Mayor Faust invited the Council and audience to join him in the Pledge of Allegiance.
ROLL CALL.
Present: Mayor Faust; Couneilmembers Jenson, Roth and Stille.
Absent: Councilmember Gray.
Also Present: City Manager Mark Casey, Retiring Fire Chief John Malenick, New Fire Chief Mark
Sitarz, Police Chief John Ohl, Finance Director Shelly Rueekert, and Liquor
Operations Manager Mike Larson.
Guest: Wendy Webster (SANB Community Services Director).
CONSIDERATION, DISCUSSION, AND POSSIBLE ACTION ON ALL OF THE FOLLOWING
ITEMS.
APPROVAL OF DECEMBER 10, 2013, CITY COUNCIL MEETING AGENDA.
Motion by Councilmember Jenson, seconded by Councilmember Roth, to approve the City
Council Meeting Agenda of December 10, 2013.
Motion carried 4-0.
II. PROCLAMATIONS AND RECOGNITIONS.
A. Recognition of Retiring Fire Chief John Malenick for his years of service to the City of
St. Anthony.
City Manager Casey stated that Fire Chief Malenick started with the City in 1982 as a part-time
liquor store employee and was promoted to full-time store manager shortly thereafter and in
1988, he joined the Fire Department as a part-time firefighter and one year later became a full-
time firefighter and in May 2004, he was promoted to Fire Chief. He announced that Fire Chief
Malenick will retire on December 13, 2013, after 32 years of service and extended his
congratulations to Fire Chief Malenick for his many years of service to the City.
Fire Chief Malenick thanked the City Council and citizens and stated he has had an incredible
career, thanks to the environment provided by the City that allowed him to grow and learn. Ile
stated they were able to hire within the ranks to fill his position and that is a testament to the
talent that exists in the Fire Department. He again thanked the City Council and residents for his
32 years with the City.

1 Councilmember Roth thanked Fire Chief Malenick for his service and stated he has been
2 impressed with the way Fire Chief Malenick has handled himself in difficult situations, adding
3 he has always felt that the City and its residents were in good hands. He thanked Fire Chief
4 Malenick for his professionalism and dedication to the job.

6 Councilmember Stille thanked Fire Chief Malenick for his years of service and stated he
7 appreciates how conscientious Fire Chief Malenick has always been and how personable and
8 approachable he has always been with residents.

10 Councilmember Jenson thanked Fire Chief Malenick for his years of service and stated Fire
11 Chief Malenick's commitment to the Fire Department and his desire to serve the residents of St.
12 Anthony has always been evident.

14 Mayor Faust thanked Fire Chief Malenick for his years of service and stated it was important that
15 the City promote from within whenever possible and the fact that there are people who are
16 qualified to follow in succession comes in no small part from Fire Chief Malenick's leadership.
17 He expressed appreciation to Fire Chief Malenick for his compassion and service and stated the
18 City feels a deep commitment to him and wishes him the very best in his retirement.

20 Fire Chief Malenick requested that the City Council acknowledge all of the City's firefighters
21 and their families.

23 Mayor Faust and City Manager Casey presented a recognition fire hydrant plaque to Fire Chief
24 Malenick.

26 B. Recognition of New Fire Chief Mark Sitarz.
27
28 City Manager Casey stated it was his great pleasure to hire the new Fire Chief and introduce
29 Mark Sitarz. He stated Fire Chief Sitarz was selected through a competitive process and
30 indicated Fire Chief Sitarz is a resident of St. Anthony and started as a paid on call firefighter in
31 1998 then became a full time firefighter in 2001. He stated Fire Chief Sitarz is probably most
32 proud of his role as a trainer and he and Fire Marshal Chris Fuller were recognized as Trainers of
33 the Year by the State Fire Marshal's office last year.

35 Fire Chief Sitarz expressed thanks for the opportunity to serve as Fire Chief and thanked Retiring
36 Fire Chief Malenick for leaving the Fire Department in a very positive state and one that is
37 welcoming to him. He also thanked his wife, Sarah, for her support during this process. He
38 announced that Jay Olson has been named Assistant Fire Chief and Chris Fuller has been named
39 Fire Marshal.

41 Mayor Faust extended the City Council's congratulations to Fire Chief Sitarz.

43 C. Recognition of New Fireman Joe Benik.
44
45 Fire Chief Sitarz stated that Joe Benik came from the Fire Department's part-time paid on call
46 ranks and was the top in his class. He then introduced Joe Benik as the City's newest full time
47 firefighter and also introduced Mr. Benik's wife, Britanny, and son, BJ.

A. Community Services Update. Wendy Webster, SANB Community Services Director,

presenting.

Mayor Faust Mayor introduced Wendy Webster, Community Services Director.

Ms. Webster discussed the community education philosophy of education as a life-long process
42
and stated that 75% of their budget comes from program fees, with approximately $800,000 in
43
program fees brought in during the 2012-2013 budget year. She stated they are required to have
44
an Advisory Council and thanked Councilmember Jenson for serving as the City Council
45
representative on the Advisory Council. She discussed the Early Childhood Family Education
46
programs and stated they served 204 parents and 238 children last year. She stated the School
47
Age Care program provides an engaging and welcoming environment for grades K-6, the Middle

and Iligh School program's youth enrichment had approximately 2,600 participants in the after
school classes and the open gym program keeps kids engaged in healthy after school activities.
She discussed adult programming and stated they have started a family learning program to learn
English skills and this program is intended to reach out and connect with families who have
recently immigrated to the United States. She stated the senior citizen programs include trips,
classes, and special events, adding the card groups are some of the most popular. She advised
that the residential survey conducted by Decisions Resources in June 2013 surveyed 400
randomly selected households in the St. Anthony -New Brighton School District and 38% of
those surveyed were community services users with 31 % participating within the past year. She
stated when survey respondents were asked how they felt about renewing the $2 million
operating levy, 80% said they would support or strongly support renewing the levy and that
support jumped to 94% among community services users. She stated 61% of residents also said
they would support the capital projects levy to support technology in schools and that number
jumped to 83% among community services users. She discussed the partnerships with the City
and with many local businesses, including Chandler Place that has a "grandfriends" program
with the preschool. She stated that a program was recently started for families at Equinox that is
held every Tuesday afternoon at Culver's. She stated that Diamond 8 Terrace Apartments has
also been supportive of their programs and recently set up program activities on Thursday
mornings where families work on ECFE activities. She added the Chamber of Commerce, St.
Anthony Kiwanis, and St. Anthony Library have also been great partners.
Councilmember Stille thanked Ms. Webster for the update and thanked her for all the work she
does to engage the community.
Councilmember Jenson thanked Ms. Webster for her commitment and enthusiasm.
Mayor Faust thanked Ms. Webster for her hard work and expressed appreciation to Ms. Webster
for her passion and stated she is a dedicated servant and the City is grateful for her work in the
community.
B. Resolution 13-084; a Resolution Authorizing the Application for Metropolitan Council
2013 Clean Water Fund Inflow/Infiltration Grant Program.
City Manager Casey presented a resolution authorizing the City to apply for grant monies up to
$2,000 to reduce clear water from entering the sanitary sewer system. He advised that if the City
receives the funds, staff will come back with a plan for how the dollars will be spent.
Motion by Councilmember Roth, seconded by Councilmember Jenson, to approve Resolution
13-084; a Resolution Authorizing the Application for Metropolitan Council 2013 Clean Water
Fund Inflow/Infiltration Grant Program.
Motion carried 4-0.
C. Resolution 13-085; a Resolution Setting the 2014 General Operating Budget and Property
Tax Levy. Shelly Rueckert, Finance Director, presenting.
Finance Director Rueckert presented the 2014 General Operating Budget and Property Tax Levy
and explained that the 2014 budget parameters include maintaining the present level of City

services, salary increases of 2% to reflect cost of living adjustments, a 13.3% increase in health
insurance premiums, and for the first time in several years, the City will receive LGA. She
stated the overall levy increases by $206,218 or 3.8% and pointed out that the overall levy would
have increased by 6.9% without LGA. She stated that 37% of LGA will be used to provide more
resources for unmet capital needs, 25% will be used for property tax relief by negating the
impacts of annual wage adjustments, health insurance premiums, and increased energy costs,
24.5% will be used to address severance obligations and litigation risk, 10% will be used for
property tax relief by supplementing anticipated decreases in General Fund revenue and police
state aid, and 3% will be used to slow the growth of the road improvement levy. She stated that
in 2014, the average homeowner cost for City services is $813.14 for a home valued at $208,000,
or approximately $68 per month. She advised that in 2013 the City issued road improvement
debt of $1,775,000 and in 2014, the average homeowner cost for road improvements is $460.77
or $38.39 per month. She indicated that since 1999 the City has used grants/donations and
partnerships to mitigate the impact of the annual levy and since that time has received over $17
million in grants and donations or $2,090 per resident. She stated the 2014 general operating
levy totals $3,140,501, the proposed 2014 capital equipment budget totals $299,100, liquor
operations transfers total $347,444, and the increase in all levies totals $206,218 or 3.8%.
Councilmember Roth noted that the City has made a significant investment over the last 15 years
on the City's infrastructure and a large portion of what residents pay in taxes is intended to make
the City a very livable place and a better community, adding he felt this investment would pay
dividends in the future as public buildings are paid off and the City gets to a point where road
projects are coming off and no new road projects are coming on.
Motion by Councilmember Stifle, seconded by Councilmember Jenson, to approve Resolution
13-085, a Resolution Setting the City of St. Anthony's 2014 General Operating Budget and
Property Tax Levy.
Motion carried 4-0.

City Manager Casey reminded residents of the retirement celebration for Fire Chief Malenick on

Mayor Faust invited residents to come forward at this time and address the Council on items that
are not on the regular agenda. Hearing none, Mayor Faust moved forward with the agenda.

Mayor Faust stated that this is the last City Council meeting for 2013 since the City Council has
completed all its business for the year.

BE IT RESOLVED that the City Council of the City of St. Anthony hereby designates
that US Bank, N.A. of St. Anthony as a depository for the funds of the City and that said
bank shall also be the bank for this City with respect to any/ all other banking services
required or used by this City.
BE IT FURTHER RESOLVED, that said bank deposit such securities in the amount and
in the manner required by law.
BE IT FURTHER RESOLVED, that the Finance Director be authorized to accept such
securities as collateral as required by law, and that said collateral be held at the US Bank
of St. Anthony for safekeeping.
BE IT FURTHER RESOLVED, the City Clerk shall transmit to the US Bank, N.A. of St.
Anthony a copy of this resolution.

Thank you for the opportunity to bid on public notice publication services for the City of St.
Anthony. The Bulletin has been serving the needs of the St. Anthony area for 37 years, and is pleased
to provide ongoing coverage of city government and school issues and community events.
Lillie Suburban Newspapers is the oldest weekly newspaper company in the St. Paul area. It was
founded in 1938 by the late T. R. Lillie. His grandsons, Jeffery Enright and Ted H. Lillie, are
continuing the family tradition of publishing award-winning community newspapers in the St. Paul
suburbs.

STANDING RULE FOR CONDUCTING
CITY COUNCIL MEETINGS
INTRODUCTION
In the belief that the best decisions are made by the best informed decision makers
and that public decisions are best served when the public has every opportunity to
present views, the following rules are established to govern regular and special
Council meetings as well as formal public hearings. There are several goals behind
these rules.
In general, free and open discussion by all interested parties should be an essential
part of the decision making process.
The Council process should have as little procedural overhead as possible.
Time is better spent on substantial matters rather than performa matters.
MEMBERSHIP
The formal Council membership consists of four Councilmembers and the Mayor.
All five have one vote each and all five can introduce motions. For purposes of
leading the meeting, the Mayor, or in the absence of the Mayor, the Mayor Pro tem
will be considered the Chairperson. A quorum is required to do official business
and a quorum of the Council consists of three members.
Meetings of the Council shall be held on the second and fourth Tuesday of each
month at 7:00 pm. Council work sessions will be called from time to time, as the
Mayor and Council deem necessary.

CONSENT AGENDA
These items are considered routine and will be enacted by one motion. There won't
be separate discussion of these items unless a Councilmember or citizen so requests,
in which event the item will be removed from the Consent Agenda and placed
elsewhere on the agenda. Donations to the city will be handled in the same
accordance as long as it follows the City of St. Anthony Donation Policy.

hldividuals may address the City Council about any item not included on the
regular agenda. Speakers are requested to come to the podium, state their name
and address for the secretary's records, and limit their remarks to five minutes.
Generally, the City Council will not take official action on items discussed at this
time, but may refer the matter to staff for a future report or direct that the matter be
scheduled on a upcoming agendas.
INFORMATION AND ANNOUNCEMENTS
ADJOURNMENT
AGENDA
To be considered, an item must on the agenda and the agenda must be distributed
to all the Councilmembers and any other persons having responsibility for an item
at least three working days prior to the meeting. An agenda can be modified with
addendum by a majority vote but this should be used only for minor items or items
with extreme time constraints.
An item can be moved from the consent agenda to the action agenda at the request
of the Mayor or Councilmember.
With there being an cable TV and in-person audience, who are not as familiar with
each item, the Mayor will give a brief explanation of each item as it is addressed.
The order of items on the agenda need not be followed absolutely. The Mayor may
adjust the order in the interest of:
Fill in time before a scheduled item, i.e. a public hearing.
• Grouping several items to best make use of consultant time.

o Accommodating individuals who have attended the meeting specifically to
provide input on an item.
PROCESS REGULAR AND SPECIAL COUNCIL MEETINGS
For these proceedings the Council will use the "open discussion' procedure. That
is, discussion is open to any member before or after a motion is made. The
privilege is also extended to the City Manager, and any of the consultants who may
have an interest in or can contribute to the item at hand.
The Mayor can make liberal use of the "unanimous consent" procedure. That is,
items that in the judgment of the Mayor are likely to be unanimously approved can
be introduced for approval with the statement: "If there are no objections, stands
approved (or denied)." If any Council member has an objection, the item reverts to
the standard motion procedure. This "unanimous consent" procedure cannot be
used for items requiring formal votes, i.e., resolutions or for approval of the consent
agenda.
The standard motion procedure is that each motion requires a second. This also
applies to amendments. Any motion, by any member shall be reduced to writing
upon request of any member. No motion shall be put to a vote until it has been
stated by the recorder at the request of any member of the Council.
To eliminate confusion, only one amendment will be considered at a time and that
amendment must be germane to the motion. An amendment cannot itself be
amended. If a change to an amendment is deemed appropriate, the amendment
should be withdrawn and reintroduced accordingly.
The general mode of voting will be by acclamation but with enough clarity that
individual votes can be recorded in the minutes. If in doubt, the recording
secretary can request clarification. Each individual's vote will be entered in the
minutes.
Any member may abstain from voting or disqualify himself/ herself. The reason for
disqualification or abstention must be stated by the member and entered into the
minutes. If a member disqualifies himself/ herself, he/she may leave the room
while the issue is being considered.
Roberts Rules of Order (revised) shall govern the City Council procedures not
covered by the Standing Rules of the City Council.
The meeting will be video taped and the tape will be retained for three (3) months
following approval of the minutes of the meeting. The standard retention can be
extended if in the judgment of the Mayor, City Clerk or any other Councilmember,
such action is warranted.

If the Council action is the result of a resident request and that request is denied in
whole or in part, reasons of the fact supporting the denial will be made part of the
public record.
PROCESS - PUBLIC HEARING
Since a public hearing is a more formal procedure and often requires certain
procedures and actions to be legal, the meeting rules are changed accordingly.
The primary aim of a public hearing is to take input from the public. To accomplish
this in the most effective manner, the Mayor will introduce the hearing with an
explanation of the issues. 'The Mayor will give this explanation or a person
designated by the Mayor. The use of explanatory visual aids is encouraged.
Following the explanation, input from the public will be taken. Prior to accepting
input though, the Mayor will state the areas where input will be appropriate, the
maximum time to be allotted to any individual presenter and any other procedural.
rules deemed appropriate to guarantee that all concerned parties have a fair and
adequate opportunity to be heard.
All individuals wishing to speak must fill out and submit an identification form and
speak in to a recording microphone. Individuals not wishing to speak in public
may provide a written statement. "The Council may take up to 15 minutes to review
written statements presented at the meeting. If the Council decides not to act on the
issue at the public hearing meeting, it may by majority vote extend the time where
written input will be taken to a day not later than one week before the next meeting
where a deciding vote is planned.
All speakers are expected to be business like, to the point and courteous. Anyone
not abiding by these rules will be considered to be out of order.
The Council will refrain from initiating a discussion during the public input phase
of the hearing except to clarify points brought up.
Once the public testimony phase is complete, the Mayor will announce the public
hearing to be closed and the Council will revert back to its open discussion mode of
operation. From this point on, public input will only be appropriate when solicited
by the Council.
It shall be the intent of the Council to vote on the issue at the same meeting as the
public hearing and as close in time to the public hearing as possible. Should it be
necessary to defer voting until a later date, the procedure will be clearly explained
to the audience.

If the motion contains conditions, as may occur in conditional use or variance
requests, those conditions will be conveyed in writing to the requestor.
If the public hearing is the result of a resident request and that request is denied in
whole or in part, reasons of fact supporting the denial will be made part of the
public record.
If the public hearing is to set an assessment rate, the assessment formula(s) under
discussion cannot be altered. This implies that the Council has fully discussed any
formulas prior to the hearing and that the appropriate legal, fiscal and engineering
consultants have passed on formula(s) viability, legality, and feasibility.
If the hearing is to set an assessment, it cannot be scheduled later than the first
meeting in September. This is to allow time to correct errors prior to the time
needed to certify the rolls to the county.
MAYOR PRO TEM
The Mayor Pro tem shall be appointed in January of each year. The first Mayor Pro
tem after adoption of this rule shall be the Councilmember with the most
continuous time on the Council. The position shall be rotated among
Councilmembers based on time of continuous service. If two or more members
have identical seniority, the appointment shall be based on alphabetical order by
last name. A Councilmember may not serve as Mayor Pro tem twice until all other
Councilmembers have been Mayor Pro tem. A Councilmember must serve two
years before being considered for Mayor Pro tem.
A Councilmember may decline the appointment for good cause and maintain
his/her place in the rotation for appointment the following year.
ADOPTION/MODIFICATON/SUSPENSION
These rules can be adopted, modified or suspended in whole or in part by a
majority vote of the Council. If suspended they are automatically reinstated at the
next meeting.
ANNUAL REVIEW
These rules will be reviewed annually at the first meeting in January.
INTERPRETATION
The Mayor will interpret the rules. However, the Mayor's interpretation can be
appealed by any Councilmember and can be overruled by a majority vote.

A RESOLUTION ADOPTING THE ELECTED OFFICIALS OUT OF
STATE TRAVEL POLICY FOR 2014
WHEREAS, Minnesota State Statute Chapter 156, Section 56, Article 2 now requires
that cities, counties and school districts develop a policy that regulates
travel by located elected officials outside of the state;
WHEREAS, the City Council will review this policy annually;
WHEREAS, any changes to the policy must be approved by a recorded vote; and
WHEREAS, elected officials of the City of St. Anthony Village will follow the
limitations outlined in the policy.
NOW, TIIEREFORE, BE IT RESOLVED, that the City Council of the City of St. Anthony
Village hereby approves the elected officials Out of State Travel Policy for 2014.

ELECTED OFFICIAL OUT-OF-STATE TRAVEL POLICY
Purpose: The City of St. Anthony recognizes that its elected officials may at
times receive value from traveling out of the state for workshops, conferences,
events and other assignments. "This policy sets forth the conditions under which
out-of-state travel will be reimbursed by the City. This policy will be reviewed
annually by City Council.
General Guidelines:
The event, workshop, conference or assignment must be approved in
advance by detailed motion by the City Council at an open meeting and
must include an estimate of the cost of the travel. h1 evaluating the out-of-
state travel request, the Council will consider the following:
Whether the elected official will be receiving training on issues
relevant to the City or to his or her role as the Mayor or as a
Councilmember;
Whether the elected official will be meeting and networking with
other elected officials from around the country to exchange ideas
on topics of relevance to the City or on the official roles of local
elected officials;
Whether the elected official will be viewing a city facility or
function that is similar in nature to one that is currently operating
at, or under consideration by the City where the purpose for the
trip is to study the facility or function to bring back ideas for
consideration of the full council;
• Whether the elected official has been specifically assigned by the
City Council to visit another city for the purpose of establishing a
goodwill relationship such as a "sister -city' relationship;

Whether the elected official has been specifically assigned by the
City Council to testify on behalf of the City at the United States
Congress or to otherwise meet with federal officials on behalf of the
City;
• Whether the City has sufficient funding available in the budget to
pay the cost of the trip.
2. No reimbursements will be made for attendance at events sponsored by or
affiliated with political parties.
3. The City may make payments in advance for airfare, lodging and
registration if specifically approved by the City Council. Otherwise all
payments will be made as reimbursements to the elected official.
4. The City will reimburse for transportation, lodging, meals, registration,
and incidental costs using the same procedures, limitations and guidelines
outlined in the City's policy for out-of-state travel by City employees as
outlined in the City Expenditure Policy of the City of St. Anthony's
Employee Resource Guide.
Provisions:
Limitations on paying for council members who have announced their
intention to resign, not to seek re-election, or who have been defeated
in an election (however, there may be some benefit to the city in
having newly elected officials who have not yet taken office attend
training beforehand);
• Requirements for Councilmembers to give oral or written reports on
the results of the trip a the next Council meeting;
• The ability for the city to make exceptions to the policy;
• The requirement for all frequent flyer miles to accrue to the city;
• Requirements to use the most cost-efficient mode of travel available
taking into consideration reasonable time constraints.
