Mayor haust called the meeting to order at 7:00 p.m.

13 V. REPORTS FROM COMMISSION AND STAFF.

15 A. Resolution 12-071: Approvin�_Y a Variance to the Rear Yard Setback for Property Located
16 at 3207 Silver Lake Road Brian Heinis. Planning Commission Chair, presenting.

18 Chair Heinis stated the applicants are requesting a variance to the rear yard setback for the
19 construction of a 27' x 24' garage on their property located on the corner of Silver l.akc Road
20 and 1 lilidale Avenue. l le indicated City Code requires a rear yard setback of the greater of 25'
21 or 20% of the lot depth and the rear yard setback for this property is 31'. Ile presented a diagram
22 of the property's layout noting that the driveway is located off llilldale. Ile explained that
23 placing a garage within the rear setback would limit sunlight, prohibit future deck or patio
24 expansion, and cause potential drainage issues. Ile advised the property owners are proposing to
25 use the property in a reasonable manner consistent within the R-1 district, the circumstances are
26 unique to the property not caused by the owner, and the home was constructed in a manner that
27 makes it difficult to meet the rear yard setback. He noted the variance if granted will not alter
28 the essential character of the locality and economic considerations alone are not the basis for the
29 practical difficulties. He added the variance is consistent with the Comprehensive Plan, would
30 protect the land use district, and would allow for orderly redevelopment of the site; in addition,
31 the variance will not reduce the amount of light, air, and access to the property and granting the
32 variance will not increase congestion or result in overcrowding of the land. He added the
33 variance if granted will not alter the site's compatibility with land uses in the area.

35 Councilmember.lenson requested further information regarding the location of the variance on
36 the property. Ile also asked if the proposed garage could be repositioned in such a way that a
37 variance would not be required.

39 Chair Heinis presented a diagram showing the location of the proposed garage in relation to the
40 required rear yard setback of") I '. Ile stated if the proposed garage was placed on the lot in a
41 manner that was compliant with City Code the garage would be located a Pew feet from the
42 house and would block sunlight into the house.

44 Mayor Faust noted that the location of the proposed garage appears to represent the best position
45 for the least amount of variance.

Councihnember Roth asked if the proposed garage would comply with City Code if the
applicant's address was Ililldale Avenue instead of Silver Lake Road.
Chair Ileinis replied that the proposed garage would be in compliance with the City's side yard
setback requirements if the applicant's address was Hilldale Avenue.
Mr. David Socha and Ms. Meredith Socha, 3207 Silver Lake Road, appeared before the City
Council and stated placement of the proposed garage is intended to maintain as much yard space
as possible.
Motion by Councilmember Gray, seconded by Councilmember Jenson, to approve Resolution
12-071; Approving a Variance to the Rear Yard Setback for Property Located at 3207 Silver
Lake Road.
Motion carried unanimously.
Mayor Faust thanked Mr. Socha for his military service to the country.
Chair I Icinis explained that St. Anthony Health Center wishes to construct a light well within the
required 30' setback from 37°i Avenue noting that the light well would extend into the setback
by Y. Ile advised the existing location of the physical therapy unit in the basement limits the
amount of natural light coming into the building, placing a light well at other locations would
conflict with utility and other services, and relocating the physical therapy unit is not practical.
He stated the owner is proposing to use the property in a reasonable manner and the light well is
intended to provide natural light for the physical therapy unit. IIe indicated the circumstances
are unique to the property, not caused by the owner, and the variance, if granted, would not alter
the essential character of the locality; in addition, economic considerations alone are not the
basis of the practical difficulties and the proposed location of the light well is the most logical
and best suited to allow natural light to enter the basement. I Ie added the variance is consistent
with the Comprehensive Plan, would protect the land use district, would allow for the orderly
redevelopment on the site, will not reduce light, air, and access to the property, granting the
variance will not increase congestion, will not result in overcrowding, and will not alter the site's
compatibility with surrounding land uses.
Councihnember Jenson requested information regarding the type of glass used in the light well
as well as the location of the light well in relation to the existing windows on the building.
Mr. Alan Plutowski, TWP Architects, appeared before the City Council on behalf of the
applicant and explained the light well will be laminated safety glass similar to glass used in a sky
light. Ile stated the light well will be placed at the bottom of the windowsills and slope to 2' off
the ground. Ile added the goal of the project is to improve the facility and the quality of care
provided to residents by bringing natural light into the physical therapy unit.

Motion by Councilmember Stille, seconded by Councilmember Gray, to approve Resolution 12-
072; Approving a Three -Foot Variance to the Required 30 -Foot Setback from 37`x' Avenue Nb
for the Property at the Comer of foss Road and 37°i Avenue NE.
Motion carried unanimously.
8 VI. GENERAL BUSINESS OF COUNCIL.

10 A. Autumn Woods II. Justin Messner, WSB & Associates, uresentin�
12 1. Update.

14 Project Manager Messner provided an update regarding the Autumn Woods II project now
15 known as The Leg ccj� of Sl. Aw howy. Ile stated that a revised first floor plan has been submitted
16 which includes removal of one parlor and replacing it with one additional care unit, expansion of
17 the dining hall to allow more capacity as well as expansion of the kitchen area to accommodate
18 the expanded dining hall, reduction of the overall site elevation by 2' to better fit the existing
19 grades on the site and lessen the impact to surrounding properties, and revisions to the drainage
20 system located under the parking lot south oi'the building. He explained that storm water will be
21 discharged after treatment into the storm water facility along Lowry Avenue. I le added that
22 construction is anticipated to begin next month upon approval oi'the building permit.

24 Councilmember Stille asked how many beds are being added with the removal of the parlor. Ile
25 also requested further information regarding the sign on the property advertising a restaurant.

27 Councilmember Roth requested further information regarding collection of storm water.
28
29 Project Manager Messner stated that storm water will be collected and treated under the site's
30 parking lot and treated water will be discharged into the City's storm sewer facility.

32 Mr. Greg Brook, LaNel, appeared before the City Council and stated that they refer to their
33 dining facilities as restaurants and they are proud to serve meals prepared by first class chefs. Ile
34 indicated the restaurant is for use by residents, guests of' residents, and future residents and they
35 do not advertise the restaurant for outside guests. Ile clarified that they moved the beauty parlor
36 on first floor and converted that space to a bed in the care suite area for a total of 73 units
37 compared to the previous 72 units. Ile added they hope to begin construction in late August with
38 opening scheduled for September 1, 2013.

3. Resolution 12-070; Awarding a Bid for the LLD Safet, lraurovernents at )O
Avenue and Silver Lake Road.
Project Manager Messner provided historical background regarding the City Council's request to
improve safety in the City by installing visible warning systems at certain locations, including
LLD enhanced warning signs and crosswalks. He advised that City staff met with the County to
discuss installation of mid -block LED safety improvements on Silver Lake Road and 34"'
Avenue (Hennepin County 136) and the County authorized the City to proceed with the design,
however, because this project was one of the first of its kind, the County required an engineering
study to determine the effectiveness of the proposed improvements and data was collected to set
warrants for future locations in the County. IIe indicated the City approached the University of
Minnesota to assist with the study and received a grant to complete the study; the University
students presented the results of the study to the City Council in May 2012 and the City has now
received a permit for construction from the County. He stated bids were received to install the
in -pavement crosswalk warning system and Killmer Electric Co., Inc., is the lowest responsible
bidder. Ile added that construction will begin in late August.

12-070; Awarding a Bid for 2012 LFD Pedestrian Safety Improvements at 34'x' Avenue and
Silver Lake Road Project.
Motion carried unanimously.
B. Quarterly Goals Update. Mark Casey, City Manager, presenting .
City Manager Casey presented the quarterly goals update and stated the City continues to explore
a joint fiber partnership and he has met with Ramsey County officials to discuss the County's
fiber ring. Ile advised that the City Engineer presented his findings of the study in response to
the flooding event and staff continues to work with Rice Creek Watershed District, the DNR, the
City of New Brighton, and Ramsey County; in addition, the back flow preventer has been
ordered for Mirror Lake. I le stated that discussions with the Chamber of Commerce were held
regarding business outreach and a database of approximately 300 businesses has been identified.
He advised that social media expansion for the liquor stores will be implemented soon. Ile
stated the City is in the process of purchasing new financial software that will be more effective
and secure. Ile stated that the City will begin performing utility billing for the City of
Birchwood and will provide accounting services to MWMO. Ile added the City was fortunate to
be awarded a host site for the GreenCorps program funded through the MPCA, which will
provide a staff'person at no cost to the City for eleven months. Ile stated the City continues to
work with other agencies to continue its sustainability efforts.

with the School Board and City Council work session.

15 Mayor Faust reminded the City Council of the upcoming "View from the Big River" on July 'W'
16 from 4:30-8:30 p.m.

18 VIII. COMMUNITY FORUM.

20 Mayor Faust invited residents to come forward at this time and address the Council on items that
21 are not on the regular agenda.

23 Mr. Ken Brown, 3422 Silver Lane, appeared before the City Council and stated he previously
24 sent an email to the City Council requesting that the Fire Code be changed related to outdoor
25 grilling because the current Code prohibits residents of Evergreen Townhomes from grilling on
26 their decks and patios. Ile recited provisions from the old Fire Code and an Appendix I I and
27 stated the City adopted Appendix H in 2008, particularly Section 1.1 and 1 2, but did not adopt
28 the exception. Ile stated lie met with the acting fire Marshal to discuss the definition of structure
29 and indicated in order for Evergreen residents to grill, they have to move their grills 15' away
30 from any structure, which means moving it off their deck and into an area 15' away. Ile stated
31 Section 1.2 addresses storage offuel and requires that IT tanks be removed from the grill after
32 each use and stored in the garage, which seems unreasonable and unsafe. Ile indicated it appears
33 to be okay to grill close to any other part of your structure such as in front of your garage. IIe
34 questioned why the Code does not apply to homeowners and require them to move their grills
35 15' away from their deck and he feels the Code is unreasonable for townhonic residents. IIe
36 added the Code also talks about open flames and a candle is an open flame so residents cannot
37 use citronella candles on their decks. He requested that the City Council take the initiative to
38 develop a consistent set of rules that would enable townhomc residents to grill.

40 Mr. Jerry John, 3456 Silver Lane, appeared before the City Council and discussed a situation
41 where someone was grilling on their deck and melted the siding material. Ile indicated lie
42 suggested that Mr. Brown investigate this situation further and assumed that a Fire Code
43 violation would result in a letter being sent to the resident but Mr. Brown launched an
44 investigation to learn if he could get around this situation and/or the Code by sending a letter to
45 residents suggesting that they move their grills from their decks and stating the Fire Department
46 does not enforce the rule in any event, which is not true. Ile stated if there are rules or

regulations that the townhome board does not like, then the board seeks to change those rules
without resident input and in this case, resulting in safety concerns. He urged the City Council
not to change the Fire Code.
Mayor Faust stated the City Manager and staff will review the City Code and will present their
findings to the City Council.
Mr. Brown stated the townhome association recently published a newsletter article regarding the
local code to provide education to residents regarding code requirements. Ile added he does not
view the association role to be one of writing laws on top of the local code and they are just
trying to educate residents about the local code.
IX. INFORMATION AND ANNOUNCT,MENTS.
Mayor Faust reminded residents of Villagel'est August 3-5. He stated further information is
available on the City's website. Ile added that golfers are still needed and gifts are also needed
for the silent auction.

This project has been entitled the 2013 Street and Utility Improvement Project. The project
proposes the street reconstruction of the following:
36°i Avenue NE from Roosevelt Street to Silver Lake Road
Edward Street from 35°i Avenue NE to 36°' Avenue NE
This Feasibility Report outlines the proposed reconstruction of approximately 2,650 feet of
30 -foot urban section street complete with bituminous paving and concrete curb and gutter.
Also proposed is the replacement of approximately 1,950 feet of watermain and
approximately 1,300 feet of sanitary sewer main. The installation of new storm mains and
new storm sewer catch basins is also proposed.
A total estimated project cost for the street and utility reconstruction is approximately $2.1
million. Funding for the project will come from the City's Street and Utility Reconstruction
Funds (Public Improvement Bonds), Water Utility Fund, Stormwater Utility Fund, Sanitary
Sewer Utility Fund, and Special Assessments to benefiting properties.
The project reconstruction can be completed, including the first lift of bituminous and all
restoration items, in 2013. The final lift of bituminous is proposed to be installed in June of
2014.
This project is feasible, necessary, and cost effective from an engineering standpoint and
should be constructed as proposed herein.

2. INTRODUCTION
2.1 Authorization
On June 12, 2012, the St. Anthony Village City Council authorized the preparation of an
engineering Feasibility Report for the 2013 Street and Utility Improvement Project. This
project was authorized under City of St. Anthony Village Resolution 12-055.
2.2 Scope
This project provides for the street and utility reconstruction of 36°i Avenue NE from
Roosevelt Street to Silver Lake Road, and Edward Street from 35°i Avenue NE to 36i1'
Avenue NE.
In summary, street, sanitary sewer, watermain, and storm sewer improvements are all
proposed as part of this project.
2.3 Data Available
Information and materials used in the preparation of this report include the following:
• City of St. Anthony Village Record Drawings
• City of St. Anthony Village Topographic Maps
• Subsurface Exploration
• Field observations of area
2.4 Project Location
The project is located in the northwest quadrant of the City of St. Anthony Village. The
project includes the following streets:
• 36°i Avenue NE
• Edward Street
The project area is identified on Figure I in Appendix A of this report.

2.5 Project History
This project was initiated through the recognition of the following conditions in the project
area:
• Deterioration of street conditions
Re -occurring watermain breaks in the project limits
Streets, sanitary sewer, watermain lines are over 50 years old and are exhibiting
deterioration problems
As a result, the City Council provided funding in the 2013 budget for street and utility
improvements. On June 12, 2012, the St. Anthony Village City Council authorized the
preparation of an engineering feasibility report for the 2013 Street and Utility Improvement
Project,

3. EXISTING CONDITIONS
3.1 Sanitary Sewer
The majority of the sanitary sewer system in the project area consists of 9 -inch diameter
vitrified clay pipe (VCP) installed in the early 1960s. The joint sealing material in use at
that time was typically an oakum and bituminous material. Internal inspections with a
specially designed television camera have found the structural condition of pipe to vary
between fair and poor, with numerous offsetjoints, cracked segments, dips with solids
deposition, and some root intrusion and mineral deposits at joints.
3.2 Water main
The existing water distribution mains in the project area were also installed in the early
1960s and consist of 6 -inch cast iron pipe (CIP) at the intersections of Edward Street and
Harding Street and a 10 -inch CIP water main along Edward Street from 366i Avenue NE to
35°i Avenue NE. This system has had numerous breaks over the past few years and breaks
will become more likely as the pipes are approaching 50 years of service. In addition, the
cast iron pipes are probably heavily corroded and possibly leaking.
3.3 Storm Sewer
The existing storm sewer system in the project area consists of 18 -inch reinforced concrete
pipe (RCP) sewer along 36°i Avenue NE from Belden Drive to Coolidge Street with catch
basins installed at the low points where each street intersects with 36°i Avenue NE. The
existing storm sewer on Edward Street collects stormwater from Edward Street and 35°i
Avenue NE and conveys stormwater south to 35°i Avenue NE and to the Harding Street
holding pond. Water collected in the Harding Street holding pond ultimately discharges to
the Mississippi river. The existing storm sewer on 36`I' Avenue NE collects stormwater
from Belden Drive, Coolid e Street, Harding Street, and 36°i Avenue NE, and conveys
stormwater north across 3 tt i Avenue NE along the west side of Walgreens then east along
the railroad to the existing storm sewer on Silver Take Road, and ultimately to Silver Lake.
3.4 Streets
The proposed reconstruction area consists of 30 -foot wide concrete streets with curb and
gutter. Soil borings taken for the project indicate underlying soils in the area consist of silty
clay fill or sandy clay fill. Additional soil borings have been ordered and will be included in
the Appendix C if available at the time this report is completed.

4. PROPOSEDIMPROVEMENTS
4.1 Sanitary Sewer
The existing 9 -inch VCP will be reconstructed with 8 -inch PVC, including the replacement
of sanitary sewer services within the project area.
The proposed sanitary sewer improvements are to replace the sanitary sewer system along
Edward Street and along 366i Avenue NE from Roosevelt Street to Edward Street. The
segment along Harding Street crossing 36°i Avenue NE will be replaced with 8 -inch PVC.
The proposed sanitary sewer improvements are shown on Figure 3 in Appendix A.
4.2 Water main
As stated in the previous section, this system has had numerous breaks over the past few
years. The proposed watermain improvements consist of entirely replacing the existing 10 -
inch cast iron water main on Edward Street and on 36`I' Avenue NE from Roosevelt Street to
Edward Street will also be replaced with new 10 -inch ductile iron pipe (DIP). The 6 -inch
cast iron main on Edward Street and Harding Street at the intersection of 36`I' Avenue NE
will be replaced with 8 -inch DIP
Water main does not currently exist on 36°i Avenue NE between Edward Street and Silver
Lake Road and a number of homes on 36°i Avenue NE are serviced by water service lines
extending down 36°i Avenue NE from the water mains located on Edward Street, Harding
Street, and Coolidge Street. A new 8 -inch DIP will be added along 36°i Avenue NE from
Edward Street to Silver Lake Road tying into the 8 -inch water main at Harding Sheet,
Coolidge Street, and Belden Drive. This will `loop" the water system, which increases
water circulation preventing water from becoming stagnant. Looping the water system also
creates redundancies in the water system, which allows the city to isolate a small area if a
temporary shutdown is necessary. The existing water system is shown on Figure 5 in
Appendix A.
This will not only reduce the potential for water main breaks, but also improve the delivery
of potable water and fire flow volume at reasonable pressure and head loss.
Replacement of the service lines may increase the pressure by providing a clean service
pipe.
The proposed water system improvements are shown on Figure 5 in Appendix A.
4.3 Storm Sewer
The proposed storm sewer improvements include replacing the existing storm sewer on 36°i
Avenue NE, constructing additional catch basins on 3611 Avenue NE; at Edward Street,
Coolidge Street, and Belden Drive. The existing storm sewer on Edward Street will also be

replaced to 35°i Avenue NE and additional catch basins will be added at the low point on
Edward Street.
The proposed storm sewer improvements also include water quality and filtration/infiltration
improvements as necessary to satisfy the requirements of the Rice Creek Watershed. These
improvements will likely take place within the storm sewer easement on the north side of
37" Avenue NE. Constructing a water quality system in this area will serve as a treatment
system for the entire area bounded by Roosevelt Street, 37°i Avenue NE, Silver Lake Road,
and a east/west line extending mid -block between 35°' Avenue NE and 36°' Avenue NF,.
The proposed storm sewer improvements are shown on Figure 6 in Appendix A.
4.4 Street
Reconstruction of the existing street is intended to improve the design strength of the
pavement system and provide a street surface with an extended life for the City of St.
Anthony Village. 36°i Avenue NE and Edward Street NE are proposed to be replaced at the
current width of 30 feet from back -of -curb to back -of --curb, which allows for two 12 -foot
driving lanes and 2 -foot reaction areas on each side of the street.
After the subgrade excavation is completed in the streets, a geotextile fabric will be placed
to separate the existing underlying soft materials from the granular materials. One foot of
select granular material or "sand cushion" will be placed on the geotextile fabric to provide a
firm base for the 6 inches of Class 5 aggregate base and 4 inches of bituminous asphalt
pavement.
It should be noted that this report proposes to replace the existing concrete pavement with
bituminous asphalt pavement per resolution 07-022 and the Council's decision after
reviewing the Street Reconstruction Task Force report presented at the November 13, 2007
City Council Meeting.
The proposed typical section is shown on Figure 7 in Appendix A.
4.5 Permits and Approvals
Reconstruction of the roadways will disturb over one acre and will require a National
Pollution Discharge Elimination Systems (NPDES) General Storm Water Permit (MNR
10000 1) that must be obtained by the City of St. Anthony Village from the Minnesota
Pollution Control Agency (MPCA).
The reconstruction of the existing watermain will require a permit from the Minnesota
Department of Health.
The reconstruction will also require a permit from the RCWD. This may require stormwater
treatment for the runoff from the project area.

4.6 Detour Routes
The project will require significant excavation and disposal of unacceptable material from
the existing street area and a supply of significant volumes of select granular base, aggregate
base, and bituminous pavement materials. This effort will require closing the roads under
construction and increasing loaded truck traffic on the streets adjacent to the construction
area. Adequately signed detours will be identified to direct traffic around the construction
zones and notify users of the increased truck and construction activity. In order to
accommodate the property owners along the excavated roads, temporary parking on the
adjacent streets may be necessary during the periods when vehicle access is not possible.

5.1 Opinion of Probable Construction Cost
A detailed breakdown of the Cost Opinion for the proposed project is included in Appendix
B. The opinion of cost incorporates the construction costs experienced during 2011 and
2012, and includes a 15% contingency factor. Administrative costs are projected at 25% of
the construction cost and include engineering, legal, financing, and other administrative

5.2 Funding Sources
The total project cost is projected to be approximately $2.1 million. Funding for the project
will come from the City's Street and Utility Reconstruction Funds (Public Improvement
Bonds), Water Utility Fund, Stormwater Utility Fund, Sanitary Sewer Utility Fund, and
Special Assessments to benefiting properties.
The City's policy for street assessment is based on front footage along improved roads. The
property owner is assessed 35% of total street and local drainage construction costs. Each
property owner that receives a new water service will be assessed 100% of the actual service
cost.

FEASIBILITY AND RECOMMENDATION
Project costs are anticipated to be approximately $2.1 million, which includes the total
street and utility reconstruction of 36°i Avenue NE from Roosevelt Street NE to Silver
Lake Road and Edward Street from 35°i Avenue NE to 361' Avenue NE.
Due to the poor structural condition of portions of the street sections, the deterioration of
the existing sanitary sewer and storm sewer systems, and frequent watermain breaks, this
project is both feasible and necessary from an engineering standpoint. Alternative
methods of improving the utility systems and roadways are not feasible or cost effective
due to the location and condition of the existing utilities and the existing soils conditions.
Based on our analysis and data presented, the proposed project is feasible, necessary, and
cost effective from an engineering standpoint. We recommend reconstruction of the
sanitary sewer, watermain, storm water collection system, and the street as detailed in this
report.

Resolution 12-075; A Resolution Ratifying the 2012 - 2014 Agreement between the Law
Enforcement Labor Services, Inc. #186 Local Representing the St. Anthony Police Department
Licensed Employees and the City of St. Anthony
OVERVIEW:
This is a three (3) year contract with the St. Anthony Police Department's licensed employees. For
patrol officers there will be a 1 % increase in 2012, a 2%o increase for 2013 and 2014. For
Lieutenants there will be a 2% increase in 2012, a 4% increase for 2013 and 2014. The contract
includes reducing the accrual for personal leave pay out, a hard cap of maximum paid time off
(PTO) accrual and an increase in uniform allowance.
For 2012, there will be a $100 per month increase for health insurance coverage. We have added a
re -opener clause to the contract in case any changes come from the Health Insurance Benefits
Committee.

A RESOLUTION RATIFYING THE 2012 - 2014 AGREEMENT BETWEEN THE
LAW ENFORCEMENT LABOR SERVICES, INC. #186 LOCAL REPRESENTING
THE ST. ANTHONY POLICE DEPARTMENT LICENSED EMPLOYEES
AND THE CITY OF ST. ANTHONY
BE IT RESOLVED, that the 2012 - 2014 Agreement between the Law
Enforcement Labor Services, Inc., Local #186 representing the St. Anthony Police
Department Licensed Employees, and the City of St. Anthony is hereby ratified.
The Mayor and City Manager are authorized to execute the Agreement on behalf
of the City.
