<br />PTJBLI C HEARING ON LICENSE APPLICATION <br />TO OPERATE A DAIRY IIiAY <br />l~iednesday, 6-10-1953 <br />Present: H. L. Henry, Mayor <br />George J. Shaver, Trustee <br />George I. Lodahl, Trustee <br />Clyde J. Stewart, Cler k <br />Ralph Van Hovers, Treasurer <br />Frank N. Graham, Attorney <br />Absent: Arthur A. Lindig, Trustee <br />r <br />The Mayor declared the hearing open at 8:15 P.M. and announced <br />the purpose of the hearing. He then called on the license applicant, Mr. Carl <br />R. Litsheim, 1648 Ford Parkway, St Paul, to provide details as to the type of <br />business he proposes to oper ate. <br />Carl R. Litsheim said the type of business he proposes to ope rate on <br />the Rees property described in the notice of the hearing <br />(first lot south of Neber's Cottage Inn) is primarily an <br />ice cream dispensing business, including cones, aundays <br />ark a certain amount of ice cream to be taken home for <br />home use. Houga of operation, he said, would be from <br />11 A.M. to about 11 P.M. or 11:30 P.M., seven days a week. <br />Said he and Mrs. Litsheim plan to operate the business to <br />begin with and. later expect to add one or two employes <br />from the neighborhood. Trash will be placed in two <br />receptacles and these will be picked up at the end of the <br />day; also that the business will operate from about March <br />or April to October each year. <br />Carl e. Swenson, Attorney, representing Ddr. Litsheim, spoke as to limitations which <br />may be fixed in issuing the license, and ref erred to the <br />record and reputation of Mr. Rees, the property owner, in <br />connection with desirable business developments. <br />Don S. Anderson Sales Manager, Dairy Nay, answering questions as to lighting; <br />said lights would be placed on the corners of the proposed <br />building and that such lights would be beamed down. He also <br />said that the area to be used by the Dairy Way will be black- <br />topped. <br />Attorney Swenson said that Mr. Litsheim is a man of high character and that <br />he intends to make his home in the community. Said the <br />proposed business is clean and respectable and is patronized <br />especially by women and children from the community. <br />1 <br />Opposition The Mayor then asked if anyone wished to speak in opposition ~. <br />the Dairy Nay license application - <br />Philip J. Bifulk, Said he owns the property next to the proposed business <br />1546 Crawford place and referred to the effect a Dairy Way would have on <br />his home investment, home conditions, yard and children. <br />Said regardless of Mr. Rees' business reputation, the latter <br />could not assure them thB proposed Dairy Nay w'i11 not be a <br />nuisance. Mr. Bifulk said the DairyWay may operate six or <br />seven months but would then be closed the rest of the year. <br />Firmly believes a Dairy Y~ay would not enhance appearance of <br />s the neighborhood and will not encourage anyone to come in and <br />buy. Said that under present conditions there i s no traffic <br />
