16 Councilmember Horst directed Council to the Check Register on page 12 of the packet. He
17 stated the register did not add up correctly and would like it corrected before approval.

19 Finance Manager Larson stated the checks are correct. The total should be $895.00.

22 Register with corrected total of $895.00.

29 V. REPORTS FROM COMMISSION AND STAFF.

32 VI. GENERAL POLICY BUSINESS OF THE COUNCIL.
33 A. Resolution 06-072; Proposed 2007 Tax Levy and Budget in Compliance with the Truth in
34 Taxation Act.

36 Assistant City Manager Moore -Sykes presented the proposed 2007 tax levy and budget. She
37 reported the budget must be submitted to the county by September 15, 2006. She stated the goal
38 for St. Anthony is to be a progressive, livable, walkable Village, which is safe and secure.

40 Assistant City Manager Moore -Sykes reported staff and council participated in a goal setting
41 Worksession discussing financial strategies and budgeting goals for 2007. A public hearing was
42 held on April 25, 2006. She also reported a work session was held on August 28, 2006 with City
43 Staff and Council members to work on the preliminary budget. She informed Council it is
44 required by state statute to adopt a preliminary budget on September 12, 2006 and once adopted
45 it could not be increased, but could be decreased.

1 Assistant City Manager Moore -Sykes reminded Council of future events relative to the 2007
2 budget and tax levy. These events include: November 17, 2006 - Proposed property tax
3 statements would be mailed to residents; December 4, 2006 — Truth-in-taxation/budge
4 presentation to the City Council and residents; and December 11, 2006 — Final adoption of the
5 2007 Budget/Tax Levy.

7 Assistant City Manager Moore -Sykes reported a 6.59 percent increase in the 2007 budget and a
8 6.93 percent increase in the tax levy. Assistant City Manager Moore -Sykes detailed the 2007
9 Total proposed Tax Levy included: the general fund, roads, levy, a fire truck, a public facilities
10 bond, the HRA levy, tax abatement and PERA. She stated total levy increase with roads equals a
11 6.93 percent increase.

13 Assistant City Manager Moore -Sykes reported the issues impacting budget include increased
14 motor fuel costs, increased employer health insurance costs, a cost of living adjustment for City
15 Staff, the addition of a part-time community services offer, additional police overtime,
16 maintenance costs of City parks and utility costs for City buildings.

18 Assistant City Manager Moore -Sykes stated new revenue line items include a police impound
19 fee for $10,000; an additional $25,000 liquor operation transfer; and $12,700 maintenance
20 agreement with Hennepin County.
21
22 Mayor Faust mentioned the line item for increased police impound administrative fee, stating
23 this would be because of the council's approval to increase the fee schedule at the beginning of
24 the year. He explained that this is not a new fee.

26 Finance Manager Larson stated this is because of the time required to perform administrative
27 tasks relating to impounding vehicles received as the result of DUl/DWl arrests.

29 Councilmember Horst asked about the maintenance agreement as a new line item.

31 Finance Director Larson stated the increase means the City would receive $12,700 more from
32 Hennepin County. He reported it is an increase to an existing line item.

34 Assistant City Manager Moore -Sykes reported next steps in the budget process include sending
35 out the proposed property tax statements on or about Nov 17. She reported the truth -in -taxation
36 hearing would be held on December 4, 2006 at 7:00 p.m. in Council Chambers. Ms Moore -Sykes
37 encouraged Council and residents to call Finance Director Larson at 612-782-3316 with any
38 questions or comments.

40 Motion by Councilmember Gray, seconded by Councilmember Thuesen, to approve Resolution
41 06-072; Proposed 2007 Tax Levy and Budget in Compliance with the Truth in Taxation Act.

43 Councilmember Stille stated the budget and levy had not been taken lightly and was discussed
44 over several work sessions. He reported the budget had been gone over line by line. He reported
45 everyone worked together as it progressed over the year. Councilmember Stille mentioned the

1 public should also be aware that with the truth in taxation corning out the City will be placing an
2 insert in the statements which further explains the 2007 budget and levy.
4 Councilmember Thuesen added the department head meetings included lots of dialog. He stated
5 everyone did a good job working together cooperatively between departments to make the
6 budget fair.

8 Mayor Faust noted the reason a notice did not go out last year was be because there was not an
9 increase to the levy. He stated he believes the budget is good, solid and would assure core
10 services citizens have come to expect would be available.

14 B. Resolution 06-073; Amendingthe h�ty Council meeting schedule for the second Tuesday
15 in December and replacing with the second Monday.

17 Assistant City Manager Moore -Sykes explained the truth -in -taxation hearing would be held on
18 Monday, December 4, 2006 because, by law, it could not be held at any time a County School
19 Board would have the City cannot hold its truth in taxation meeting on the same day as the
20 county or school board holds theirs. She mentioned it would be indicated on the truth -in -taxation
21 notice and also on channel 16.

23 Motion by Councilmember Stille, seconded by Councilmember Horst, to approve Resolution 06-
24 073; Amending the City Council meeting schedule for the second Tuesday in December and
25 replacing with the second Monday.

29 VII. REPORTS FROM CITY MANAGER AND COUNCILMEMBERS.
30 Assistant City Manager Moore -Sykes reported she and City Manager Mornson met with the
31 Lowry Grove Association representatives and the owners of Lowry Grove to present the first
32 draft of a park closing ordinance. She indicated the first reading before the City Council would
33 be October 11, 2006.

35 Assistant City Manager Moore -Sykes stated the Comprehensive Plan Task Force would meet
36 September 13, 2006 to further discuss the update required by State of Minnesota.

38 Assistant City Manager Moore -Sykes stated she and City Manager Mornson met with North
39 Suburban Cable Commission to talk about the Commission's proposal for a feasibility study to
40 determine the extent of the N -Net and wireless infrastructure that would be capable of supporting
41 new and emerging technology like WiFi.

43 Assistant City Manager Moore -Sykes reported she received information from Ramsey County on
44 the compost agreement and they are interested in continuing the agreement. She stated she also
45 received a phone call from John, Ramsey County Public and Environmental Health Supervisor
46 who said they are interested in continuing the Joint Powers Agreement with the City. He would

1 be sending statistics about the compost facility. She stated everyone is very pleased with how
2 the whole project went.
4 Mayor Faust asked Ms Moore -Sykes what the meeting with the cable commission was it about.
6 Assistant City Manager Moore -Sykes replied it was a discussion about doing a feasibility study
7 about what infrastructure exists and what the member cities would need to support existing
8 technology or new and emerging technology.

10 Mayor Faust mentioned he is not sure if he has had any other issue that has garnered more
11 positive comments that the compost effort. He stated the City would not stop the composting
12 agreement and encouraged Ms Moore -Sykes to do consider extending the contracts for three
13 years rather than yearly. Mayor Faust stated the compost project had initially begun as a pilot
14 and, given the many positive comments he had received; it looks as if it is working well.

16 Councilmember Horst reported he attended the Community Services Board on September 7,
17 2006 where the discussion was an update on the status of Community Services programs, early
18 childhood and day care. He reported a lively discussion ensued on the City's funding and more
19 discussion would happen when he meets with Community Services.

21 Councilmember Horst stated he attended a Sister City meeting on September 10, 2006 to discuss
22 the City's sculpture. He reported the sculpture is ready to be moved and the City Engineer is
23 working with Public Arts Saint Paul and contacted several sources to move the sculpture to the
24 site and an artist to assemble the pieces. He stated a contractor would be consulted to make sure
25 the bases could hold a sculpture of this size. Councilmember Horst stated the sculpture would be
26 installed on September 1, 2006 and he wanted to have a dedication in the next couple of weeks.
27 He mentioned the first week in October is homecoming and is not a good weekend.
28 Councilmember Horst stated this is a tremendous project and opportunity for St. Anthony.

30 Councilmember Stille reported he had completed his NIMS training which is a prerequisite for
31 the Fire Chief to apply for grants.

33 Councilmember Stille state he attended the Parks Commission meeting September 12, 2006 that
34 consisted of a tour of City parks. He stated discussions included cleaning along the fences and
35 park connectivity. Councilmember Stille reported they toured Central Park and mentioned the
36 concern that people drive to the pavilion. He stated signage would be strategically placed to
37 inform visitors the path was not for vehicle traffic. Councilmember Stille worked with an Eagle
38 Scout on a project to mark the pathways in Central Park. He stated that public works is working
39 with him to place signs that interpret the marks.

41 Mayor Faust reported attending a revenue meeting with the Association of Metropolitan
42 Municipalities on August 27, 2006.

44 Mayor Faust reported the Council met with the School Board and the new Superintendent on
45 August 29, 2006. He mentioned a committee was assigned to look at the issues addressed by
46 Councilmember Horst.

2 Mayor Faust advised that the Chamber of Commerce meeting normally scheduled on Tuesday,
3 September 19 will be held on Friday, September 22 because the speaker is Col. Nick Holten,
4 who is from a unit serving in Iraq and that the members of the Chamber supported last year. Col.
5 Holten is also a graduate of St. Anthony High School. He encouraged anyone who contributed
6 or who is interested to attend this month's Chamber of Commerce meeting.

9 Mayor Faust invited residents to come forward at this time to address the Council on items not
10 on the regular agenda.

Sub)ect: Single Sort Recycling and Proposed Language Change to City's Garbage Hauler Ordinance
Background: On April 17th, Staff met with representatives of the garbage haulers that do business in the City to
discuss the possibility to change the City's Ordinance language to allow recycling pick up every other week to
accommodate single -sort recycling. All of the haulers agreed that they would like to have the City Council
consider a language change in the Ordinance to allow for the bi-weekly pick up of recycla.bles. Garbage would
continue to be picked up on a weekly basis.
The meeting with the haulers was the result of an initial report from Waste Management that Walter's Recycling
was violating the City's ordinance. Waste Management had reported that Walter's was not doing weekly
recycling pick-up but were implementing a single sort program and picking up their customer's commingled
recycling materials every other week. In discussing this report with Mr. Sederstrom of Walter's Recycling, he
admitted that he was doing single sort pick-up every other week based on what he was told "a couple of years
ago" by City staff indicating that he could do single -sort in St. Anthony. Staff advised Mr. Sederstrom that
according to the Ordinance, he was required to pick up recycling once a week, despite the method offered to and
used by their customers for recycling. Mr. Sederstrom indicated that collecting the single -sort recycling every
week is not cost effective and asked what he could do to change the ordinance. We discussed the process
involved in changing the ordinance and the haulers were told that proposing a change did not guarantee that the
Council would approve the requested change. Mr. Sederstrom was also advised that if and until the language is
changed, Walter's would still have to pick up his customer's recycling on a weekly basis.
Mr. Sederstrom volunteered to survey his customers in St. Anthony to determine the satisfaction level of his
customers with Walter's single source recycling program. Copies of those surveys are available in the Assistant
City Manager's office for your information.
Summary of Survey Mr. Sederstrom mailed 706 surveys to his customers and received 429 back (61%).

This survey, as I stated earlier, was done only with Walter's Recycling customers. The haulers from BFI and
Waste Management agreed to have Mr. Sederstrom do the survey. They would all like to have the City .
Ordinance language changed to allow recycling pick-up on a bi-weekly basis.
With a single -sort program, all items that are considered recyclable are put into one container; no garbage is
allowed to be mixed with these recyclables. Because garbage by -necessity has to be treated differently, collecting
it weekly continues to be desirable in St. Anthony for the public health of the community and the haulers are in
agreement with this requirement. Recyclable materials are considered "clean" materials and as such, the industry
does not judge there to be a need for this material to be collected weekly.
Several Metro -area cities, including: Blaine, Shoreview, Anoka, Arden Hills and New Brighton have adopted or
will be adopting single -sort recycling programs.

The policy stated in the Ramsey County Solid Waste Master Plan is:
"Ramsey County requires municipalities to assure recycling service is available to all residents at their
place of residence. Ramsey County encourages a level of service that will maximize residential recycling,
but requires the following minimum levels of service:
a. Municipalities with 5,000 or more in population must assure collection of at least four broad types of
materials at least twice per month to all residents.
b. Municipalities under 5,000 in population must assure collection of at least three broad types of
materials at least once per month to all residents, but are strongly encouraged to assure collection of at
least four broad types of materials at least twice per month."
And ordinance requirement is a very good mechanism to assure that the City has something to stand on when
talking to property owners/managers about establishing recycling for their residents. It is not the only tool, but it is
a good one.
What is your timeframe for this research? It is possible Ramsey County's consulting team of RW Beck and Dan
Krivit & Assoc. could provide some assistance in looking at what other cities have done. Norm Schiferl manages
the contract with Beck/Krivit and would have to determine whether there is funding on our side to add St. Anthony
to the list of cities receiving assistance, and work out the scope of services being provided. You can talk with
Norm about that if you're interested.
If you are short on time, it might not work as well to tap into our consultant team. Instead, you could call a few
cities to talk with them about what mechanisms they use. Several cities contract for the service, along with single-
family, though if St. Anthony isn't interested in going into a contract situation, there are other ways. I would
suggest contacting your fellow recycling coordinators in Maplewood (DuWayne Konewko), New Brighton (Dave
Fridgen), or North St. Paul (Keith Stachowski is a new coordinator, so you may want to talk to his predecesor,
Brian Frandle). These three cities passed ordinances in recent years. Mounds View (Tracy Juell) did not adopt
an ordinance, but did adopt some requirements in their housing occupany code. As for enforcement, inspectors
in New Brighton and Mounds View, for example, check on the status.of recycling services when they do their
annual inspections for multi -family properties. I think North St. Paul is starting to do that as well.
Little Canada has had an ordinance on the books for years, as has Vadnais Heights.
It is also worth considering an ordinance requirement that haulers to offer recycling service to the multi -family
customers they serve, similar to how the city has set up a requirement to serve single-family. The property would
not have to use the hauler for both recycling and trash, they could collect and haul the recycling themselves or go
with a recycling service separate from their trash hauler (e.g., Eureka Recycling), but at least having an ordinance
that requires haulers to offer the service takes one argument away from a property owner that the service isn't
available.

AN ORDINANCE AMENDING THE MUNICIPAL, CODE OF MOUNDS VIEW BY AMENDING
CHAPTER 603, GARBAGE AND RUBBISH
The City of Council of the City of Mounds view hereby ordains:
SECTION 1. Subd 2b of Section 603.06 is hereby amended with additions underlined and deletions to
read as follows:
Subd b. Additional Restrictions for Residential Haulers: In addition to the other requirements of this
Chapter, haulers servicing residences, mobile home parks and multiple _dwellings shall comply
with the following:
(1) Curbside recycling collection will be made available to all residential and multiple
dwelling customers no later than July 1, 1990. Such service shall include an at least bi-weekly
collection of all recyclable materials on the same day as garbage and rubbish collection for
residences.
(2) Collection of garbage and rubbish materials will be provided on a weekly basis and
recyclable materials will be provided on an at least bi-weekly basis, but not necessarily on the
same day, for multiple dwellings and mobile home parks.
(3) Collection service priced on the basis of volume shall be provided. All billings shall
be itemized so as to show what individual charges are being levied.
(4) Each licensee shall separately collect and dispose of yard waste on a regular basis for
a minimum of eight (8) weeks in the spring, commencing on April 1, and eight (8) weeks in the
fall, commencing on September 15.
(5) Collection of garbage and rubbish materials for single family residence shall be
restricted to Wednesdays and Thursdays only, except when Wednesday or Thursdayis
holiday. In the case of a holiday, the collection will occur the following business day.
SECTION 2. This ordinance shall take effect thirty days after the date of its publication.

AN ORDINANCE AMENDING CHAPTER 5 OF THE CITY CODE,
BEING THE LICENSES, PERMITS AND BUSINESS REGULATIONS
The City Council of the City of St. Anthony Village ordains as follows:
555.01 Definitions. For purposes of this Section 555, the following terms have the
following meanings:
Subd. 3. Regyclables: Materials which may be recycled or reused through
recycling processes, including metal and plastic beverage containers, glass,
newsprint, and any other materials designated as recyclables by Council
resolution.
Subd. 11. Residential Container: Any container intended for the collection of
waste or recycling materials that has a volume of 100 gallons or smaller
container upon request of the resident.
555.021-icensing Requirements.
Subd. 5. In addition to the other requirements of this Section, haulers servicing
residences must comply with the following:
(a) Curbside recycling collection will be made available to all residential
customers. At minimum, such service must include bi-weekly collection and
hauling of all recyclables on collection days. Charges for service to
customers who have no curbside recycling collection will be no less than the
charges for services, which include curbside recycling collection.
555.03Reguirements and Restrictions. All licensees and any other haulers in the City,
must comply with all of the following requirements and restrictions:
(k). Haulers are required to provide residential containers for recycling that will
hold 100 gallons or smaller container upon request of the resident.
