• No. 99-17 <br />CITY OF FALCON HEIGHTS <br />COUNCIL RESOLUTION <br />Date: July 14, 1999 <br />RESOLUTION REQUESTING MNDOT GRANT A VARIANCE <br />TO MUNICIPAL STATE AID RULES ON GARDEN AVENUE <br />WHEREAS, the City of Falcon Heights wishes to use a portion of its state-aid allocation <br />on local streets not on an approved state-aid system, as allowed for under Minnesota Rules <br />8820.1800 Subp. 2; and <br />WHEREAS, staff with the Minnesota Department of Transportation, State Aid for Local <br />Transportation Division have reviewed the state-aid street system in Falcon Heights; and <br />WHEREAS, the state-aid street system is in acceptable condition and therefore eligible <br />for said funding of off-system streets, except for a segment of Garden Avenue/MA Route No. <br />• 105 which is substandard in width; and <br />WHEREAS, Minnesota Rules 8820.3300 provides an opportunity to request a variance <br />to the standards; <br />NOW THEREFORE, BE IT RESOLVED that the City of Falcon Heights requests a <br />variance from the Geometric Design Standards for width, as specified in Minnesota Rules <br />8820.9936, as they apply to Garden Avenue between Snelling Avenue and Pascal Avenue; <br />and <br />FURTHERMORE, the City of Falcon Heights indemnifies, saves, and holds harmless the <br />state of Minnesota and its agents and employees of and from claims, demands, actions, or <br />causes of action arising out of or by reason of the granting of this variance. <br />------------------------------------------------------------ <br />Moved b :Gibson Talbot A roved b <br />Y PP Y <br />Mayor <br />July 14, 1999 <br />GEHRZ 4 In Favor Date <br />GIBBON TALBOT <br />HUSTAD 0 Against Attested by: <br />• JACOBS (absent) City Administrator <br />KUETTEL July 14, 1999 <br />Date <br />
