No. 00-11 <br />CITY OF FALCON HEIGHTS <br />COUNCIL RESOLUTION <br />Date: April 12, 2000 <br />RESOLUTION GRANTING VARIANCE AT 1821 ASBURY STREET <br />WHEREAS, on April 5, 2000 the Falcon Heights city council granted a variance of 6 feet <br />in the 30 foot required rear yard setback of 1821 Asbury Street. The variance was granted to permit the <br />construction of an addition to the single family home; and <br />WHEREAS, the city council determined that the property is unique because it is narrower <br />than most lots in Falcon Heights and, therefore, creates a hardship for the property owner at 1821 <br />Asbury Street. <br />NOW THEREFORE, BE IT RESOLVED that: <br />a. Granting the variance will not be detrimental to the public welfare. <br />b. Granting the variance will not substantially diminish or impair property <br />values or improvement in the areas. <br />c. Granting the variance is necessary for the preservation and enjoyment of substantial <br />property rights. <br />d. Granting the variance will not impair the orderly use of the public streets. <br />e. Granting the variance will not impair an adequate supply of light and air to adjacent <br />property. <br />f. Granting the variance will not increase the danger of fire or endanger the public <br />safety. <br />g. A particular hardship, as distinguished from mere inconvenience to the owner, would <br />result if the strict letter of the chapter was carried out. <br />h.
