22lt9 <br />SPECIAL MEETIldG HELD MAY 29, 1965 <br />A special meeting of the Falcon Heights Village Council was called to order <br />at 10:00 A.ld,, P,~ay 29, 1965 with the following members present: Mayor Nilsen, <br />Clerk Strandquist, Trustees Warkentien and Black. Absent: Trustee Stone. <br />Warkentien introduced the following resolution and moved its adoption. <br />WHEREAS, C. H. Alexander, 1868 Arona Avenue has made an application to <br />the Village of Falcon Heights for a variance permit for construction of a <br />fence on his residential property at 1868 North Arona Avenue, and <br />WHEREAS, said request for a variance involves the construction of a fence, <br />not to exceed six feet in height, on the north side lot line, on the rear lot <br />line, and on the south side lot line which abutts Ruggles Street, in accordance <br />with the drawing submitted, and <br />WHEREAS, Falcon Heights Village Ordinance Number 61t, as adopted on December <br />21, 1961 provides in Section x..7(2) that 'rFences and Walls may be placed <br />anywhere on a lot, except not in a required front yard or within thirty (30)feet <br />of a street on a side yard adjacent to a street,' and <br />WHEREAS, said Ordinance Number 61~ provides for variance procedure and this <br />application for a variance has been duly referred to the Planning Commission in <br />accordance with Imo' ov3.sions of Ordinance 6~., and <br />WHEREAS, the Planning Commission has reviewed said application and has <br />referred the matter with its recommendations to the Village Council, and <br />WHEREAS, the Village Council has reviewed the plans, has inspected the <br />site of the proposed fence and. has further inspected the set-back of other <br />buildings and fences in the area involved and has consulted with the Village <br />Planning Consultant, <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the Village of Falcon <br />Heightsi <br />1. The application for a variance is approved provided that said fence <br />does not exceed six feet in height at the southeast corner, and that it <br />be constructed in such a manner that it is level at the top running in <br />a westerly direction from the southeast corner of the lot. <br />2. Approval of the variance application is further dependent upon the <br />owner of the property agreeing to maintain the sodded area between the <br />south side of the fence and the north line of Ruggles Street. <br />The motion for the adoption of the foregoing resolution was duly seconded by <br />Strandquist and upon a vote being taken, the following voted in favor: Nilsen, <br />Warkentien, 5trandquist and the following voted. against same: Black.
