Mayor Faust called the meeting to order at 7:00 p.m. 9 PLEDGE OF ALLEGIANCE. 10 11 Mayor Faust invited the Council and audience to join him in the Pledge of Allegiance. 12 13 ROLL CALL. 14 15 Present: Mayor Faust; Councilmembers Gray, Roth, and Stille. 16 Absent: Councilmember Jenson. 17 Also Present: City Manager Mike Mornson, Fire Chief John Malenick, Public Works Director Jay 18 Hartman, and City Engineer Todd Hubmer. 19 20 21 Mayor Faust advised that the Fire Chief has been asked to discuss the gas line break that occurred in the 22 City this afternoon. 23 24 Chief Malenick explained that at approximately 2:30 p.m., a CenterPoint Energy contractor performing 25 routine work on the gas mains drilled through a 12" gas line that feeds most of Northeast Minneapolis 26 and into Columbia Heights. He stated that the vast majority of the gas is currently blowing into 27 Minneapolis and crews from Minneapolis and the City immediately barricaded the neighborhood and 28 evacuated many people along Stinson Boulevard. He indicated that because the gas line is under so 29 much pressure, the gas is shooting straight up in the air where it poses a decreased danger; CenterPoint 30 Energy advised the City that the bulk of what is going to fall back down is the odorizer included with the 31 gas and there is little danger it will come back down and settle into homes, etc. He stated that 32 CenterPoint Energy is currently working on a bypass to cut off the gas to the leak itself and the bypass 33 work should be completed by 10:30 p.m. this evening, when people can return to their homes. He added 34 that CenterPoint Energy expects to continue working past midnight to complete all repairs. He indicated 35 that the majority of residents affected by the leak are in the area of 30111 and Stinson and the City has 36 welcomed residents into the fire station if they need a place to stay until they can return to their homes. 37 38 Councilmember Stille asked if the potential severe weather will impact repair work. 39 40 Chief Malenick replied that any rain will force the gas down to earth in a safe manner; however, 41 lightning could create a problem and fire crews stationed in the area are prepared to deal with any severe 42 weather. I -Ie encouraged residents to contact the Fire Department with any questions or concerns at 612- 43 782-3400 or to call 911. 44 45 Mayor Faust expressed the City Council's thanks on behalf of all residents to the Fire Department and 46 other emergency workers. 47 48 CONSIDERATION, DISCUSSION, AND POSSIBLE ACTION ON ALL OF THE FOLLOWING 49 ITEMS. PROCLAMATIONS AND RECOGNITIONS. 10 11 A. Recognition of Junior Achievement Completion for Mrs. Wyatt's 2"d Grade Class. 12 13 City Manager Mornson introduced Mrs. Wyatt and her 2"d grade class and explained the Junior 14 Achievement project this year involved "Our Community" and the students talked about schools, 15 parks, cities, jobs, and businesses, as well as the role of government, taxes, and banking. He 16 stated that he was very impressed with the students and it was delightful working with Mrs. 17 Wyatt and her students. 18 19 Mayor Faust presented a certificate to each student for completing the Junior Achievement 20 program. I -Ie expressed the City Council's appreciation to Mrs. Wyatt and congratulated the 21 students on their hard work. 22 23 III. CONSENT AGENDA. 24 25 A. Consider April 26, 2011 Council meeting minutes; 26 B. Consider licenses and permits; 27 C. Consider payment of claims; and 28 D. Consider Resolution 11-032; Approving the Memorandum of Understanding in the St. 29 Anthony -New Brighton School District #282 for the 2011 Election Season. 30 31 Motion by Councilmember Stille, seconded by Councilmember Gray, to approve the Consent 32 Agenda items. 33 34 Motion carried 4-0. 35 36 IV. PUBLIC HEARING. 37 38 None. 39 40 V. REPOR'T'S FROM COMMISSION AND STAFF. 41 42 None. 43 44 VI. GENERAL 13USINESS OF COUNCIL. 45 2 City Council Regular Meeting Minutes May 10, 2011 Page 3 1 A. Ordinance 2011-02; Ordinance Terminating Moratorium on the Issuance of Licenses for 2 Pipe and Tobacco Shops (second reading). 4 City Manager Morrison stated that this represents the Second Reading of the ordinance 5 terminating the moratorium on the issuance of licenses for pipe and tobacco shops. He advised 6 that the City Council can waive the third reading and move to adopt the ordinance this evening. 8 Motion by Councilmember Stille, seconded by Councilmember Roth, to approve the Second 9 Reading of Ordinance 2011-02; Ordinance Terminating Moratorium on the Issuance of Licenses 10 for Pipe and Tobacco Shops, and to waive the Third and Final Reading. 11 12 Motion carried 4-0. 13 14 B. Storm Water Pollution Prevention Plan (SWPPP) Public Information Meeting Todd 15 Hubmer, WSB & Associates, presenting. 16 17 City Engineer Ilubmer presented the City's Storm Water Pollution Prevention Plan (SWPPP), 18 and noted that the presentation fulfills the annual requirement for holding a public information 19 meeting regarding stormwater in the City. He reviewed the Clean Water Act, National Pollution 20 Discharge Elimination System (NPDES), non -point source pollution, minimum control measures 21 specified by the Federal government and defined by the State, public education and outreach, 22 public participation and involvement, illicit discharge detection and elimination, construction site 23 stormwater rrmoff control, post -construction stormwater management in new development and 24 redevelopment, pollution prevention, and best management practices. 25 26 City Engineer Hubmer stated that the phosphorous content in pet waste is a significant water 27 pollution concern and residents will begin to see educational outreach on the importance of 28 cleaning up after their pets. 29 30 Councilmember Roth requested further information regarding pollution associated with 31 discarded cigarette butts. Ile also requested information regarding redevelopment of the 32 potential Vikings stadium site and its impact on the pollution in the ground. 33 34 City .Engineer Hubmer explained that discarded cigarette butts will be in the environment for 35 several decades before breaking down and represent a significant pollution concern. I Ie added 36 that discarded cigarette butts would be considered an illicit discharge under the NPDES rules. 37 Iie stated that the pollution on the Army ammunition site has been in the environment for a long 38 period of time and there are some indications that the level of contamination is beginning to 39 subside. Ile indicated that if the site is redeveloped, there will be special concerns associated 40 with whether the improvements have the potential to move the contamination in the soil into the 41 drinking water of the communities in the area. He added there will be a significant amount of 42 discussion on this topic in the future to manage the pollutants and manage storm sewer runoff. 43 44 C. Resolution 11-033; Accepting and Approving the Grant Agreement Between the City of 45 St. Anthony Village and the Metropolitan Council of Environmental Services for the 46 Improvement of Publicly Owned Infrastructure. 3 City Council Regular Meeting Minutes May 10, 2011 Page 4 2 City Engineer Hubmer advised that the City Council previously approved a resolution 3 authorizing the preparation and submittal of a grant for the City to receive UI grants through the 4 Met Council and the City is eligible to receive $103,262. He stated that the Met Council requires 5 a resolution that the City will accept this grant. 7 Motion by Councilmember Gray, seconded by Councilmember Stille, to approve Resolution 1I- 8 033; Accepting and Approving the Grant Agreement Between the City of St. Anthony Village 9 and the Metropolitan Council of Environmental Services for the Improvement of Publicly 10 Owned Infrastructure. 11 12 Motion carried 4-0. 13 14 D. Resolution 11-034; Requesting a Variance from Minnesota State -Aid Rule 8820.2800 15 Subpart 2A for the 2009 Street and Utility Improvement Project. 16 17 City Engineer Hubmer advised that this is a housekeeping resolution which requests a variance 18 from the State Aid Rules regarding the timing on Mn/DOT's approval of the City's original 19 variance for two curves on Foss Road. Iie stated that there was a disparity between the date of 20 the official letter granting approval and the contract bid opening date, and Mn/DOT has 21 requested that the City Council pass a resolution authorizing a variance to the State Aid rule. 22 23 Motion by Councilmember Roth, seconded by Councilmember Gray, to approve Resolution 1I- 24 034; Requesting a Variance from Minnesota State -Aid Rule 8820.2800 Subpart 2A for the 2009 25 Street and Utility Improvement Project. 26 27 Motion carried 4-0. 28 29 E. City Engineer's Update. 30 31 City Engineer Hubmer presented an update on the 2010 Street and Utility Improvement Project, 32 including Ilighcrest Road/Old Highway 8, Silver Lane Sidewalk west of Silver Lake Road, and 33 Silver Lane east of Silver Lake Road. He stated that the curb and sidewalk on Silver Lane west 34 of Silver Lake Road will be replaced as well. 35 36 City Engineer Hubmer reviewed the 2011 Street and Utility Improvement Project started last 37 week on .Edward and Coolidge. He stated that all work should be completed sometime in July 38 and residents can contact Tim McAnallen at 612-272-2683 or City staff with any questions. 39 40 City Engineer Hubmer provided a preview of the 2012 street and utility improvement project 41 which is locatedjust south of this year's street and utility project. 42 43 Councilmember Stille requested further information regarding the project and the rationale for 44 choosing these streets versus other streets in the City. 45 0 City Council Regular Meeting Minutes May 10, 2011 Page 5 1 City Engineer Hubmer explained that the selection of next year's project location was based on 2 the fact that this area has had a number of water main breaks and once this project is finished, all 3 roads west of Silver Lake Road will be reconstructed and the City can then move to other 4 segments of the City. He stated that utility replacement is given highest priority when selecting a 5 project and the area around Belden and Coolidge has had a number of water main breaks. He 6 added that the City also does not want to have construction traffic over a recently reconstructed 7 street, which will mean that the 2012 project will have an entrance route on 36t" Avenue and the 8 City will then redo 36°i Avenue when construction is complete without damaging any new roads. 9 10 Councilmember Roth asked about the City's alleyways and the standards used in construction of 11 those alleyways. He also expressed concern about garbage haulers and stated it was his 12 understanding that the haulers agreed they would not enter the alleyways with loaded trucks. 13 14 City Engineer Hubmer stated that there are design issues with the alleys because they are not 15 designed to the same level as the streets, they are very flat with poor drainage, and some will 16 decay sooner than the roadways. 17 18 City Manager Morrison stated that the haulers agreed not to enter the alleys with loaded trucks; 19 in addition, the haulers are using smaller trucks in some cases. 20 21 City Engineer Hubmer added that the City has applied for a 319 grant to remove phosphorous 22 and pollutant loads to Silver Lake and improve Salo Park pond, which will help the City get into 23 TMDL compliance. He noted that the City already has $50,000 from Rice Creek Watershed 24 District for this project. 25 26 VII. REPORTS FROM CITY MANAGER AND COUNCIL MEMBERS. 27 28 Councilmember Roth reported on his attendance at the May 5 North Suburban Cable 29 Commission meeting. He stated that the Cable Commission will move into its new space during 30 June and will host an open house later this summer. City Manager Mornson reported on the following: • City Council Regular Meeting on May 24 will include amendments to the ordinance updating the City's building permit fees to coincide with new State fees • May 31 - joint meeting with School Board at 5:15 p.m. • April 27 labor seminar sponsored by Dorsey & Whitney • May 2 meeting with Lauderdale to discuss options on the police contract • May 4-6 City Manager's conference in Brainerd • Presented information on green initiatives currently underway as part of the GreenStep Cities program City Manager Mornson congratulated Public Works Director Hartman and his staff for the great job done on Clean -Up Day, and Mike Larson, Liquor Operations Manager and his staff for a successful Beer Tasting on May 7"'. He also expressed his appreciation to everyone involved in working to resolve the gas leak this evening, including the Police Departments, Fire Departments, and Public Works staff. 22 VIII. COMMUNITY FORUM. 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 46 Mayor Faust invited residents to come forward at this time and address the Council on items that are not on the regular agenda. Hearing none, Mayor Faust moved forward with the agenda. IX. INFORMATION AND ANNOUNCEMENTS. Councilmember Roth discussed the recent article about branding as a city and suggested that it may be worthwhile to consider changing the name of St. Anthony Village from a branding standpoint. X. To determine what other Cities charge, staff conducted a survey of surrounding Metropolitan Cities. The data shows that building permit fees vary and there is no consistency or a uniform method used for establishing building permit fees. A compact history of how fee schedules in Minnesota have developed is as follows: 1) In 1972, Minnesota adopted the "Uniform Building Code (UBC)" which included a fee schedule. a. It was updated every three years. 2) In 2003, the UBC decides that it would no longer include a fee schedule. 3) In 2003, the League of Minnesota Cities and AMM formed a committee and developed a fee schedule based on using the UBC and applying the Consumer Price Index. a. St. Anthony adopted this fee schedule and is what is used today. 4) Since no one was updating the fee schedule, in 2009, the Minnesota Department of Labor and Industry developed a fee schedule that is part of State Statute 326B.153. The attached Excel spreadsheet reviews the building permit fee costs for 9 communities: 1) Blaine, Lino Lakes & Fridley are using the 2003 UBC fee schedule. 2) Golden Valley and St. Anthony are using the updated 2003 League of Minnesota Cities/AMM schedule. 3) New Brighton, Roseville and Columbia Heights appear to be using their own fee schedule. 4) Arden Hills adopted the State Statute fee schedule in January 2011. In discussing this issue and networking with other Finance Directors, their feedback indicates they are either in the process of reviewing or have plans to review the building permit fee schedule as defined in State Statute. Staff Recommendation: 1) Council approves ordinance amendment #2011-03 changing the City Ordinance Chapter 33.061 for Building Permit Fees as defined in Minnesota State Statute 32613.153. 2) Effective date 01/01/20]2. Subdivision 1. Building permits. (a) Fees for building permits submitted as required in section 32613.106 include: (1) the fee as set forth in the fee schedule in paragraph (b) or as adopted by a municipality; and (2) the surcharge required by section 32613.148. Surcharge. Surcharge fees are required for permits issued on all buildings including public buildings and state licensed facilities as required by section 32613.148. Subd. 4. Distribution. (a) This subdivision establishes the fee distribution between the state and municipalities contracting for plan review and inspection of public buildings and state licensed facilities. (b) If plan review and inspection services are provided by the state building official, all fees for those services must be remitted to the state. (c) If plan review services are provided by the state building official and inspection services are provided by a contracting municipality: (1) the state shall charge 75 percent of the plan review fee required by the state's fee schedule in subdivision 2; and (2) the municipality shall charge 25 percent of the plan review fee required by the municipality's adopted fee schedule, for orientation to the plans, in addition to the permit and other customary fees charged by the municipality. (d) If plan review and inspection services are provided by the contracting municipality, all fees for those services must be remitted to the municipality in accordance with their adopted fee schedule.
