4 VI. GENERAL BUSINESS OF COUNCIL.
A. Ordinance 2011-03; Amending the Building Permit Fees as stated in the Minnesota State
Statute 32613.153. Roger Larson, Finance Director, presenting,
9 Finance Director Larson presented the proposed amendments to Chapter 33.061 of the City's
10 Ordinance related to building permit fees as defined in Minnesota State Statute 32613.153. He
11 provided a brief history of building permit fees, noting that the City's fee schedule has not been
12 revised since 2003. He stated that staff conducted a survey of nine metro communities and
13 found that there is no uniform building fees schedule being used in these communities and the
14 trend among the communities is to adopt the fee schedule developed by the Minnesota
15 Department of Labor and Industry and contained in State Statute 32613.153. He reviewed the
16 implementation schedule which proposes an effective date of January 1, 2012.

18 Councilmember Gray noted that Arden Hills adopted the fee schedule contained in the State
19 Statute and asked if there was any opposition to the new fee schedule.

21 Mr. Larson replied that there was no opposition in Arden Hills to the new fee schedule. He
22 added that builders have often commented that there is no uniformity in the fee schedules across
23 the metro and the trend toward adopting the fee schedule contained in the State Statute will serve
24 to provide a fair and equitable system among the cities.
25
26 Councilmember Roth requested information about the overall percentage increase the new fee
27 schedule represents. He also requested information about the amount of revenue the building
28 permit fees generate for the City.

30 Mr. Larson replied that the new fee schedule represents an approximate 12% increase from the
31 2003 rates. He reiterated that the City's building permit fees have not been increased since 2003,
32 while the City's administrative costs have gone up. He advised that in 2010, building permit fees
33 generated approximately $109,000; however, the City receives 40% of the building permit fees
34 and the remaining 60% goes to the building officials. He added that the City estimates the
35 revenue from building permit fees will increase to $123,000 in an average year, and the City
36 would receive an additional $6,000-$7,000 in an average year.

38 Councilmember Stille asked if building permits fees will be increased if the Minnesota
39 Department of Labor and Industry amends the fee schedule contained in the Statute.

41 Mr. Larson explained that there is no provision in the Statute for automatic revision; however,
42 staff plans to monitor the Statute and any change in the building permit fees would come back to
43 the City Council for review.

Mayor Faust stated that the one of the charges of the Regional Council of Mayors is to provide
some transparency among communities, e.g., regulation and permitting fees, and the adoption of
this fee schedule will enhance the goal of making the Twin Cities a competitive region.
5 Motion by Councilmember Gray, seconded by Councilmember Jenson, to approve the First
6 Reading of Ordinance 2011-03; Amending the Building Permit Fees as stated in the Minnesota
7 State Statute 326B.153.

9 Councilmember Stille suggested that the City Council consider waiving the second and/or third
10 reading since the proposed amendment is not controversial.

12 Mayor Faust suggested that the words "as stated in Minnesota State Statute 326B.153" be
13 deleted from the title of the Ordinance because the statute may change in the future and the City
14 Council should retain its authority to amend the fee schedule. He requested that the City
15 Manager review this revision prior to the second reading of the Ordinance.

19 VII. REPORTS FROM CITY MANAGER AND COUNCIL MEMBERS.

21 City Manager Morrison reported on the following:
22 • The League and City Attorney have been asked for advice on how to proceed with the
23 recent changes to the variance law and the changes will be discussed with the City
24 Council and Planning Commission in the near future
25 • Staff is working with Ehlers to update the City's key financial strategies for presentation
26 to the City Council later this summer
27 • May 18 - meeting with Lauderdale staff regarding potential municipal liquor store
28 • May 19 — Regional Council of Mayors meeting to discuss ULI
29 • May 23 - St. Paul Chamber meeting panel discussion on "State of the Suburbs" in
30 Ramsey County
31 • MWMO grant for overseeder in the amount of $5,972
32 • Bike Rack Grant in the amount of $2,700 from Bike Walk Twin Cities Program to install
33 18 bike racks throughout the City
34 • GMAC seminar with Wendy Webster regarding the rebate and loan programs
35 • The City was notified that it is one of seven cities that will be awarded a Step 2
36 GreenStep Cities award by the Minnesota Pollution Control Agency
37 • May 24 — tour and presentation to the Pollution Control Agency and DNR stormwater
38 staff regarding the City's water reuse facility. He stated that the PCA is developing a
39 manual on water reuse facilities and the City we will be identified in this manual
40 • Recited email from resident thanking staff for the beautiful, clean park facilities.

42 Mayor Faust extended the City Council's thanks to staff for their work on the GreenStep Cities
43 program and the Step 2 award.

Councilmember Jenson reported on his attendance at the May 2 worksession and participation in
the May 7 Clean -Up Day.

8 Mayor Faust reported on the following:
9 • May 11 League meeting regarding the future of the League
10 • May 23 meeting with the Freshwater Society regarding participation in a pilot project on
11 water quality and community clean-ups. The project will involve volunteer organizations
12 to perform fall cleanup in October, including street sweeping to test how much
13 phosphorous is contained in the contents of the clean-up and to provide feedback on the
14 effects of grass clippings, etc. The MWMO is supporting this effort and wants to do the
15 pilot project in St. Anthony because of the City's demonstrated leadership and
16 willingness to work with the Watershed on water quality issues. Further information will
17 be provided and a DVD from the Freshwater Society will be available at City Hall for
18 any interested residents.

22 Mayor Faust invited residents to come forward at this time and address the Council on items that
23 are not on the regular agenda.

27 IX. INFORMATION AND ANNOUNCEMENTS.

29 City Manager Morrison reminded the City Council of the joint meeting with the School Board on
30 Tuesday, May 31, which will include a tour of the School District's final referendum
31 improvements. He reported that the St. Anthony History Book will be completed on June 7. He
32 announced that he and the Mayor will serve on a panel at the League conference on June 17.

WHEREAS, the City of St. Anthony Police Department received a donation in

A RESOLUTION ORDERING PREPARATION OF FEASIBILITY
REPORT FOR 2012 STREET AND UTILITY IMPROVEMENTS
WHEREAS, the following locations are proposed for street and utility reconstruction:
Belden Drive from 34th Avenue NE to 36th Avenue NE
Coolidge Street NE from 34th Avenue NE to 36th Avenue NE
35°i Avenue NE from Harding Street to Belden Drive
WHEREAS, a portion of the cost of the improvements are to be assessed to the benefited
properties, pursuant to Minnesota Statutes Chapter 429.
NOW, THEREFORE, BE IT RESOLVED, of the City Council of the City of St. Anthony:
That the proposed improvement be referred to WSB & Associates, Inc. for study and that they
are instructed to report to the Council with all convenient speed advising the "Council in a
preliminary way as to whether the proposed improvement is necessary, cost-effective, and
feasible and as to whether it should best be made as proposed or in connection with some other
improvement, and the estimated cost of the improvement as recommended.
Adopted this day of 2011.

This letter is intended to provide you with an update on the status of projects that are ongoing within the
City of St. Anthony Village. Outlined below please find a list of the projects and their status:
2011 Street and Utility Reconstruction Project
The replacement of utilities on Edward Street and Coolidge Street has been completed and
construction of the new roadway has begun. In the following weeks, the gravel subgrade and
concrete curb will be place followed by the first lift of asphalt. The reconstruction of Harding
Street and Belden Drive is anticipated to begin the week of June 13, 2011.
2010 Street and Utility Reconstruction Project
The reconstruction of Silver Lane is nearing completion. The final lift of asphalt has recently
been placed and pavement marking will soon be placed. Final touches to the turf establishment
will be made throughout summer as the contractor monitors the growth of the seeded areas.
Rice Creek Watershed Grants
We have received two $50,000 Urban Cost Sharing Grants from the Rice Creek Watershed
District. The grants are for constructing an Alum Treatment System at Salo Park and for a
Biofiltration Basin at Central Park.

ITEM: BUILDING PERMITS — MN STATUTE 326B.153
To determine what other cities charge, staff recently conducted a survey of surrounding
Metropolitan Cities. The data shows that building permit fees vary and there is no
consistency or a uniform method used for establishing building permit fees.
What the survey did reveal is that a trend is developing where surrounding communities
are in the process of discussing adoption or have adopted the fee schedule defined by MN
Statue 326B.153.
At the April 4d' and May 2"d work sessions, discussions occurred with the City Council to
review St. Anthony's current fee structure for "Building Permits" compared to the fees of
other Cities and the fee structure defined in State Statue 326B.
On May 24`h Council approved the first reading to amend City Ordinance 33.061 to set
St. Anthony's building fees at the same level as defined in the State Statue.
At that meeting, Council asked Staff to update them on the building permit fees of
Minneapolis. Their fees are currently higher than State Statue (see attached fee
schedule).
Also, per the direction of the Council, Staff changed the heading of the ordinance to "AN
ORDINANCE AMENDING THE BUILDING PERMIT FEES" eliminating the language
"AS STATED IN MINNESOTA STATE STATUTE 326B.153".
Additional Update for the City Council
Surrounding cities who have implemented the State Building Permit Fee Schedule now
include:
1) Arden Hills — Adopted January 2011.
2) Moundsview — Recently adopted.
3) Roseville — Recently adopted.
Recommendation:
1) Council approves second reading - ordinance amendment 42011-03 changing the
City Ordinance Chapter 33.061 for Building Permit Fees.
2) I affective date 01/01/2012.
