ANTHONY CITY COUNCIL REGULAR MEETING MINUTES MARCH 23, 2010 CALL TO ORDER. Mayor Faust called the meeting to order at 7:00 p.m. PLEDGE OF ALLEGIANCE. Mayor Faust invited the Council and audience to join him in the Pledge of Allegiance. ROLL CALL. Present: Mayor Faust; Councilmembers Gray, Jenson, Roth, and Stille. Absent: None. Also Present: City Manager Mike Morrison, Public Works Director Jay Hartman, Stacie Kvilvang of Ehlers & Associates, Todd Hubmer and Justin Messner of WSB & Associates, and City Attorney Jerome Gilligan. CONSIDERATION, DISCUSSION, AND POSSIBLE ACTION ON ALL OF THE FOLLOWING ITEMS. I. APPROVAL OF MARCH 23, 2010 CITY COUNCIL MEETING AGENDA. Motion by Councilmember Gray, seconded by Councilmember Stille, to approve the City Council Meeting Agenda of March 23, 2010. Motion carried unanimously. II. PROCLAMATIONS AND RECOGNITIONS. None. PUBLIC HEARING. Mayor Faust opened the public hearings for Resolution Nos. 10-025, 10-026, and 10-027 at 7:03 p.m. Todd Hubmer, WSB & Associates, provided an overview of the 2010 Street Improvement Project. He discussed the project schedule, project cost, and funding sources, the assessment amount of $110,008.92, and the assessment process in accordance with Minnesota Statutes Chapter 429. Mr. Hubmer reviewed Resolution Nos. 10-025 and 10-026 for consideration by the City Council. Councilmember Stille requested a recap on the engineer estimate in relation to the current competitive environment in the market. Mr. Hubmer stated the original engineer estimate included in the feasibility study was approximately $1,900,000 for the St. Anthony portion of the project. This estimate was reduced, and bids on the project then came in at $1,375,000. Mr. Jim Christy, 3472 Silver Lane, addressed the City Council and stated his request that the 2010 Street Improvement Project include curb cuts on every corner. He also requested that the traffic signals and street signs be located far enough back to accommodate wheelchair access. Mr. Hubmer stated that the project will need to meet ADA standards. There will be proper pedestrian standards and crossings and there may be an opportunity to include midblock pedestrian crossings in a couple of locations. In regards to the placement of traffic signals, the signal at Silver Lane and Silver Lake Road is not proposed for replacement at this time. Stacie Kvilvang, Ehlers & Associates, provided background information on 429 assessment bonds as the typical method of financing street reconstruction projects. She stated total project costs of the 2010 Street Improvement Project are approximately $1.3 million, and that the City will be assessing approximately $110,000 to benefiting property owners. Since the amount being assessed is not at least 20% of the project costs, the City will be financing the improvements through street reconstruction bonds instead of the typical 429 assessments bonds. It is proposed that the City issue General Obligation Street Reconstruction Bonds to finance the entire remaining balance of the project not being paid by assessments. Ms. Kvilvang provided an overview of the requirements for proceeding with the GO Street Reconstruction Bonds, including the requirement that the City Council hold a public hearing and approve the 5 -year Street Reconstruction Plan (SRP). Ms. Kvilvang indicated that the project cost has been reduced from the $155,000 included in the staff report to a cost of approximately $118,000 to $120,000. Ms. Kvilvang reviewed Resolution 10-027 and 10-028 for consideration by the City Council. Councilmember Stille clarified with Ms. Kvilvang that the interest rate on the assessments will be at a rate of 2.0% above True Interest Costs of the bonds. Resolution 10-025; Ordering Improvements for the 2010 Street Improvement Project. 2 3 Motion by Councilmember Gray, seconded by Councilmember Jenson, to adopt Resolution 10- 4 025; Ordering Improvements for the 2010 Street Improvement Project. 6 Councilmember Gray stated the City is getting this work done cheaper than it would be under 7 normal circumstances due to the current market. More importantly, it can be seen in the news 8 what is happening with cities that are not keeping up their infrastructure. He stated the upkeep 9 on infrastructure is a big plus for living in St. Anthony, and that the negative aspects of not 10 spending the money at this time and putting off upkeep and reconstruction would be detrimental. 11 12 Councilmember Stille concurred. He commented a constituent he talked with when running for 13 re-election informed him that he moved to St. Anthony because he knew from his research that 14 take care of the City. 15 16 Motion carried unanimously. 17 18 B. REPORTS FROM CITY MANAGER AND COUNCIL MEMBERS. 10 11 City Manager Morrison reported on the following: 12 • League of Minnesota Cities Legislative Day at the Capital is scheduled for Thursday, 13 March 26, 2010. 14 • He will be conducting the Junior Achievement Program again this year with P grade 15 students at Wilshire Elementary. 16 • Public works Director Hartman was interviewed by Karel l regarding the City's street 17 sweeper program. The story will run on Thursday, March 25, 2010 at 6:00 p.m. 18 19 Councilmember Gray: No report. 20 21 Councilmember Jenson reported on his attendance at the March 16, 2010 joint meetings with the 22 Planning Commission and the School Board. 23 24 Councilmember Roth: No report. 25 26 Councilmember Stille: No report. 27 28 Mayor Faust reported on his attendance at the March 16, 2010 joint meetings with the Planning 29 Commission and the School Board. He reported on his attendance at the March 16, 2010 30 Historical Society meeting and the book on the history of St. Anthony being prepared by the 31 Historical Society. There will be an article about the book included in Village Notes coming out 32 next week. He stated St. Anthony Village High School Athletics Director Erdahl has reported 33 that the lights in Central Park will likely be working in May. There will be an open house when 34 the lights are operational. 35 36 VIII. COMMUNITY FORUM. MA 38 Mayor Faust invited residents to come forward at this time and address the Council on items that 39 are not on the regular agenda. 40 41 Hearing none, Mayor Faust moved forward with the agenda. 42 43 IX. INFORMATION AND ANNOUNCEMENTS. 44 45 Mayor Faust announced the Fire Chief has provided information on H1N1, which was discussed 46 at the last City Council meeting. A third wave of the virus will be coming. Mayor Faust encouraged residents to contact the Fire Chief with any questions about the H1N1 Mayor Faust announced that Village Notes will be coming out next week. He encouraged residents to review the information on the City Council Goals, Spring Clean -Up Day on May 1, 2010, Village Fest, and the Historical Society. X. ADJOURNMENT. Morrison, City Manager From: Barb Suciu, City Clerk Date: April 13, 2010 Subject: Ordinance Amendment — Political Signs Background: Recently the State Legislature passed a bill to move the State Primary from the second Tuesday in September to the second Tuesday in August. Because of this change there are several other amendments to current election laws. One change that is directly affecting our ordinance is the placement of political signs. Current language in section 155.23 (F) indicates that signs can be placed from August 1 in the state general election year. This language needs to be amended to 46 days before the state primary to correspond with the new date of the primary election. All non-commercial signs of any size may be posted in any number from August 146 days before the state primary in a state general election year until 10 days following the state general election. For local elections, which are usually held on the first Tuesday after the first Monday in November of odd - numbered years, all noncommercial signs of any size may be posted for 4 weeks prior to a local election until 5 days following the local election. These exempted non- commercial signs are not allowed to be placed within 10 feet from the curb and 10 feet from the property lines. If these signs are placed in violation of these setbacks, they will be removed by the City Code Inspector. These ordinance changes shall be in fill force and effect upon passage by the City Council and publication of the Ordinance or a Summary thereof in the City's official newspaper.
