Mayor Faust called the meeting to order at 7:01 p.m.
PLEDGE, OE ALLEGIANCE.
Mayor Faust invited the Council and audience to join him in the Pledge of Allegiance.

Mayor Faust read the letter submitted by George 11. Wagner, Executive Director, Chamber of
Commerce. The letter requested the City provide "in-kind" donations to include police and fire
protection, public works, power, and picnic table set up. He encouraged all residents to attend.

7 A. Consider Resolution 05-075 rc: intoxicating liquor license for St. Anthony Rcstaurant

9 Mayor Faust opened the public hearing at 7:08 p.m.

11 Mr. Morrison stated the liquor license request was withdrawn in July 2005 due to plans. The
12 police department conducted abackground investigation and found nothing that does not allow
13 them to obtain a license.

is Councihnember Stille stated the application has a lot of blanks, and asked if it is a draft. He
16 noted several examples including, page 3, the amount of investment, and page 1, the name of the
17 business. Mr. Mornson replied the City only needs information on the principal owners to do a
18 background check. lie added some items are still being negotiated.

20 Robert Foster, Attorney, representing the applicant, St. Anthony Restaurant Group, stated the
21 lease was signed today. Ile noted the construction company, Aincon Development, has informed
22 him the building permits are in. Iie anticipates construction will begin as soon as the liquor
23 license is approved. He added when the paperwork was submitted a few weeks ago the lease
24 terms were still being negotiated and they are now in a position to finalize it.

26 Councilmember Hoist aslced if they have decided on a name. Guy Peterson, principal owner,
27 replied The Village Grill and Bar.

29 Dermis Cavanaugh, 2909 St, Anthony Blvd, stated this issue is difficult because it is not about a
30 liquor license, but a restaurant. He noted he is worried the City is getting too much of a bar, that
31 it does not feel like a restaurant, and that quality of life will be diminished. He noted he is also
32 worried it is not for the community, that it would attract motorcycles and, again, that it is going
33 to be a bar. He added he feels the operators do not have the passion .for coming to the City and
34 helping the community. He recommended Council not grant the license.

36 Mayor Faust closed the public hearing at 7:18 p.m.

38 Councilmember Horst stated previous meetings focused on the community's concerns and it was
39 clearly pointed out that this must be a family -style restaurant, not a bar. He added Council
40 agreed the operator deserves a chance. He added Council couldn't stop a business from coming
41 into the City because of a license. He encouraged Council support the resolution.

1 Councilmember Stille stated he will vote against this. He added the City sold themselves short
2 on the redevelopment agreement, there is not much of a business plan, and he is not impressed
3 with the operator, yet challenges him to be proved wrong.

5 Mayor Faust stated he intends to vote for the resolution although he had strong concerns a month.

Councilmember Thuesen stated he will stand with the initial vote on assessments and believes
the operator understands Councils' concerns.
Councilmember Gray stated he has reason to believe in the operator, they have a good plan, and
Council expects at least 50% food sales.
Councilmember Stille reiterated ]re is voting no and understands they have entered into a
redevelopment agreement which needs to be honored.

A. Consider; Resolution _05 076,_ re: conditional use permit for Sr dcr's Dr.u)Store at St.
Aulron_v Marl-< iplace.,
Commissioner Stromgren stated Snyder's is looking to relocate to the west of St. Anthony
Marketplace. This CUP, which the Commission approved with conditions, is for a drive-th ru
window.
Councilmember Thuesen asked ifthere would be fairly low usage and if there were peak times.
Commissioner Stromgren replied the usage would be low, generally senior citizens and parents
with children. He added he is not aware of any peals times. Dave Leonard, Snyder's Drug,
stated peak tunes vary by store but may be between 5:00 p.m. and 7:00 p.m.
Councilmember Thuesen asked if the window would be used only for prescriptions. He added
the open time seems a bit late, and asked if there was a discussion regarding hours. Mr. Leonard
replied yes, it is for drop off and pick up only. Commissioner Stromgren replied noted hours are
operation hours and are consistent with Snyder's corporate standard.
Councilmember Horst asked how it was decided to not allow a full canopy on the drive-thru.
Commissioner Stromgren replied it was not a request from the applicant. Mr. Leonard replied
there is no intention to match the canopy to what is there, they just need to protect the drawers.
Councilmember Stille asked if there was any discussion with regard to hours on weekends. Ile
also asked about neighborhood opposition. Commissioner Stromgren replied it is industry
standard that there is significantly reduced hours on the weekend. He added there is no
neighborhood opposition.
Mayor Faust asked if esthetics would mimic what is currently there. He added limited hours on
Saturday and Sunday, as noted in the resolution, seems vague. Mr. Leonard replied there would

be an eight hour shift on Saturday and less than that on. Sunday. He added the store has the
ability to stay open longer but pharmacy horns are less.
Mr. Gilligan pointed out that it should be noted the CUP runs with the Snyder's property,
otherwise somebody else could use it; therefore, Council may want to limit it Snyder's. Mayor
Faust replied "limited to the use or a pharmacy operation" will be added to the resolution under
the second WHFRFAS, item 5.
Motion by Councilmember Thuesen, seconded by COnnellmeMber Gray to approve Resolution
05-076, re: conditional use permit for Snyder's Drug Store at. St. Anthony Marketplace with the
addition of item 5.
Motion carried m animously.

Commissioner Stromgren stated this request was denied by the Planning Commission, the
applicant did not appearance at the public hearing, and there was a lack of submitted
information. [Ie added the applicant has requested a withdrawal of the request.
Motion by Councihneunber Horst, seconded by Councilmember Stille to approve the applicant's
withdrawal of Resolution 05 -078, rc: rezoning request 3645 Chelmsford Road.
Motion carried unanimously.
B. Consider Resolution 05-077, rc: conditional usellermit for International 49ers Group.
Commissioner Stroingren stated this CUP is a continuation of text change to allow catering
operations at the building. Ile reviewed the conditions.
Councihmennber Stille asked what is the rationale for police notification. Commissioner
Stromgren replied it is a remote location.
Motion by Councilmember Gray, seconded by Councilmember Thuesen to approve Resolution
05-077, re: conditional use permit for International 49ers Group.

D. Consider Resolution OS -079s.... re; administrative OL

Commissioner Stromgren stated Kenzie properties is moving forward with plans to build on the
site and has agreed to combine these lots as a single plot.
Mayor Faust asked if this consideration is a combination to get the property on one pin number.
Mr. Gilligan replied the property includes parcels bought plus an existing piece. He asked if
there is a legal description. He noted the survey is dated 2005.

Motion by Councilmember Stille, seconded by Councilmember Gray to approve Resolution 05-
079, re: administrative subdivision of property on Kenzie Terrace.
Motion carried unanimously.
7 L. Consider Ordinance 2005-010, re: e)ress window well.
8 Commissioner Stromgren reviewed the text amendment noting currently City code does not also
9 window wells as an erncroachmcnt. The Planning Commission decided the issue could be
10 handled adninsitrativcly and reviewed by the lire marshal rather than by a CUP.

12 Mayor Faust asked if any other cities ordinances have been reviewed regarding egress wells.
13 Comnussioner Stromgren replied yes, they do not require any CUP process.

15 Councilmember Stille stated the permitting process would allow a building inspector or fire
16 marshal to impose a condition if needed. Ile asked if it is too close to a neighbor or there is a
17 safety issue could the marshal require them to fix it. Commissioner Strom -ren replied wells are
18 allowed to rothaveguardrails or other protections. Mr. Gilligan replied the building official
19 could impose reasonable conditions for safety concerns.

21 Councilmember Stille stated if a neighbor has a concern a well is too close to their driveway, an
22 applicant could put up a fence, but this will not always happen so another mechanism is needed.
23 Mr. Gilligan replied there needs to be reasonable standards; the City could require improvements
24 or fencing to address safety concerns.

26 Councilmember ITorst stated something should be specified and asked the importance of wells
27 versus safety. Commissioner Stromgren replied the wells are a result of inner cities not having
28 conditions.

30 Councihnennber Stille stated it makes sense to table the amendment to add standard language.

32 Mayor Faust stated the amendment would be tabled for Staff review.

34 F. Consider Ordinance 2005-011, rc: zonin ordinance amendment—vehicle sales.
35 Commissioner Stromgren stated the City is adding restrictions on vehicle sales, noting there is a
36 number of vehicles with sales signs parked at the school overnight and/or on the weekend.
37 Buildings are unoccupied during these times so police do not receive calls; and the property is
38 private which means the police are limited on taking action.

40 Councilmember Hoist stated the ordinance protects the rights of people that want to sell their
41 vehicle.

7 City Manager Morrison reported the following:

the comp plan.
A FEMA grant was applied for and $221,000 was received; the City will be buying a new
generator for the fire station and an exhaust system for the .fire system.
The [nternational City Managers Conference is being held this week.
® '['here will be a'Police Liability meeting put oil by the League.
® The Leagnie annual conference is coining up.
Councihruember Stifle noted the walk at Emerald Park is changed to 6:30 p.m.
Councilmen fiber Horst stated he split his time between the Sister City meeting and the Silver
Lake Task Force meeting. The Sister City meeting discussion focused on the upcoming MN
Rocks Symposium being held at the St. Paul College Campus in spring, that St. Anthony is
participating in. Ile added he attended the St. Paul Arts Council meeting where they picked a
sculptor from 1�inlaad, who is coming to the symposiums; his sculpture will be put on display at
Salo Park. St. Anthony has been asked to contribute money to assist with the artist's travel. The
Sister City Committee put together a pictorial "day in the life of a student" in St. Anthony.
Students took pictures of clays in their life and traded with people in Salo Park The Silver Lake
Task Force discussion focused on the recent hiring of a design company to work on roads. They
looked at two roads recently redone by Hennepin County and ideas were shared. The new
assignment is to look at what is important to the City as members of the Task Force, such as
pedestrians and turn lanes.
Councilmember Stille stated on. September 22 he attended the New Brighton collaborative board
meeting. The collaborative is losing a share of their funding but there is a lot of enthusiasm for
the group. Discussions included how to engage parents and kids to be active in the community.
He added he would be reporting more after the first quarter meeting next year.
Councihnember Thuescn stated September 28 at 7:00 p.m., in New Brighton there will be the
final Town Hall meeting for the Ramsey County Library System. He added the object is to
gather input from residents on how the Ramsey County Library System should look in the future.
Councihnember Gray stated he, too, attended the Silver Lake Road ,cask Force meeting. They
are a great group of insightful people; attendance was 100%. He added he appreciates that the
Hennepin County engineers came in with a blank slate and listened to input from the community.

1 Mayor Faust stated he attended a meeting with Ramsey County regarding recycling yard waste.
2 The City will start a pilot program, after a letter of agreement is signed, to take yard waste to the
3 Ramsey County drop off site. He thanked the City Staff for their hard work during the storm.
4 1 le added there are power lines under Silver Lake Road and if more were underground this
5 would free up some workers; therefore, the City should Look at this option.

Mayor Faust invited residents to come forward at this time and address the Council on items that
are not on the regular agenda.
Dennis Cavanaugh, 2909 St. Anthony Boulevard, stated he is part of a pilot project, which has
been meeting for more than a year, between the community center and Autumn Woods. Ile
noted they are grass roots; they have no Staff or funding. He noted on September 28 and on
October 2.0 they will be holding Medicare workshops. They have received a $1.5,000 grant firom
Un1ed Health Group. 'they are contracted with the IJ or to conduct amale survey later this
year, which they hope to shave with Council. Mayor Faust replied Council would be happy to
hear the survey results. I lc added if any help is needed, such as putting information on the web
or on areader board, let him know.
INFORMATION AND ANNOUNCEMENTS.
Mayor Faust stated Clic 2005 law summaries from League of1AN Cities are out.
Mr. Mornson stated at the International City Managers Conference, attended by over 3,200 from
1.7 countries, there was a session on strategic planning which discussed the success of the
Village.

Ordinance 2005-011; Amending section 1650.03 of the St. Anthony City Code to include
Encroachment in Yards.
MANAGER'S REVIEW:
Council is being asked to consider a proposed text amendment to the City's Zoning
Code to allow egress window wells as encroachment no more than 3 feet into the side
yard or front yard setback. By omission from the St. Anthony Zoning Code, egress
window wells are not a permitted use or allowed as an encroachment into the side yard
setback of the R-1 Zoning 'District. Section 1600.03 Uses Not Specified states that if a
use is not specifically permitted, permitted by conditional use permit or prohibited, the
use will be considered prohibited; and Section 1650.03 Encroachments in Yards, does
not include egress window wells as an allowed encroachment. Because this is a life
safety issue for the residents and potentially for responding emergency personnel, Staff
has developed language for the City's ordinance to allow egress window wells to extend
into the setback of an R-1 residential structure. This proposed language has been
reviewed by the City Attorney and the Planning Commission.

AN ORDINANCE RELATING TO AMENDING SECTION
1650.03 OF THE ST. ANTHONY CITY CODE
The City Council of the City of St. Anthony hereby ordains:
Section 1650.03 of the St. Anthony City Code shall be amended, by adding stipulation
(i) and Q) in the zoning code:
1650.03 Encroachment in Yards.
(i) Any life safety improvements to a residential structure such as egress
window wells and/or other similar above grade exiting requirements so
long as access to the rear yard is preserved.
Q) The Building Official and/or the Fire Marshall shall have the authority to
require a fence or any other means of structure to be installed in such
a manner as to protect the public from accidentally falling, tripping or
sustaining an injury of any sort as the result of the installation and
existence of an egress window well.
This Ordinance shall be in full force and effect upon passage by the City Council and
publication of the Ordinance or a Summary thereof in the City's official newspaper.

MANAGER'S REVIEW:
Section 38 of Article 2, of Chapter 156, of the Minnesota State Statues, now requires
that cities, counties and school districts develop a policy that regulates travel by local
elected officials outside of the state. The policy must be approved by a recorded vote
by .January 1, 2006 and must specify when travel by local elected officials outside of the
state is appropriate; determine applicable expense rates; and establish procedures for
approval of the out-of-state travel.
This policy is to be review annually and any changes to the policy must be approved by
a recorded vote.

Purpose: The City of St. Anthony recognizes that its elected officials may at times
receive value from Iraveling out o rthe state for workshops, conferences, events and other
assignments. This policy sets forth the conditions under which out-of-state travel will be
reimbursed by the City. This policy will be reviewed annually by City Council.
General. Guidelines:
The event, workshop, conference or assignment must be approved in advance by
detailed rnotiou by the City Council at an open meeting and must include an
estimate of the cost of th,e travel.. In evaluating the out -of state travel request, the
Council will. consider the following:
Whether the elected official will be receiving irainiug on issuesrelevant to
the City or to his or her role as the Mayor or as a council member;
Whether the elected offrcial will be meeting and networking with other
elected officials from around the country to exchange ideas oil topics of
relevance to the City or on the official roles of local elected officials;
Whether the elected ofTrcial will be viewing a city facility or function that
is similar in nature to one that is currently operating at, or under
consideration by the City where the purpose for the trip is to study the
facility or function to bring back ideas for the consideration of the full
council.;
® Whether the elected official has been specifically assigned by the Council
to visit another city for the purpose of establishing a goodwill relationship
such as a "sister -city" relationship;
e Whether the elected official has been specifically assigned by the Council
to testify on behalf of the City at the United States Congress or to
otherwise meet with federal officials on behalf of the City;
Whether the City has sufficient funding available in the budget to pay the
cost of the trip.

affiliated with political parties,
3. The City may make payments yr advance fo airfare, lodging and registration if
specifically approved by the Council. Otherwise all payments will be made as
reimbursements to the elected official.

incidental costs using the sarn.e procedures, limitations and guidelines outlined in
the City's policy J'or out-of-state travel by City employees (See City of St.

Limitations on paying for council members who have announced their

an election (however, there may be some benefit to the city in having
newly elected officials who have not yet taken office attend training
beforehand);

® The requirement for all frequent flyer miles to accrue to the city;

When looking at the statistics, St. Anthony's park dedication fees are the lowest in the.
Metro area. The goal of our fee structure has been to keep our fees, charges and rates
competitive to what other cities charge. With that respect, it seems prudent that Council
consider increasing the established park dedication fees and implement a reasonable fee
for future commercial and industrial development.
Council is aware that Minnesota Statutes requires that an increase in park dedication fees
must comply with the "Nexus Test." 'The requirement of the Statute establishes that a
municipality most reserve and use a reasonable portion of the fee for a related public
purpose such as parks, recreational facilities, streets, roads, sewer or storm water
improvements and cannot be excessive beyond the scope of [lie intended improvements.
The Statute also prevents cities from redirecting or transferring the funds for other uses
and the funds collected through dedicated fees must be used for their intended purpose.
Based on St. Anthony's use of current park dedication fees the City is in compliance with
the Statute (100% of the monies are going to park and public improvements). However,
the current fee structure is much lower than the fair market or average fee charged
In addition, staff contacted Jerry Gilligan from Dorsey & Whitney. Iie indicated that
given the amount that the City has paid in park improvements, the costs necessary to
maintain those parks and our current fee structure the City can easiIy justify an increase
in fees.
Recommendation:
Council amend ordinance Section 1500, Subsection 12 (Park Dedication Fees). A lac

Ordinance 2005-015; An amendment to ordinance 615.06 Other License Fees to include

MANAGER'S REVIEW:
This ordinance would allow businesses with an on -sale wine license and an on -sale 3.2
malt liquor license to sell intoxicating malt liquor without an additional license. Under
current liquor legislation, the State of Minnesota allows this special license.
The establishment would need to be in compliance with all provisions stated in Section
1000.12. Under section 1000.12 subd. 3 Percentage of Food; businesses would need to
abide by the State Statue of gross receipts are at least 60% attributable to the sale of
food and hold a liquor liability insurance policy.
The second ordinance would allow the fees for the Combination On -Sale Wine and 3.2
Malt Liquor License.

ORDINANCE 2005-014
AN ORDINANCE AMENDING SECTION 1000.05 OF THE CITY OF ST.
ANTHONY CITY CODE TO ADD A COMBINATION ON -SALE WINE AND
ON -SALE 3.2 MAI...T LIQUOR LICENSE. TO THE ST. ANTHONY CITY CODE
The City Council of the City of St. Anthony hereby ordains:
Section 1000.04 of the St. Anthony City Code shall be added as the following:
1000.04 1 cense T.ynes:
H. Combination On -Sale Wine and On -Sale 3.2 Malt Liquor License — A
hold of an on -sale wine license issued pursuant to this Section who is also
licensed to sell 3.2 percent malt liquor pursuant to State Statue and gross
receipts are at least: 60 percent attributable to the sale of food and hold a
liquor liability insurance policy, may sell intoxicating malt liquor on -sale
without an additional license.
This Ordinance shall be in full force and effect upon passage by the City Council and
publication of the Ordinance or a Summary thereof in the City's official newspaper.

Section 615.06 of the St. Anthony City Code shall be added as the following:
615.06 Other License Fees:
On -Sale Wine and 3.2 $100 processing fee
Malt Liquor Combination & 1,500 license fee
i -his Ordinance shall be in full force and effect upon passage by the City Council and
publication of the Ordinance or a Surnmarythereof in the City's official newspaper.
