No. R-93-06 <br />CITY OF FALCON HEIGHTS <br />C O U N C I L R E S O L U T I O N <br />Date: Jan. 27. 1993 <br />RESOLUTION AMENDING VARIANCE FOR 2097 FOLWELL AVENUE <br />WHEREAS, on January 25, 1993, the Planning Commission reviewed <br />the application to amend a variance for 2097 Folwell Avenue, approved by the <br />council on May 27, 1992; and <br />WHEREAS, the Planning Commission makes without qualification on the <br />basis of the evidence presented at the meeting the following findings: <br />a. That the amendment to the variance will not be <br />detrimental to the public welfare; <br />• b. That the amendment to the variance will not sub- <br />stantially diminish or impair property values or <br />improvements in the area; <br />c. That the amendment to the variance is necessary for <br />the preservation and enjoyment of substantial <br />property rights; <br />d. That the amended variance will not impair an adequate <br />supply of light and air to adjacent property; <br />e. That the amended variance will not impair the orderly <br />use of the public streets; <br />f. That the amended variance will not increase the danger <br />of fire or endanger the public safety; and <br />g. That the unique shape of the tract, together with its <br />location adjacent to an unused public right-of-way <br />is such that a strict adherence to the letter of the <br />chapter would preclude the preservation of a large <br />existing elm tree on the tract. <br />r~ <br />LJ <br />
