ANTHONY CITY COUNCIL REGULAR MEETING MINUTES January 8, 2008 CALL TO ORDER Mayor Faust called the meeting to order at 7:01 p.m. PLEDGE OF ALLEGIANCE Mayor Faust invited the Council and audience to join him in the Pledge of Allegiance. ROLL CALL Present: Mayor Faust; Councilmembers Gray, Roth, Stille, and Thuesen Absent: None. Also Present: City Manager Mike Morrison, City Clerk Barb Suciu, and Planning Commission Chair Joel Stromgren CONSIDERATION, DISCUSSION, AND POSSIBLE ACTION ON ALL OF THE FOLLOWING ITEMS: L APPROVAL OF JANUARY 8, 2008 CITY COUNCIL, MEETING AGENDA Mayor Faust removed the presentation from Dorothy Waltz; Ramsey County Conservation District 12 Representative, from the agenda due to the illness of Ms. Waltz. Motion by Councilmember Gray, seconded by Councilmember Thuesen, to approve the City Council Meeting Agenda of January 8, 2008 as amended. Motion carried unanimously (510) H. PROCLAMATIONS AND RECOGNITIONS. A. Swearing in of Mayor Jerome Faust Mayor Faust was sworn in as Mayor by the City Clerk Suciu. B. Swearing in of Council Member Hal Gray Mr. Hal Gray was sworn in as Council Member by the City Clerk Suciu. C. PUBLIC HEARINGS. 35 36 None 37 38 V. REPORTS FROM COMMISSION AND STAFF 39 40 41 me_ 42 43 B. Presentation from Hennepin County Commissioner Mark Stenglein. 44 45 Commissioner Stenglein provided handouts and presented the significant 2007 Hennepin County 46 events and milestones. He then presented the 2008 Hennepin County goals and highlights. C1 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 46 City Council Regular Meeting Minutes January 8, 2008 Page 3 Mayor Faust thanked Commissioner Stenglein and Commissioner Ms. Rosemary Franzese for their assistance with the trail connection. He stated he appreciates the prompt and courteous response the City receives from Hennepin County. Councilmember Thuesen thanked Hennepin County for the great maintenance of the trail system so it is usable in the winter as well as all year long. C. Presentation from Metropolitan Council Representative Lynette Wittsack Representative Lynette Wittsack presented a history of the Metropolitan Council and information regarding the direction of the Metropolitan Council for the future. She discussed new transit and transportation options in St. Anthony. She stated new services include a Park & Ride at Industrial Boulevard and 35W and a limited stop service from St. Anthony to the University of Minnesota. She stated that 2008 would see a renewed interest in parks, a dialog with adjacent counties on mutual interests and concern, and waste water treatment systems. Councilmember Thuesen questioned whether the Met Council took a position on the use of LED lights. Representative Wittsack replied she did not know if the Met Council had taken a position at this time. Mayor Faust commented a great deal of time was spent on UL He stated it is encouraging to hear that the Met Council understands St. Anthony's issues. He thanked Representative Wittsack for the information on the transportation opportunities. He complemented the Met Council on 40 years of success. Representative Wittsack complimented Council on being the first city to send in their Comprehensive Plan. D. Resolution 08-012• Variance for Lot Width at 3112 - 32nd Avenue NE Planning Commission Chair Stromgren presented the background on Resolution 08-012. He stated the Planning Commission unanimously recommended approval of the variance. He stated two issues: 1) combined side yards did not meet the 15 -foot requirement and 2) the 25 -foot height restriction have been revised by the applicant as required. Motion by Councilmember Gray, seconded by Councilmember Thuesen, to approve Resolution 08-012, a Resolution for a Variance for Lot Width at 3112 — 32nd Avenue NE. Councilmember Stille commented this reinforces the fact that the Code needs revision. He stated that going forward it is important to research the hardship issue further. Motion carried unanimously (5/0) City Council Regular Meeting Minutes January 8, 2008 Page 4 VI. GENERAL POLICY BUSINESS OF THE COUNCIL None VII. REPORTS FROM CITY MANAGER AND COUNCIL MEMBERS City Manager Mornson reported that in December 2007, several police officers participated in Wal -Mart's Shop with a Cop program for underprivileged kids ages 10 to 12 in St. Anthony. 10 City Manager Mornson reported that in December 2007, Jay Hartman, Barb Suciu, and Kim 11 Moore -Sykes participated in the bell ringing in front of the Cub Foods. 12 13 City Manager Mornson reported that the Fire Department also participated in bell ringing and the 14 Toys for Tots drive in December 2007. He reported they collected over 2000 toys. 15 16 City Manager Mornson reported the second annual Kids vs. Cops Annual Basketball game 17 would be held on January 17, 2008 at 7:00 p.m. at the Community Center. 18 19 City Manager Mornson reported the Police Chief and Fire Chief reported their activities to the 20 Vital Aging Council in December 2007. 21 22 City Manager Mornson reported the Liquor Store would celebrate 60 years as a municipal liquor 23 store on February 10, 2008. He stated that each month staff would attempt different themes to 24 coincide with 60 years of being in business. 25 26 City Manager Mornson reported the third annual Citizen's Academy would be held March 26 — 27 May 14, 2008. He reported a Lauderdale resident donated $300 towards the academy to express 28 their support of the program. He stated that anyone interested could sign up with the Police 29 Department. 30 31 City Manager Mornson reported the agenda for the January 22, 2008 Council meeting would 32 include reports from City Engineer Todd Hubmer, a Public Hearing on Applebee's change of 33 ownership for the liquor license, and the Silverwood Park staff would be in attendance. 34 35 City Manager Mornson reported the following 2007 goals would be carried over to 2008: Silver 36 Lake Road project, re -codification of the City Ordinances, environmental goal, and the payment 37 of two bonds. 38 39 Mayor Faust clarified the liquor license is a transfer of ownership and requires Council review 40 and a Public Hearing. IIe explained it remains an Applebee's restaurant. 41 42 Councilmember Stille presented a letter from a resident of Falcon Heights commending the St. 43 Anthony Police Department. 44 45 Councilmember Gray thanked citizens for placing their faith and trust in him for another four 46 years. He stated it is an honor to serve the community. City Council Regular Meeting Minutes January 8, 2008 Page 5 Councilmember Gray reported that on January 2, 2008 he attended the Chamber of Commerce Directors Meeting. He encouraged everyone to start thinking about the Business of the Year and the Villager of the Year. He stated the nominations forms would be available shortly. Councilmcmber Gray encouraged residents to seriously consider attending the Citizen's Police Academy. 9 Mayor Faust reported that on December 18, 2007, the Chamber of Commerce held its Annual 10 Christmas Tree Lighting contest. He announced the winners of the contest were Mr. John 11 Kaharski for the individual award and Autumn Woods won the community award. 12 13 Mayor Faust reported the Chamber Board Meeting had a successful Adopt a Family Program 14 whereby about $700.00 was collected for a acedy family in St. Anthony. 15 16 Mayor Faust reported attending the MMWMO Board Meeting and stated the first four 17 applications for the process of building a cutting edge demonstration and headquarters building. 18 19 Mayor Faust thanked the residents of St. Anthony for re-electing him as Mayor and putting their 20 trust in him. He stated he would give it his utmost. 21 22 VIIl. COMMUNITY FORUM 23 24 Mayor Faust invited residents to come forward at this time and address the Council on items that 25 are not on the regular agenda. 26 27 There being none, Mayor Faust continued with the agenda. 28 29 IX. INFORMATION AND ANNOUNCEMENTS 30 31 Mayor Faust pointed out the St. Anthony Notes newsletter was mailed out. He highlighted an 32 article written by a St. Anthony police officer titled Reflections of a Responder to the 35W 33 Bridge Collapse, 34 35 Mayor Faust mentioned that a burglary occurred in St. Anthony on January 8, 2008 and the 36 burglars were apprehended. 37 38 X. As I previously stated, I currently have some grants that are paying the full cost of our bullet resistant vests. If you are still inclined to give the donation. I would use the money toward a new AED (automatic electronic defibulator). AED's are the machines that shock people who are in cardiac arrest. We are in need of some newer models, as protocols have changed and some of our old AED's can not be upgraded. We could also use some new TASERS, and SWAT equipment as well. You could simply make out the check to the St. Anthony Police Department, and I could make sure the donation went toward one of these items. ANTHONY VILLAGE RESOLUTION 08-014 A RESOLUTION APPROVING THE TRANSFER OF THE INTOXICATING LIQUOR LICENSE FOR APPLEBEE'S RESTAURANTS NORTH, LLC., DBA APPLEBEE'S RESTAURANT AT 2800 - 39'1'11 AVENUE. WHEREAS, American Limited Partnership of Minnesota, received their intoxicating liquor license in January 2005; and WHEREAS, the American Limited Partnership of Minnesota, has maintained their intoxicating liquor license in good standing with the City of St. Anthony; and WHEREAS, the applicant, Applebee's Restaurants North, LLC., has completed the necessary application process for the transfer of the intoxicating liquor license; and WHEREAS, the St. Anthony Police Department has conducted a conclusive background check on all officers and employees in the corporation.
