CALL TO ORDER.
Mayor Faust called the meeting to order at 7:00 p.m.
PLEDGE OF ALLEGIANCE.
Mayor Faust invited the Council and audience to join him in the Pledge of Allegiance.
ROLL CALL.
Present: Mayor Faust; Councilmembers Gray, Jenson, Roth and Stille.
Absent: None.
Also Present: Director of Public Works Jay Hartman.
Guest: Metro Cities Executive Director Patricia Nauman.
CONSIDERATION, DISCUSSION, AND POSSIBLE ACTION ON ALL OF THE FOLLOWING
ITEMS.
I. APPROVAL Oh SEPTEMBER 24, 2013, CITY COUNCIL MEETING, AGENDA.
Motion by Councilmember Gray, seconded by Councilmember Jenson, to approve the City
Council Meeting Agenda of September 24, 2013.
Motion carried unanimously.
II. PROCLAMATIONS AND RECOGNITIONS.
A. Proclamation of Kiwanis Peanut Day on September 27, 2013,
Councilmember Stille recited the Proclamation of Kiwanis Peanut Day on September 27, 2013.
Mayor Faust introduced Kiwanis Board members Rick Dunn and Tom Miller.
Mr. Dunn stated the Kiwanis Club appreciates the close working relationship with the City and
thanked the City for its ongoing support of the Kiwanis through contributions and volunteer
work. IIe stated the Kiwanis Club supports a number of community projects including providing
two scholarships each year to graduating seniors at St. Anthony Village High School as well as
leadership development clubs in the schools. He indicated that this is the Kiwanis Club's 42"
year of holding the Peanut Day in St. Anthony and expressed appreciation to the City for
allowing them to hold this event every year.
Mayor Faust requested that Mr. Dunn express the City Council thanks to the membership of the
Kiwanis Club for their commitment and for everything Kiwanis has given to the community.

Motion by Councilmember Jenson, seconded by Councilmember Gray, to approve the Consent
Agenda items.
Motion carried unanimously.

V. REPORTS FROM COMMISSION AND STAFF - NONE.
VI. GENERAL BUSINESS OF COUNCIL.
A. Metro Cities Update. Patricia Nauman, Metro Cities Executive Director, presenting,
Ms. Nauman provided an update on the 2013 legislative session and stated that Metro Cities'
priorities included reinstating the sales tax exemption, reforming LGA, organized waste
collection streamlining, promoting tools for economic development, and I&I legislation. She
reported that Metro Cities and the League worked on the sales tax exemption bill and Senator
Rest of the Senate Tax Committee provided assistance in getting the bill passed. She advised
there are some issues with joint powers entities that are not exempt and Metro Cities is working
to get that clarified, adding it was not the legislature's intent to exemptjoint powers entities from
the bill. She stated another key issue this year was reforming the LGA program to fix inequities
in the program and avoid instabilities in the program, noting that 70% of LGA was going to
greater Minnesota and 30% to the metro, and Metro Cities was able to get reforms to bring more
money into the metro area, with 31 cities now receiving LGA that did not receive LGA in the
past. She advised that Metro Cities also worked on streamlining the organized waste collection
process resulting in a new law requiring a 60 -day negotiation period before a waste collection
study is established. She stated there was a study recently completed on the fiscal disparities
program and this has been a fairly contentious issue, adding they expected to see legislation this
year that would have sought to diminish fiscal disparities and there was legislation proposed to
assist the Mall of America with its expansion and in the end, a bill was passed that provides $250
million to Mall of America. She reported that Metro Cities was able to secure $1 million for I&I
mitigation under the Legacy Bill that will allow cities to assist private property owners in cities
identified as being excess I&I contributors. She advised that Metro Cities continued to push for
more flexible economic development tools including expanding TIF to allow cities more time to
spend the increment but these efforts were unsuccessful. She indicated that Metro Cities is
monitoring the Met Council's work on Thrive MSP 2040, including Met Council's role in
economic development, climate change, and whether to expand Met Council's scope of authority
as it relates to water supply. She stated Metro Cities will be establishing an advisory committee
to assist in reviewing and responding to the Thrive MSP 2040; in addition, Metro Cities will be
asking Met Council to revisit how they allocated the affordable housing numbers. She stated she
is co-chairing a working group of cities and the Met Council to discuss options regarding the
Sewer Availability Charge (SAC). She discussed the next legislative session that will be a
bonding year and will likely include significant transportation projects, adding she felt the next
session would also include some revisiting of the tax bill since there was a lot of controversy

regarding expansion of the sales tax to services and warehousing. She then distributed the
summer/fall 2013 Metro Cities newsletter.
4 Mayor Faust felt it was important for residents to understand how important the Metro Cities
5 membership means to the City and advised that Metro Cities worked to secure millions of dollars
6 from the DNR to assist the City in resolving flooding issues and this is certainly an example of
7 the City's return on investment for the dues it pays to Metro Cities. He also thanked Ms.
8 Nauman for her efforts four years ago on the I&I issue and explained that the City invested a lot
9 of money and over the last three years has recouped approximately $300,0004400,000 from the
10 I&I funding through Met Council. Ile stated that the last time the City received LGA was in
11 2002 and will now receive LGA in 2014 that will help the overall community. He indicated that
12 the City will be discussing the Thrive MSP 2040 project with Met Council including the latest
13 population projections for the City. IIe requested Metro Cities' assistance in working with the
14 Met Council as it relates to bus service and particularly related to bus shelters in the City.

16 VII. REPORTS FROM CITY MANAGER AND COUNCIL MEMBERS.

18 Councilmember Stille reported on his attendance at the September 23"' Planning Commission
19 meeting and advised the Planning Commission recommended approval of an Ordinance related
20 to solar energy systems that will be considered by the City Council at its next meeting.

28 Mayor Faust reported on the September 14°i Touch a Truck event sponsored by the Chamber of
29 Commerce. He thanked all the City staff that assisted with this event. IIe also reported on his
30 attendance at the September 17°i ribbon cutting ceremony for Midwest Podiatry.

35 are not on the regular agenda. Hearing none, Mayor Faust moved forward with the agenda.

RESOLUTION 13-064
A RESOLUTION APPOINTING ELECTION JUDGES FOR THE
2013 MUNICIPAL AND SCHOOL BOARD GENERAL ELECTION
WHEREAS, Minnesota §204B.21, subd. 2 Appointing authority, powers and duties;
indicates election judges for precincts in a municipality shall be appointed by
the governing body of the municipality; and
WHEREAS, the individuals listed on Exhibit A have submitted applications to the City
Clerk to be Election Judges for the November 5, 2013, Municipal and School
Board General Election:
The members of city staff that will be assisting, with absentee voting are Phuongmai Dang,
Robin Flartfiel, and Sandy Simon. The absentee ballot board will consist of a group of above
listed election judges and city staff.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of St. Anthony
hereby appoints Election Judges for the 2013 Municipal and School Board General Election.

Resolution 13-066; a Resolution Certifying Special Assessments for Delinquent Public Utility
Service Accounts to the 2014 Ramsey County'rax Rolls
REVIEW:
h1 accordance with St. Anthony City Code; § 33.044 Certification of Delinquent Account
Balances, the utility billing department has determined which accounts necessitate certification.
Attached are resolutions, County specific, with the outstanding water/sewer accounts to]-
2013
or2013 certification. With City Council approval, they will be certified to the appropriate
county's tax rolls.

RESOLUTION 13-065
A RESOLUTION CERTIFYING SPECIAL ASSESSMENTS FOR DELINQUENT PUBLIC
UTILITY SERVICE ACCOUNTS TO THE 2014 HENNEPIN COUNTY TAX ROLLS
WHEREAS, utility records for the City of St. Anthony identify certain delinquent charges and utility
accounts as of September 30, 2013; and
WHEREAS, the owners of record of the properties served by each delinquent account have been
notified of the delinquency according to the legal requirements of the ordinance 33.107;
and
WHEREAS, the delinquent charges may be assessed ander Minnesota Statutes, Section 429.101 and
444.075 that authorize certification of such delinquent charges to the County tax rolls for
collection; and
WHEREAS, pursuant to proper notice duly given to the owners of record as required by raw, the City
has met the requirements for the assessment of these delinquent public utility charges.
NOW, THEREFORE, BE IT RESOLVED that:
I ) The special assessment of delinquent public utility accounts is hereby adopted and

An Amendment to the Saint Anthony Village City Code to Add Chapter
§152.187 Relating to Solar Energy Systems
OVERVIEW
It is beneficial to review sections of the City Code on a regular basis in order to identify potential issues
before they are found through a request or land use application. In addition, it ensures that the City Code
is reflective of what is desired for the community. Following a cursory review of the City's Zoning
Ordinance, staff created a list of code provisions to review and potentially update, to be reviewed by the
Planning Commission. At the regular meeting of the Planning Commission on January 28, 2013, the
Planning Commission reviewed this list and created a "Work Plan".
The Work Plan is a schedule of objectives established by the Planning Commission, which provides an
efficient method of prioritizing projects and achieving the most important goals of the Planning
Commission and the community. Among potential projects in 2013, the Planning Commission prioritized
a list of projects they would like to work on. The City Council, at their regular meeting on April 12, 2013,.
approved the Work Plan as presented by the Planning Commission.
Item #6 on the Planning Commission Work Plan is to "review green/energy reuse ordinance(s)". With
increased interest in renewable energy, more specifically for the installation of solar energy systems, staff
has prepared a draft Ordinance relating to Solar Energy Systems. The purpose of the amendment is to
incorporate more detailed standards governing the installation of solar energy systems. The ordinance is
expected to provide clarity and predictability while ensuring that solar energy systems may be installed in
a manner that allows for effective energy production. Further, the standards are intended to ensure that
these systems are installed in a manner that would not unduly affect community character. The proposed
text amendment would:
• Provide clarity for City staff as well as solar installers and property owners;
• Set standards for building -mounted systems;
• Clarify that solar access easements may be purchased from nearby property owners, consistent
with state statute.
The proposed text amendment provides for an administrative review process. For new solar energy
systems that do not or cannot comply with the new standards, the proposed ordinance includes a
conditional use permit (CUP) process that would authorize the City to grant exceptions to the standards.
This process would offer flexibility — more flexibility than a variance process -a while also offering nearby
property owners an opportunity to review and comment on proposals that may affect their property. In
this instance the City could place reasonable conditions on applications in order to mitigate any adverse
impacts associated with installations that do not meet the standards of the ordinance.

As proposed, solar energy systems would be permitted as accessory uses within the Ll — Light Industrial
and R/O — Recreation/Open Space Districts subject to the provisions as outlined in the proposed draft
ordinance text attached as Exhibit A.
Staff presented the proposed amendments to the City Code at a work session with the Planning
Commission on August 26, 2013 and with tihe City Council on July 30, 2013 and again on August 28,
2013.
A public hearing on the draft ordinance was held at the regular meeting of the Planning Commission on
September 23, 2013 where the Planning Commission voted 6-0 to recommend the City Council approves
the draft ordinance as written

Chair Faust called the meeting to order at 7:52 p.m.

Subject: Early Decertification of TIF District No. 3 —Apache Plaza I (Cub Foods)
On March 23, 1993, the City and its Housing and Redevelopment Authority (HRA)
established the above referenced redevelopment TIF district for the development of the Cub
Foods. This district has a 26 year term from the date of receipt of the first tax increment,
which was 1998. Based upon this, the district would terminate on December 31, 2023,
The City/HRA issued taxable TIF bonds in the amount of $1,170,000 for the project. The
bonds were paid in full on February 1, 2013. State Statute dictates that when the obligation
(bonds, pay-as-you-go TIF notes or interfund loans) are paid in full, the district must be
decertified and any remaining tax increment in the account returned to the County for
redistribution to the City, County and School District.
The estimated cash balance in the account as of October 1, 2013 is approximately
$324,288. Of this, the City's portion that would be redistributed back is approximately
$134,000. It should be noted that the City will need to continue reporting on this TIF district
to the Office of the State Auditor even though it is being decertified. This is due to the
outstanding interfund loan from this District to TIF District 3-5 (Apache Plaza). The City
"pooled" these funds to TIF District 3-5 to pay off the Fannie Mae loan. When these dollars
are returned to this District, they can be redistributed for other redevelopment projects
under the legal pooling authority. If no future projects are warranted, then the City can
return these funds as well to the County for redistribution to the City, County and School
District.

RESOLUTION 13-05
RESOLUTION APPROVING THE DECERTIFICATION OF TAX INCREMENT
FINANCING DISTRICT NO. 3 APACHE PLAZA REDEVELOPMENT I OF THE
CITY OF ST. ANTHONY VILLAGE
WHEREAS, on March 23, 1993, the City of St. Anthony Village (the "City") created its'I'ax Increment
Financing District No. 3 Apache Plaza Redevelopment I, (the "District") within its
Redevelopment Project Area No. 3 (the "project"); and
WHEREAS, tax increment bonds to which tax increment from the District have been pledged was
issued, and
W I IEREAS, the bonds have been paid in full all other costs ofthe Project have been paid; and
WHEREAS, there are no parcels located in the District which have delinquent or contested taxes, and
W HEREAS, the City desires by this resolution to cause the early decertification of the District due 1'o all
obligations being paid in full; and
WHEREAS, expiration of the District will cause all property taxes generated by property within the
District to be distributed in the same manner as all other property taxes beginning in 2014.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of St. Anthony Village that the
City's staff and consultants shall take such action as is necessary to cause the County Auditor of Ramsey
County to decertify the District as a tax increment district and to no longer remit tax increment from the
District to the City.
