concept review at the July
1.9a, Planning Commission meeting. As stated earlier, the property adjacent to the subject property is
currently zoned R-2, despite its current structure being used as a single-family residence.
The R-2 Zoning District requires that a corner lot have an area of 14,000 SF and 100 feet in width at that
building setback line. Based on two different sources, Staff has varying information about the square
footage of the subject lot. The plat map that the City receives from Hennepin County shows that the lot is
107 x 220' (23,540 SF) while the information from. Hennepin County's web site shows the lot as 107' x 180'
(19,260 SF). The enclosed copy of a survey of the lot shows an 18' x 220' roadway easement that mostly
accounts for the discrepancy in the square footages. Nevertheless, this lot conforms with the area and
width as required by the City's Zoning Ordinance for an R-2 designation.

Municipal planners, nationally, long have maintained that owner -occupied homes go hand-in-hand with lower crime

many situations, the yard generally is sufficient to allow for this installation without going into the setback,
side yard or front yard. And. in these situations, the Building Inspector and Fire Marshall would oversee
the installation to ensure proper placement and dimensions as required by the building code.
All the cities that responded. to Staff's requests for information indicated that they do not have anything irh
their zoning ordinances that: specifically address egress windows in the setback because, it's more of a safety
issue. As such, egress window wells are mostly allowed by their city's policy, and usually without the
zoning departm.ent's consideration. All stated that building permits are required for egress window wells
construction so that Building Inspector and Fire Marshall can review the building plans.
The cities of Minneapolis, St. Paul, Blaine, Hopkins, New Brighton and Lexington have adopted policies
that are based on the MN Building Codes for encroachments into the side or front yard for egress wind.ov\r
wells. Staff members for Blaine, Lexington and Hopkins have not been able to locate any ordinances that
have language that address egress window requirements or restrictions in I lie setback of'a lot. Some cities,
like New Brighton, address requests through the building inspections depa:riment to install egress windows
in the setback on a case-by-case basis.

In speaking with the planning and zoning departments for the cities of Minneapolis and St. Paul, they bq3
indicated that egress window wells are allowed no matter what because it's an issue of safety for both the
resident and emergency personnel. St. Paul said that the City Council did have concerns as wellabout
people falling into the wells, so have required fencing around the wells .in areas where the setbacl< to the
property is narrow. Otherwise' if someone falls into a well and the individual is not the property owner,
the individual can be cited for trespassing.
Michelle Howard of the -Minneapolis .Planning and Zoning Department said that they viewed the
installation of egress window wells the same as St. Paul. She said that both cities have side yard setbacks
on some properties that: that are 3 to 4 feet from the property lines and they view egress window wells as
always allowable because of the safety issues that they address. Ms. Howard, as did the planner from. St.
Paul, repoi:ted that they have never required properties owners to attend public hearings on their requests
to prove hardship or to consider economic gain as an impedimsnt to the allowance and construction of
these structures. It is simply a rr.atter of safety and they can be installed without planning and zoning
review. This seems to be the same procedure for other cities that Staff contacted.
Staff also requested memos form. the Building- Official and the St. Anthony Fire_ Department regarding
egress window wells.

Construction and installation of an egress window well would still require a building permit. This permit
ha,ould trigger inspections by the Bu ildvng Inspector and. Fire Marshall, which would provide oversight and.
control over the construction of an egress window well in the setback.
Staff recommends that the Plana ng Commission and the City Council approve the text amendment that
allows the construction and installation of any life safety improvement to a residential. structure. Expert
consideration for these installations should be required from emergency personnel and the building official.

I have been asked by the Assistant City Manager to respond 'to the issue of egress windows
as a life saving device.
When properly placed and maintained, egress windows are, without a doubt, a valuable tool
in the protection of human life. They are Currently required in all new construction of all
below gradedwellings and are required in any major renovation projects of below grade
dwellings. Without egress windows, a single stairway is often the only means of entering and
exiting the basement of many St. Anthony homes (one way in, one way out). This is a very
potentially dangerous situation not only for the occupants put also for any emergency
personnel required to mitigate a below grade problem. Should the sole means of egress
becorne impassible due to fire or structural failure, there would be no other escape and time
would become critical to life.
Because of this, placement of an egress window is of great concern To place the egress
window in close proximity to the stairway would be impractical in the event a single small fire
Could block both means of escape. Ideally, the egress window would facilitate the most
heavily used room in the basement and be remote from the stairway. They are also required
in any below grade bedroom.
It is my recommendation that the placement of an egress window be reviewed during the
building permitting process by not only our building code official but also our Fire Marshall.

1 have not been considering the area well as an encroachment into the side yard setback
areas for the following reasons.
® tigress windows, of a specific minimum size, are a life -safety requirement of the
building code, when finishing habitable space in a basement. When these
windows are below finished grade, they require a specific minimum size area well
in order to provide for occupant egress and firefighter ingress. It is generally
accepted in code administration that a specific life -safety code requirement should
take precedence over a general zoning code requirement. Zoning setback
requirements are generally not based on life -safety issues.
0 Structures are prohibited in the setbackareas, however retaining walls are
specifically exempted 11-om the definition of structures. Reference St. Anthony
Zoning Ord. 1605.0 1, Subd.72. I feel that an area well more closely matches the
definition of a retaining wall than that of a structure.
® 1605.01 Subd. 17 states that setback distances are measured to "the building," not
to the overhangs, projections, etc. I don't consider the area well as being" the
building. "
® 1605.01 Subd. 84 states that measurement is to the "principal building."
® There is an extensive List of allowable encroachments into yards in section
1650.03, paragraphs (a) thru (h). I don't believe that when this ordinance was
authored, area wells of this size, (3'x 3' minimum), were in conunon use, or even
contemplated. If they had been, presumably they would have been included as an
exception.
® It is feeling of the code community that providing for the safety of the building's
occupants is the primary consideration. People will continue to finish, and
inhabit, basements. I would rather have them do this work with a valid building
permit, and a compliant egress window, than have them avoid the permitting
process due to overly restrictive zoning requirements.

AN ORDINANCE RELATING TO AMENDING SECTION
1650.03 OF THE ST. ANTHONY CITY CODE
The City Council of the City of St. Anthony hereby ordains:
Section 1650.03 of the St. Anthony City Code shall be amended, by adding stipulation
(i) in the zoning code:
1650.03 Encroachment in Yards.
(i) Any life safety improvements to a residential structure such as egress
window wells and/or other similar above grade exiting requirements so long
as access to the rear yard is preserved.
This Ordinance shall be in full force and effect upon passage by the City Council and
publication of the Ordinance or a Summary thereof in the City's official newspaper.

Staff have received several complaints rccen ly from residerits about all the vehicles for sale at Mtshire
Park School parking lot. Becai:ise this use is not listed as allowable in the Zoning Ordinance for any zoning
district, selling vehicles in this manner is not allowed. Vehicles parked on public property or public right:-
of-ivav would be cited and towed at the mnaur's expense. Wiltshire.Park is con 7dczea pi avate property
and as such, th.e noli.ce can oraly respond if and when there is a call from the. school staff
The Police and the Public Worlcs'Departments have been workbr g with the school staff to determine a
resolution to this situation. As a result of Staff discussion, I received a copy of the City of Falcon.Heights'
ordinance regarding vehicle sales. This ordinance language was used. as an example of a. possible ordinance
that the City may adopt to alleviate the situation. This proposed language was sent to the City Attorney
and the Police Department for their comments.

AN ORDINANCE RELATING TO ADDING SECTION
926 OF THE ST. ANTHONY CITY CODE
The City Council of the City of St. Anthony hereby ordains:
Section 926 of the St. Anthony City Code shall be added as the following:
926.00 Restriction on Vehicle Sales
926.01 Residential Districts.
Subd. 1 Motor vehicles and recreational vehicles which are permitted
within the respective residential district may be advertised for sale
and sold provided the vehicle is owned by the resident on whose
property the vehicle is parked and to whom the vehicle is currently
licensed and is operable.
Subd. 2 Commercial vehicles shall not be parked in a residential district:
and advertised for sale.
Non-residential Districts.
Subd. 1 Motor, commercial and recreational vehicles shall not be
displayed "for sale" or sold within non-residential districts unless
the vehicle is owned by the employee of said business where the
vehicle is parked and with the consent of the business owner.
This Ordinance shall be in full force and effect upon passage by the City Council and
publication of the Ordinance or a Summary thereof in the City's official newspaper.

Chair P'aust called the meeting to order at 7:46 p.m.

Commissioners present: Chair Faust; Commissioners Stille, slid Thuesen.

Motion by Commissioner Stille, seconded by Commissioner Thuesen, to approve the September
13, 2005 housing and Redevelopment Authority Agenda as presented.

Motion by Commissioner Thu en; seconded by Commissioner Stille, to approve the Consent
