48 Mr. Morrison explained the resolution. The amendment to the Ordinance is the addition of Item
49 J: The Building Official and/or the Fire Marshall shall have the authority to require a fence or

1 any other means of structure to be installed in such a manner as to protect the public from
2 accidentally falling, tripping or sustaining an injury of any sort as the result of the installation
3 and existence of an egress window well.

5 Motion by Councilmember Stille, seconded by Councilmember Gray, to approve the first and
6 final reading of Ordinance 2005-011 re: An Ordinance relating to amending Section 1650.03 of
7 the St. Anthony City Code.
9 Councilmember horst stated the sentence noting the fire Marshall shall have the authority to
10 require a fence or any other means of structure to be installed is unclear. In discussions, it was
11 stipulated that this should be a fence dividing the yards and not a fence around the egress
12 window. Mayor Faust said it is his understanding the fence would keep someone off the
13 property rather than encompassing the window well. Ile added that the responsibility would be
14 on the applicant to be sue it is safe in order to have it approved.

16 Councilmember Borst clarified that: the fence would have to go between the yards to get an
17 egress window permit. Mr. Mornson answered that is correct. 'rhe Tire Marshall and/or the
18 Building Official have the authority to determine whether a fence or other structure is needed.

20 Councilmember Nous] said he was concerned about the Tire Marshall holding the authority to
21 require a homeowner to make additional improvements restulting from safety issues. He
22 suggested the fire Marshall have the ability to strongly suggest changes be made, but not to
23 require changes be made. lie stated an egress window is a safety feature, which is more life -
24 saving than the prospect of falling into a window well.

26 Mayor Faust pointed out that if the applicant does not have an egress window in the basement,
27 no one can sleep in there, legally, according to the State Statute. To be in compliance, a permit
28 must be obtained from the City. The :Building Official and Fire Marshall would issue the permit,
29 and they would be the right persons to determine the safest way to come into compliance. That
30 may include putting in a fence.

34 VI. GENERAL POLICY BUSINESS OF THE COUNCIL.
35 A. Consider Resolution 05-080, re: Elected Offrcials'.ravel Policv.
36 Mr. Morrison reviewed the resolution with the Council and indicated that this is a requirement
37 from the state statute. All local units of government must develop a policy that regulates travel,
38 and the policy must be reviewed annually. Any changes must be by recorded vote. This policy
39 is the same that appointed staff members have to follow. Council has always followed it, but
40 now a written policy must be in place.

42 Mayor Faust stated the policy is strengthened from the model provided by the League of
43 Minnesota Cities.

45 Councilmember Stille stated the General Guidelines states the travel must be approved in
46 advance by detailed motion, lie questioned whether that means it would be something other than
47 the Consent Agenda. Mr. Morrison said it would be.

2 Councilmember Stills noted the second provision on page 15 states the results of the trip will be
3 given at the next Council meeting. He suggested it should state within 30 days if it is not
4 practical to give the results at the next meeting. Mayor Faust said rather than changing it, we
5 have always given reports orally and this should be sufficient. If someone would like to present
6 a PowerPoint presentation, an exception could be made. 'Chis could be changed over time if it i
7 needed.

Motion by Councilmember Gray, seconded by Councilmember Thuesen, to adopt Resolution 05-
080, re: Approving Elected Officials Out of Statc Travel Policy.

B. Consider Ordinance 05 013Park Dedication I`ees, f r stread fes_
Mr. Morrison reviewed the Ordinance with the Council and indicated that this is amending
Ordinance Section 1500, Subsection 12. He read the current rates for park dedication fees. IIe
said a survey has just been completed, and it showed the City's rates are low. He also noted the
City does need to enhance its revenue. He recommended the rates be raised to $1,500/unit for
single family, $1,800/emit for duplex, $2,000/unit for townhouse development, $1,000 for mobile
borne, $1,500 unit for multi family apartment/condo and $4,000/acre for commercial/industrial.
Ile noted these rates are still lower than the metropolitan average.
Councilmember Stille commented that St. Anthony is more in line with the inner ring suburbs.
The outlying cities that have new parks being built are a diffcrent market. This allows us to be
competitive with our neighbors.
Motion by Councilmember Horst, seconded by Councilmember Stille, to approve the first
reading of Ordinance 05-013, re: Amending Section 1500.12 of the City of St. Anthony City
Code to Include Park Dedication Fees.
Motion carried uuanirnously.
C. Consider Ordinance 05.-014�_Winc and _3_ .2 Malt Liquor Combination License (First
Reading).

Mr. Morrison indicated this Ordinance would allow businesses with an on -sale wine license and
an on -sale 3.2 malt liquor license to sell intoxicating malt liquor without an additional license.
Under current liquor legislation, the State of Minnesota allows this special license. He said the
establishment would need to be in compliance with all provisions stated in Section 1000.12
under Section 1000.12 subd. 3 'Percentage of Food; businesses would need to abide by the State
Statute of gross receipts are at least 60% attributable to the sale of food and hold a liquor liability
insurance policy. The second ordinance would allow the fees for the Combination On -Sale Wine
and 3.2 Malt Liquor License.
Councilmember Stille clarified that this Ordinance would allow on -sale wine and anything above
3.2 beer. Mr. Morrison responded that it allows any type of beer over 3.2 but no mixed drinks.

1 He added that those that obtain the intoxicating liquor license pay the $8,000. He said
2 establishments have asked for this Ordinance in the past.

4 Councihnember Stille asked if there is a limit in the Ordinance for 3.2 beer. Mr. Morrison said

38 month. He also thanked the Mayor for the work he did on the Joint Power of Agreement. He
39 thanked the staff for their response during the storms.

45 Councilmember Stille said as the Parks Commission Liaison he attended the September 20 open
46 house. It was an open house for the residents in the area to get a feel for the possibilities and
47 voice their opinions. The architect took comments and intends to bring something back to the

Parks Commission and the Council in the first quarter of 2006. He said the open house was well
attended.
Mayor Faust indicated that this Saturday from 3:00 to 9:00 p.m. is the Open Rouse for Silver
Lake Village. There will be entertainment, sidewalk sales, food, street dance, and more.
He noted the Chamber is taking on a fundraiser to help our troops. One of our residents is
serving in Iraq. The soldiers cannot keep in contact with family very easily. Ile explained that
AT&T calling cards are needed by the soldiers, and this is what the fundraising is for.
VIII. COMMUNITY FORUM.
Mayor Faust invited residents to come forward at this tune and address the Council on items that
are not on the regular agenda.
Hearing none, Mayor Faust moved forward with the agenda.

THIS AGREEMENT made and entered into by and between the COUNTY OF
ITENNEPIN, STATE OF MINNESOTA, hereinafter referred to as the "COUNTY," A-2300
C3overnmcnt Center, Minneapolis, Minnesota 55487, on behalf of the Hennepin County
Department of Environmental Services, 417 North Fifth Street, Minneapolis, Minnesota 55401-
1397, hereinafter referred to as the "DEPARTMENT" and the CITY OF SAJN'f ANTIlONY,

2004, approved the Hennepin County Residential R.ecyclrng Fmuding Policy for the period
January T, 2005, through December 31, 2007, and authorized grant funding (or municipal
recycling programs consistent with said policy; and
WHEREAS, the CITY operates amunicipal curbside residential recycling program. and
other waste reduction and recycling activities (the Recycling Program) as described in their grant
application referred to in Section 2 below; and
WHEREAS, said Recycling Programa is consistent with Minnesota Statutes, Chapter
115A; the Office of Environmental Assistance Solid Waste Management Policy Plan; Hennepin
County's Solid Waste Management Master Plan; and Hennepin County's Residential Recycling
Funding Policy.
NOW, THEREFORE, in consideration of the mutual undertakings and agreements
hereinafter set forth, the COUNTY, on behalf of the DEPARTMENT, and the CfrY agree as
follows:
L TERM AND COST OF THE AGREEMENT
a. his Agreement shall commence upon execution and terminate on December 31,
2007.

b. The initial grant payment for the year 200.brshall be equal to Eleven thousand one
hundred twenty-oiae dollars ($11,121). Grant payments for subsequent years shall
be calculated as set forth in Section 3.
2. SERVICES TO BE PROVIDED
M
a. The CITY will operate its Recycling program as more fully described in the Grant
Application that was submitted by the CITY and kept on 'tile with the COUNTY.
The CITY agrees to submit an updated Grant Application each year of the term of
this Agreement in order to be eligible for future grant funds. "The terms of the
Grant Application, as updated each year, are incorporated herein by reference.
b. In addition to the services referred to above, the CITY agrees as follows:
On an annual basis, the CITY must demonstrate that the averagc pounds of
recyclables collected from households participating in their curbside .

recyclables collected in 2004 by the total number of households
participating in the curbside recycling program in 2004. Failure to achieve

COUNTY approval that specifics the effort's the CITY will undertake to
increase the recycling percentage within 90 days of the submittal of the
nu nicipal year-end report.
2. At a minimum, the ,CITY shall collect the following materials at curbside:
a. Newspaper and advertising supplements;
b. Corrugated cardboard;
G. Clear, brown, and green glass food and beverage containers;
d. Metal food and beverage containers;
C. All plastic bottles with a neck, except bottles that previously
contained hazardous materials or motor oil;
f. Magazines and catalogs;
g. Mixed paper; and.
h. Boxboard.
3. The CITY must estimate its participation rate in the curbside recycling
program during the month of October. Methodology for measuring
participation must be approved by the COUNTY.
4. The CITY shall submit, on forms provided by the COUNTY, a Final 2005
Report by February 15, 2006; a Final 2006 Report by February 15, 2007;
and a Final 2007 Report by February 15, 2008.
All grant finds accepted by the CITY from the COUNTY pursuant to this
Agreement shall be used to operate its Recycling program, including

capital and operating expenses related thereto, in the year granted_ The
C.f"fY shall not retain airy grant finds in excess of actual Recycling
program expenses.
6. The CITY may not charge its residents through property tax, utility fees, o,
any other method for that portion of the costs of its Recycling Program:
that is funded by COUNTY giant funds.
The CITY shall establish a separate accounting mechanism, such as a
project number, activity number, cost center, or fund that will separate
recycling and waste reduction revenues and expenditures from all other
municipal activities, including solid waste and yard waste activities.
Recycling and waste reduction activities, revenues, and expenditures are
subject: to audit by the COUNTY.
If the CITY does not contract for curbside services, the CITY will receive
grant funds provided that at least ninety percent (90%) of the grant funds

and approves this Agreement signed by an authorized official of the CITY.
Provided the CITY is otherwise in compliance with the terns of this Agreement,
future grant fund payments will be made after submittal by the CITY and approval
by the COUNTY of the Grant Application and Final Report as described in
Section 2 and receipt by the COUNTY of SCORE funds from the State of
Minnesota.
4. INDEPENDENT CONTRACTOR
The CITY shall. select the rocans, method, and rmanner ofperfonning the services herein.
Nothing is intended or should be construed many mamler as cr:eatirhg or establishing the
relationship of cn-partners between the parties hereto oras constituting the CITY as the
agent, representative, or employee of the COUNTY for any purpose or many manner
whatsoever. The CITY is to be and. shall remain an independent contractor with respect
to all services performed under this Ao rcenrent The CITY represents that it has or will

Agreement. Any and all personnel of the CITY or other persons while engaged in the
performance of any work or services required by the CITY under this Agreement shall
have .no contractual relationship with the COUNTY, and shall not be considered
employees of the COUNTY. Any and all claims that may or might arise under the
Minnesota Economic ,Security Law or the Workers' Compensation Act of the State of
Minnesota on behalf of said personnel, arising out of employment or alleged employment,
including, without limitation, claims of discrimination against the CITY, its officers,
agents, contractors, or employees shall in no way be the responsibility of the COUNTY.
The CITY shall. defend, indemnify, and hold harmless the COUNTY, its officials,
officers, agents, volunteers, and employees from any and all such claims irrespective of
any determination of any pertinent tribunal, agency, board, commission, or court. Such
persormel or other persons shall neither require nor be entitled to any compensation,
rights, or benefits of any kind whatsoever from the COUNTY, including, without
limitation, tenure rights, medical and hospital care, sick and vacation leave, Workers'
Compensation, Re-employment Compensation, disability, severance pay, and retirement
benefits.
5. INDEMNIFICATION AND INSURANCE
a. The CITY agrees to defend, indemnify, and hold harmless the COUNTY, its
officials, officers, agents, volunteers and employees from any liability, claims,
causes of action, judgments, damages, losses, costs, or expenses, including
reasonable attorney's fees, resulting directly or indirectly from any act or omission
of the CITY, a subcontractor, anyone directly or indirectly employed by them,
and/or anyone for whose acts and/or omissions they may be liable in the
performance of the services required by this Agreement, and against all loss by

reason of the failure of the CITY to perform fully, in any respect, all obligations
under this Agreement.
b. In order to protect the CITY and those listed above under the indemnification
provision, the CITY agrees at all times during the term of this Agreement, and
beyond such term when so required, to have and keep in force .insurance, either
under a self insurance program or insurance policies as follows:

6. DATA PRIVACY
CITY, its officers, agents, owners, partners, employees, volunteers and subcontractors
agree to abide by the provisions of the Minnesota Government Data Practices Act,
Minnesota Statutes, Chapter 1. 3, the Health ].nsurance Portability and Accountability Act
and implementing regulations, if applicable, and all other applicable state and federal
laws, rules, regulations and orders relatiing to data privacy or confidentiality, and as any of
the same may be amended. CITY agrees to defend, indemnify and hold harmless the
COUNTY, its officials, officers, agents, employees, and volunteers from any claims
resulting from City's officers', agents', owners', partners', employees', volunteers',
assignees' or subcontractors' unlawful disclosure and/or u.se of such protected data. The
terms of this paragraph shall survive the cancellation or termination of this Agreement.

7. RECORDS —AVAILABILITY/ACCESS
Subject to the requirements of Minnesota Statutes Section 1.6C.05, Subd. 5 (as may be
amended), the CITY agrees that the COUNTY, the State Auditor, the Legislative .Auditor
or any of their duly authorized representatives, at any timc during normal business hours,
and as often as they may reasonably deem necessary, shall have access to and the right to
examine, audit, excerpt, and transcribe any books, documents, papers, records, etc., which
are pertinent to the accounting practices and procedures of the CITY and involve
transactions relating to Oris Agreement. Such materials shall be maintained and such
access and rights shall be, in. force and effect during the period ofthis Agreement and for
six (6) yeas after its termilnation, or cancellation.
g, SUCCESSORS,, SUBCONTRACTING ING AND ASSIGNMENTS
a. The CITY binds itself, its partners, suc ccssors, assigns and legal representatives to
the COUNTY in respect to all covenants, agreements and obligations contained in

pledge this Agreennent and/or the services to be performed hereunder, whether ill.
Whole or in part, nor assign any nnonies due or to become due to it hereunder
without the prior written consent of the COUNTY.

CITY of its liabilities and obligations under the Agreement. llurtber, the CITY
shall be fully responsible for the acts, omissions, and failure of its subcontractors
in the performance of the herein specified contractual services, and of person(s)
directly or indirectly employed by subcontractors. Contracts between the CITY
and each subcontractor shall require that the subcontractor's services be
performed in accordance with the terns and conditions herein specified. A
consent to assign shall be accomplished by execution of a form prepared by the
COUNTY and signed by the CITY, the assignee and the COUNTY.
9. MERGER AND MODIFICATION
a. It is understood and agreed that the entire Agreement between the parties is
contained herein and that this Agreement supersedes all oral agreements and
negotiations between the parties relating to the subject matter hereof. All items
referred to in this Agreement are incorporated or attached and are deemed to be
part of this Agreement.
b. Any alterations, variations, modifications, or waivers of provisions of this
Agreement shall only be valid when they have been reduced to writing as an
amendment to this Agreement signed by the parties hereto.

10. I) IT i?Aui;.r AND CANCELLATION
a. If the CITY fails to perform any of the provisions of this Agreement or so fails to
administer the work as to endanger the performance of the Agreement, this shall
constitute a default. Unless the City's default isexcused bytb.e COUNTY, the
COUNTY may upon written notice immediately cancel this Agreement in its
entirety. Additionally, failure to comply with the terms of this Agrecment shall be
just cause for the COUNTY for delaying payment until the City's compliance. Iii
the event of a decision to withhold payment, the COUNTYshall furnish prior
written notice to the CITY.
b. Notwithstanding any provision of this Agreemorrt to the contrary, the CITY shall
not be relieved of liability to the COUNTY for damages sustained,by the
COUNTY by virtue of any breach of this Agreement by the CITY.
C. l!pon early termination or cancellation of this Agreement, the CI'T'Y shall itemize
any and all grant funds expenditmcs up to the date of termination or cancellation

d. The above remedies shall be in addition to any other right or remedy available to
the COUNTY under this contract, law, statute, rule, and/or equity.
C, The COUNTY's failure to insist upon strict performance of any provision or to
exercise any right under this Agreement shall not be deemcd a relinquishment or
waiver of the same, unless consented to in writing. Such consent shall not
constitute a general waiver or relinquishment throughout the entire term of the
Agreement.

(30) days' written notice.
g. - In the event the COUNTY does not receive any SCORE funds, this Agreenent
will be terminated upon written notice by the COUNTY.
11. CONTRACT ADMINISTRATION
In order to coordinate the services of the CITY with the activities of the Department of
Environmental Services so as to accomplish the purposes of this contact, Carl Michaud,
Solid Waste and Recycling Program Manager, or his or her successor, shall manage this
contact on behalf of the COUNTY and serve as liaison between the COUNTY and the
CITY.

12. COMPLIANCE
':Che CITY shall comply with all applicable federal, state and local statutes, regulations,
rules and ordinances pertaining to solid waste reduction, manuagement, and recycling; in
force or hereafter enacted.
13. PAPER RECYCLING
The. COUNTY encourages the CI'T'Y to develop and implement an office paper and
newsprint recycling program.
14. NOTICES
Any notice or demand which must be given or made by a party hereto under the teams of
this Agreement or any statute or ordinance shall be in writing, and shall be sent registered
or certified mail. Notices to the COUNTY shall be sent to the COUNTY Administrator
with a copy to the originating' Department at the address given in the opening paragraph
of the Agreement Notice to the CLL'Y shall be sent to the address stated in the opening
mragraph of the Agreement
15. PROMOTION, LI'I`ERA'rUR E
CITY agrees th.at th.e terns "Hennepin County" or any derivative thereof shall not be
utilized in any promotional literature, advertisements of any type or form or client lists
without the express prior written consent of the COUNTY.
16. MINNESOTA LAWS GOVERN
The Laws of the State of Minnesota shall govern all questions and interpretations
concerning the validity and construction of this contract and the legal relations between
the herein parties and performance under it. The appropriate venue and jurisdiction for
any litigation hereunder will be those courts located within the COUNTY of Hennepin,
State of Minnesota. Litigation, however, in the federal courts involving the herein parties
will be in the appropriate federal court within the State of Minnesota. If any provision of
this Agreement is held invalid, illegal or unenforceable, the remaining provisions will not
be affected.

not receive recycling collection services under a municipally arranged coniract? (e.g., ordinance

By City Ordinance, residential haulers are required to provide curbside recycling services to
single-family residential customers at no cost. Recyclable items collected include newspapers, glass,
plastic bottles, aluminum cans and tin cans. The residential haulers working; in St. Anthony are
required to pick-up recyclables once a week.
It should be noted that while the City's Ordinance does not require recycling services for
multiple family residences units, recycling services are available to a majority of those residents. The
City is reviewing the licenses of the one or two facilities that do not offer recycling and will be
contacting them at renewal time in January about: the importance of recycling in our community,
3. How will the municipality assure that all recyclables collected from residential properties are
recycled, whether collected by the municipality's contracted vendor or another service provider?
As stated in #2, the Cite requires, residential haulers to pick-up recyclable on a weekly basis
Also, staff receives monthly reports from these haulers and that, information is used to complete the
semi -annul reports required by the County. Those reports are kept and are available for review.
4. What changes are planned or anticipated for 2006?
None, with the exception that we will work to gain 100% compliance with the multiple family
facilities.
5. How are recycling services in 2006 to be paid for, beyond any use of SCORE funds? What long-
term funding source is in place for recycling services?
Whatever expenses are not covered by the SCORE Grants, the City has budgeted to pay then. h2
the past, SCORE funds have been used for administration costs, Clean -Up Day expenses, City
newsletter production and mailing costs, and recycle bins.
6. Describe the municipality's source reduction and recycling promotional efforts. List types of
materials to be used, intended audiences, and method and frequency of distribution.
City newsletter, Village Notes, published quarterly-- St. Anthony Ramsey (Hennepin) County
residents and businesses are the intended audiences.
City Cable Channel 16 -- nrformation related to recyclingis posted on CTV Channel l6 on the
Community's Bulletin Board. St. Anthony residents are the intended audiences.
City's new electronic marquis sign -- Upcoming information on recycling events is posted on the
City's sign. The untended audience is the residents, but others using Silver Lake Road will also benefit
from the information.
City Staff newsletter, Village Team -- Provides some educational information for staff members to
use on the job and in their own lives. Most of the staff do live in Ramsey County. 'the City encourages
in-house recycling by providing- recycling containers for workspaces and break rooms.

In addition, the City has flyer available in the City Hall information rack and handouts are givers
to new residents when they come in to pick up their recycling bins. This ,information is also easily
available to anyone else who comes in. The City also organizes and promotes an annual Spring Clean -
Up day. The Recycling Coordinator works with the local newspapers and community groups to
encourage and maintain recycling efforts throughout the City.
The City has been working with Ramsey County on sow ce reduction efforts citywide. Because
the City is in two counties, only those residents that two in Ramsey County are able to use the yard
waste sites. Residents that live in I lennepin County cannot: access the Ramsey County yard waste sites
need to take their yard waste to sites in I-Iennepin County. Both agencies are in the process of
negotiating and approving a joint powers agreement whereby Hennepin County residents of St.
Anthony are permitted to take their yard waste to Ramsey County sites.
7. What measurable goals do you have for source reduction and recycling activities in 2006? At
least ONE measurable goal most be listed. Please describe how you will measure progress
toward those goals and how activities will be evaluated.
The City of St. Anthony proposes to use SCORF funds to maintain and increase recycling
participation by the community thereby increasing tonnage collected. One measurable goal is to
increase publicity for recycling. The City will continue to add recycling infarnation to its
communication modes - the City's web site, City newsletter, City Hall electronic sign and cable
channel. Each year, the City strives to add more information for the residents The City prornows
information about County drop-off sites and it is hoped that these efforts will see increased
participation.
B. If any activities will be conducted by a cent roctor or, subcon'iractor, what provisions will be, made
I o monitor and audit those activities?
City Staff reviews the recycling volume and tonnage that is reported by the residential haulers
that work in St. Anthony. 'Phe City requires monthly repofti ng and reviews these reports. The

submitted to the County

Administration: Prepare recycling reports and disseminating recycling information to Ramsey
County residents through the use of newsletter, Cable TV, Web site, and electronic signs.
Promotion_ Funds will offset the cost of production, printing and mailing of the recycling section
of the quarterly City newslettev, Village Notes, Unat goes to Ramsey County residents.

Attached for your consideration is a resolution ordering the preparation of a feasibility report for
improvements to the trunk sanitary sewer system, and the Foss Road Lift Station. This project is
being proposed to increase the trunk sanitary sewer system capacity to serve the Silver Lake
Village Redevelopment Area.
This project proposes to improve:

JOINT POWERS AGREEMENT BETWEEN
RAMSEY COUNTY AND CITY OF SAINT ANTHONY
FOR USE OF YARD WASTE MANAGEMENT SITES
This Agreement is entered into pursuant to Minnesota Statutes Section 471.59 on this .—day of
_ 2005 between Ramsey County (the "County"), a political subdivision of the State
of Minnesota, and the City of Saint Anthony (the "Municipality"), a political subdivision of the State
of Minnesota.
Whereas, Ramsey County operates a yard waste management system, which includes
seven sites for the collection of yard waste from Ramsey County residents; and
Whereas, YW Policy ##4 in the Regional/Ramsey County Solid Waste Master Plan states
that "Ramsey County will not allow residents of other counties or allow, commercial yard waste
haulers/collectors, lawn services, or tree services to use County yard waste sites,"
Whereas, a portion of the City of Saint Anthony is within Ramsey County, and City
residents within that area may use the County's yard waste sites, but those City residents not in
Ramsey County are not allowed to use the County's yard waste sites; and
Whereas, The City would like to provide additional yard waste management opportunities
to all of its residents, whether they reside in Ramsey County or Hennepin County; and
Whereas, Ramsey County is willing to make yard waste services available to the City of
Saint Anthony for a reasonable cost, and provide an exception to YW Policy #4 to address the
practical difficulties of providing yard waste services for residents of the City because this
City has significant population in two counties. Now, therefore, it is agreed:
COUNTY OBLIGATIONS
a. The County shall allow all residents of the City, regardless of county of residence, to use
County Yard Waste sites at the same level of service that the sites are available to County
residents.
b. The County will monitor the use of the yard waste sites by City residents, noting the county
of residence of the residents using the sites, and will report to the City on a regular basis.
c. The County will provide the City with information about site services, hours and dates of
operation, and site rules, for use by the City in promoting the sites.
d. The County will work with the City to evaluate use of the yard waste sites by City residents
and determine whether to renew this agreement and, if to be renewed, the appropriate
terms and conditions for that renewal.
CITY OBLIGATIONS
a. Upon receipt of an invoice from the County, the City will pay the County $5,000 in order to
assure services for those City residents that do not reside in the County.
b. When it promotes use of the County yard waste sites, the City will provide information
consistent with information provided by the County.
c. The City will work with the County to evaluate use of the yard waste sites by City residents
and determine whether to renew this agreement and, if to be renewed, the appropriate
terms and conditions for that renewal.
2. TERM
The term of this agreement shall be from November 1, 2005, through December 31, 2006, the date
of signatures notwithstanding.
3. TERMINATION
a. FOR CAUSE: In the event that the City fails to comply with the terms of this Agreement, or
any statutory requirement, ordinances and/or plans related to this Agreement, the County
may terminate this Agreement. In the event that the County exercises its right to terminate
the Agreement for cause, the County shall submit a written notice to the City specifying
reasons for terinination and the date upon which the termination becomes effective.
b. WITHOUT CAUSE: This Agreement may be terminated by either party without cause, on
one hundredeighty(180) days written notice to the other party.
c. OTHER EVENTS: In the event that the County's authority to provide services
contemplated in this agreement is affected by amendments to Minnesota Statutes or by
other means, this Agreement shall be immediately terminated.
4. GENERAL CONDITIONS
a. Hold Harmless The City and County agree to defend, and hold the other party harmless
from any costs, claims, demands, actions or causes of action, including reasonable
attorney's fees, arising out of any act or omission on the part of the party or any of its
agents or employees in the performance of or relation to any of the work or services
provided by the party under the terns of this agreement. Nothing in this agreement shall
constitute a waiver by either party of any limitations or exceptions of liability under
Minnesota Statutes Chapter 466.
b. Data Practices All data collected, created, received, maintained, or disseminated for any
purpose in the course of this Agreement is governed by the Minnesota Government Data
Practices Act, Minn. Stat. Ch. 13, or any other applicable State statute, any State rules
adopted to implement the Act and statutes, as well as federal statutes and regulations on
data privacy. The Municipality agrees to abide by these statutes, rules, and regulations.
c. Access to Documents All books, records, documents, and accounting procedures and
practices of the Municipality and its (sub)contractoi(s), if any, relative to this Agreement are
subject to examination by the County and the State Auditor, as appropriate, in accordance
with the provisions of Minnesota Statutes §160.05, Sued. 5.
d. Equal Employment Opportunity The City and County agree to comply with all federal,
state and local laws, resolutions, ordinances, rules regulations and executive orders
pertaining to unlawful discrimination on account of race, color, creed, religion, sex, sexual
preference, marital status, status with regard to public assistance, disability or age. When
equired by law and requested by the other party, each party shall furnish a written
affirmative action plan to the other party.

Per Council's direction,) have further researched the new Data Practices Act regarding
fees for providing copies of public government data.
The new law (effective 8/1/2005) is very specific. The Statute 13.03 reads as follows:
1) For 100 or fewer copies, the entity "May not charge a per -page fee of not
more than 25 cents per page."
Also, "The entity is authorized to charge on the per -page charge and cannot
use a fee Calculation Method for fewer than 100 copies."
Can we establish a fee structure based on a Fee Calculation Mdhod?
Yes? For any copies requested over 100 pages.
What is a reasonable fee based for St. Anthony to charge?
The Statute is specific about what costs may be included in establishing a Pee Calculation
Method. Some of them include:
1) You must use the lowest paid persons hourly rate.
2) Staff time required to retrieve documents, remove doctunents,
Sort and label documents, remove staples, taking documents
to the copier and copying, but not for returning the documents.
3) Paper costs
4) Mailing costs, etc.
Based on an estimated time of 3 minutes to perform the task, a charge of $1.00 per each 3
minutes of staff time and $.25 cents per copy can be justified.
Who can challenge the City?
Staff contacted Jerry Gilligan, who supplied an Internet address (www.ipad.state.nui.us)
where there is literally dozens of case law and examples of Cities being challenged.
Some examples include:
City of Lakeland — Charged $1.00 (State ruled against/costs not justified)
Oak Park Heights - Charge $50.00 per hour (State ruled against/costs not justified).
City of Rosemount — Charged $.50 per page (State ruled against/costs not justified)
Staff also contacted a League of Minnesota Cities attorney and was advised that their
interpretation of the Statute was:
1) First 100 copies at $.25 cents per page
2) Over 100 reimbursement of actual costs (Fee Calculation Method)

Fees For providing Copies of Public Government Data
Effective August 1, 2005
This document is intended to guide government entities in determining an appropriate fee for providinly
copies of public government data when the requester is not the subject of the data and the. coy fee is
not established specifically by_ statute.
Minnesota Statutes, section 13.03 provides that, if a person requests copies or electronic transmittal of
public government data, and the requester is not the subject of the data, the responsible authority for
the government entity may require the requester to pay a fee. Amendments to section 13.03 in 2005
require entities to calculate any fee that is charged by using one of the two methods below. (Minnesota
Session Laws 2005, Chapter 163, section 8, effective August 1, 2005.) Regardless of which method is
used, the entity may not charge for separatuzg public data from not public data.

WHEREAS, When requested the City of St. Anthony, Administration, Police and Fire
Departments provide copies at various fees; and
WHEREAS, State Statue 13.03 was recently amended to include language that Cities
may charge a per page fee of not more than twenty-five cents per page for
the first 100 pages; and
WHEREAS, The Statue allows Cities to establish a fee calculation method that is
based on the actual costs for all requests for over 100 copies;
NOW, THEREFORE, BE IT RESOLVED, that in compliance with State Statue 13.03,
the City of St. Anthony hereby sets the copying charges:
First 100 pages - $.25 per page
Over 100 pages - $1.00 for each 3 minutes of staff time and $.25 per page.

Metro area The goal of our fee structure has been to keep our fees, charges and rates
competitive to what other cities charge. With that respect, it seems prudent that Council
consider increasing the established park dedication fees and implement a reasonable fee
for future cornrnercial and industrial development.

Council is aware that: Mimresota Statutes requires a at an increase in park dedication :Pees
I ust comply with the "Nexus Test." The requirement of Clio Statute establishes that a
municipality must reserve and use a reasonable portion of the fee for a related public
purpose such as parks, recreational facilities, streets, roads, sewer or storm water
improvements and cannot be excessive beyond the scope of the intended improvements.
'The Statute also prevents cities from redirecting or transferring the funds for other uses
and the funds collected through dedicated fees must be used for their intended. purpose.
Based on St. Anthony's use of cnrrentpark dedication fees the City is in. compliance with.
the Statute (100% of the monies are going to park and public improvements). However,

Ordinance 2005-015; An amendment to ordinance 61.5.06 Other License Fees to include
the fee for the Combination On -Sale Wine and 3.2 Malt Liquor License.
MANAGER'S REVIEW:
This ordinance would allow businesses with an on -sale wine license and an on -sale 3.2
malt liquor license to sell intoxicating malt liquor without an additional license. Under
current liquor legislation, the State of Minnesota allows this special license.
The establishment would need to be in compliance with all provisions stated in Section
1000.12. Under section 1000.12 subd. 3 Percentage of Food; businesses would need to
abide by the State Statue of gross receipts are at least 60% attributable to the sale of
food and hold a liquor liability insurance policy.
The second ordinance would allow the fees for the Combination On -Sale Wine and 3.2
Malt Liquor License.
