Greetings Saint Anthony Mayor and City Council!
My name is Nick Voss, MN GreenCorps 'Living Green' member at Saint Anthony Village for the 2012/2013 service year. I graduated
from Bethel University in 2010 with a double major in Environmental Science and Reconciliation Studies, and a minor in Philosophy.
My professional career so far has taken me to the U of MN Cedar Creek Ecosystem Science Reserve, Belize, and the nonprofit Metro
Blooms in Minneapolis.
I'm excited to learn from this opportunity and serve Saint Anthony in furthering its mission in sustainability. Equipped with mentors,
training, and support from the MPCA who coordinates the GreenCorps program, I'm confident that together we'll make substantial
strides in sustainability this year. MN GreenCorps is a State AmeriCorps program that is facilitated by the MN Pollution Control
Agency (MPCA). Because of this, there is no cost to a host site for having a GreenCorps member. As businesses, nonprofits or cities
such as Saint Anthony apply to become a GreenCorps host site, the MPCA interviews and delegates members to these host sites for
a variety of environmental projects. Member tracts include Waste/Recycling, Clean Energy, Local Foods, Stormwater, and Living
Green.
Being a Living Green Corps member, I get to pursue a variety of projects from multiple tracts, forming a wholesome all-around
mission in sustainability. All of my projects will require appropriately planned education and outreach, with detailed documentation
to ensure success. What's more is that asking, "How will Saint Anthony sustain my projects come the end of my service year" will be
a regular, ongoing dialogue between me and my supervisors. Saint Anthony's GreenCorps Projects include:
- Recycling
o Improve rates and volumes through data collection, education and outreach, and consolidating resources from
Ramsey and Hennepin Counties.
o Coordinate with schools, multi -family complexes, and trash haulers to specify recycling improvement strategies
and put them to action.
Bio manipulation at Silver Lake:
o Coordinate Carp removal with Rice Creek Watershed, Three Rivers Park District, the DNR, and local commercial fish
processors.
o Support efforts with education and outreach for rainbarrels, raingardens, and shoreline restoration to ensure
healthy, holistic, and long lasting impact on Silver Lake.
Stormwater BMP (Best Management Practice) education, planning, and implementation
o Integrate resources from Rice Creek Watershed and Mississippi Watershed Management Organization to install
stormwater BMPs and advocate eco -friendly lawn care techniques.
o Educate residents to independently take initiative on stormwater issues, and work with local schools to create
educational science opportunities from raingardens and BMPs.
o Consult with City Engineer (WSB & Associates) for design and implementation of BMPs.
- Pet waste education and outreach
o Develop an educational campaign concerning pet waste and its implications on water quality. Work with local
businesses and residents to build community collaboration and improved public and private pet waste practices.
I want to thank the council for this opportunity to gain such valuable work experience that also helps Saint Anthony make
progressive strides. Facilitating and fostering Saint Anthony's existing eager environmental initiatives will be a joy for the community
and will yield measurable outcomes for Saint Anthony's environment. I look forward to getting to know the city and its residents
more in depth in the coming year, and I'm honored to come along side Saint Anthony's rich and progressive history as a "Village in

CALL TO ORDER.
Mayor Faust called the meeting to order at 7:01 p.m.
PLEDGE OF ALLEGIANCE.
Mayor Faust invited the Council and audience to join him in the Pledge of Allegiance.
ROLL CALL.
Present: Mayor Faust; Councilmembers Gray, Jenson, Stille, and Roth.
Absent: None.
Also Present: City Manager Mark Casey.

Motion by Councilmember Gray, seconded by Councilmember Jenson, to approve the City
Council Meeting Agenda of October 9, 2012.
Motion carried unanimously.
II. PROCLAMATIONS AND RECOGNITIONS.

III. CONSENT AGENDA.

Motion by Councilmember Gray, seconded by Councilmember Jenson, to approve the Consent
Agenda items.
Councilmember Roth asked if the City certifies special assessments for delinquent public utility
charges every year.

Mayor Faust replied in the affirmative. He requested that City Manager Casey verify the PID #s
for the four Ramsey County properties that have the same PID # with four different addresses.
Motion carried unanimously.

VI. GENERAL BUSINESS OF COUNCIL.
A. Ordinance 2012-08; Ordinance Amending Criminal Historyground for Applicants
for Cit} Employment and City Licenses (Second Reading). Mark Casey, City Manager,
presenting.
City Manager Casey stated this is the second reading and advised that § 32.50(A)(3) has been
revised to delete the reference to the City Council; in addition, § 111.002(C)(2) has been
amended to add "and any other licenses the city deems appropriate" and the last paragraph of that
section has been revised to delete the reference to the City Council.
Motion by Councilmember Stille, seconded by Councilmember Gray, to approve Second
Reading of Ordinance 2012-08; Ordinance Amending Criminal History Background for
Applicants for City Employment and City Licenses.
Motion carried unanimously.
B. Ordinance 2012-09; Ordinance Amending Section 31.12; Mayor and Councilmembers
Salaries First Reading). Mark Casey, City Manager, presenting.
Mayor Faust explained this ordinance amendment increases the monthly salary of the Mayor
from $625 to $675, the monthly salary of the Mayor Pro Tem from $563 to $613, and the
monthly salary of Councilmembers from $500 to $550. He indicated the ordinance will not go
into effect until January 1, 2014, and noted it has been six years since these salaries were
adjusted.
Motion by Councilmember Roth, seconded by Councilmember Jenson, to approve First Reading
of Ordinance 2012-09; Ordinance Amending Chapter 31.12; Mayor and Councilmembers
Salaries.
Councilmember Stille pointed out for the record that this is the first reading and there will be two
more readings of the amendment.

3 C. Quarterly Goals Update. Mark Casey, City Manager, presenting.

5 City Manager Casey presented the P quarter goals update and stated that the City's GreenCorps
6 staff member will attend the next City Council meeting to discuss areas where he will be
7 working, including implementing the phosphorous reduction grant program, Silver Lake clean -
8 up, and the rain garden workshops. He advised that the City installed 18 bike racks as part of its
9 effort to plan and encourage bike transportation, the 2012 street project has been completed, the
10 City continues to meet with Ramsey County regarding the private/public fiber ring owned by
11 Ramsey County, the sealcoating program has been included in the 2013 budget, the summer
12 survival school program was completed, and the City's goal of developing a financing plan for
13 large equipment has been adopted in the 2013-2018 CIP.

15 Councilmember Stille requested an update regarding the Mirror Lake back flow preventer. He
16 also requested an update regarding the Dominion project.

18 City Manager Casey advised this item will go out for bid on October 11 and is being bid as part
19 of the Autumn Woods project. He added the City tried to bid this work separately but the prices
20 were not satisfactory so the project will be combined with Autumn Woods for a contractor doing
21 similar work. He stated the City anticipates the Dominion project will commence in early 2013.

27 Councilmember Stille reported on his attendance at Councilmember Gray's induction into the St.
28 Anthony Village IIall of Fame last weekend. He extended congratulations to Councilmember
29 Gray and stated Councilmember Gray gave a great acceptance speech, which reminded him of
30 the depth of knowledge Councilmember Gray brings to the City as a lifelong resident.

34 Councilmember Jenson reported on his attendance at Councilmember Gray's induction into the
35 St. Anthony Village Hall of Fame last weekend and stated the City is privileged to have
36 Councilmember Gray's service to the community as a lifelong resident.

40 Mayor Faust reported on his attendance at the following:
41 • October Is` City Council work session attended by all Councilmembers.
42 • Councilmember Gray's induction into the St. Anthony Village Hall of Fame last
43 weekend. He extended congratulations to Councilmember Gray and noted that only 25
44 individuals have been inducted into the Hall of Fame, which speaks highly of that select
45 group of people.

I • October 8°1 Regional Council of Mayors meeting. He stated that a copy of the Met
2 Council presentation was emailed to the City Council and includes information regarding
3 "MSP Thrive 2040" which looks at future demographics in the state and how to provide
4 transportation and jobs that will sustain the state into the future and distinguish the state
5 from other parts of the country.

Mayor Faust invited residents to come forward at this time and address the Council on items that
are not on the regular agenda. Hearing none, Mayor Faust moved forward with the agenda.
IX. INFORMATION AND ANNOUNCEMENTS.
Mayor Faust stated that Village Notes was recently published and copies are available at City
Hall. He reminded residents of the live sustainability training workshop on Thursday, October
11'x', at Silverwood Park which is being held with the cities of Falcon Heights, Lauderdale, and
St. Anthony and encouraged all residents to attend the event. He stated that the Chamber of
Commerce will be hosting a candidate forum on Monday, October 15°i, at 6:30 p.m. with the
candidates for Hennepin and Ramsey County Commissioner and the candidates for Senate seat
41 and House seat 41b.
City Manager Casey reminded residents of the Fire Department's Open House on Saturday,
October 13"i, from 1:00-4:00 p.m. at the fire station.

Resolution 12-082; Authorizing Continued Support of the St. Anthony New Brighton School
District #282 Community Services Recreational Programs for years 2013 and 2014.
MANAGER'S REVIEW:
This is a renewal of the agreement between the City of St.
Anthony and St. Anthony -New Brighton School District
#282 for the operation of recreational programs.
Points to note to the agreement are as follows:
■ The Advisory Council that was enacted through the last
agreement has been meeting on a regular basis with a
City Councilmember serving on this Council.
Councilmember Jensen is the Council Representative.
■ Community Services will continue to be responsible for
scheduling and administering the recreational programs.
■ The City of St. Anthony will pay $52,175 per year
commencing January 1, 2013 through December 31, 2014
to the St. Anthony -New Brighton School District.
Wendy Webster, SANB Community Services Director will
be present to provide the City Council with additional
information.

WHEREAS, the City Council of the City of St. Anthony recognizes that the St. Anthony -New
Brighton School District #282 Community Services provide a variety of
recreational opportunities and senior citizen activities to community residents;
and
WHEREAS, due to changes enacted by the Minnesota State Legislature, St. Anthony -New
Brighton School District 4282 is no longer allowed to levy $52,175 for the cost of
operating Community Services; and
WHEREAS, the City Council supports recreational opportunities and senior citizen activities
for residents of the community and would like the St. Anthony -New Brighton
School District #282 to continue providing these services to St. Anthony
residents.
NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of St. Anthony
Village hereby authorizes continued support of the St. Anthony -New Brighton
School District #282 Community Services Recreational Programs for the years
2013 and 2014.

A RESOLUTION AUTHORIZING THE APPLICATION FOR
METROPOLITAN COUNCIL MUNICIPAL PUBLICALLY OWNED INFRASTRUCTURE
INFLOW/INFILTRATION GRANT PROGRAM
WHEREAS, the Minnesota Legislature has appropriated to the Metropolitan Council of Environmental
Services (MCES) in the 2012 State Bonding Bill, $4,000,000 for a grant program to be
administered by the MCES for the purpose of providing grants to municipalities for
capital improvements to public municipal wastewater collection systems to reduce the
amount of inflow and infiltration to the MCES metropolitan sanitary sewer disposal
system (I/I Municipal Grant Program).
WHEREAS, the MCES has identified the City of St. Anthony Village as a contributor of excessive
inflow and infiltration to the MCES metropolitan sanitary sewer disposal system and thus
an eligible applicant for grant funds under the I/1 Municipal Grant Program.
WHEREAS, grant monies will be awarded to pre -approved municipalities for a pre -determined
amount up to 50% of eligible improvements completed between May 12, 2012 and June
30, 2014.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of St. Anthony Village that:
1) The Council authorizes the application for grant monies from the Metropolitan Council of
Environmental Services I/ I Municipal Grant Program
2) Todd Hubmer, City Engineer, is hereby designated as the individual responsible for receiving and
responding to all communication regarding matters related to the I/I Municipal Grant Program,
except for those actions that must be approved by the City Council.

AN ORDINANCE AMENDING CRIMINAL HISTORY BACKGROUND FOR
APPLICANTS FOR CITY EMPLOYMENT AND CITY LICENSES
The City Council of the City of Saint Anthony ordains as follows for City Employment:
§ 32.50 EMPLOYMENT BACKGROUND CHECKS
A. Applicants for City Employment
(1) Purpose: The purpose and intent of this section is to establish regulations that will allow
law enforcement access to Minnesota's Computerized Criminal History information for
specified non -criminal purposes of employment background checks for City positions.
(2) Criminal History Employment Background Investigations: The City of St. Anthony Police
Department is hereby required, as the exclusive entity within the City, to do a criminal
history background investigation on the applicants for the following positions within the
city, unless the city's hiring authority concludes that a background investigation is not
needed:
All full and part-time positions.
(3) In conducting the criminal history background investigation in order to screen
employment applicants, the Police Department is authorized to access data maintained in
the Minnesota Bureau Department of Criminal Apprehensions Computerized Criminal
History information system in accordance with BCA policy. Any data that is accessed and
acquired shall be maintained at the Police Department under the care and custody of the
chief law enforcement official or his/her designee. A summary of the results of the
Computerized Criminal History data may be released by the Police Department to the
hiring authority, the City Manager.
(4) Before the investigation is undertaken, the applicant must authorize the Police Department
by written consent to undertake the investigation. The written consent must fully comply
with the provisions of MN Statute Chapter 13 regarding the collection, maintenance and
use of the information. Except for the positions set forth in Minnesota Statutes Sections
364.09, the City will not reject an applicant for employment on the basis of the applicant's
prior conviction unless the crime is directly related to the position of employment sought
and the conviction is for a felony, gross misdemeanor, or misdemeanor with a jail
sentence. If the City rejects the applicant's request on this basis, the City shall notify the
applicant in writing of the following:
a. The grounds and reasons for the denial.
b. The applicant complaint and grievance procedure set forth in Minnesota Statutes
Section 364.06.

c. The earliest date the applicant may reapply for employment.
d. That all competent evidence of rehabilitation will be considered upon
reapplication.
§ 32.43 POLICE DEPARTMENT
(A) Responsibilities. The Police Department will have the duties and responsibilities given in accordance with
the Constitutions and laws of the United States and the State of Minnesota, this code and other official acts of
the city. The Police Department, under the direction of the Chief of Police, is charged with the protection of all
persons and property within the corporate limits of the city, and the other areas as agreed upon by the City
Council or required by law. The Police Department will be responsible for prevention of crimes, accidents, and
civil disorders, control of traffic, and general enforcement of this code and applicable statutory laws.
The Ciftj Council of the City of Saint Anthony ordains as follozes for City Licenses:
§ 111.002 APPLICATION.
(C) License Background Checks.
(1) Purpose:

113.03 LICENSING; EXEMPTIONS
(E) Procedure. All applications will require criminal history data as described in Section 111.002
subsection C. Within 30 days after receipt of the completed application and the criminal history
background has been completed, the Police Department will make a written report and
recommendation to the City Council as to the issuance or non -issuance of the license. If the City
Manager denies the license, the applicant must be notified in writing of the decision, the reason for
denial and of the applicant's right to appeal the denial by requesting, within 20 days of receiving a
notice of rejection, a public hearing before the City Council. The City Council shall hear the appeal
within 20 days of the date of the request. The decision of the City Council following the public
hearing can be appealed by petitioning the Minnesota Court of Appeals for a writ of certiorari.
Effective Date. This ordinance shall become effective after publication.

Subd. 1. Mayor. The salary of the Mayor is $675.00 per month.
Subd. 2. Mayor pro tem. The salary of the Mayor pro tem is $613.00 per month.
Subd. 3. Councilmembers. The salary of each Councilmember other than the
Mayor or Mayor pro tem is $550.00 per month.
Subd. 4. Duration. The salaries established in this Section will remain in effect
until amended in accordance with § 415.11.

Re: Late Payment Fees/Certification of Delinquent Accounts
The current process for charging penalties on utility bills is $2.00 for the first
occurrence on consecutive quarters and 10% of cumulative balance thereafter.
Staff is recommending that the City amend ordinances to a 5% cumulating penalty
per occurrence.
• 10% fee is a burden on large families (bills) that are having temporary cash
flow issues. Also, 10% fee is significantly higher than current carry cost
(market interest rates).
• Replacing the $2/10% late fee with 5% smooth's out the penalty and
encourages people not to be late more than once.
• $2 is a very low return on cost to process.
In addition, staff recommends certification of delinquent accounts for account
balances greater than $50.00 and at least two quarters past due.
Summary:
Staff recommends amending Ordinance 33.043 to reflect a 5 % cumulative late fee. The
City would use the certification to taxes as its main tool to collect past due balances.
This along with the revised late fee charges is expected to reduce the delinquency rate
in the long term and result in lower internal costs. The policy for delinquent bills will
be revised accordingly. See attached.

AMENDING CHAPTER 33 AND CHAPTER 52 REGARDING
UTILITY BILLING PROCEDURES
The City Council of the City of Saint Anthony ordains as follows:
§ 33.002 COLLECTION.
Payment of city billings must be made not later than the date specified in the billing. If the
amount is not paid when due, a late charge may be added. If a charge is more than 15 days past
due, it will be considered delinquent. All delinquent accounts will be certified to the Clerk, who
will prepare an assessment roll each year providing for assessment of the delinquent amounts,
plus interest at the rate of 8% per annum from the date amounts become delinquent, against the
respective properties served. The assessment roll will be delivered to the City Council for
adoption on or before October 10 the second "1'ues(hy of 0clober of each year. Assessment will
not preclude any other legal action to collect delinquent accounts.
§ 33.039 TESTING METER.
At the request of any customer and payment of $10, a meter will be inspected and tested for

§ 33.042 WATER METER DEPOSIT.

§ 33.044 CERTIFICATION OF DELIQUENT ACCOUNT BALANCES.
Delinquent account balances greater than $50.00 and at least two quarters past due will
be certified to taxes by November 30th of each year. Accounts significantly exceeding either of
these criteria's are considered at -risk and are subject to early certification or water shut-off at the
City's discretions.

The City Council of the City of Saint Anthony ordains asfollows:
§ 52.05 WATER READING AND BILLING.
(A) Meter reading. All water meters will be read quarterly on or before the third day
of the months of January, April, July, and October.
(B) Billing and payment. Quarterly water statements will be sent out on or around the
twentieth day of the months of January, April, July, and October and are payable on or before the
twenty-fifth day of the following month. If payment is made by U.S. mail, a bill will be
considered paid as of the date of postmark. If the payment date deadline falls on a Saturday,
Sunday, or legal holiday, payment may be made on or prior to the first day thereafter on which
city offices are open. If payment is not timely made, a late fee in the amount set forth in Chapter
33 is due. If payment on a quarterly statement is not made on or prior to the fifth day of March,
June, September, or December respectively, the wi44 city retains the right to send a final notice of
payment overdue to the customer by certified mail, notifying the customer that: payment must
be received at the City Hall within 5 days; failure to make the payment in full within the 5 -day
period will result in the discontinuance of water service; and the customer has the right to a
hearing before the Public Works Director before water service is discontinued, provided the
customer has made a request for a hearing within the 5 -day period. If a request for a hearing is
timely, made by the customer, a hearing will be held in accordance with the provisions of §
52.06. If a payment is not received and a hearing request is not timely made, the city may
discontinue service to the customer. A charge will be made to the customer in the case of
discontinuance of service for nonpayment of a water bill, and a charge will also be made to the
customer for turning on the water service after it has been shut off for nonpayment, each in the
amounts set forth in Chapter 33. Payments of any bill must be made at the City Hall, and
employees of the Water Department are not authorized to accept payment of any bill.
Effective Date. These ordinances shall become effective as of January 31, 2013.
