• No. 95-20 <br />CITY OF FALCON HEIGHTS <br />COUNCIL RESOLUTION <br />Date June 28. 1995 <br />RESOLUTION APPROVING A VARIANCE FOR 1865 N. HAMLINE AVENUE <br />On June 28, 1995, the Falcon Heights city council granted the following variance <br />request for 1865 N. Hamline Avenue: <br />Chapter 9-2.05 subd. 2(a) in the reauired interior side vard setback for <br />a deck on an R-1 lot. <br />A variance of two feet to allow a deck to be built at an interior side <br />setback of three feet where a minimum of five feet is required in the <br />zoning code. <br />• The city council adopted the following condition upon the granting of the variance. <br />That the deck not be converted into any type of covered interior living <br />space, including but not limited to, three- or four-season porches or an <br />addition to the house. <br />The city council adopted the following findings for granting the variance• <br />a. That the granting of the variance will not be detrimental to the public <br />welfare; <br />b. That the granting of the variance will not substantially diminish or <br />impair property values or improvements in the area; <br />c. That the granting of the variance is necessary for the preservation and <br />enjoyment of substantial property rights; <br />d. That the variance will not impair an adequate supply of light and air to <br />adjacent property. <br />e. That the amended variance will not impair the orderly use of the public <br />• streets; <br />
