CALL TO ORDER.
Mayor Faust called the meeting to order at 7:00 p.m.
PLEDGE OF ALLEGIANCE.
Mayor Faust invited the Council and audience to join him in the Pledge of Allegiance.
ROLL CALL.
Present: Mayor Faust; Councilmembers Gray, Jenson, Stille, and Roth.
Absent: None.
Also Present: City Manager Mark Casey, City Engineer Todd Hubmer, and Administrative Intern
Bob Matthews.
Guests: Planning Commissioner Don Jensen, University of Minnesota Adjunct Professor
Dave Wanberg and University of Minnesota Sustainability Studies Minor Students.
CONSIDERATION, DISCUSSION, AND POSSIBLE ACTION ON ALL OF THE FOLLOWING
ITEMS.
I. APPROVAL OF SEPTEMBER 25, 2012, CITY COUNCIL MEETING AGENDA.
Motion by Councilmember Gray, seconded by Councilmember Jenson, to approve the City
Council Meeting Agenda of September 25, 2012.
Motion carried unanimously.
H. PROCLAMATIONS AND RECOGNITIONS.
A. Kiwanis Peanut Day Proclamation.
Councilmember Jenson recited the Kiwanis Peanut Day Proclamation designating Friday,
September 28, 2012, as St. Anthony Kiwanis Peanut Day.
Mr. John Dierbeck, President of the St. Anthony Kiwanis Club, appeared before the City Council
and introduced Mr. Tim Mezzenga, President-elect of the St. Anthony Kiwanis Club. He
reported the St. Anthony Kiwanis Club achieved "Distinguished Club" status for the third year in
a row and advised that the St. Anthony Kiwanis Club currently supports three clubs in the school
as well as the Aktion Club for youth with disabilities and a new club was recently chartered
called the Circle K Club at Hamline University. He thanked the community for its support.
Mayor Faust expressed the City Council's thanks to Mr. Dierbeck and the St. Anthony Kiwanis
Club for everything they do in the community and congratulated the St. Anthony Kiwanis Club
on its 50°i anniversary.

B. University of Minnesota Sustainability Students.
City Manager Casey introduced Mr. Dave Wanberg, University of Minnesota adjunct professor
of sustainability studies minor.
6 Mr. Wanberg stated he pleased to announce the City has agreed to work on a project with several
7 students from the sustainable community's class, which will incorporate real world type projects.
8 He indicated this project is a great opportunity for the students to apply their knowledge and will
9 include working with the cities of Lauderdale and Falcon Heights as well as St. Anthony and the
10 students are looking forward to working with each community.

12 Mr. Ben Zientara appeared before the City Council and explained that two workshops have been
13 scheduled at Silverwood on Thursday, October 11"', and Thursday, November I", from 6:00-
14 9:00 p.m. and extended an invitation to all residents of St. Anthony, Lauderdale and Falcon
15 Heights to attend. He stated the meetings are intended to develop ideas that the cities can use to
16 implement strategies for sustainability in their community.

18 Ms. Libby Norris appeared before the City Council and explained that the first workshop will
19 include a "State of the City" presentation by each of the Mayors to provide an understanding of
20 each City and its goals, followed by small group discussions. She stated the students are
21 preparing sustainability guidelines that lay out principles of sustainable city planning to get
22 citizens thinking about what sustainability actions they would like to see. She indicated the
23 residents will brainstorm ideas about what they want to focus on and she stressed that this is a
24 grassroots -led movement and they want active engagement with the citizens.

26 Mr. Ben Biancini appeared before the City Council and explained that the second workshop will
27 build on the first meeting and will include sharing ideas on how to create a more sustainable
28 community. He indicated the second workshop will take the ideas generated at the first meeting
29 and turn them into concrete goals with deadlines for meeting those goals. He added the plan for
30 the workshops is to spark ideas and assist each community in raising awareness and propel each
31 community's sustainability goals into the future months and years.

33 Mr. Wanberg stated the workshops are not intended to suggest in any way that communities
34 should add more City staff or programs; rather, the workshops will generate ideas about what
35 residents can do to create a more sustainable community into the future. I -Ie expressed thanks to
36 City Manager Casey and Public Works Director Hartman for their leadership and stated that
37 invitations to the workshop will be sent to a number of elected officials, the Watershed District,
38 as well as representatives from the faith community and School District. 1- le added that everyone
39 is welcome to attend the workshops.

41 Councilmember Stille stated that the workshops will provide a springboard for the City Council's
42 goal setting in January for implementation into the City's 2013 strategic plan. He asked if the
43 University of Minnesota students envision continued involvement with the City on this project.

45 Mr. Wanberg stated the University would like to continue working with the City and indicated
46 there will be opportunities for other sustainability students to work with the City in the future.

2 Mayor Faust stated the City worked with sustainability studies students earlier this year on
3 becoming a Step Three GreenStep City. He thanked the University of Minnesota students for
4 working with the City and felt this project would reach well into the community. He stated the
5 City wants residents involved and encouraged them to attend the workshops.

22 V. REPORTS FROM COMMISSION AND STAFF.

24 A. Resolution 12-079, Approving a Variance to Allow an Accessory Structure in the Front
25 Yard for the Property Located at 2653 Stinson Boulevard. Don Jensen, Planning
26 Commissioner, presenting.

28 Planning Commissioner Jensen presented the variance request to allow a 10' x 20' shed in the
29 front yard and explained that the Code requires accessory structures to be placed in the rear yard
30 but the shed cannot be placed in the year yard because of the way the house is oriented toward
31 Stinson Boulevard. IIe advised the shed would be used for storage of items currently stored in
32 the garage, thus freeing up space for parking a vehicle in the garage. He presented a sketch plan
33 and several photos of the property, noting that the shed would be constructed using cedar shake
34 siding to replicate the garage/art studio. He reviewed the variance criteria, stating that the
35 property owners propose to use the property in a reasonable manner, the circumstances are
36 unique to the property, the variance will not alter the character of the locality, economic
37 considerations are not the basis of the practical difficulties, the variance is consistent with the
38 City's Comprehensive Plan, and the variance is in harmony with the intent of the Zoning Code.

40 Councilmember Roth requested information about the accessory structure's foundation.

42 Ms. Nina Guertin and Ms. Patty LaBossiere appeared before the City Council and Ms.
43 LaBossiere stated the shed will not sit on a concrete slab because of the footprint limitations on
44 the property and the shed will have a green treated floor similar to a pallet that will allow air to
45 go underneath the shed. She indicated the equipment currently being stored outside and in the
46 garage will be moved into the shed.

Councilmember Jenson asked if there was some reason why the proposed shed could not be
located in the side yard.
Ms. Guertin explained they felt if they put the shed against the back fence there would be more
exposure of the shed versus placing the shed in the front yard with the shorter 10' side facing
Stinson. She indicated the proposed shed will be hidden somewhat by the large pine tree adding
that aesthetics was their main concern and they want the shed to look smaller rather than larger.
Mayor Faust stated that the City Council's concern is aesthetics given the uniqueness of the lot
and to make sure the shed is pleasing to the eye and enhances the property.
Motion by Councilmember Roth, seconded by Councilmember Gray, to approve Resolution 12-
079; Approving a Variance to Allow an Accessory Structure in the Front Yard for the Property
Located at 2653 Stinson Boulevard.
Councilmember Stille stated he appreciated that the property owners intend to tie in the shed and
garage with the use of cedar shakes and did not think the proposed shed would impact the
community or be too close to the neighbors. He urged the property owners to do what they could
to keep the shed hidden as much as possible, adding that this is not a perfect variance.
Councilmember Jenson asked if this variance would put the City at risk of setting a precedent for
allowing buildings in the front yard.
City Manager Casey stated that from a land use perspective, no precedent would be set because
each variance request is looked at individually and in this case, the circumstances are unique to
the property.
Motion carried unanimously.
VI. GENERAL BUSINESS OF COUNCIL.
A. Ordinance 2012-06; Amending Chapter 32.07(A) of the City Code, Being the Planning
Commission Bylaws (Final Reading). Mark Casey, City Manager, presenting.
City Manager Casey presented the final reading of the Ordinance to reschedule the Planning
Commission meetings from the third Tuesday of the month to the fourth Monday of the month
beginning in October.
Motion by Councilmember Stille, seconded by Councilmember Jenson, to approve Ordinance
2012-06; Amending Chapter 32.07(A) of the City Code, Being the Planning Commission Bylaws
Motion carried unanimously.

B. Ordinance 2012-08: Ordinance Amending Criminal History Background for Applicants
for City Employment and City Licenses (First Reading). Mark Casey, City Manager,
presenting.
City Manager Casey explained that the Bureau of Criminal Apprehension has changed the rules
by which police departments can access computerized criminal history data for background
checks. He stated the Ordinance incorporates those changes and brings the current Code into
compliance and will enable the Police Department to continue with background checks as done
in the past.
Mayor Faust noted that the last sentence of § 32.50(A)(3) [is this what he was referring to?]
states that a summary of results of computerized criminal history data may be released to the
hiring authority, including the City Council, which implies that the City Council is involved in
the hiring process. He stated this should be a function of the City Manager and department heads
and asked that this section be revised prior to second reading.
Motion by Councilmember Roth, seconded by Councilmember Jenson, to approve First Reading
of Ordinance 2012-08; Ordinance Amending Criminal History Background for Applicants for
City Employment and City Licenses.
Motion carried unanimously.
VII. REPORTS FROM CITY MANAGER AND COUNCIL MEMBERS.
City Manager Casey — No report.
Councilmember Roth — No report.
Councilmember Stille reported on his attendance at the following:
• September 12°i inauguration of the new pedestrian crosswalk in front of City Hall.
• September 131x' presentation about local government to Mrs. Huninghake's 4°i grade class.
He thanked the 0' graders for allowing him to talk to their class.
• September 14°i attendance at the groundbreaking/ribbon cutting ceremony at Wilshire
Park followed by the turning on of the new lights at the football stadium. He stated the
City received three different grants from Hennepin County and the Twins Community
Fund for the new lights at the stadium, the soccer fields, Wilshire Park, the ball field
lights at Central Park, and the new grand stands. He expressed the City's thanks to
Hennepin County and the Twins Community Fund for the grants.
Councilmember Gray - No report.
Councilmember Jenson reported on his attendance at the September 14°i events at Wilshire Park
and the high school.

1 Mayor Faust reported on the following:
2 • He stated the new crosswalk will make the community a lot safer and reminded drivers
3 that if the lights in the crosswalk are flashing and someone is in the crosswalk, State law
4 requires that drivers stop.
5 • He thanked Mr. Troy Urdahl for assisting the City in securing the Hennepin Youth Sports
6 Program grant.
7 • Attendance at the September 18°i Chamber of Commerce meeting. He stated Mr. Bob
8 Laney gave an informative briefing on 'Building Assets; Reducing Risks."

Mayor Faust invited residents to come forward at this time and address the Council on items that
are not on the regular agenda. Hearing none, Mayor Faust moved forward with the agenda.
IX. INFORMATION AND ANNOUNCEMENTS.
None.
Mayor Faust recessed the regular meeting of the City Council at 7:44 p.m. to convene a Closed
Meeting of the City Council to discuss litigation matters pursuant to attorney-client privilege.
Mayor Faust reconvened the regular meeting of the City Council at 8:34 p.m.
X. ADJOURNMENT.

A RESOLUTION APPOINTING ELECTION JUDGES FOR THE
2012 GENERAL ELECTION
WHEREAS, Minnesota §204B.21, subd. 2 Appointing authority, powers and duties; indicates election
judges for precincts in a municipality shall be appointed by the governing body of the
municipality; and
WHEREAS, the individuals listed on Exhibit A have submitted applications to the City Clerk to be
Election Judges for the November 6, 2012, General Election:
The members of city staff that will be assisting with absentee voting are Phuongmai Dang, Robin Hartfiel,

REVIEW:
Attached are resolutions certifying property delinquent public utility charges for Hennepin
and Ramsey Counties. The owners of record of the properties were served proper notice of
the delinquency and failed to contact the City regarding the outstanding charges.
City Ordinance 33.107 states that if an owner of a property fails to pay delinquent bills, the
City may levy the amounts plus interest as a special assessment against the property. This
section applies to all charges which may be assessed under Minnesota Statutes 429.101 and
444.075.
The amount of the assessment will be certified to the respective County Auditor and will be
paid with collection of the 2013 real estate taxes.

AN ORDINANCE AMENDING CRIMINAL HISTORY BACKGROUND FOR
APPLICANTS FOR CITY EMPLOYMENT AND CITY LICENSES
The City Council of the City of Saint Anthony ordains as follozos for City Employment:
§ 32.50 EMPLOYMENT BACKGROUND CHECKS
A. Applicants for City Employment
(1) Purpose: The purpose and intent of this section is to establish regulations that will allow
law enforcement access to Minnesota's Computerized Criminal History information for
specified non -criminal purposes of employment background checks for City positions.
(2) Criminal Iistory Employment Background Investigations: The City of St. Anthony Police
Department is hereby required, as the exclusive entity within the City, to do a criminal
history background investigation on the applicants for the following positions within the
city, unless the city's hiring authority concludes that a background investigation is not
needed:
All full and part-time positions.
(3) In conducting the criminal history background investigation in order to screen
employment applicants, the Police Department is authorized to access data maintained in
the Minnesota Bureau Department of Criminal Apprehensions Computerized Criminal
History information system in accordance with BCA policy. Any data that is accessed and
acquired shall be maintained at the Police Department under the care and custody of the
chief law enforcement official or his/her designee. A summary of the results of the
Computerized Criminal History data may be released by the Police Department to the
hiring authority, inc-lueling the Cly Council, the City Manager.
(4) Before the investigation is undertaken, the applicant must authorize the Police Department
by written consent to undertake the investigation. The written consent must fully comply
with the provisions of MN Statute Chapter 13 regarding the collection, maintenance and
use of the information. Except for the positions set forth in Minnesota Statutes Sections
364.09, the City will not reject an applicant for employment on the basis of the applicant's
prior conviction unless the crime is directly related to the position of employment sought
and the conviction is for a felony, gross misdemeanor, or misdemeanor with a jail
sentence. If the City rejects the applicants request on this basis, the City shall notify the
applicant in writing of the following:
a. The grounds and reasons for the denial.
b. The applicant complaint and grievance procedure set forth in Minnesota Statutes
Section 364.06.

c. The earliest date the applicant may reapply for employment.
d. That all competent evidence of rehabilitation will be considered upon
reapplication.
§ 32.43 POLICE DEPARTMENT
(A) Responsibilities. The Police Department will have the duties and responsibilities given in accordance with
the Constitutions and laws of the United States and the State of Minnesota, this code and other official acts of
the city. The Police Department, under the direction of the Chief of Police, is charged with the protection of all
persons and property within the corporate limits of the city, and the other areas as agreed upon by the City
Council or required by law. The Police Department will be responsible for prevention of crimes, accidents, and
civil disorders, control of traffic, and general enforcement of this code and applicable statutory laws.
The Cihj Council of the City of Saint Anthony ordains as follows for City Licenses:
§ 111.002 APPLICATION.
(C) License Background Checks.
(1) Purpose:
The purpose and intent of this section is to establish that will allow law enforcement

(PAWNBROKERS)
111.290 APPLICATION VERIFICATION.
All applications shall be referred to the Police Department for verification and investigation of
the facts set forth in the application as described in Section 111.002 subsection C. Within 60 days after
receipt of a complete application, the Police Department shall make a written report and
recommendation to the City Council as to issuance or non -issuance of the license.
(PHYSICAL CULTURE AND HEALTH SERVICES AND CLUBS)
111.345 INVESTIGATION.
All applications shall be referred to the Police Department -for verification and investigation of
the facts set forth in the application as described in Section 111.002 subsection C.

timely -received shall take place before the City Council within reasonable period.
(PEDDLERS AND SOLICITORS)
113.03 LICENSING; EXEMPTIONS
(E) Procedure. All applications will require criminal history data as described in Section 111.002
subsection C. Within 30 days after receipt of the completed application and the criminal history
background has been completed, the Police Department will make a written report and
recommendation to the City Council as to the issuance or non -issuance of the license. If the City
Manager denies the license, the applicant must be notified in writing of the decision, the reason for
denial and of the applicant's right to appeal the denial by requesting, within 20 days of receiving a
notice of rejection, a public hearing before the City Council. The City Council shall hear the appeal
within 20 days of the date of the request. The decision of the City Council following the public
hearing can be appealed by petitioning the Minnesota Court of Appeals for a writ of certiorari.
Effective Date. This ordinance shall become effective after publication.

CALL TO ORDER.
Chair Faust called the meeting to order at 7:30 p.m.
ROLL CALL.
Commissioners present: Chair Faust; Commissioners Gray, Jenson, and Roth.
Commissioners absent: Commissioner Stille.
Also Present: Executive Director Mark Casey.
I. APPROVAL OF SEPTEMBER 11, 2012, HRA MEETING AGENDA.
Motion by Commissioner Jenson, seconded by Commissioner Roth, to approve the September
11, 2012, Housing and Redevelopment Authority Agenda as presented.
Motion carried 4-0 (Commissioner Stille absent).
II. CONSENT AGENDA.
Motion by Commissioner Gray, seconded by Commissioner Jenson, to approve the Consent
Agenda, which consisted of:
A. H.R.A. Meeting Minutes of August 28, 2012; and
B. Claims.
Motion carried 4-0 (Commissioner Stille absent).
III. PUBLIC HEARINGS.
