CALL TO ORDER.
Mayor Faust called the meeting to order at 7:00 p.m.
PLEDGE OF ALLEGIANCE.
Mayor Faust invited the Council and audience to join him in the Pledge of Allegiance.
ROLL CALL.

Also Present: City Manager Mark Casey, City Engineer Todd Hubmer, GreenCorps member Nick
Voss, and St. Anthony New Brighton Community Services Director Wendy Webster.
CONSIDERATION, DISCUSSION, AND POSSIBLE ACTION ON ALL OF THE FOLLOWING
ITEMS.
I. APPROVAL OF OCTOBER 23, 2012, CITY COUNCIL MEETING AGENDA.
Motion by Councilmember Gray, seconded by Councilmember Jenson, to approve the City
Council Meeting Agenda of October 23, 2012.
Motion carried unanimously.
II. PROCLAMATIONS AND RECOGNITIONS.
A. Introduction of Nick Voss, GreenCorps Member.
City Manager Casey explained the City applied for and was chosen as a host site for
GreenCorps, a program sponsored by Americorps and facilitated by the Minnesota Pollution
Control Agency. He stated there is no cost to the City and Mr. Voss will be with the City for
eleven months.
Mr. Voss stated he graduated from Bethel University with a degree in Environmental Science
and Reconciliation Studies and is excited to be part of the GreenCorps program. He explained
he will be working in the Living Green area focusing on storm water, clean energy, local foods,
and recycling and will be working with schools, homes, and multi -family complexes on
improving recycling rates and eliminating waste. He stated other projects include facilitating an
invasive carp removal project in Silver Lake, storm water projects to provide education on rain
barrels, and developing an education campaign regarding pet waste and its implications on water
quality. He stated St. Anthony is a standalone "Village in the City" with a unique history and has
made significant strides in addressing run-off pollution. He stated he was excited to help
progress this rich history that benefits the entire community adding that the City's efforts are
leading the entire metro area and the State. He indicated as a Level 3 GreenStep city the City is

1 proving that a community can come together to make structural environmental changes that are
2 healthy for residents and was confident the City would reach the GreenStep Level 4 city. He
3 thanked the City Council for the opportunity to serve the City.

5 Mayor Faust thanked Mr. Voss for working with the City and stated the most important thing
6 will be what the City does with the information presented by an unbiased professional to make
7 the City better for the future.

Mayor Faust introduced Wendy Webster, St. Anthony New Brighton Community Services

Director.

Ms. Webster explained that Community Services is affiliated with the School District and the
38
City and has a philosophy that education is a lifelong process, that all citizens share the
39
responsibility of educating all members of the community, and that citizens have a responsibility
40
to be involved in determining a community's needs and identifying resources to improve the
41
community as a whole. She stated that 2012 budgeted revenue totaled $1,084,000 with 76% of
42
43
revenue from program fees, 17% from property tax levies, 1% from State funds, and 5% from
the City's investment each year. She indicated that Community Services offers a wide range of
44
programs and the Community Services Advisory Council includes an Early Childhood Advisory
45
Council and Senior Citizen Advisory Council that advise staff on community needs and offer
46
recommendations on programs. She described the Early Childhood Family Education (SCFE)

program that includes half and full day preschool and early childhood screening. She stated that
Community Services also offers programs for grades K-6 that includes before and after school
programs and an eight week summer recreation program. She stated that Community Services
offers an open gym program and after school clubs for grades 6-12 and also coordinates aquatics
programs and facility use and rental of School and City -owned facilities. She thanked the Public
Works Department, particularly Mr. Jay Hartman, Mr. Chuck Autio and Mr. Tom Sullivan for
the outstanding service they provide to Community Services. She discussed the adult programs
and senior citizen programs offered by Community Services as well as the partnerships with the
Greater Metropolitan Housing Corporation, MWMO, and the Police and Fire Departments,
adding that the Police and Fire Departments have been incredibly helpful in providing training
on lockdown drills and fire drills. She stated that Mr. Voss has planned a creative activity on
recycling for the Halloween carnival on Friday, October 26"i, from 5:30-8:00 p.m. and Mr. Voss
will also be working with Wilshire Park Elementary on recycling. She indicated Community
Services was fortunate to receive a grant to offer a Dad's reading night in January attended by 63
fathers, grandfathers, and male adults and included dinner, reading of stories, and a tour of the
Police Department. She thanked the Police Department and Officers Erdman and Schlingman
for their participation in the event.
Councilmember Jenson stated he has been fortunate to be the Council Liaison to Community
Services and stated everyone involved has a positive attitude and is enthusiastic to be there. He
requested further information about the number of groups involved in Community Services.
Ms. Webster stated there are 28 different budgets within the Community Services budget and she
applauded the efforts of the Advisory Council. She added the annual report for Community
Services will reflect there are approximately 10,000 program participants coming in and out of
the School and City -owned facilities each year.
Mayor Faust complimented Ms. Webster and the Community Services staff for their
collaboration with the School District and City, adding that the City's contribution to Community
Services is absolutely the best value for the dollar and the City is happy to support the programs.
Motion by Councilmember Stille, seconded by Councilmember Jenson, to approve Resolution
12-082; Authorizing Continued Support of the St. Anthony -New Brighton School District #282
Community Services Recreational Programs for the years 2013 and 2014.
Motion carried unanimously.
B. Resolution 12-083; Authorizing the Application for Metropolitan Council Publically
Owned Infrastructure Inflow/Infiltration Grant Program. Todd I-Iubmer, WSB &
Associates, presenting.
City Engineer Hubmer explained the State legislature allocated $4 million to 47 metro
communities to reduce inflow and infiltration and the City has been a participant in the program
in the past. He stated the City will submit a grant application to request $114,000 through this
program, noting that the $4 million allocation would provide approximately $85,000 to eligible
cities and Met Council has told the City it would receive about $50,000. He stated there are

communities that will not use their total share and those funds get reallocated to cities that
exceed their allocation. He advised the City intends to use the funds for 2012 street
improvements as well as $39,000 for Emerald Park improvements in 2013 and $1,200 for
miscellaneous replacement of castings for a total of $114,000.
6 Councilmember Gray asked if the grant criteria is based on the projects themselves or whether it
7 is based on how the City has done in controlling inflow and infiltration.
9 City Engineer Hubmer stated the City still has some work to do in controlling inflow and
10 infiltration and the criteria indicates that the 47 communities have been on the list because they
11 are exceeding allowable flow. Ile noted that most of the communities are older communities
12 with clay sanitary sewers that allow water to enter the sanitary sewer system. He advised the
13 City has reduced its flow significantly but as its flows are reduced, the Met Council reduces the
14 City's allowable target. He added that the City exceeded its flow Last year during the intense
15 rainfall events and worked with Met Council to address the issue and avoid a surcharge.

18 12-083; Authorizing the Application for Metropolitan Council Municipal Publically Owned
19 Infrastructure Inflow/Infiltration Grant Program.

23 C. Resolution 12-084; Awarding the Bid for the 2012 Drainage Improvement Project. Todd
24 Hubmer, WSB & Associates, presenting.

26 City Engineer Hubmer explained that the first portion of the project is located in the Autumn
27 Woods assisted living facility to correct existing drainage issues. Ile stated they have met with
28 the Minneapolis residents and Councilmember Reich to review the project and a maintenance
29 agreement will be entered into between Minneapolis and St. Anthony. He advised the project
30 includes installation of a new storm sewer along the north side of Lowry Avenue and new curb
31 and gutter that will direct flow to the catch basins into the storm sewer line along Highway 88.
32 He stated they will use directional drilling to protect the existing trees and landscaping and there
33 will be no tree removal. He explained the second portion of the project represents the first phase
34 of the flood response to the 2011 storm event at Mirror Lake and includes installation of a
35 backflow preventer in the culvert under the railroad tracks. He stated the purpose of the project
36 is to keep water off the low point on Foss Road to prevent flooding and will also repair the
37 biofiltration swale and routing the larger storm sewer to reduce water to a manageable level. I -Ie
38 advised the engineer's cost estimate was $238,000 and five bids were received with the low bid
39 of $257,325.46 from New Look Contracting. He stated the City's share of $140,000 includes
40 $50,000 for the Lowry Avenue improvements and $89,000 for the Foss Road improvements and
41 the assessable portion of $116,500 will be assessed directly to Autumn Woods. He added that
42 construction will begin next week with final completion the end of November.

45 much rain it will handle.

City Engineer Hubmer explained the backflow preventer will handle a ten year rainfall event,
which is the equivalent of 4.2" of rain in 24 hours. He stated the Lowry Avenue improvements
are designed for a 100 year rainfall event and will significantly reduce discharge rates. He added
they are tearing up the parking lot on the south side of Lowry and installing pipes so that
drainage from the new assisted living complex will drain underground to be let out at a slow rate
into the Lowry drainage system being constructed. He added the Autumn Woods site is
operating in accordance with the City's rules and MWMO rules.
Councilmember Stille asked if the project currently is being done by New Brighton is in
response to the flooding.
City Engineer Hubmer stated the Freedom Park improvements are the first phase of a two phase
project to deal with flooding issues east of Freedom Park. He added this water does not
discharge into the City's ditch system and will not affect the City's projects or drainage. He also
provided an update on the County ditch work being done by Rice Creek and stated they are
working on language for a petition to the cities of New Brighton and St. Anthony to request Rice
Creek to look at ditch improvements and mechanisms for funding. He stated he spoke with the
DNR today and learned the DNR is looking for something from St. Anthony and New Brighton
on this issue to take to the legislature. He added New Brighton has also begun evaluating their
performance of the flood mitigation program and are in the process of preparing an analysis of
those improvements which will be presented to the legislature in 2013.
Motion by Councilmember Roth, seconded by Councihnember Gray, to approve Resolution 12-
084; Awarding a Bid for the 2012 Drainage Improvement Project.
Mayor Faust pointed out that the cost of the backflow preventer is not being assessed to any of
the property owners.
Motion carried unanimously.
D. Ordinance 2012-08; Ordinance Amending Criminal History Background for Applicants
for Cit} Employment and City Licenses (Final Reading) Mark Casey, City Manager,
presenting.
City Manager Casey advised this is the third and final reading of the Ordinance to amend the
regulations regarding criminal history background for applicants and noted that no changes have
been made since the last reading.
Motion by Councilmember Gray, seconded by Councilmember Stille, to approve Final Reading
of Ordinance 2012-08; Ordinance Amending Criminal History Background for Applicants for
City Employment and City Licenses.
Motion carried unanimously.

Mayor Faust advised this amendment will increase the monthly salary for the Mayor, Mayor Pro
Tem and Councilmembers by $50 per month. He noted that the monthly salaries have not been
raised since 2008 and the increases will not be effective until January 1, 2014.
Motion by Councilmember Roth, seconded by Councilmember Stille, to approve Second
Reading of Ordinance 2012-09; Ordinance Amending Section 31.12; Mayor and
Councilmembers Salaries.
Motion carried unanimously.
F. Ordinance 2012-10: Ordinance Amending Chanter 33 and Chapter 52 RegardingUtility
Billing Procedures (First Reading). Mark Casey, City Manager, presenting.
City Manager Casey explained that the current process for charging penalties on delinquent
utility bills is $2 for the first occurrence and 10% of the cumulative balance thereafter. He stated
the ordinance would be amended to a 5% cumulative penalty per occurrence; in addition,
delinquent accounts with balances greater than $50 and at least two quarters past due would be
certified to the County. He added staff feels this will reduce delinquency and lower
administrative costs.
Mayor Faust indicated this ordinance has never been reviewed and encouraged residents to use
automatic electronic payment to avoid any delinquency issues.

of Ordinance 2012-10; Ordinance Amending Chapter 33 and Chapter 52 Regarding Utility
Billing Procedures.

VII. REPORTS FROM CITY MANAGER AND COUNCIL MEMBERS.
City Manager Casey reported that the first utility billing for the City of Birchwood was
completed using the City's new financial software and everything went smoothly. He also
reported that three of the five new bus stops have been installed on Foss Road. Ile stated the
City currently has openings on the Parks Commission and Planning Commission; applications
are available on the City's website or at City Hall and are due November 16.
Councilmember Gray - No report.
Councilmember Jenson reported on his attendance at the October 1 lth sustainability workshop.
Councilmember Roth reported on his attendance at the October I It" sustainability workshop and
reminded residents that the second workshop will be held on Thursday, November 1st, at 6:00
p.m. at Silverwood Park and all residents are welcome to attend.

1 Councilmember Stille reported on his attendance at the October 11 °i sustainability workshop and
2 stated the workshop focused on rain gardens, walkability, bikeability, energy and water
3 conservation and what it means to be sustainable from an environmental perspective. He added
4 the November 1st workshop will memorialize a plan for going forward.
6 Mayor Faust reported on his attendance at the following:
7 • October 11°i sustainability workshop attended by all Councilmembers.
8 • October 12°i dedication for the grand reopening of St. Anthony Shopping Center
9 • October 13'1' Fire Department Open House where over 300 people attended

11 • October 19°i League of Minnesota Cities Planning Committee meeting for the 2013
12 conference in St. Paul.

17 are not on the regular agenda. Hearing none, Mayor Faust moved forward with the agenda.

21 Mayor Faust reminded residents of the November I" sustainability workshop at 6:00 p.m. at
22 Silverwood Park. He invited residents to the MWMO open house on Saturday, October 27"i,
23 from 10:00 a.m. to 2:00 p.m. at MWMO's new building on the corner of Lowry and Marshall.
24 He stated the open house will include a dedication of the new Lowry Avenue Bridge around
25 11:00 a.m. He also reminded residents to vote on Tuesday, November 6"i.

Regarding: Proposed Zoning Code Amendments Relating to the Regulation of
Assemblies, Meeting Lodges and Convention Halls
BACKGROUND
On March 13, 2012, the St. Anthony Village City Council passed a moratorium on the issuance of
Conditional Use Permits for Assemblies, Meeting Lodges or Convention I falls in order to give staff time
to prepare a study regarding the intent and regulation of these uses within the Light Industrial and
Commercial Districts. The need for the study arose from two recent applications for religious assembly
in the Light Industrial Zoning District. "these applications were a concern to the City Council frons a
land -use perspective. The City Council has stated its belief thatthe intent of the assembly use in the
Commercial and Light Industrial Zoning Districts is for secular purposes, not religious.
In May 2012, staff prepared "A Study for tlne Purpose of Considering Amendments to the City Zoning
Code Regarding the Regulation of Assemblies, Meeting Lodges, and Convention Idalls". The goals of the
Study were to:
• Determine the City's intended meaning of "assembly" within the Zoning Code;
• Determine whether the City intended religious assemblies to exist as conditional uses within
commercial and light industrial zoning districts;
• Ensure that any annendmcnts 1'o the City Zoning code do not conflict with the City's intent in
planning for property use within its commercial and light industrial zoning districts;
• Ensure that, if amended, the Zoning Code is improved in regards to consistency and clarity with
respect to the use of "assemblies";
• Ensure that the Zoning Code is consistent with federal law; and
• Respect the current as of the time of the study] applicant's interest's in receiving a reasonable and
timely decision regarding the pending application.
At its Special Session on .lune 4, 2012, the St. Anthony Village Planning Commission recommended to
adopt "A Study for the Purpose of Considering Amendments to the City Zoning Code Regarding the
Regulation of Assemblies, Meeting Lodges, and Convention 1falls". Specifically, the Planting
Commission recommended to the City Council to adopt what was identified in the study as "Option 3".
"Option 3" allows all assembly use (both religious and non -religious) within the Conunercial Zoning
District and eliminates all assembly use (both religious and non -religious) frons the Light Industrial
Zoning District. The intent of "Option 3" is to provide an alternative to those seeking places for assembly
within the City and to treat assemblies equally within all zoning districts. "Option 3" will also preserve
the light industrial zoning district as an area of the City developed specifically to industry-01-iented
development and economic growth.

The City Council unanimously adopted the study and endorsed "Option 3" at its .lune 12, 2012 meeting.
Ordinance language was then drafted by staff, and was brought back for a discussion before the Planning
Commission at their regular meeting on July 17, 2012. A final draft ordinance was created and sent to the
City's attorney for review and comment.
Since that time, staff has worked with the City's attorney to develop the proposed changes, which were
reviewed by the Planning Commission for a final time at a Special Work Session Meeting on October 22,
2012.
This meeting will be used to review and consider the proposed changes as outlined below, for adoption
into the zoning Code.
PROPOSED CHANGES
There are several areas within the City Code where changes are needed to implement "Option 3". This
section of the report highlights recommended changes within the different sections of the City Code,
I. Title XV, Chapter 152, Section 152.008 (Definitions)
The following terms currently do not have a definition in the Zoning Code and should be defined:
religious institution, assembly, and club or lodge. The definitions below use the recommended
language fa- inclusion in the Zoning Code.

with its accessory buildnags (supporting homes, convents or rectories) and uses commonly
associated with religious institutions, where persons assemble for religious worship and which
building or portion thereof, together with its accessory buildings aril common religious uses, is
maintained and controlled by a religious body organized to Sustain religious ceremonies and

5. Title XV, Chapter 152, Section 152.142 (Permitted Conditional Uses LI Light Industrial
District)
This section of the City Code needs to be modified to reflect the direction provided by the
Planning Commission and the City Council to remove assembly, meeting lodge, or convention
halls as a permitted conditional use. The current text reads as follows:

(G) Assembly, nneeting lodge, or convention halls;
(11) Catering operations and in-house cafeterias not intended for retail or public use;
(1) Day-care center without drive-through facilities.
Staff recommends eliminating references to assembly, meeting lodge or convention hall (noted in
st++heflwo gh tex!) and re -lettering the remaining permitted conditional uses (noted in italics).
Staff recommends the following text to replace what is currently in the City Code:

DISCUSSION
The revised definitions and changes to the City Code are intended to show that there is a clear intent for
various land uses allowed in residential, commercial and industrial districts. By removing all assemblies
from the Light Industrial District and allowing all assemblies (secular and religious) in the Commercial
District, the City Code should also be in compliance with the Religious Land Use and hnstitutionalized
Persons Act (RLUIPA).
Staff has consulted with the City Attorney on the proposed changes, and Inas concluded that they are
consistent with the direction provided by the Planning Commission, City Council, and with federal law.
ACTION
1. Approve the Recommended Changes to the City Code. In the event of a recommendation for
approval, the City Council may refer to Exhibit A and may modify the recommended ordinance
as it deems necessary.
2. Request Additional Information. In the event the City Council finds that there are unresolved
issues regarding the proposed changcs by staff, the City Council should continue the meeting
until a later time.

MANAGER'S REVIEW:
At the March 13, 2012, City Council meeting, the Council
adopted Ordinance 2012-03; Issuing a Moratorium on the
issuance of conditional use permits for assemblies, meeting
lodges, or convention halls within commercial and light
industrial zoning districts.
This moratorium was for the purpose of protecting the
planning process while the City conducted a study for the
purpose of considering amendments to the Zoning Code
with respect to the regulation of assemblies, meeting
lodges, and convention halls. The study was presented to
and adopted by the City Council at the June 12, 2012, City
Council meeting.
Tonight, for your approval is Ordinance 2012-12 to

The City Council of the City of Saint Anthony Village hereby ordains
Section 1. Moratorium Terminated. For the purpose of protecting the planning process
while the City conducted a study for the purpose of considering amendments to the City's
Zoning Code with respect to the regulation of assemblies, meeting lodges, and convention halls,
the City Council adopted Ordinance No. 2012-03, which imposed a moratorium on the issuance
by the City of Conditional Use Permits under sections 152.122(C) and 152.142(G) of the City
Code pursuant to the authority contained in Minnesota Statutes section 462.355, subd. 4. The
study has now been completed, and the City Council has approved relevant amendments to the
City's Zoning Code. The moratorium imposed by Ordinance No. 2012-03 is hereby terminated
by the City Council.
Section 3. Effective Date. This ordinance shall be effective as of the date of its publication.
PASSED AND DULY ADOPTED TI -IIS 13th day of November, 2012, by the City Council of

Proposed Issue:
$1,500,000 General Obligation Water and Sewer Refunding Bonds,
Series 2013A
Authority:
The Bonds are being issued pursuant to Chapter 444 and 475, which
allows cities to issue debt without limitation as long as debt service is
expected to be paid from water and sewer revenues.
The Bonds will be general obligations of the City, for which its full
faith, credit and taxing powers are pledged.
Purposes/Funding Sources:
The proposed issue includes a current refunding of the City's existing
General Obligation Water and Sewer Revenue Bonds, Series 2003B.
Debt service will continue to be paid from water and sewer revenues.
Interest rates on the Bonds proposed to be refunded are 3.75% to
4.45%. The refunding rates are expected to be 0.45% to 1.80% and
reduce interest expense by approximately $226,500 over the next
eleven years (averaging $20,595 per year). The Net Present Value
Benefit of the refunding is estimated to be approximately $209,799,
equal to over 14% of the value of the refunded principal,
This refunding is considered to be a Current Refunding as the Bonds
being refunded are either callable (pre -payable) now, or will be
within 90 days of the date of issue of the new Bonds.
Term/Call Feature
The term of the Bonds is the same term as the original Bonds (not
being extended). The Bonds are being issued for an eleven year term..
Principal on the Bonds will be due on February 1 in the years 2014
through 2024. Interest is payable every six months beginning August
1, 2013.
The Bonds maturing February 1, 2020, and thereafter will be subject
to prepayment at the discretion of the City on February 1, 2019 or any
date thereafter.
Bank Qualification
The refunded Bonds were originally designated "bank qualified"
obligations when issued in 2003. As such, the new Bonds will not
count towards the $10,000,000 per calendar year in new bonds that
the City can designate. Bank qualified status broadens the market for
the Bonds, which can result in lower interest rates.
Rating:
The City's most recent bond issues were rated AA by Standard &
Door's. The City will request a new rating for the Bonds.
If the winning bidder on the Bonds elects to purchase bond insurance,
the rating for the issue may be higher than the City's bond rating in
the event that the bond rating of the insurer is higher than that of the

area and regional underwriters.
We have included an allowance for discount bidding equal to 1.0% of
the principal amount of the issue. The discount is treated as an
interest item and provides the underwriter with all or a portion of its
compensation in the transaction.
If the Bonds are purchased at a price greater than the minimum bid
amount (maximum discount), the unused allowance will be used to
lower your borrowing amount.
Review of Existing Debt:
We have reviewed all outstanding indebtedness for the City and find
that the 2008A Bonds callable on February 1, 2015 provide the City
with an opportunity for savings. We will discuss the opportunity in
2013 if the City wants to refinance.
Continuing Disclosure:
Because the City has more than $10,000,000 in outstanding debt
(including this issue) and this issue is over $1;000,000, the City will
be agreeing to provide certain updated Annual Financial Information
and its Audited Financial Statement annually as well as providing
notices of the occurrence of certain "material events" to the
Municipal Securities Rulemaking Board (the "MSRB"), as required
by rules of the Securities and Exchange Commission (SEC). The
City is already obligated to provide such reports for its existing
bonds, and has contracted with Ehlers to prepare and file the reports.
Arbitrage Monitoring:
Because the Bonds are tax-exempt securities/tax credit securities, the
Issuer must ensure compliance with certain Internal Revenue Service
(IRS) rules throughout the life of the issue. These rules apply to all
gross proceeds of the issue, including initial bond proceeds and
investment earnings in construction, escrow, debt service, and any
reserve funds. How issuers spend bond proceeds and how they track
interest earnings on funds (arbitrage/yield restriction compliance) are
common subjects of IRS inquiries. Your specific responsibilities will
be detailed in the Signature, No -Litigation, Arbitrage Certificate and
Purchase Price Receipt prepared by your Bond Attorney and provided
at closing. You have retained Ehlers to assist you with compliance
with these rules.

Resolution Providing for the Sale of
$1,500,000 General Obligation Water and Sewer Refunding Bonds, Series 2013A
A. WHEREAS, the City Council of the City of St. Anthony, Minnesota, has heretofore determined that it
is necessary and expedient to issue the City's $1,500,000 General Obligation Water and Sewer
Refunding Bonds (the "Bonds"), to finance the current refunding of the City's existing General
Obligation Water and Sewer Revenue Bonds, Series 20038; and
13. WHEREAS, the City has retained Ehlers & Associates, Inc., in Roseville, Minnesota ("Ehlers"), as its
independent financial advisor for the Bonds and is therefore authorized to solicit proposals in
accordance with Minnesota Statutes, Section 475.60, Subdivision 2(9);
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of St. Anthony, Minnesota, as
follows:
1. Authorization; Findings. The City Council hereby authorizes Ehlers to solicit proposals for the sale
of the Bonds.
2. Meefing; proposal O enin . The City Council shall meet at 7:00 p.m. on December 11, 2012, for the
purpose of considering sealed proposals for and awarding the sale of the Bonds.
3. Official Statement. In connection with said sale, the officers or employees of the City are hereby
authorized to cooperate with Ehlers and participate in the preparation of an official statement for the
Bonds and to execute and deliver it on behalf of the City upon its completion.
The motion for the adoption of the foregoing resolution was duly seconded by Council Member
and, after full discussion thereof and upon a vote being taken thereon, the
following Council Members voted in favor thereof:

AMENDING CHAPTER 33 AND CHAPTER 52 REGARDING
UTILITY BILLING PROCEDURES
The City Council of the City of Saint Anthony ordains as follows:
§ 33.002 COLLECTION.
Payment of city billings must be made not later than the date specified in the billing. If the
amount is not paid when due, a late charge may be added. If a charge is more than 15 days past
due, it will be considered delinquent. All delinquent accounts will be certified to the Clerk, who
will prepare an assessment roll each year providing for assessment of the delinquent amounts,
plus interest at the rate of 8% per annum from the date amounts become delinquent, against the
respective properties served. The assessment roll will be delivered to the City Council for
adoption on or before the second Tuesday of October of each year. Assessment will not preclude
any other legal action to collect delinquent accounts.
§ 33.039 TESTING METER.

§ 33.043 UNTIMELY PAYMENT; LATE PAYMENT PENALTY.
The fee for this Ordinance is set by Resolution.
§ 33.044 CERTIFICATION OF DELIQUENT ACCOUNT BALANCES.
Delinquent account balances greater than $50.00 and at least two quarters past due will
be certified to taxes by November 30°i of each year. Accounts significantly exceeding either of
these criteria's are considered at -risk and are subject to early certification or water shut-off at the
City's discretions.
§ 33.061 ESTABLISHMENT OF FEE AMOUNTS.
The dollar amounts of fees required by this code are as stated in the following table:

The City Council oJ the City of Saint Anthony ordains as follows:
§ 52.05 WATER READING AND BILLING.
(A) Meter reading. All water meters will be read quarterly on or before the third day
of the months of January, April, July, and October.
(B) Billing and payment. Quarterly water statements will be sent out on or around the
twentieth day of the months of January, April, July, and October and are payable on or before the
twenty-fifth day of the following month. If payment is made by U.S. mail, a bill will be
considered paid as of the date of postmark. If the payment date deadline falls on a Saturday,
Sunday, or legal holiday, payment may be made on or prior to the first day thereafter on which
city offices are open. If payment is not timely made, a late fee in the amount set forth in Chapter
33 is due. If payment on a quarterly statement is not made on or prior to the fifth day of March,
June, September, or December respectively, the city retains the right to send a final notice of
payment overdue to the customer by certified mail, notifying the customer that: payment must
be received at the City Hall within 5 days; failure to make the payment in full within the 5 -day
period will result in the discontinuance of water service; and the customer has the right to a
hearing before the Public Works Director before water service is discontinued, provided the
customer has made a request for a hearing within the 5 -day period. If a request for a hearing is
timely, made by the customer, a hearing will be held in accordance with the provisions of §
52.06. If a payment is not received and a hearing request is not timely made, the city may
discontinue service to the customer. A charge will be made to the customer in the case of
discontinuance of service for nonpayment of a water bill, and a charge will also be made to the
customer for turning on the water service after it has been shut off for nonpayment, each in the
amounts set forth in Chapter 33. Payments of any bill must be made at the City Hall, and
employees of the Water Department are not authorized to accept payment of any bill.
Effective Date. These ordinances shall become effective as of January 31, 2013,
